Transportation – Transportación
6. PATENT EASEMENT ABANDONMENT: ROAD FILE NO. PAB-0001
Road File No. PAB-0001 to Abandon a portion of Federal Patent Easement Number
1197559, lying in the Southwest quarter of Section 22 – T5N, R4E, of the Gila and Salt
River Meridian, Maricopa County, Arizona. In addition, direct MCDOT and the Clerk of the
Board to fulfill all notice requirements as outlined in Ordinance P-34, Patent Easement
Ordinance.
Pursuant to provisions in A.R.S. §11-251.16, Maricopa County Ordinance No. P-34 and
Maricopa County Department of Transportation Procedure # P5203. (C-64-15-015-M-01)
Mitch Wagner, Department of Transportation, provided background information to the
patent easement abandonment process. He explained that this patent easement
abandonment request is located in Supervisorial District 2, and gave a presentation
detailing the County roadway system for that area and the adjacent properties.
Mr. Wagner stated that at the time of the setting of hearing for this item, the Maricopa
County Department of Transportation (MCDOT) had not received any opposition and
recommended approval to the Board of Supervisors. He advised that MCDOT does not
have any plans to utilize this patent easement as a roadway, and the public utilities did
not object to abandonment. He noted that several letters of opposition have since been
received; however, the opposition is not 50 percent of abutting owners. He added that
some of the neighboring residents in opposition thought that the County would use this
roadway in the future, but the County does not have any plans to utilize or incorporate
this patent easement into the County roadway system.
Supervisor Kunasek asked if public utilities can be placed into the ground of that
easement without abandoning the patent easement. Mr. Wagner responded that
federal law allowed for public utilities, and the state law and County Ordinance require
public utilities to be notified and given the opportunity to object. All of the easements in
this area are in unincorporated Maricopa County, but he was not certain who services
the utilities for this particular area.
Robyn L. Interpreter, Esq., resident, spoke in opposition to this item. She discussed the
rural character of the area, and that the neighborhood is prone to flooding during the
monsoon season. Ms. Interpreter disclosed that she is an attorney who works on
federal land title issues. She is familiar with patent laws. She explained that one of her
concerns is about the federal authority that exists to allow for the abandonment, and
whether or not there will be a process at the federal level for this patent easement
abandonment.
Ms. Interpreter explained that residents of the neighborhood are unable to leave their
properties during flooding of several streets that are used for ingress and egress to the
residential properties. She stated that there is currently no roadway along the alignment
that can be used in case of an emergency.

Chairman Barney asked Ms. Interpreter if she had any interest in abandoning the patent
easement that is on her property. Ms. Interpreter responded that she is not interested at
this time. She explained that part of her concern is that if the patent easement being
discussed is abandoned, then she would be burdened by residents driving through her
property during emergencies and flooding.
Discussion ensued about the use and configuration of the patent easement located on
Ms. Interpreter’s property.
Supervisor Chucri thanked Mr. Wagner for outlining the facts, as well as the residents
that registered their position. He explained that approving the request will give the
private property owner full rights to that owner’s property, and asked for further
clarification on the reason for opposing abandonment. Ms. Interpreter responded that
the concern is not being able to access 64th or 65th Street without going onto the
applicant’s private property, if the patent easement is abandoned.
Chairman Barney explained that because the easement is not an improved roadway,
the rural character of this community would benefit from the Board’s approval of this
item.
Darren Calhoun, resident, discussed his concerns and opposition to the item. He
showed the Board Members a map of the floodplain for this area, and explained that if
the applicant becomes the owner of this patent easement, then the owners would have
the right to build on that location and prevent neighbors from using it to access 64th or
65th Street. He added that the neighborhood is located within the floodplain, with the
exception of the proposed abandonment. He stated that the patent easement is one of
the only routes for adjacent property owners to utilize going north-east, which makes
abandonment a public safety concern. He added that even though the County does not
have plans to use this patent easement as a roadway, it is possible that the County will
find use for it in the future.
Chairman Barney explained that residents of rural neighborhoods, like the one where
this patent easement is located, purposefully chose not to have certain planning
elements put in place, which creates certain transportation issues. He stated it is
unlikely that the County would ever decide to improve the roadway of this easement in
the future. He noted that abandonment of the patent easement is allowing an arcane
solution to allocate a reservation of rights to use that property in the future and release
that overlay to allow the property owner further use of their land. Mr. Wagner pointed out
that there are hundreds of miles of roads similar to this patent easement throughout the
County. Mr. Wagner explained that the only way for the Department of Transportation
to utilize and incorporate these easements into the county roadway system is through
major tax increases to provide funding to pave these roads.
Christy Smith, applicant, stated that she is working with the City of Scottsdale, and
accommodating the City’s request to run water lines through 10 feet of the easement.
She addressed the support of the abutting property owners. She noted that the Milton
Street alignment will not give access out of the area when the washes are running and
provided an aerial map of the area.
Chairman Barney thanked the property owners for speaking to the Board. He noted that
the area has three nearly parallel washes, and added that the roadways add character
to the rural nature of the community.
Supervisor Kunasek explained that cities already have the authority to abandon patent

easements, and since authority is not reserved solely to the federal government,
authority has also been given to states and counties.
Supervisor Chucri stated that he understands the reason for this request and believes
that approving abandonment will help keep the nature of the community intact.

1,935,729 registered voters, with 877,187 ballots cast in the General Election for an
overall voter turnout of 45.32%. This is one of the lowest turnouts since 1942. She
explained the five ballots that were rejected at tabulation, noting that two Republican
and two Democrat ballots from the primary election were turned in at the General
Election, and there was another ballot explaining why that voter would not be voting in
the election. She stated that there were also around 40,000 ballots that needed to be

because the ballots did not include official write-in candidates. She stated that she will
continue to encourage voters not to write in unofficial candidate names.
Karen Osborne noted that the 2014 General Election was unusual due to the low voter
turnout. She said that the Elections Department had done a lot to encourage voting,
and that she was not sure what else could have been done to increase voter turnout.

20. CONTINGENCY DOLLARS TO COMPLY WITH GRAVES V ARPAIO
Approve two additional Physicians Assistants (PA's) to support the Graves v Arpaio Fourth
Amended Judgment Paragraph 5.a(2): "If the receiving screening indicates a pretrial
detainee is suffering from a serious acute or chronic health condition, a physician,
physician assistant, or nurse practitioner will conduct a face-to-face examination of the
pretrial detainee within 24 hours after the receiving screening. FY2015 costs are estimated
at $118,579 (Detention Fund operating). Due to limited contingency funds, all funding in
FY2015 is requested from non-operating contingency. Therefore; it will be necessary for
the FY2016 Detention Fund Operating budget to fund these expenses on an on-going
basis, requiring a threshold adjustment of $203,279 (and also adjusted for any fixed or
variable benefit increases from FY 2015 to FY 2016) to the FY 2016 Correctional Health
(260) Detention Fund (255) budget threshold.
In accordance with A.R.S 42-17106(B), authorize the following amendments to the FY
2016 budget:
a) Decrease the expenditure appropriation for the Non Departmental (470) Detention Fund
(255) Non-Operating (0001) Contingency (4711) in the line "Unreserved Contingency " by
$118,579;
b) Increase the expenditure appropriation for Correctional Health (260) Detention Fund

c) Direct OMB to include an adjustment of $203,279 to the FY 2016 Correctional Health
(260) Detention Fund (255) Operating (0000) budget threshold to fund the annualized
operating cost associated with this action.
These actions will have a County-wide net impact of zero and they do not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to

Authorize and approve the employee awards from the Rewarding Ideas Program in the
amount of $5,000.00, and present awards on December 10, 2014. The Rewarding Ideas
Merit Award Board met on October 28, 2014, and approved the following recommended
employee awards.
Ryan McDevitt, $2,500, Recorder’s Office: Proposed eliminating a large percentage of the
manual updates for the Recorder’s Grantee/Grantor database records by running a query
to remove unnecessary suffix data, update records, and delete duplicates from the
Recorder’s historic indexing database. The increased efficiency resulted in the elimination
of the Office Assistant position and resulting in an annual savings of $27,872.
Frances Stephenson, $2,500, Risk Management: Proposed the utilization of an “online”
safety training product that is customizable in order to reference Maricopa County’s internal
policies and procedures and provide all of the mandatory regulatory components. This
eliminated the costly annual membership fees of the product currently utilized. The new
idea resulted in the elimination of the Syntrio contract, resulting in an annual tangible
savings of $16,500, and an intangible savings of $44,000 per year in labor hours. (C-20-15-

$657,866. These grant funds are for Emergency Planning within Maricopa County. The

composite indirect cost rate at 13.50%, or $66,510.00. The recoverable indirect cost of
administering this grant is $66,510.00.
In addition, approve an increase in revenue and expenditures for Fiscal Year 2015 for

23. EMPLOYEE BENEFIT TRUST – BENEFIT HOLIDAY
Approve a benefit holiday of Medical Plan related premiums paid to the Employee Benefit
Trust by employees for the 12/7/2014 payroll in an amount which is estimated to be
$475,026 and approve a benefit holiday of Medical Plan related premiums paid to the
Employee Benefit Trust by departments for the employer share for the 12/7/2014 payroll in
an amount which is estimated to be $4,674,024.
As benefit premiums fluctuate with each payroll, the total rebate will not exceed
$5,500,000.
The funding for this action will be sourced from a reduction of Employee Benefit Trust
revenues. The employee rebate will be implemented by not charging employees for
medical plan related premiums for all employees that have an active “A” status or leave
status of “L” or “P” at the time of the refund. The employer portion of the holiday will be
implemented in the same manner as the employee holiday. The Benefit premiums involved
in this action will be for the following Self-Funded plans: three Medical Plans, one
Pharmacy Plan, one Behavioral Health Plan and the three benefit premium incentive
programs.
This action will reduce Benefit Trust revenues but will not eliminate the Benefit Cost
allocation to the departments for the 12/7/2014 pay period. The cost allocation was
budgeted to be lower than actual benefit premium charges and thus the departments have
already benefited from receiving a discounted cost allocation. (C-39-15-011-2-00)

Fund (100) Non-Recurring (0001). The transfer will only be made if the Environmental
Services Department is unable to cover remaining General Fund expenditures within its
current appropriation.
Approval of this action will provide funding authority to the Environmental Services
Department to purchase the vector control adulticiding chemical, Duet, which is an
environmentally friendly and effective vector abatement, electric foggers and additional
mosquito control products and directly related supplies. This funding will allow for
continued mosquito outbreak control due to unexpected heavy rain storms causing
enormous amounts of standing water throughout the County during the months of
September and October. The need for an FY 2014-15 budget adjustment will be evaluated
based on the timing of additional adulticide being purchased.
Previously dispersed larvacides were also washed away during these storms, which makes
it necessary to re-treat areas within Maricopa County. The funding would allow the
Environmental Services Department to purchase eight (8) totes of Duet, three (3) electric
foggers, additional mosquito control products and other directly related supplies.
Calendar year to mid-October Environmental Services has received a total of 14,428
mosquito complaints. Last year Environmental Services received a total of 6,189
complaints for the entire fiscal year.
Environmental Services has treated 326,568 acres for adult mosquitoes fiscal year to date.
Environmental Services treated 194,757 acres total in fiscal year 2014.
Fiscal year to date, Environmental Services has incurred 1,126 hours of overtime for
fogging. (C-88-15-002-2-00)
