Environmental Services Department, Maricopa County Department of Transportation,
Drainage Review Division, Planning and Development Department, or the Flood Control
District of Maricopa County may be grounds for initiating a revocation of this Special Use
Permit as set forth in the Maricopa County Zoning Ordinance.
l. Development of the site shall be in conformance with all Federal and State requirements,

Administration (FAA), National Environmental Policy Act (NEPA), and State Historical
Preservation Office (SHPO). The applicant shall be responsible for obtaining all necessary
approvals prior to construction, and shall be accountable to those agency requirements,
and penalties.
m. All necessary building permits must be obtained for proposed changes.
n. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval is temporary
and allows the property to enjoy uses in excess of those permitted by the zoning existing
on the date of application, subject to conditions and stipulations. In the event of the failure
to comply with any condition or stipulation, and at the time of expiration of the Special Use
Permit, the property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to comply with any
conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation or expiration of the Special Use Permit. The Special
Use Permit enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of the
property as if the Special Use Permit had never been granted. (C-44-15-011-M-00)
Deborah Stark, Director of Maricopa County Planning and Development Department,
reviewed the item noting it was continued from the September 8, 2014 hearing in order
to allow the applicant to work with District 3’s Office and the community. She stated the
applicant has lowered the height of the flagpole from 80 feet to 70 feet and requested
that condition “g” be modified to 20 years instead of 10 years. She noted that
Commission and Staff recommend approval with revisions to “a”, “b”, “c”, and “g”.
Chairman Barney and Supervisor Kunasek thanked everyone involved for working
together to reach an agreeable outcome.
Motion to concur with the recommendation of the Planning Commission and Staff to
approve conditions ”a” through “n” with revised language to “a”, “b”, “c” and “g” by
Supervisor Kunasek, seconded by Supervisor Hickman
Mr. Vidrine thanked Staff and Supervisor Kunasek’s Office for working with the applicant
and for the opportunity to work with the community.

8. POST DECREE OPEN NEGOTIATIONS FEE
Pursuant to A.R.S. §11-251.08, convene the scheduled public hearing, to solicit comments
and consider the adoption of Post Decree Open Negotiations Fee. Upon Board approval,
this item will become effective September 24, 2014.
Pursuant to Rule 66(B)(5) of the Arizona Rules of Family Law Procedure, open negotiation
is a process of non-confidential negotiations between the parties conducted by a neutral
third party (a Conciliator) in an attempt to resolve their dispute. The intent of this rule is to
encourage the resolution of family-related cases through an additional non-adversarial

dispute resolution process created pursuant to the authority of Rule 68(E) of the Arizona
Rules of Family Law Procedure.
The fee will be assessed when a request for an open negotiation is sought following
dissolution of marriage and a report regarding legal decision making (formerly known as
custody) or parenting time is issued for judicial review. Parties will be permitted to request
a waiver or deferral of this fee utilizing the process that is established and no party will be
precluded from pursuing relief solely due to inability to pay these costs. Upon Board
approval, the post decree open negotiation costs will be assessed to each party that
requests or is ordered to a post decree open negotiation.
Requests for post decree open negotiations are directed to the Court’s Conciliation
Services unit with the Family Court Department. When a post decree open negotiation is
requested, a Conciliator is scheduled with the parties. Administrative support staff time is
expended as is time during the open negotiation and in drafting a report for the court. The
final product that is forwarded to the judicial officer for review is a completed parenting plan
or the parties position statements depending on the outcome of the conference. None of
these costs are currently billed to the parties and current statutes never contemplated this
service provided to the parties. Regardless how well-satisfied the parties might be with
initial results of their original judgment, many couples become discouraged with the court
orders as they apply these directives to daily parenting time, child(ren) exchanges, support,
and legal decision making issues. This leads to one or both parents coming back to the
Court to seek relief.
Authorizing the Post Decree Open Negotiations Fee of $100 per party will provide the
Court needed resources for staff time that is expended in preparing reports for the Court.
Revenue generated from this fee will be deposited into the Superior Court Special
Revenue Fund 259 and used to offset the costs associated Post Decree Open
Negotiations. Revenue projections for FY14 will be approximately $45,000; a full year of
revenue is projected at $68,000. (C-80-15-001-2-00)
The Deputy Clerk noted the item was to convene the scheduled public hearing and
there were no speaker requests for this item.

65. MARICOPA COUNTY AIR POLLUTION CONTROL REGULATIONS AQ-2014-001-
INCORPORATION BY REFERENCE 2013-2014
Pursuant to A.R.S. §49-479(b), set a public hearing for November 5, 2014 to solicit
comments and consider the adoption of incorporating federal standards into Maricopa
County Air Pollution Control Regulations, Rule 321 (Municipal Solid Waste Landfills), Rule
360 (New Source Performance Standards), Rule 370 (Federal Hazardous Air Pollutant
Program), Rule 371 (Acid Rain), and Appendix G (Incorporated Materials). Upon Board
approval, this item will become effective November 5, 2014.
The Maricopa County Air Quality Department (department) is proposing to revise Rules
321, 360, 370, 371, and Appendix G by incorporating federal regulations and documents
promulgated by the U.S. Environmental Protection Agency (EPA): New Source
Performance Standards (NSPS), National Emission Standards for Hazardous Air Pollutants
(NESHAP), Acid Rain and other parts of Title 40 Code of Federal Regulations. The
proposed action will include amending the incorporation by reference date from July 1,
2013, to July 1, 2014, in each of the rules and appendix to remain current with federal
regulations. The adoption of the proposed amendments to Maricopa County Air Pollution
Control Regulations Rules 321, 360, 370, 371 and Appendix G is necessary prior to
requesting the EPA’s delegation of authority to the department for the implementation and
enforcement of the federal regulations and documents.
These amendments should not have an economic impact on businesses in Maricopa
County and should not impose additional costs on the regulated community, small
businesses, political subdivisions, and members of the public beyond that already incurred
by reason of federal or state rule or law. The costs of compliance with these rules have
already occurred and were considered when the federal and state rule or law was
proposed and adopted.
The department did not receive any public comments during the public comment period.

Chairman Barney reviewed the public comment guidelines and invited all those wishing
to speak to note those guidelines.
Lisa Donaldson, resident of Levine, spoke about return-to-owner rates and provided
recommendations on improvements for Maricopa County Animal Care & Control
(MCACC) which she detailed in a handout to the Board Members. She asked if there
were any statistics available to the public on the return-to-owner rates. She noted that
there are many lost and found animals in Levine not reunited with owners. She
suggested having a “Lost and Found” sign put up at the West Shelter that would allow
owners to leave flyers for lost pets. She also recommended that MCACC partner with

groups such as Lost Dogs Arizona and Missing Pet Partnership to improve the number
of adoptions and provide additional support for the public.
Julie Hughes, resident of Goodyear stated she was recently made aware of the animal
situation and number of dogs euthanized at MCACC shelters. She discussed a recent
experience that occurred on September 13, 2014 involving a six year old dog listed on
the MCACC West Shelter euthanasia list that she planned to adopt for her neighbor’s
grandfather. She explained that Eloise Prevost of Dog Love Rescue called to have the
dog pulled for adoption, but found the dog had been euthanized.
Ed Bufford, resident of Tempe, discussed the owner/surrender policies and changing
the policy to require proof of ownership. He added that the MCACC shelters are closed
on Sundays and that may be the best time for adoptions. He encouraged the Board to
consider establishing a marketing department to help improve adoption rates and save
more lives.
Lisa Hendricks, resident of Glendale, expressed her concern over the owner/surrender
process at MCACC. She discussed a specific instance involving a couple that went
through a divorce and the husband took the family pet to the shelter and had the dog
euthanized. She explained that owner/surrender animals are not given the same
consideration as a stray animal. She advocated that those surrendering dogs show
proof of ownership.
Trish Manes, President of No Kill Maricopa County, discussed lost animal reclaims as
one of the most overlooked areas in animal control centers and asked that the shelters
make a more proactive effort in order to return lost animals to the families and reduce
killings. She added that No Kill Maricopa County is launching a microchip fundraising
campaign as a way to help MCACC increase pet redemptions. Their goal is to use the
funds to offer free microchips to all MCACC shelters and pet owners in Maricopa County
for one year in order to reunite pets with families and reduce the cost associated with
sheltering and killing unclaimed pets.
Eloise Prevost, representing No Kill Maricopa County, presented Trio, a dog labeled
S5 that she rescued from being euthanized. She provided a handout to the Board of a
pre-euthanasia list and picture of a dog that was mislabeled S5. She also discussed her
efforts to rescue dogs from being euthanized and evaluating the dogs to ensure proper
labeling.
Deborah Faust, representing No Kill Maricopa County, reported that she posts pictures
of dogs in an effort to save the dogs from being euthanized. She provided several
pictures to the Board Members of dogs at the MCACC shelters and included a
description of what happened to the dogs. She stated she will continue to email the
Board Members regarding the outcomes of dogs included on the handout.
Gary Hamilton, representing No Kill Maricopa County, read a letter from Laura Marlowe
regarding the implications of mislabeling a dog as aggressive or frightened, and
expressed her concern over the labeling of dogs in a cage or kennel. She advocated
that dogs need more space and better care in order to properly evaluate behavior.

that do not euthanize animals have more volunteers, and appealed to the Board of
Supervisors to turn Maricopa County into a No Kill County.

Approve a document between the Flood Control District of Maricopa County (District) and
the Maricopa County Parks Department (County) where the District will assign certain rights
and obligations to the County for recreational purposes.
White Tanks Number 3 Outlet Channel was constructed in 2013 and connects to White
Tanks FRS No. 3 spillway. This channel allows the flood retarding structure to be drained
after a storm event. This channel was also constructed as part of the White Tanks No. 3
rehabilitation program and the project had a multi-use component in which a recreational
trail could be constructed on the District’s Operations and Maintenance road. The easement
assigned to County Parks will complete the trail process. This agenda item impacts
Supervisorial District Number 4.
This right is granted at no cost pursuant to IGA FCD 2006A002. (C-69-15-009-3-00)
Supervisor Kunasek thanked the cities and Flood Control District Board for their efforts
in moving these improvements forward.
Motion to approve by Director Chucri, seconded by Director Hickman

F-3. RESOLUTION FOR DELEGATION OF AUTHORITY – DESIGNATION OF APPLICANT
AGENT
Adopt Resolution FCD 2014R002, Delegation of Authority – Designation of Applicant Agent,
delegating to the Chief Engineer and General Manager of the Flood Control District of
Maricopa County (District) the authority to designate the District’s Agent to file applications
for emergency and disaster relief assistance with the Arizona Division of Emergency
Management on behalf of the District for the purpose of obtaining financial assistance.
To obtain emergency and disaster relief assistance, the Arizona Division of Emergency
Management requires that the District designate an Applicant Agent. Delegation of the
authority for this designation provides for timely adjustments to agent designations in
response to situational needs. This Agenda Item impacts all supervisorial districts. (C-69-15-

S-1. BALLPARK SOD AGREEMENT WITH WEST COAST TURF
Approve the “Ballpark Sod Agreement” between West Coast Turf, Inc., AZPB Limited
Partnership, AZPB REM Limited Partnership, AZPB FM Limited Partnership, Arizona
Diamondbacks Foundation, Inc., the Maricopa County Stadium District and Select Artists
Associates, LLC. The agreement grants certain advertising and other rights to West Coast
Turf in exchange for West Coast Turf providing annual turf replacement at Chase Field and
other services at the rates specified in the agreement. West Coast Turf will also supply and
install, at the cost specified in the agreement, up to five (5) Diamondbacks Youth Fields over
the term of the agreement. The agreement is effective from December 1, 2014 to November
30, 2018. Pursuant to the agreement, the Stadium District will pay as follows:
2015: $75,850
2016: $77,746
2017: $79,689
2018: $81,681
This agreement replaces a prior agreement with West Coast Turf, the “Ballpark Sod
Agreement” (C-68-07-006-1-01) addressing the same services which were effective
February 7, 2011 through November 30, 2014. Under the Facility Management Agreement
the Facility Manager (AZPB FM Limited Partnership) is responsible for managing and
operating the Facility and for selecting and contracting with service providers. West Coast
Turf developed the original sod for use at the Facility and this contract continues its
responsibility to provide and install the sod necessary for maintaining optimum Major
League Baseball playing conditions for this unique indoor/outdoor facility. (C-68-15-003-M-
00)
Supervisor Kunasek noted that historically the sod that is removed from Chase Stadium
has been reused on other sports fields throughout the Valley and goes to very
worthwhile uses in the community.
