More information is available on the website: www.pets.maricopa.gov. Supervisor Barney asked what foster volunteer entails. Ms. Gable responded that individuals give their home and hearts to care for animals. Often puppies and kittens need to be sent to a foster home until they are old enough to be adopted. She noted it is a wonderful program versus euthanizing. She said that fostering is normally until the animal is eight weeks or two pounds but each case depends on the animal. ~ Supervisor Gallardo entered the meeting ~ PRESENTATIONS - PRESENTACIÓNES 5. A-529 Road File No. A529 to Open and Declare the following described alignment into the County Transportation System. This item has been withdrawn per the department's request. (C-64-15-078-M-01) 7. ROAD DE-ANNEXATION FROM THE CITY OF PEORIA TO MARICOPA COUNTY Pursuant to A.R.S. §9-471.03 regarding the de-annexation of right-of-way from City of Peoria jurisdiction to Maricopa County. Right-of-way location: 99th Avenue from North of Olive Avenue to Peoria Avenue. The Board of Supervisors determined at a public hearing on February 18, 2015 that such action would be in the public interest and has complied with the additional requirements of Formal Meeting Minutes Wednesday, March 25, 2015 Page 5 of 49 ARS §9-471.03. If approved, the Board of Supervisors: 1. Orders that the public right-of-way be returned as specified in Peoria’s Ordinance No. 2014-32, returning the public right-of-way to Maricopa County. 2. Pursuant to ARS §9-471.02, directs the Clerk of the Board to notify the City of Peoria that the Board of Supervisors order regarding the de-annexation of the public right-of-way was approved, and 3. Directs the Clerk of the Board to certify a copy of the order of the Board and file it for record in the Office of the County Recorder. Analysis of this requested action: The City of Peoria annexed land area east of a line 40’ east of the 99th Avenue section line on May 23, 1963. On November 21, 1966, The Board of Supervisors, adopted a resolution declaring 99th Avenue to 65 feet east of the 99th Avenue section line for a road improvement project, project 56-372. A 25 foot strip of the roadway declared was in Peoria jurisdiction. By declaration of 99th Avenue, the operation and maintenance of the 25’ strip in Peoria jurisdiction was assumed by Maricopa County. The Department of Transportation has maintained the entire width of 99th Avenue to 65’ east of the 99th Avenue section line since the construction of the MCDOT road improvement project. Since a 25 foot portion of 99th Avenue lies within City of Peoria jurisdiction, Peoria and MCDOT have agreed that it is in the best interest of both parties to de-annex from the City of Peoria that portion lying within the 99th Avenue corridor that is maintained by MCDOT to avoid confusion between the two entities as to which is responsible for the road maintenance, regulation and policing as well as a benefit to the public by making it easier to determine which entity to contact regarding issues related to the road. Also, since MCDOT is currently maintaining the road in question, there would not be additional financial burden due to this action beyond what it already has. MCDOT would assume full liability in the de-annexed strip as the City of Peoria would no longer be the jurisdiction of record. The understanding is retroactively effective to July 1, 2014 and will continue through June 30, 2017. It can be cancelled by either party at any time with a 2-week written notice. The Sheriff’s Office will charge a two-hour minimum cost for fuel per service request, which is approximately 102 gallons of fuel with additional time being billed in 10-minute increments (8.5 gallons) of fuel. The cost of fuel will be based on the rate at the time of service. Because this is back up service, less than 10 calls for service per year are anticipated. Authorize the use of $7,535 in matching General Funds for FY14-15, which is included in the Juvenile Probation Department's FY14-15 General Fund (100) appropriated budget. The objective of the program is to divert delinquent or incorrigible offenders from the court process by providing counseling until the family can mobilize its own resources for meeting its problems. In addition the counseling is provided to reduce referral frequency to the Juvenile Probation Department. The allocation to Maricopa County for FY14-15 is $30,140 which will be retained by the Administrative Office of the State of Arizona Supreme Court. A four (4) to one (1) ratio County match is required in the amount of $7,535 and is included in the Juvenile Probation Department's FY14-15 budget. A resolution by the Board of Supervisors will make it possible for additional families to participate in the Family Counseling Program during the fiscal year that would not be able to do so otherwise. MOU WITH MARICOPA COUNTY SHERIFF’S OFFICE FOR BACK UP HELICOPTER TRANSPORTATION SERVICE Approve a Memorandum of Understanding for Back up Helicopter Transportation Service between Maricopa County Sheriff’s Office and Maricopa County Office of Enterprise Technology, Radio Division. The Sheriff’s Office will provide backup helicopter transportation when the contracted commercial vendor is unable to deliver service. The Sheriff’s Office provided emergency service in FY 2015 during the late summer monsoon and this is why the understanding is dated back to July 1, 2014. (SUNBELT) AND THE CITY OF BUCKEYE FOR ROOSEVELT STREET CROSSING OF THE WHITE TANKS FRS NO. 4 INLET CHANNEL Approve Agreement (GA) FCD 2014G002 for the Roosevelt Street Crossing of the White Tanks FRS No. 4 Inlet Channel for the construction and maintenance of box culvert and utilities (Project [#201]) among the Flood Control District of Maricopa County (DISTRICT), ROOSEVELT STREET CO., L.P. (SUNBELT) and the City of Buckeye (BUCKEYE). This General Agreement (GA) details responsibilities for design and construction of the project, easements, and future ownership and maintenance responsibilities for the Project. The estimated total cost of this agreement is $1,100,000 with a DISTRICT cost of $668,795.66 as a cost to cure paid to SUNBELT. BUCKEYE will operate and maintain the all-weather box culvert and associated utilities. The District is rehabilitating White Tanks FRS No. 4 and the rehabilitation includes extending the dam north beyond the Roosevelt Street Alignment. Extending the dam to the north requires relocating the existing inlet channel to the west and the acquisition of Rights of Way from SUNBELT. SUNBELT is developing lands adjacent to White Tanks FRS No. 4, and the development requires improving Roosevelt Street to a BUCKEYE arterial street along the boundary of SUNBELT’S property to Jackrabbit Trail (195th Avenue). SUNBELT developed designs and plans and applied for a permit for the proposed improvements across DISTRICT Right of Way prior to 2009. The proposed improvements required revision after the extension of the White Tanks No. 4 FRS was identified in 2009. SUNBELT and BUCKEYE require easements for Roosevelt Street and utility purposes across District- owned Right of Way. The development and Roosevelt Street are within BUCKEYE and BUCKEYE shall be responsible for operation and maintenance of the south half of Roosevelt Street west of Jackrabbit Trail upon completion of construction and acceptance of the improvements contemplated by this agreement. It is anticipated that the south half of Roosevelt Street will be constructed beginning in 2017and the north half would be constructed at some future unknown date. The box culvert is being constructed under this agreement for the full roadway buildout such that future modifications of the culverts will not be required when the north half of the roadway is constructed. AMENDMENT TO RESOLUTION FOR FLOODPRONE PROPERTIES ASSISTANCE PROGRAM Adopt Resolution Amendment No. 1 FCD 2006R003A for the Floodprone Properties Assistance Program (FPAP) to clarify funding, revise eligibility criteria and prioritization ranking per Exhibit A. The Board of Directors (Board) approved Resolution FCD 2006R003 on October 4, 2006 (C- 69-07-016-6-00), authorizing the Flood Control District of Maricopa County (District) Chief Engineer and General Manager to utilize the Floodprone Properties Acquisition Program (FPAP) in place of the Alternative Flood Control Works Program (FCD 95-01A). Resolution Amendment FCD 2006R003A still maintains the structure and majority of the information that was adopted through Resolution FCD 2006R003. There are minor revisions throughout the revised policy to clarify funding, revise eligibility criteria and prioritization ranking (see Exhibit A). Amendment FCD 2006R003A authorizes the update and revises the FPAP as required and present any proposed revisions to the Board for review and approval. The FPAP will continue to be a part of the District’s CIP and operating budget process with limited funding as it becomes available. (C-69-07-016-6-01) Motion to approve by Director Barney, seconded by Director Kunasek Ayes: Chucri, Hickman, Barney, Kunasek, Gallardo F-4. AMENDMENT TO RESOLUTION FOR FLOOD CONTROL DISTRICT SMALL PROJECT ASSISTANCE PROGRAM MODIFICATIONS Adopt Resolution Amendment FCD 2009R003B, Modifications to the Flood Control District Small Project Assistance Program (SPAP). This amendment authorizes the SPAP to be utilized to mitigate frequent, localized flooding for areas in Unincorporated Maricopa County. The SPAP provides an efficient vehicle to mitigate critical local drainage problems that have historically caused flooding of structures, where regional solutions are impractical. The SPAP has three core benefits: • Reduces the frequency of localized flooding from routine storm events; • Mitigation of repeated flood damage to structures; • Rapid implementation of projects. Previously the SPAP was available to municipalities only. The modified procedure allows the SPAP to be implemented in areas of Unincorporated Maricopa County where there is no local jurisdiction. The District will generally assume lead agency responsibilities, though non- municipalities or agencies can also submit under this modified program. The modified SPAP Procedure will be implemented starting with the FY2017 program. This Agenda Item impacts all supervisorial districts. CONTRACT FOR POWERLINE CHANNEL AND VINEYARD ROAD FLOOD RETARDING STRUCTURES REHABILITATION PROJECT Approve Contract No. FCD 2014C021 for Powerline Channel and Vineyard Road Flood Retarding Structures Archaeological Services. This contract establishes responsibilities with respect to archeological testing and mitigation work to be completed prior to any disturbance or construction within the proposed project limits or Area of Potential Effects (APE). The contract has a value of 2 million dollars for archaeological mitigation. The proposed APE for the archeological work includes the property upstream of the three earthen flood retarding structures (Vineyard Road FRS and Rittenhouse FRS are the other two) located in northwestern Pinal County, east of the Central Arizona Project (CAP) canal and south of Baseline Road. The Powerline, Vineyard Road, and Rittenhouse FRSs Rehabilitation or Replacement Project is a District planning study currently in the design stages with a tentative date of construction in June, 2015. As part of the requirements under the National Historic Preservation Act of 1966, archeological surveys were completed by the District and identified approximately 15 register eligible sites within the APE which will require monitoring, testing and data recovery prior to the start of construction activities. In order to move forward with data recovery efforts and ultimate construction of the project, approval of the contract for archaeological services is required by the board. Subsequently, the contract will allow for testing and mitigation of sites within the proposed APE prior to project construction. This Project has been selected by NRCS to be fully cost share funded from planning through construction. Per NRCS funding authorization requirements the Project must be constructed by September 30, 2018. Currently the Project is in the design phase. This item impacts Supervisorial Districts 1 and 2. (C-69-15-037-5-00) Motion to approve by Director Barney, seconded by Director Kunasek Ayes: Chucri, Hickman, Barney, Kunasek, Gallardo F-6. RESOLUTION FOR FLOOD CONTROL DISTRICT CAPITAL IMPROVEMENT PROGRAM PRIORITIZATION PROCEDURE MODIFICATIONS Adopt Resolution FCD 2015R005, Modifications to the Flood Control District Capital Improvement Project Prioritization Procedure (CIPPP). The District's CIPPP evaluates regional projects. The District attempts to support and recommend flood control projects that, whenever possible, will provide a regional flood control benefit, and that will also contribute to community development, maintain the benefits of existing watercourses, help protect natural habitat and landscapes, and provide multiple- use opportunities for flood control facilities. Proposals for new projects are evaluated on eight evaluation criteria (highest point value listed first): (25) Area protected; (15) flooding threat; (12) level of partner participation; (12) funding commitment and priority; (12) ancillary benefits; (10) level of protection (8) flood control/drainage master plan element; and (6) operations and maintenance cost to the District. During the fall of 2014 the District participated in a strategic planning effort with the Board of Directors and received direction to modify the CIPPP. Appropriate additions, deletions and modifications were made to the CIPPP accordingly, with areas of emphasis as follows: • The project partner’s readiness to enter into an IGA and funding availability to implement a project; • The expectation that the project partner provides a higher level of cost share participation and contributes at least 50% of the project cost; ; • Potential community economic benefits; Formal Meeting Minutes Wednesday, March 25, 2015 Page 46 of 49 • Flooding issues caused by inadequate regulation by the requesting agency; and • Redistribution of point allocations between the 8 criteria. The modified CIPPP will be implemented starting with the FY2017 procedure. This Agenda Item impacts all supervisorial districts.
