Following the public hearing, the Board is requested to adopt the proposed revisions to this rule. Board Required Information (Appears on Agenda): August 2010 MARICOPA COUNTY AGENDA INFORMATION FORM Complete description of requested action: (Include, if applicable, background, impact, long-term commitment) The objective of these proposed revisions is to transform Rule 345 into a clear, concise, and understandable rule for the owners and operators of vehicle coating operations. The volatile organic compound (VOC) emissions from paints and clean-up materials used in the vehicle coating operations react in the presence of sunlight to form ground- level ozone, a major component of “smog” which is hazardous to human health and the environment. The Phoenix area is classified as Marginal nonattainment for ozone as determined by violations of the National Ambient Air Quality Standards (NAAQS). The proposed revisions to Rule 345 will clarify and simplify rule requirements, which encourages compliance with the rule and leads to the control of air emissions. The proposed revisions to Rule 345 do not impose any new compliance burdens on regulated entities or introduce additional regulatory requirements. None of the revisions have potentially significant economic impacts and will not impose increased monetary or regulatory costs on other state agencies, political subdivisions of this state, persons, or individuals. Additional Information-History/Reason for Item (Does not appear on Agenda): EXECUTIVE SUMMARY The NAAQS are regularly reviewed and the ozone standard could be lowered again. The U.S. Environmental Protection Agency (EPA) has conducted a series of studies to assess the potential source of emissions of VOCs from the use of consumer and commercial products, e.g. commercial vehicle coatings, which contribute to the violation of the NAAQS for ozone. From this study, the EPA determined that automotive coating operations, such as those regulated by Rule 345, account for at least 80 percent of the VOC emissions in areas that violate the NAAQS for ozone such as the Phoenix Area. The Maricopa County Air Quality Department (department) is proposing revisions to Rule 345 (Vehicle and Mobile Equipment Coating) to ensure that the standards and work practices for commercial vehicle coating operations are concise and understandable for the owners and operators of vehicle coating facilities. The rule is proposed to be restructured so that VOC coating limits are identified based on vehicle weight which eliminates the need to use the North American Industrial Classification System (NAICS) to describe the vehicle parts, facility types and the corresponding coating limit. Repetitive and obsolete language is also proposed to be deleted. For example, obsolete reporting requirements such as those for small facilities and those applicable to suppliers and manufacturers of vehicle paints and coatings are proposed to be deleted. Proposed changes in Rule 345 also include spray-gun requirements that will allow the use of different models of spray-guns. A Notice of Final Rulemaking will be distributed per normal procedures once approved.
