Action Requested;
This is the time scheduled for a public hearing to solicit comments and consider the the proposed fee of
$5.00 for all writs issued by a Justice of the Peace In civil cases, effective upon Board of Supervisors'
approval. Fees collected will be deposited into the Constable Ethics Committee Fund established by
Section 22-136. Senate Bill 11130, enacted September 21, 2000, amends A.R.S. §11445 to allow Board of
Supervisors to establish a fee not-to-exceed $6.00 per writ served. (C2507002000)
Complete description of action requested:
In the 2006 session, the Arizona State Legislature amended A.R.S. 11445 with regard to the Constables
Ethics Committee under Senate Bill 1180, Effective September 21, 2008, each County Board of
Supervisors is mandated to set an additional fee on each Writ issued bye. Justice of the Peace Court in
their respective counties. The fee to be set shall not exceed $5.00 per writ and shall be administered by
the Constable Ethics Committee.
The fees shall be established by the Board of Supervisors requires the Constables Ethics Committee to
use 80% of the monies for Constable training, equipment, and related grants; and 20% will be used for
funding the Constables Ethics Committee, which currently does not have any appropriated funding.
Senate Bill 1180, also known as the "Marilyn Jarrett Constable Ethics Act," directs the State Treasurer to
invest and divest the monies in the fund as provided by law and on notice from the Constables Ethics
Committee and provides that monies earned from investments be credited to the fund and exempts the
fund from lapsing of appropriations. The intent of this law change was to provide sufficient funding for
the training of Constables throughout the State of Arizona in an effort to increase the knowledge,
training, and professionalism of all Constables and to increase the ability of the Constables Ethics
Committee to adequately perform its mandated duties, Currently, many counties do not provide funding
for Constables training even though training is mandated by law. The collection of funds from the
additional writ fees will alleviate this problem by making funding for training available to all Constables.
The end result should be that the public will benefit from the availability of training for all Constables
who should be able to more effectively serve their constituents in a professional manner.

B. Project Proposal Form
Instructions: Please describe completely the project you propose to complete if awarded the
Constable Ethics, Standards and Training Board Equipment Grant. Be complete in your description
of the project. At a minimum your response to this form must contain:
• A detailed description of the proposed project.
• An explanation of needs for equipment purchases.
• An explanation of outcomes to be expected from the funding proposal.
• An explanation of how grant funds will be used (this is not a substitute for
the Project Budget required in Section IV C.)
Response:
1. Maricopa County wishes to apply for grant funds to purchase three mobile radios.
2. Maricopa County Constables use radios to communicate with local and county law enforcement
agencies. At this time there is a shortage of radios to supply all Constables in Maricopa County with
a mobile radio. Communications with the county sheriffs office is a major safety issue for
Constables working in the field.
3. Because radios are a major expense there is insufficient funds in the Constables budget to purchase
the required equipment. This grant will allow more Constables and Deputy Constables to have
communications with county and local law enforcement.
4. Purchase three mobile radios allowing communications with county and local law enforcement.
This will provide greater safety for Constables working in the field.

D. Project Performance Measures
Instructions: Please identify performance measurements that you will use to illustrate the outcomes
of your proposal, if selected for funding. The following perfoimance measures must be included at a
minimum for consideration. The performance measurements you identify in this section, as approved
by the Constable Ethics, Standards & Training Board, will become provisions of your grant contract
if the Applicant is selected as a CNA EG Program Grantee,
The performance measurements must demonstrate how the proposed project will meet the program
goals described in this Grant Manual. Minimum performance measurements for each project
shall include:
1. The total number of Constables & Deputy Constables that will benefit from
the equipment funding,
2. Please explain the estimated savings of your local government entity by award
of CNA EG,
3. Please identify the improved safety of Constables & Deputy Constables in
their required duties.
4. Please explain the improved execution of Constable duties and responsibilities
by purchase of equipment being requested.
Response:
1. Three Constables will directly benefit from the equipment funding. Five of the Constables who currently
without Radios will be given the ability to communicate with the sheriffs office.
2. The savings for Maricopa County will be for the cost of purchasing the Radios and equipment. This project
would not be able to proceed without funding from this grant.
3. By using radios in the field will give Constables added safety with direct communication with the sheriffs
office and other units. This will allow constables to be made aware of dangers that may arise in the
performance of their duties.
4. A radio will allow the Constable to be more productive with direct communication with the sheriff's office
and other units. Constables will have the added protection of their location being made available to other
agencies and units when serving court orders.
