Request: Special Use Permit for a Wireless Communication Fadility in
the RU-43 zoning district
Site Location: Approx. 600' south of Dixeleta Dr. and 171st St. alignment on
the west side of 171st St.
Site Size: Approx. 722 sq.ft. of a 10 acre site

Description of Proposal:
1. The request is for a 62' (h) stealth wireless communication facility (faux water tower)
including a prefabricated equipment shelter measuring 11'-6" x 25'-6", 10'-8"(h). The
subject property is located just south of Dixeleta Dr. and 171st St. in the Rio Verde area.
The zoning is RU-43 and is located in Wireless Communication Facility Use District 1.
2. The site is currently occupied by a single family residence, tennis court, equestrian uses
and other accessory structures. The proposed SUP lease area will be 722 sq.ft. of the 10
acre property, and includes a 12' wide access easement from Dixeleta to the lease
area.
3. The wireless communication facility is to be located on the NEC of the subject site,
setback from the northern property line at 35 1-6", 604 1-4" to the south, 40' to the east,
and 572'-1" to the west. The applicant proposes 3 sectors, each with 4 antennas, for a
total of 12 antennas concealed within the proposed water tower. The applicant is
requesting to not have screening due to property owner's concerns with visual
aesthetics of the site.
Public Participation Summary:
4. The applicant has complied with the Maricopa County Citizen Review Process. The
applicant's Citizen Participation Plan included notifying property owners within 300' of the
request and posting the property. As of the writing of this report, staff is unaware of any
public support or opposition to the proposed Special Use Permit.
Existing On-Site and Adjacent Zoning/Land Use:
5. On-site: RU-43 / Single family residence
North: RU-43 / Vacant
East: RU-43 / Vacant
South: RU-43 / Vacant
West: RU-43/ Vacant

Adopted Plans:
6. Maricopa County "Eye to the Future 2020" Comprehensive Plan: The Comprehensive
Plan designates this site as being within the Rio Verde Foothills Area Plan.
7. Rio Verde Foothills Area Plan: The County's Area Plan adopted July 6, 2005, designates
this site as Rural Densities (0— 1 d.u./ac.). Wireless Communication is an important part of
the telecommunications industry and is essential to the growth of that infrastructure.
Staff considers the request to be in concert with the Plan's land use designation. The
plan does not address wireless communication facilities.

Utilities and Services:
8. Water: N/A (unmanned facility does not require water)
Wastewater: N/A (unmanned facility does not require sewer)
Fire Protection: Rural/Metro Fire Department
Police Protection: Maricopa County Sheriff's Office (MCSO)
Electric: APS
Outstanding Concerns from Reviewing Agencies:
9. N/A
Staff Analysis:
10. Staff believes that the stealth design for the new faux water tower WCF blend's into the
rural character of the area. Below are photo simulations showing how the water tower's
color and design aspects blend into the surrounding landscape.
[Photo simulations of water tower and equipment shelter]
PHOTOGRAPHIC SIMULATION PHOTOGRAPHIC SIMULATION
VIEW I - LOOKING SOUTH- VIEW 2- LOOKING SOUTHWE5T-
The lack of screening as proposed by the applicant is justified as a wall would create a
compound/facility feel and look to the site where the design of the water tower
Agenda Item: 2 -Z2014061

provides an aesthetic quality while complimenting the surrounding uses and rural
nature of the area. Staff feels that screening is not needed to suppress any noise since
the generator is located within the proposed equipment shelter. A total of 12 antennas
are proposed within the faux water tower's water tank and will not be visible from
outside the facility. The applicant has provided maps showing the existing coverage
and the new coverage available with the proposed WCF which justifies a gap in service
for the area. There are no outstanding issues from reviewing County Agencies.
Recommendation:
12. Staff recommends the Commission motion for approval with conditions "a" - of
Z2014061 for the following reasons:
• There is no opposition to the proposal from the surrounding property owners.
• The proposal is located in a stealth manner.
• The use appears to be compatible with the surroundings.
• The proposed facility will fulfill an area where there is a gap in service coverage.
• Reviewing County agencies have no concerns.
Subject to the following conditions 'a' - 'k':
a. Development of the site shall comply with the site plan entitled "Site Name: RHO
Vista Verde", consisting of six (6) sheets, stamped received October 1, 2014,
except as modified by the following conditions.
b. Development of the site shall be in conformance with the narrative report
entitled "Special Use Permit Application for Wireless Communication Facility,
Project Name: RHO Vista Verde", consisting of five (5) pages, stamped received
October 1, 2014, except as modified by the following conditions.
c. The overall height of the wireless communication facility including all antennas
and attachments shall be limited to 62'.
d. There shall be no outdoor lighting of the facility.
e. The following Drainage Review conditions shall apply:
1. Drainage review of planning and/or zoning cases is for conceptual design
only and does not represent final design approval nor shall it entitle
applicants to future designs that are not in conformance with section 1205
of the Maricopa County Zoning Ordinance and the Maricopa County
Drainage Policies and Standards.
2. All development and engineering design shall be in conformance with
Section 1205 of the Maricopa County Zoning Ordinance and current
engineering policies, standards, and best practices at the time of
application for construction.

f. This Special Use Permit shall expire 25 years from the date of approval by the
Board of Supervisors, or upon termination of the use, whichever occurs first. All of
the site improvements shall be removed within 60 days of such termination or
expiration.
g. The applicant shall submit a written report outlining the status of the development
at the end of five (5) years from the date of approval by the Board of Supervisors.
The status report shall be reviewed by staff to determine whether the Special Use
Permit remains in compliance with the approved conditions.
h. There shall be no co-location unless the future carrier can place the antennas
within the tank, and not interfere with the stealth quality. A Minor Amendment
shall be required to co-locate future carriers provided the carrier can place their
equipment within the existing compound. All equipment shall be stored/placed
within a structure.
Major changes to the Special Use Permit shall be processed as a revised
application, with approval by the Board of Supervisors upon recommendation of
the Planning and Zoning Commission. Minor changes may be administratively
approved by the Planning and Development Department. Major changes to
the Special Use Permit may require a new Citizen Participation Process as
determined by the Planning and Development Department.
Noncompliance with the conditions of approval will be treated as a violation in
accordance with Chapter 14 (Violation and Penalty) of the Maricopa County

be grounds for the Planning and Zoning Commission to take action in
accordance with the Maricopa County Zoning Ordinance,
k. Non-compliance with the regulations administered by the Maricopa County
Environmental Services Department, Maricopa County Department of
Transportation, Drainage Review Division, Planning and Development
Department, or the Flood Control District of Maricopa County may be grounds
for initiating a revocation of this Special Use Permit as set forth in the Maricopa
County Zoning Ordinance.

NARRATIVE REPORT
SPECIAL USE PERMIT APPLICATION FOR WIRELESS
COMMUNICATION FACILITY
A. Title Page
a. Project Name: PHO Vista Verde
b. General Location: 17047 E. Dixileta Dr., Rio Verde, Arizona 85204
C. Case Tracking Number: Z2014110
d. Applicant: Verizon Wireless
e. Date: September 22, 2014
f. Vicinity Map:
RECEIVED OCT 1 2q14
Z2014061

B. Purpose of Request:
Verizon Wireless is requesting a Special Use Permit for a new Wireless Communication
Facility (WCF) to be located on the property with the address of 17047 E. Dixileta Dr., Rio
Verde, AZ, 85204. The purpose of the new WCF is twofold: 1) improve Verizon's wireless
coverage to the nearby existing and future residences in this area and 2) ensure sufficient
wireless capacity exists for future residential development. Verizon Wireless is requesting a
Special Use Permit for a 25-year term for this facility.
C. Description of Proposal:
1. Construction of the 62'0" foot tall faux water tower: Verizon Wireless is proposing
to construct a 62'0" tall stealth tower disguised as a water tower at the above address
(APN is 219-38-013G). Verizon will conceal wireless panel antennas within the faux
water tank part of the WCF and the ground equipment will be located adjacent to the
west side of the tower within a prefabricated 12'0" wide by 26'0" long wireless
equipment shelter, along with an interior backup diesel powered generator. The
antennas will be mounted at a height of 55'0". The facility will be unmanned once
construction is completed, except for monthly maintenance that will occur by a
Verizon Wireless representative, generally lasting a few hours. When complete, the
facility will comply with the structural and building requirements of all applicable
local, state and federal building regulations for telecommunication sites. The site will
be capable of supporting future wireless carrier co-location if the owner allows for
additional ground lease space.
2. Ground Space and Equipment Shelter: The existing parent parcel is 9.99 acres in
size. Verizon will lease a new 722+7- SF (.016 acres) portion of the parent parcel
located in the northeast corner of the parcel. Inside of the new lease area, Verizon
will place the 62'0" water tower, and 12' x 26' foot prefabricated enclosed equipment
shelter building of approximately 11' 6" in height which will house the ground
equipment radio cabinets and backup diesel generator. The diesel powered generator
will be completely enclosed inside the equipment shelter building and will be utilized
to ensure the site remains operational in the event of a loss of power. It is important
to note that the generator will only operate approximately 30-45 minutes per week
during its routine test cycle (at a time interval to be determined by the Property
Owner and Maricopa County) and during power outages. No existing landscaping
will be disturbed and none will be added. Though Article 1202.3.1.m of the Maricopa
County Zoning Ordinance requires a solid screen wall of a maximum of six feet high,
the property owner has expressed a desire not to have a screening wall for aesthetic

purposes, and Verizon Wireless has determined that the rural, isolated nature of the
site will act as a natural buffer between the site and the surrounding homes. Noise and
visual impact will be minimal, due to the design of the site, as well as the distance
from other homes.
3. Access and Utility Easements: As part of its lease agreement with the Property
Owner, Verizon will lease all access and utility easements necessary to access and
operate the facility. The Verizon technician will park adjacent to the site.
4. Business Operations: This telecommunications site is an unmanned facility and will
operate 24/7 throughout the year. The site will not make any noise other than 1) the
air conditioning unit which cools the equipment inside the shelter, and 2) the
generator once a week for approximately thirty to forty-five minutes when it cycles
on for a test run. The site will include a level 2 acoustic enclosure, which will dampen
the already low (approx. 70-decibel) noise level. A technician will visit the site once
a month to perform routine maintenance and system checks. The visits will be
approximately a few hours in duration and will be conducted during business hours
unless there is an emergency.
5. Signs: There will not be any signs or advertising posted at this site other than the site
identification required under FCC Regulations.
6. Justification of the Site: The primary objective of this WCF is to provide improved
coverage to the Rio Verde Community as well as increase capacity of 4G L IE
coverage in the region. This site will result in smart phone internet speeds equivalent
to home cable internet speeds. Specifically, Verizon is seeking to improve in-home
coverage for the residents of this area to enhance commerce, convenience and safety.
Many homeowners today are making wireless telephony the primary (and sometimes
only) means of communication in their homes, and this site has been designed to
make that goal achievable in this area. The selection of this particular site was a
lengthy process and was ultimately arrived at through a process of elimination. After
several visits to the area both the landowner and Verizon settled on the proposed
location since it is the only viable site that can provide good coverage and yet remain
well disguised as a water tank and blend with its surroundings. It's important to
clarify that the proposed WCF will be built to a height that is the minimum necessary
to achieve the network coverage objectives. The attached propagation maps
graphically depict the expected coverage pattern and demonstrate a substantial
improvement in coverage with the addition of this site. The proposed site is in
compliance with the criteria enumerated in Section 1202.3.3 of the Maricopa County
Zoning Ordinance, will not be a detriment to adjacent properties, and will not have
any adverse effects on the public. On the contrary, it will greatly advance public
safety, morale and welfare by promoting safety, commerce and convenience for all
persons living, working or traveling in the vicinity.
D. Relationship to Surrounding Properties: The surrounding properties are zoned RU-43.
The proposed site is compatible with the surrounding area for many reasons, not the least

of which is its disguised appearance. As explained above, the antenna support structure
will be a 62'0" tall faux water tower and it will blend in well with the surrounding area
due to the existence of rolling hills, rural land uses, such as horse facilities, and desert
landscaping. The adjacent 12' x 26' prefabricated structure that houses the electrical
radio equipment and backup diesel generator will be fmished with an aggregate rock
façade that will blend well with the surrounding area. The closest adjacent residential
dwelling is approximately 896' away to the north. Based on the design and location of
the site, it is compatible with the area and meets the planning objectives for WCF' s in
Maricopa County. This site will provide the residents, visitors and commuters in the area
with wireless telephone and 4 th Generation internet coverage and greatly enhance
commerce, safety, and convenience for their families and businesses. The importance of
wireless cell phones is well established today and the advantages that will be provided to
the citizens of the County in this area far outweigh any potential detriment of the new
antennas.
E. Location and Accessibility: The Verizon Wireless site will be located in the northeast
corner of the subject property, accessible off of 171st Street, the nearest public right of
way, through the side property entrance.
F. Circulation System: There will not be any improvements necessary to the on and off site
circulation systems.
G. Development Schedule: The site is expected to be built in 2015 and will take
approximately 90 days to construct.
H. Community Facilities and Services: The facility will be unmanned and will generate no
refuse. It will have no impact on traffic, water, sewer, or police services. The facility is
distant from other buildings thereby minimizing fire or other potential hazards. There
will be no impact on local schools or any other community facilities or services.
. Public Utilities and Services: Police: Maricopa County Sheriff's Department: 602-876-
1011; Fire: Rural/Metro Fire Department: 1-800-645-9413; Telephone: CenturyLink: 1-
800-475-7526; Power: APS: 1-800-659-2975; Water and Sewer: Maricopa County
J. Other Information:
1. Grading and Drainage: A grading and drainage plan will be included with this
application if required by the County.
2. Traffic Impact Study: A traffic impact study has not been provided due to only one
trip generation per month by the cell site technician.

3. Summary: In summary, this site meets an important network coverage objective and
was placed in the least intrusive location given the lack of availability of alternative
sites in the area. The letter and spirit of the County zoning ordinance has been
followed to the greatest extent possible and, on behalf of Verizon Wireless, I
respectfully ask for approval of this project and thank you for your time and
consideration of this matter. Please contact me if you have any questions at all about
this submittal.
Sincerely,
James Gardner

Dear Mr. and Mrs. McConnell,
Thank you for expressing your concerns regarding this proposal. We at Verizon are very cognizant of the
possible impacts of our projects, and welcome any communication regarding our cases. Though we
understand the concern that the height of the tower may obstruct views of the admittedly beautiful
mountain range near your home, the site was designed in order to prevent this obstruction. Your home is
approximately 1/2 mile to the west of this tower, and significantly higher in elevation than the top of the
proposed tower.
The significant distance from your home and considerably lower height will prevent it from obstructing
your views, and will be minimally impactful upon immediate neighbors, due to its design and placement
upon the site. Please contact me with any further concerns, and note that the County Planner, Raymond

My husband, Raymond Paul McConnell and myself, Angela Rae McConnell, residents of 16704 E. Dixileta. Dr,

values, it will be unsafe for the environment, ourselves and our animals, as well as be an eyesore. We have
fought for almost twenty years to keep our desert pristine and to only do what is good to the community. A

Good Morning Mr. Banker,
My name is Robert Allen, I own property in the Rio Verde area at 164-05 East Lone Mountain Rd. and would like to make
a comment regarding the proposed cell phone tower.
I am personally in opposition to the placement of a cell phone tower in our residential area for a number of reasons,
noted below:
• First and foremost, the cell phone tower will bring our property value down in the area, we are only now seeing
a small bounce back from the 2008 real estate fiasco that lowered our property value tremendously.
• Secondly regardless of it being disguised as a water tower, there are inherent concerns about microwaves, why
would we allow something such as a cell tower impact our quality of life. I live on Long Island in New York and
specifically purchased my home in Rio Verde, so that I could enjoy a rural life style upon my retirement. I do not
see any benefit of having a cell phone in my community
Please use this email as my vote of objection to the placement of the proposed cell phone tower in the Rio Verde area
identified above.

Importance: High
Dear Raymond:
I am writing to voice my opposition to a proposed Verizon cell phone tower (disguised as a water tower) in the vicinity of
168th St. and Dixileta in Rio Verde. Our family purchased our home for the beautiful desert and rural environment and
we do NOT want a tower constructed between our property and the mountains. More importantly, I have serious
concerns about the electromagnetic waves that will be generated by the proposed tower. The International Agency for
Research on Cancer (" IARC") has classified radio frequency electromagnetic waves ("EMF's") as "possibly carcinogenic
to humans" (http://www.iarc.frien/media-centre/pr/2011/pdfs/or208 E.pdf). If someone gave you a glass of water and
said it was possibly carcinogenic, who you drink it or give it to your child to drink? Since cell phone towers are relatively
"new," there are no long-term studies that show the impact on human health over a long period of exposure.
In Brazil, there was a study that linked cancer deaths to the cell phone towers. Over 80 percent of the 7,000
deaths resided within one-third of a mile of a cell phone tower
(http://www.naturalnews.com/040905_cell phone towers radiation_cancer.html#ixzz3LYBNLKbb). EMF's
have been linked to cancer, neurodegenerative diseases, sleep disorders, weakened bones etc. Please refer
to the attached linked for a report by Prof. Girish Kumar to the Department of Telecommunications in India,
http://www.scribd.coin/doc/44736879/Cell-Tower-Radiation-Report-sent-to-DOT-Department-of-
Telecommunications . Cell phones have become such a part of the American culture that the possibility of it
being a health hazard is a rather an inconvenient truth that the telecommunication companies will do anything to
refute.
I have lived out here for almost five years and Verizon has been my provider. I have excellent service. Quite
frankly, I am not willing to sacrifice my family's health for the sake of better reception. I appreciate your time
in reviewing this case and I hope you hear my community's plea to reject this special use permit.

We are opposed to the proposed 65' water tower to be located at 168th Street and Dixelita. The
reason for our opposition is it would completely destroy our presently undistorted views from
these parcels of Four Peaks and surrounding mountains, as well as, Weaver's Needle and the
Superstition Mountains. In our opinion, the tower will destroy our pristine Sonoran Desert views
which is the reason so many have invested in this area.
We also believe the tower will further plummet property values in a currently distressed market.

Subject: Cell Tower - 168th Street and Dixileta - Opposition
Dear Mr Banker,
We are opposed to the proposed construction/placement of a cell tower at the location of 168th Street and Dixileta. We
believed that the proposed 65-foot tall cell tower will greatly impact our property value since it will be visible and
diminish the view of the mountains. The surrounding area has low brush and a few iron wood trees that would not mask
the tower. All utilities are run underground in the northern side of Rio Verde Dr that ensure the unobstructed view of
the area from unsightly poles / antennas / wires preserving a natural look to the surrounding environment (this
proposition is contrary to that approach). Additional health concern is exposure to EMF/wireless microwave radiation
that will be emitted to the surrounding area.
We hope that our voice is heard, valued and taken into account as a major stake holder.

What is the need for the "faux" water tower or any tower, for Verizon? We have Verizon, and we have excellent
coverage all up and down Rio Verde Drive. We live one half mile South of Rio Verde Drive, off 176th Street, and we are
quite close to the high power lines, and we have no challenges with Verizon's Services.
Sensing there might be a reason that Verizon wants to be able to service the new development, Tegevah/Shea Homes
(formally Vista Verde) with NEW services, other than cell and data, there seems to be no need for this type of new
antenna. If this be the case, the development would be better served by using the fibre-optic cable that exists, coming
down Rio Verde Drive, adjoining their property. There are also some antennas on the back of the SRP Substation, and
high pole lines on the East side of 176th; VERY tall lines.
Some residents out here in the Rio Verde Foothills, specifically between 136th and 144th Streets, to the far North, paid
an extra premium for their power utilities to be put underground. The so called water tower would be considered way
more objectable, and the SRP is requiring that all of the electrical utility construction going to the North of Tegevah, be
underground. (no power poles visible)
When I, Ferrell, went to look for the notices on this particular permit, I only found them on 170th and 172nd Street
North of the 168th street location. There is a group of homes to the East, where we perceive where the tower is going to
be; they all can look out to the East and see a wide range of excellent views. They are not impacted. BUT, the houses to
the West of this tower, their views will be severely impacted.
If a cell tower in the area of 168st Street is deemed necessary, for any special services requiring this height, if might be
better to consider putting it on the high voltage power poles that run from Pima and Dynamite, diagonally to the
North/East of this area. This site would be much better because it would cover virtually all the area up to and including
the 136th Street, as well as giving better cell service to persons who might be injured or needing help from the Tonto
National Forest.
In speaking with both Valerie Beckett and Raymond Banker, I want to ask that in the future, residents beyond the 300
foot limit, be notified, too. There are many resident out here that have more than 2 to 3 acres, and some have 10 and
above. We are spread out, and want our beautiful views.
By the way, is there a light that needs to be placed on a tower of this heigh? Airplanes from Deer Valley Pilots School
often come out here to practice at night, and believe me, having a flashing light would not be fun to see all night.
Thank you,
Ferrell and Jean Anderson

Subject: Rio Verde Verizon Cell Tower disguised as a Water Tower
Hello Raymond,
Thanks for the opportunity to speak to you this afternoon.
My property is at 17308 E. Cascalote Dr. (north of Dixileta off 172nd St) in the Rio Verde
Foothills, not far from Vista Verde. I am in the process of developing the property and live on
an adjacent property. I have Verizon service and it works perfectly for the 8 years I've been out
here. I am not in need of an improved service.
I am writing to voice my opposition to the proposed Verizon cell phone tower (disguised as a
water tower) in the vicinity of 168th St. and Dixileta in Rio Verde. I purchased my property for
the beautiful, lush Sonoran desert and rural environment that it is, and I would not want such
a tower constructed between my property and the mountains I love, nor that of my neighbors.
I understand one property owner has the opportunity to profit by "hosting" the tower on his
property to the tune of $2000 per month. How nice for him, if this is true. I don't begrudge his
windfall, but it seems insensitive to our delicate desert environment.
I also have concerns about electromagnetic waves that will be generated by the proposed
tower and the potential effects it could have on our tall, old, majestic saguaros and other
wildlife, and the people who will someday inhabit the vacant 10 acre properties surrounding
the proposed site. There is not adequate research currently to account for the impact on living
things.
I have lived out here for 8 years and Verizon has been my provider. I have always had
excellent service. If this tower is to provide infrastructure for the former Vista Verde/Tegevah,
and now Shea Homes Trilogy, as I understand it may be, then let them build that tower
somewhere on the 850 acres they will be developing rather than on private property in
proximity to other rural, pristine private properties, or perhaps on the other 75+ acres retained
by the Verde Communities in immediate proximity to the development.

Mr. Banker,
We opposed to the cell tower construction planned for the area of 168th st and dixeleta
These are residences out here and this tower will hurt property values and will be an eyesore.
It does not belong in an area such as OUTS.

Hi Raymond,
Thank you for taking the time to speak with me earlier,....
The proposed site of the "tower" at 168th & Dixileta in the Rio Verde Foothills is in the middle of our
neighborhood! My land is the entire NW corner of same. We enjoy the peace, quiet and views of this
gorgeous desert and are completely shocked that a "commercial" endeavor could destroy our community. I'm a
Realtor and know how this will single handedly devalue our property. We all work hard to maintain the desert
(picking up trash etc....) and make improvements to our properties. We truly treasure living the unique lifestyles
out here!
I know my views will be destroyed to the south. I'm sure my horses could care less.
Please help us in fighting this monstrosity

This case is to install a 65 foot disguised water tower at 168th Street & Dixileta,
How do I formally file an objection to this case/special use permit as I am unable to attend the
meeting?
Installing a tower of that hight will obstruct the view of the best mountain range in all of the
Phoenix area and many of the homeowners views will be substantially and negatively affected
should this be approved.
I look forward to your reply.

I want to start by saying that I certainly agree wireless telecommunications is an important service for the Rio Verde
Foothills (RVF) Area.
The only issue is how to implement the infrastructure in a way that is compatible with the character of the area.
The first part of that issue to consider should be, is this tower necessary?
Verizon's website shows excellent coverage in this area. I see no substantiated justification for this tower and reject the
claim that
"The proposed facility will fulfill an area where there is a gap in service coverage."
Key elements characterizing RVF have been emphasized by residents - and are repeated throughout the Rio Verde
Foothills Area Plan - are that:
1) the area has a natural beauty that is unique in Maricopa County,
2) the area is rural,
3) the area is serenely quiet, and
4) the area is "dark" with very little stray lighting.
The staff and applicant have made a fair attempt to disguise what would otherwise be a wholly unacceptable eyesore,
and I could even envision it blending with other areas of the county. I was encouraged to see stipulation d. for no
outdoor lighting; However, the installation it is not sufficiently "stealthy" for this location and I disagree with the Staff
assessment that the "stealth design for the new faux water tower WCF blend's into the rural character of the area".
There are no tall structures in the area except for electrical towers and one WCF. The thought of multiple tall WCFs
makes me shudder.
Given the lack of justification or description of options, I must oppose this SUP at this time.
In order to move ahead, at a minimum, the following items need to be rernediated:
1) The height at that location creates an unacceptable visual barrier.
Many RVF residents have paid considerably extra for underground utilities. View 2 of the Photographic
Simulations clearly shows the impact and is extremely meaningful to local residents. The natural "sight-line"
barriers may somewhat hide the equipment enclosure, but clearly cannot hide the antennas. Another location
or more, shorter antennas are options to be explored. I urge the Zoning and Planning Commission to disapprove
this application on this one point alone.
2) The natural quiet is another essential element.
The vague description that 'THE TOPOGRAPHY OF THE AREA ALSO ACTS AS A NATURAL ... ACOUSTIC
DAMPENER" is ludicrous. As can be seen in the overhead view and topography of the site plan, that site is
substantially flat with a 3% grade. It is nearly devoid of trees. In my area, with substantially more trees, I can
hear neighbor's voices 1200 ft away.
The level of noise created by the generators and equipment is stated at "approximately 70 dB". This is not an
operating specification, so it must be rejected as insufficient. Having a "level 2 acoustic enclosure" similarly
provides no measureable/enforceable standard to assure compliance. Routine visits and maintenance
1

operations during "Business flours" is a vague standard given the 24/7 nature of the telecommunications
business. Until an agreement can be written into stipulations for acceptable operation and noise levels that
neighbors agree with, I urge the Zoning and Planning Commission to disapprove this application.
3) Many details about the faux finish need to be more complete in order to assure the installation meets the intent
of the application submittal, for example:
a. Faux wood on all visible metal surfaces of the tower exceeding 10 sq in. (not just "TYP")
b. Remaining metal to be treated to be of a dull (non-reflecting, for example, black oxide or red oxide
steel) finish.
c. Equipment enclosure to be limited to a maximum elevation
d. Antennas, structures, and covering to limited to a maximum elevation
e. Additional utilities to the site are to be placed underground.
f. Maintenance of the faux finish is not addressed in order to maintain the "steath" character throughout
the life of the SUP.
g. Need for a screening wall shall be re-evaluated each 5 years.
h. This assumes the usual SUP re-evaluation every 10 years.
4) Specific stipulation modifications
(additions highlighted in green)
d. There shall be no outdoor liahting of the facility, Intetinr fing iq j o shio1doJ o that rc
irectjiji•Yiiih'COLQQ, is Asi re -tom fhle_gOsitie of the enclosure
To avoid having a "zombie" SUP that does not provide any service, I request this
wording change to stipulation g.
g. The applicant shall submit a written report outlining the status of the development
at the end of fivc (5) years from the date of approval by the Board of
Supervisors.
L§UP will expire if cons-tritc ion has not.orn Wed in 2 years_ from the date- _o QV?
he Bg.ard of Supervg
The status report shall be reviewed by staff to determine whether the Special Use
Permit remains in compliance with the approved conditions. Notiti c at i o n of rn i
compliance also allows staff to independently determine compliance. If thd,
development is not completed within two years from date of approl by the oard
i'10: GUS ; then t all e re
h.There shall be no co-location unless the future carrier can place the antennas
within the tank, and not interfere with the stealth quality. A Minor Amendment
shall be required to co-locate future carriers provided the carrier can place their
equipment within the existing compound designated as "Lessee Lease Areal

I appreciate the opportunity to participate in the zoning process.

Hi my name is Danielle. My husband and I just moved here in February. We live off 168th and Horned
Owl Trail. I drive down Dixileta on a daily basis considering my mail box is on Dixi.leta. I don't know who
comes up with the ideas of what to put out here for cell phone towers, but I think it's ridiculous to put a 65
foot fake water tower. It must be someone who doesn't live here otherwise they would not suggest
something so hideous that will not only not blend in with the beauty of the desert around here, but also
block the beautiful views for the home owners around that area. The people I know around here that don't
have good cell service don't make a big deal about. They have a house phone, or they get on the service
that works better out here. AT&T and Verizon. Plus a lot of us like not getting full service. We come here
for the somewhat solitude we get. If we want better service and people to get ahold of us then we get
house phone. I don't see the need for a 65 foot water tower. We have to have water delivered to our
houses so why that? Why not the fake cactus? Why something that doesn't blend in? I might not get a
response from anybody I email, but at least I am trying along with many others in this area. I think that we,
the people that live in this area should have more say then some money grubbing company. We moved out
here for the beauty and views and this ugly fake tower is only going to ruin that. It's not gonna make sense.
Stop and think of all the people that live in this area. Listen to what we want as a community because I can
guarantee it's not that. We want to keep the views and beauty. We want people to move out here and be
able to enjoy the views and beauty for many many years, but if Maricopa doesn't listen to us as a
community then eventually there won't the views and beauty to enjoy. Please think about it. Come look
around. Day and night. Come talk to the people in the community. Every one will tell you why they live
out here. It's for the same reasons my husband and I chose to live here.

Thank you

Subject: in Favor! CELL TOWER AT 168TH STREET, Rio Verde
Hello Ray,
Your email was listed on the Rio Verde Foothills facebook page by a woman asking residents to flood your email and
voicemail with opposition to the project. I however am writing to let you know I'm in favor of the project. The area is long
overdue for an upgrade in services and I for one am looking forward to better cell service and it will make the area more
attractive and safer to the residents and visitors. Although some may oppose it, I'm sure they'd feel differently if they were
to fall off their horse, or dirtbike and be unable to call for help because they had no connection.
I also happen to have a commercial property in Phoenix and was approaced several years ago about putting a cell
tower on the property. The hearing had one or two attendees who opposed it and the hearing officer /judge ? advised
them federal law prohibited them from considering potential health risks as they were unproven. I don't know if this has
changed. At any rate I expect the project to go as planned but thought you might want to be able to say you were
contacted by someone in favor of the project.
