Project Summary:
1. The subject site is zoned RU-43 with an approved Special Use Permit (SUP) Z98-18 for an
equine hospital. The request is to amend Z98-18 to eliminate the 30 year time stipulation,
entitle a boarding and training component to the site as part of the SUP, and allow for
an existing fence sign on the southern property line.
2. The request for removing the time stipulation is that the use is a significant investment
that is compatible with surrounding developed residential and equestrian properties
and provides a benefit to the community. There are no proposed changes to the
existing approved site plan (amended with Z2013035) other than the requested signage
along the fence. The boarding on the site would be located in the existing barn, and
training would occur in the existing arena. No additional onsite improvements or
structures are needed.
3. The existing sign was not included as part of the SUP or subsequent amendments and
the applicant is requesting add this item as part of this request. The sign is an etching on
metal which is 4’ (h) x 42’ (l) and is non-illuminated. The 168 sq.ft. sign exceeds the
commercial “perimeter wall sign” area allowance of 120 sq.ft.
[Existing signage on property with dimensions requested to be entitled with this case.]

Existing On-Site and Adjacent Zoning/Land Uses:
7. On-site: RU-43/SUP (Z98-18) for equine clinic
North: RU-43/residential
South: RU-43/vacant
East: RU-43/vacant
West: 14th St. alignment then RU-43/residential
[Aerial of existing and proposed uses on subject site.]
Utilities and Services:
8. Water: Cave Creek Water Company
Wastewater: Septic
Electric: APS
Fire: Daisy Mountain Fire District
Outstanding Concerns from Reviewing Agencies:
9. N/A
Staff Analysis:
10. Staff is in support of all the requested stipulation modification changes. The equestrian
clinic is consistent with the uses in the area and is a valuable business to the surrounding
community that has many equestrian based uses. Staff considers the limited boarding
on the site as an extension of the veterinary clinic, utilizing the existing barn. Training will
be located in the existing arena and will be used for rehabilitation as well as other types
of training for the horses.
Agenda Item: 5 – Z2014085

11. The existing signage located on the southern fence is for identification purposes of the
clinic and provides an aesthetic component to the site. Staff and the applicant met
with the New River/Desert Hills Community Association (NRDHCA) on January 13, 2015
to discuss the request. Their concerns were with the signage being illuminated which it is
confirmed that there will be no lighting. Staff is concerned that if the property to the
south of the subject site is developed, they would have a direct view of the sign and
the sign would thus be unnecessary since identification would not be viewable from 14th
St. or the Carefree Highway. A condition has been added that if the property to the
south of the subject site is developed, the sign shall be removed. The applicant is in
agreement with the condition.
12. Staff recommends removing condition ‘c’ regarding a previous stipulation for updating
the site plan and ‘h’ for the SUP entitlement time frame. Staff will add a new condition
‘h’ which relates to removal of the fence sign if the property to the south is developed,
below are conditions in final format:
Remove stipulations ‘c’ and ‘h’ from Z98 -18
c. The site plan shall be revised within 30 days of approval by the Board of
Supervisors and prior to zoning clearance for a building permit, to indicate the
sign and all fencing is located outside the dedicated right-of-way of 14th Street.
h. The Special Use Permit shall expire 30 years from the date of approval by the
Board of Supervisors. At that time it can be revisited and either extended or
formally removed.
Proposed language conditions ‘c’ and ‘h’
c. The following Engineering condition shall apply:
1. Building Permit B201207091 for Interior and Exterior Alteration with Addition
for Cave Creek Equine Center must be finalized (final building safety
inspection is required).
h. In the event that the property located south of the subject site is developed, the
identification signage on the southern fence shall be removed.
All other conditions approved by the Board of Supervisors shall remain in effect.
Recommendation:
13. Staff recommends approval of Z2014085 with the following conditions ‘a’ – ‘l’:
a. Development and use of the site shall comply with the narrative report entitled
“Cave Creek Equine Surgical and Diagnostic Imaging Center”, consisting of five
(5) pages, stamped received December 24, 2014, except as modified by the
following conditions.
b. Development and use of the site shall comply with the site plan entitled
“Z2014085 – A request to amend the SUP…”, consisting of two large-scale sheets,

d. The sign shall be comprised of a material and an earth tone color so as to be
harmonious with the natural desert landscape.
e. The building exteriors will be of an earth tone color harmonious with the natural

Maricopa County Zoning Ordinance. No light fixture shall be higher than 18’.

promote water conservation and mitigate habitat loss.
h. In the event that the property located south of the subject site is developed, the
4’ x 42’ fence sign on the southern property line shall be removed; unless staff
receives a written response from the property owner of the property to the south
waiving this condition.
i. A Status Report shall be filed in two years from the date of approval by the Board
of Supervisors. Said report is intended to allow the County to monitor for dust
control on 14th Street. The findings of said report may warrant the Special Use
Permit being revisited by the Commission and Board of Supervisors.
j. Non-compliance with these listed stipulations of approval will be treated as a
violation in accordance with provisions of the Maricopa County Zoning
Ordinance.
k. Major changes to this plan of development (the site plan and narrative report)
shall be processed as a revised application in the same manner as the original
application, with final determination made by the Board of Supervisors following
recommendation by staff and the Planning and Zoning Commission. Minor

Application Narrative
SUP 98-18
Revised 12/22/14
Creek Equide Surgical and Diagnostic Imaging Cen
EINEM
RECEIVED DEC 24 2014

I. Purpose of the Request
The purpose of this request is to amend a previously approved Special Use Permit
("SUP") (Z98-18) on Parcel 211-52-073C and 211-52-073D (which has since been combined
forming Parcel 211-52-073E, collectively the "Site") for an existing Large Animal Surgical and
Referral Hospital located at 34705 N. 14 th Street in Maricopa County, to eliminate the time
stipulation, penult boarding and training on a limited basis, and to enhance the signage. The
SUP was unanimously approved by the Board of Supervisors on April 7 th, 1999.
Description of Proposal
Cave Creek Equine Surgical & Diagnostic Imaging Center ("Cave Creek Equine") is a
state-of-the-art referral equine hospital that opened in 2002 under the ownership and direction of
Dr. F. Ross Rich, DVM, PA-C. The facility offers medical and surgical services geared towards
diagnosis and treatment of sports-related problems in the elite equine athlete, as well as the
future equine athlete (the young horse). Orthopedic and respiratory issues continue to be Cave
Creek Equine's primary interest and focus. However, they also deal with other soft tissue
problems in the equine athlete. Cave Creek Equine provides innovative care for horses.
Currently, Cave Creek Equine offers the following services on site:
• Equine MRI
• Digital Ultrasound
• Digital Radiography
• Nuclear Scintigraphy
• Video Endoscopy
• Treadmill Video Endoscopy
• Gastroscopy
• Lameness or poor performance
• Examination
• Slow Motion Video Evaluation
• Orthopedic Surgery
• Arthroscopy
• Soft Tissue Surgery
• Respiratory and Upper Airway Surgery
• Laparoscopy
• Laser Surgery
• Regenerative Medicine
• Stem Cell Therapy
• IRAP

• PRP
• Shockwave Therapy
• Rehabilitation Services
• Performance Examination
• Pre-Purchase Examination
• Neurological Evaluation
• Dentistry and Dental Surgery
• Microchip implantation
• Rehabilitation
The list of services offered may change or expand as technology changes. However, Cave Creek
Equine will continue to be a cutting edge equine veterinary hospital. Significant investment has
gone into Cave Creek Equine's facility, and it has proven to be a compatible use with the
surrounding developed residential and equestrian oriented properties. It has also proven to be a
benefit to the community. As such, this application requests to amend the approval to eliminate
the time stipulation.
Additionally, Cave Creek Equine would like the ability to do some limited boarding and
training on site. Horses would be boarded in the existing barn, and the existing arena would be
used for training. Currently on limited rehabilitation occurs on site, and often the horses are sent
to other farms or ranches for rehabilitation purposes. However, Dr. Rich's wife is an
accomplished dressage rider, and would like the ability to board and train horses on the property,
both for rehabilitation purposes, as well as training purposes. No alterations to the site plan are
proposed as part of this request. Finally, Cave Creek Equine has added some art to the site,
including an etching in their south fence line. This etching is carved metal, which is 4 feet tall,
and 42 feet long. No illumination is proposed as part of this request. As a result, this
amendment purposes to permit such signage along the south property line, as shown on the
accompanying graphics.

III. Relationship to Surrounding Properties
The Site is located within the New River Area Plan, which depicts the site as Rural
Residential.
The site also located in the Carefree Highway Scenic Corridor. The Carefree Highway Scenic
Corridor Study, which was completed in 2008, specifically recommends the following land uses
as appropriate for the area:
• Riding and Boarding Stable public; and
• Veterinary Clinics for Animals, subject to zoning regulations.

As noted, the site is currently zoned Rural-43, with a Special Use Permit permitting a veterinary
hospital. This use is by its nature rural in character, and complements the surrounding rural and
equestrian oriented community. The property immediately to the north is also used for
equestrian purposes. This use has proven, since its opening in 2002, to be benefit to the
surrounding community.
The site is currently accessed from Carefree Highway and 14 th Street. The applicant has
regularly maintained, since the inception of the clinic, 14 th Street from Carefree Highway to the
clinic. He has graded the road and added ABC gravel to this portion of the road for dust control.
The parking area on site is paved. Below please find an aerial image of the site:
Again, no changes to the site are proposed as a result of this request.

SUBJECT: Cave Creek Equine Center Special Use Permit (SUP) stipulation
modification; Z2014085
The Maricopa County Environmental Services Department (MCESD) has reviewed
documents received from the Maricopa County Planning and Development
Department for the above referenced project. This project is a request for a Special
Use Permit Minor Amendment (Z98-18) to "eliminate the time stipulation, permit
boarding and training on a limited basis, and to enhance signage" at the existing
facility at 34705 N. 14th Street (APN 211-52-073E) in Cave Creek. The facility is a
veterinary equine center. According to previously submitted documents, the Cave
Creek Water Company provides potable water and an onsite septic system treats
sewage from the site. The proposed request should have little affect on the existing
water and sewer facilities. The project is not located in the urbanized unincorporated
area, and is therefore, not regulated by the Maricopa County Stormwater Quality
Program.
Based on the above, MCESD raised no objections to the Planning & Development
Department in Accela Automation on November 25, 2014 and will allow the project
to proceed at this time subject to the following stipulations:
Stipulations: None
It should be noted that several other Maricopa County agencies must review and
recommend approval of this project. Final approval authority for this project rests
with the Maricopa County Board of Supervisors.

Current Zoning: Rural-43 w/CUP, ref Z98-18
Current Use: Large animal Surgical & Diagnostic Imaging Center.
Request for: Modification' of Conditions (stipulations).
Background: In (1999) the Special Use Permit (SUP) approved for parcels APN#211-52-073C & 211-52-073D
which have been combined and assigned the APN# of 211-52-073E. Parcels prior to SUP approval were all
zoned Rural-43.
Analysis:
Scope of request: Internal renovation and external addition (enclose existing front porch & add lattice covering
front entry), update accessibility route to entry; eliminate time stipulation (SUP original stipulation states SUP
expires 30 years after issued); modification of use, enhance the signage; and allow signage along south property
Surrounding parcels: West of parcel & across 14th Street A_PN 211-52-076H residential development, APN
211-52-076P residential development, North of & abutting parcel APN 211-52-076E residential development,
APN 211-52-067D residential development, East and abutting vacant parcel zoned Rural-43, South & abutting
vacant parcel zoned Rural-43.
The Center is an asset to and compatible with the area. Unhealthy animals treated and some rehabilitated on
site in existing pens. The request to board and train horses on site would be little different from what is
currently happening as part of the rehabilitant process. The boarding and training of horses should not be
approved open ended but limited in numbers allowed at any one time. Chapter 5, Article 501.2.15.p.1 allows
owner to board 5 horses (owner has no ownership) in any rural residential zoned district. There exist little
visual difference between training and rehabilitation.
Article 503.2 Use, all those allowed in Rural-190 (501.2). Article 503.5.4 allows a lot coverage of 25%
proposed 5.674%. Chapter 14 Signs, Section 1401, Article 1401.3.3.2 lights off between 10:00 pm and 6:00

am. Article 1401.3.3.7 lighting shall not be visible from any adjacent residential zoned district. Article
1402.1.3 sign limited to 24 square feet.
The Narrative wishes to be allow the current sign (they call is "art") on the south side of the property. This does
not appear to be lighted currently and if this is the case, the sign is not objectable.
The planner has clarified that, although the narrative refers to the request as a minor amendment, this request is
actually a request for a Modification of Conditions. Like a Major Amendment, a request for a Modification of
Conditions requires this case to go through the hearing process including a Board of Supervisors hearing for
approval/denial.
The Narrative states "The site is currently accessed from Carefree Highway and 14th Street, which is a chip
sealed road." However, the road should be improved to control dust.
I would recommend approval if I had more details or an explanation as to whether the enhancement to signage
includes lighting. Without that information, it is not possible to determine whether the enhancements to the
signage will have a negative impact. There is also concern about the 14th Street that needs something done to it
for dust control.
If any lighting is used or enhanced, it should be fully shielded so as not to be visible to adjacent parcels. This
parcel is located within the Carefree Scenic Corridor Study Area and any visible light would defeat the intent of
the scenic corridor.
Recommendation: 111 Denial Approval 111 Other - Approval if the lighting and road concerns
are addressed.
Sincerely,
Paul H. McAllister

DATE: March 12, 2015
TO: Planning and Zoning Commission
FROM: Ray Banker, Planner
SUBJECT: Z2014085- Cave Creek Equine-Agenda item 5
Staff received an updated memo from New River/Desert Hills Community Association (NRDHCA) dated
March 8, 2015. They stated issues with the request to remove the 30 year time extension condition and
concerns with the 14fh Street road issues. Staff would like to clarify in the memo their concern for condition
'c from Z98-18 (updated site plan within 30 days of approval) to be removed is because this issue has been
taken care of with a previous updated site plan and a subsequent amendment to the SUP case.
Staff would like condition 'h' removed from the recommendation because if the property to the south of
the subject site develops, the effectiveness of the sign will be a concern only of the two property owners
and the owner to the south will have had knowledge of the existing sign.
With the removal of condition 'h', staff has relabeled all conditions and recommend the Commission
motion for approval with conditions 'a' - 'k' as follows:
a. Development and use of the site shall comply with the narrative report entitled "Cave Creek
Equine Surgical and Diagnostic Imaging Center", consisting of five (5) pages, stamped received
December 24, 2014, except as modified by the following conditions.
b. Development and use of the site shall comply with the site plan entitled "Z2014085 - A request to
amend the SUP...", consisting of two Iarge-scale sheets, stamped received December 24, 2014,
except as modified by the following conditions.
c. The following Engineering condition shall apply:
1. Building Permit 13201207091 for Interior and Exterior Alteration with Addition for Cave Creek
Equine Center must be finalized (final building safety inspection is required).
d. The sign shall be comprised of a material and an earth tone color so as to be harmonious with the
natural desert landscape.
e. The building exteriors will be of an earth tone color harmonious with the natural desert landscape.
f. All outdoor lighting on the subject property must conform to Section 2318 of the Maricopa County
Zoning Ordinance. No light fixture shall be higher than 18'.
g. All enhanced landscape areas will be comprised of native plant species to promote water
conservation and mitigate habitat loss.
h. A Status Report shall be filed in two years from the date of approval by the Board of Supervisors.
Said report is intended to allow the County to monitor for dust control on 14th Street. The findings of
502 N. 44th Street, Suite 200 • Phoenix, AZ 85008 • (602) 372-0318 • (602) 506-3711 fax
Dinternet: www.maricopa.gov/planning

said report may warrant the Special Use Permit being revisited by the Commission and Board of
Supervisors.
Non-compliance with these listed stipulations of approval wit be treated as a violation in
accordance with provisions of the Maricopa County Zoning Ordinance.
Major changes to this plan of development (the site plan and narrative report) shall be processed
as a revised application in the same manner as the original application, with final determination
made by the Board of Supervisors following recommendation by staff and the Planning and Zoning
Commission. Minor changes may be administratively approved by the Project Management
Division staff of the Planning and Development Department.
k. Any changes to the proposed landscaping or charges to the building appearance, shape of the
building footprint or parking lot, placement of outdoor lighting structures, or content of the sign
shall be considered to be of such a minor nature that staff of the Planning and Development
Department, Project Management Division, will be granted authority to approve said changes
without benefit of processing an administrative amendment. This stipulation is intended to offer a
certain degree of flexibility in the final site design.

have been combined and assigned the APN# of 211-52-073E. Parcels prior to SUP approval were all

• December 2014, this request was submitted. NR-DHCA recommended approval contingent on the
lighting and road concerns addressed. The analysis portion of the P&D staff report for the March 12,

o Regarding concerns with the signage being illuminated, the report states "it is confirmed that
there will be no lighting."
o Regarding the road, there is no mention of that but we have been informed that the road issue is
being address in anther manner.
• Since the December 2014, other issues have arisen
o The request eliminate the 30 year time stipulation
o We are not sure how the road situation is being addressed.
Current staff recommendation
Staff is recommend that these two stipulations be eliminated:
c. The site plan shall be revised within 30 days of approval by the Board of Supervisors and prior to
zoning clearance for a building permit, to indicate the sign and all fencing is located outside the
dedicated right-of-way of 14th Street.
h. The Special Use Permit shall expire 30 years from the date of approval by the Board of Supervisors.
At that time it can be revisited and either extended or formally removed.
Staff is recommending that these two stipulations be added;
4. Building Permit B201207091 for Interior and Exterior Alteration with Addition for Cave Creek
Equine Center must be finalized (final building safety inspection is required).
# • In the event that the property located south of the subject site is developed, the identification signage
on the southern fence shall be removed.

Analysis:
I think the stipulations "c" and "h" should NOT be eliminated. "c" is routine. For "h"; SUPs need to have a
