INTERGOVERNMENTAL AGREEMENT G-30176 WITH THE TOWN OF PARADISE VALLEY FOR COST SHARING OF PUBLIC SAFETY RADIO COMMUNICATIONS FACILITY Approve, and authorize the Chairman to execute, all documents associated with Intergovernmental Agreement G-30176 (“IGA”) with the Town of Paradise Valley (the “Town”) for Cost Sharing of the Paradise Valley Public Safety Radio Communication Facility for the acquisition, construction, installation, maintenance and operations of a public safety radio communications facility at a Town-provided site. This IGA allows Maricopa County the right to share in the development of a public safety radio communications facility which will provide the County needed public safety radio coverage as well as radio coverage for the County’s other government purposes. The initial term of the IGA will be for 25 years with an option to renew for an additional 25 years. The County and the Town will equally share in the costs for: i) acquiring the site and/or scheduled payments associated with acquiring rights to the site; ii) the costs of developing the shared components of the communications facility; and iii) the ongoing operation and maintenance costs for the subject communications facility. The Town and the County will be individually responsible for each party’s individual costs associated with procurement, installation, start-up, operation and maintenance of each party’s own radio system equipment at the subject facility. The County will have a one-time right to terminate the IGA upon completion of the Town’s full assessment of the costs associated with acquiring the site and/or rights to access the site. A subsequent Board of Supervisors’ agenda item will be submitted for the Board’s consideration upon completion of the Town’s assessment of the site acquisition costs. This IGA will support the implementation of the County’s Radio System Upgrade Project. (C-94-15-003-3-00) Scott LeMarr, Mayor, Town of Paradise Valley thanked those that have helped throughout the process and for the years of cooperative effort of everyone involved. He stated that one of the requirements in partnership with the City of Phoenix was to provide a new radio communication facility and to join the regional wireless cooperative. He stated that the new facility would be one of the largest in the valley and informed the Members that discussions of the facility started as far back as 2011. He noted the aesthetics of the wireless facility antennas which he believes will blend with the current cacti landscaping. He informed the Members that the Town of Paradise Valley personnel accompanied him to the meeting should there be any questions. Chairman Barney thanked Mayor Scott LeMarr and acknowledged the lengthiness of the process. He stated that he agrees with Supervisor Chucri and Supervisor Hickman that the facility is an invaluable collaboration to expand critical communication coverage. Jumana Hadeed, resident of the Town of Paradise Valley, stated that she believes that everyone is aware of the importance of communication in the Town of Paradise Valley. She said the project was just brought to her attention recently and noted that it will be Formal Meeting Minutes Wednesday, July 30, 2014 Page 4 of 71 located adjacent to a vacant lot where she had planned on building her future home. She said that she understands the need for public communication safety but questioned the public hazards it will create. She noted the short time frame of the public being notified and questioned the location of the antennas, and stated her concern of property being disturbed during the installation of the antennas. She stated her concern that the Town of Paradise Valley did not listen to the citizens and asked the County to deny the request. If denied, she is hopeful that the Town of Paradise Valley will revisit the proposal and move to have the antennas and facility located together at the same location. Wolfgang Monthofer, resident of the Town of Paradise Valley, stated he is an adjacent owner to the proposed equipment and is in opposition. He said 99 percent of the residents were not aware of the agreement and only found out by the survey. He was told that the City Council put it on hold and was given 23 pages of information. He said the agreement is for an established residential neighborhood and believes there are legal issues. He requested that the Board of Supervisors delay the item. Andrew Miller, Attorney for the Town of Paradise Valley, noted the numerous meetings that were held with the citizens. He stated that the Town of Paradise Valley is committed to the site and spent time with several radio communication businesses in finding a site that would help in the radio coverage gaps for fire and police. He said that the City Council asked for a statement of direction on the design of the project to be sure it is aesthetically pleasing to the residents. He noted concerns of radiation exposure and found cell sites where the radiation dissipates and there are plans to retain an expert regarding these concerns. He noted that the Town of Paradise Valley has been working on the project for quite some time, but has had negative feedback from some residents. He is glad that the County is willing to work cooperatively on the project. Supervisor Chucri concurred with the statements of Andrew Miller and stated that the County is not sanctioning the project noting that the Town of Paradise Valley could build the facility with or without the County. He stated that the agreement is simply a partnership with the Town of Paradise Valley. Supervisor Chucri informed the residents that the item of discussion is the IGA. He stated that the Mayor of the Town of Paradise Valley informed him of the work on this particular project and noted that it has been going on for quite some time. He stated that the purpose of the project is public safety. He noted that he and Supervisor Kunasek visited the area and have been told that the area is the least intrusive. Mr. Miller noted the equipment aesthetics and stated the City of Phoenix’s intent of being a part of the project. Chairman Barney summarized what the IGA will entail. He stated that it is a great opportunity to consolidate resources as a cost savings to the taxpayers. If a grading permit or construction permit for the facility has not been issued within five (5) years from the date of approval of this Major Amendment, this SUP and the related Comprehensive Plan Amendments (CPA2010012, CPA2010013, CPA2011004, CPA2013005) shall be scheduled for public hearing by the Maricopa County Board of Supervisors, upon recommendation by the Maricopa Planning and Zoning Commission, to consider reverting the zoning to back Rural-190 and the related land use designations to Business Park, Dedicated Open Space and Rural as applicable. w. Prior to issuance of any construction permits or ground disturbance activities, the developer shall provide financial assurance in an amount and form acceptable to the Maricopa County Planning & Development Department sufficient to secure the site, restore any natural areas to their pre-construction state, and to stabilize the entire site in the event the project is abandoned, expires or otherwise becomes defunct. (C-44-14-101-M-00) Debra Stark reviewed the item stating that it is a request to Amend a Special Use Permit (SUP) for a photo-voltaic solar generating facility in the Rural-190 zoning district located in District 4. The property is approximately 2,155 acres and is located north and south of Elliott Road, from 355th Avenue to approx. 371st Avenue (align.) in the Arlington Valley area. It would increase the size of the special use permit. She said there were some property owners opposed to the request; however, the property is located in an area that is industrial and there are currently utility uses in the area including the Palo Verde Nuclear Plant. The area is designated for industrial land uses on the US Hwy Area 80 plan. The Planning and Zoning Commission recommended approval by a vote of 9-0 subject to conditions ‘a’ - ‘w’. Steven Anderson representing First Solar noted the recommendation for approval by the Commission and that it is for an existing approval for additional acres and will double the size of the location of what was previously approved by the Board of Supervisors. Supervisor Hickman commented on the area becoming a great location for energy production and indicated that there has been no opposition. (C-79- 14-159-L-00) Supervisor Rogers requested that items 27 and 28 be considered separately. She questioned the kennel permit application process if it was a business. Debra Stark Formal Meeting Minutes Wednesday, July 30, 2014 Page 23 of 71 responded that the applications are normally processed through the city from which the applicant is applying and that the County only processes the applications for unincorporated areas. When the County processes the applications it is a Special Use Permit (SUP). Supervisor Rogers asked if there is a check list to be sure that all required items are completed by each applicant. Dr. Silva responded that the County does not check on the permits in the other jurisdictions. He stated that the County only has authority to approve multi-dog licenses. Chairman Barney stated that by statute the County authority is very narrow. The applicant and/or the municipality needs to verify the zoning. He asked if the County has statutory authority to ask for verification. Dr. Silva responded that the County can ask but it is up to the applicant to respond, and the County has no authority beyond approving a multi-dog license. Supervisor Rogers asked what the business license process is after the County approves the multi-dog license. Dr. Silva responded that the County does not have authority to check on what type of business license the applicant obtains. The County is really not permitting any type of business it simply approves a multi-dog license. Chairman Barney stated that the applicant would still need to obtain the business license from the appropriate jurisdiction in order to operate the business as well as the required zoning. Supervisor Rogers asked if this applied to unincorporated areas as well. Chairman Barney responded that the County would only have oversight of zoning compliance. He stated the County is offering a very narrow statutory multi-dog license. ONE-TIME TEMPORARY ADDITION TO FLEET OF PAINT STRIPER Approve a one-time, temporary addition to the fleet for the Transportation Department of redlined vehicle #45503, Paint Striper, for use as a backup vehicle to maintain production when the primary stripers are down for maintenance. Operations and maintenance are anticipated to be $5,000 and will be covered using MCDOT budgeted funds. This vehicle will be removed from service at the end of its useful life with no funding from the general fund for its replacement. Paint striping trucks have very specialized equipment mounted on a standard 2.5 ton truck. By their nature these pieces of equipment require frequent service, and are out of production approximately 25% of the time. These specialized trucks are not available for rental, resulting in reduced ability to meet production goals and critical maintenance requirements. The extra paint striping truck requested herein is an existing truck that we are requesting be kept in service to support our pavement marking operations. The current paint striper is within its replacement period and is not reliable enough for everyday use, but would work well as an interim backup piece of equipment. Maintenance cost for the paint striper will be absorbed within the department’s operating budget.
