Memorandum of Understanding for Back Up Helicopter Transportation Service between Maricopa County Sheriff's Office and Maricopa County Office of Enterprise Technology January 2015 The Telecommunications Division of the Office of Enterprise Technology has communication tower repair service and maintenance requirements that necessitate helicopter transport to various remote locations in Maricopa County. Its current service is with a commercial vendor; however there are times when the vendor is not available and the Maricopa County Sheriff's Office has filled in on occasion. The County Sheriff's Office has two helicopters with the primary purpose of supporting Law Enforcement components, Search and Rescue and some Detention support functions. However, it would be able to on occasion provide service to County Telecommunications when the contracted commercial vendor for helicopter transport service is unable to deliver service. The Sheriff's Office agrees to be the backup helicopter transport service for the Office of Enterprise Technology, Radio Division. This understanding is effective July 1, 2014 and continues through June 30, 2017. It can be cancelled by either party at any time with a 2-week written notice. The following conditions apply to this understanding: • The helicopter can hold a maximum of five passengers, plus two MCSO crew members. The total useful load for the mission, including fuel is limited to 1,900 pounds. Safety is the first concern. • For County liability reasons, the parties agree that only the Maricopa County employees assigned to the required work on the towers will be permitted passengers. Passenger ID's will be checked by the pilot prior to take off. • Sheriff's Office business (search and rescue, enforcement assists, etc.) will always take precedence and it may not be able to deliver service on occasion and the notice of cancellation may be on very short notice. Furthermore, service missions could be interrupted, although this is highly unlikely. • Requests for service should be submitted as early as possible in advance of service. - Requests should include: o Names, employee ID's, and weights of passengers. o The weight of the tower repair gear. o The date, time of service o The approximate length of time the service will take o The full accounting org string that will be billed for the service o The authorized Telecommunications Department official's consent. o The location of pick up. • Passengers should arrive at the Sheriffs hangar or other mutually agreed upon location, at least 20 minutes before takeoff. They will be asked to sign in and indicate the date, time and purpose/destination and show their County ID's. [1] • A two hour minimum charge (102 gallons of fuel) will be billed from the helicopter engine start to returning to the hangar and engine shut off. This includes stand by time. Additional time will be billed in 10-minute increments (8.5 gallons of fuel). The cost of fuel will be based on the rate at the time of service. • In cases where the job at the site is anticipated to take more than an hour, the MCSO pilot may leave and agree to return at a designated time. Regardless, the number of hours from initial engine start until final engine shut off at the Deer Valley hangar for that day's work will be continuously on the clock for the service. • In the event that overtime is worked by any Sheriff's Office employee at Aviation as a direct cause of this service, County Telecommunications will reimburse actual salary and variable benefits for actual overtime worked. • Prior to leaving the hangar site at the end of service, passengers will be asked to sign out using the form they signed in on and provide the time. This will become part ofthe record for billing for services rendered. • Based on source documents provided by Sheriff's Aviation, the Sheriff's Office Business Services Division will bill County Telecommunications. County Telecommunications will then prepare a JV transferring the designated amount for fuel costsfrom the Sheriff's Aviation org into the Telecommunications org by the amount on the billing. If applicable, overtime costs will be billed aswell as indicated in the paragraph above. • Conflict of Interest waiver: The parties to this agreement acknowledge that they are aware that the Civil Services Division of the Maricopa County Attorney's Office (Civil Division) may be chose asthe attorney for other parties to this agreement, and the signing party acknowledges that it is aware of a potential conflict of interest, and it waives any claim of conflict of interest, which may arise by virtue of Civil Division's representation of other parties to this agreement. • This understanding contains all the elements of this service agreement. No changescan be made orally. Any proposed changes must be made via written amendment that is coordinated by the Sheriff's Budget and FinanceBureau and the Sheriff's Patrol Bureau. • Contacts under this Memorandum of Understanding are: For Sheriff's Aviation: Sgt.Wesley Kuefer: w_kuefferf@mcso.maricopa.gov For Sheriff's Budget and FinanceBureau: Deputy Chief LeeAnn Bohn: I_bohn@mcso.maricopa.gov For County Telecommunications, OET: Thomas Crosby, Director: tomcrosby@mail.maricopa.gov Albert Daigre, Manager: AlbertDaigre@mail.maricopa.gov For County Telecommunications Accounting, OET: Accounting Specialist, Jan Killebrew: JKillebr@mail.maricopa.gov [2] -------------------------- Memorandum of Understanding for Back Up Helicopter Transportation Service between Maricopa County Sheriffs Office and Maricopa County Office of Enterprise Technology February 2015 Agreed: //<?r.,/~~- Sheriff's Chief Deputy Chief Information Officer, Enterprise Technology Date: 1-13-/5 Date: 1/ "> J z 0 I S Maricopa County Board of Supervisors Steve Chucri Date Chairman of the Board Attest: Fran McCarroll Date Clerk of the Board APPROVEDASTO FORM APPROVEDASTO FORM Deputy County Attorney Date Deputy County Attorney Date [3]
