6. EXEMPTIONS FROM MARKINGS FOR UNDERCOVER VEHICLES GOING INTO
SERVICE
Approve per A.R.S. 38-538.03 exemptions from markings and undercover license plate
designations for 58 county Fleet replacement vehicles assigned to the Sheriff’s Office for
undercover operations.
The safety of the deputy and the success of investigative operations requires these
vehicles be exempt from markings.
Board approval is required because by law, authorization for exemption from markings is
vehicle specific, good for one year, and does not automatically transfer to replacement
vehicles. (C-50-15-006-M-00)

7. AGREEMENT FOR LAW ENFORCEMENT SERVICES WITH THE TOWN OF QUEEN

This contract supersedes the Agreement associated with agenda C-50-11-106-M-00 and
Amendment 1 in agenda C-50-11-106-M-01.
The value of this contract is $4,261,342 for the first year of service (Initial Term).
Additionally, the Town will also reimburse Maricopa County Sheriff's Office for the actual
cost of one-time items estimated to total $521,505 in FY 2015.
Also approve establishment of eleven (11) FTE positions to meet the increase in the level
of service from four beats of service to five beats plus Town-requested additional service

Fund (100) One-Time (0001) revenue appropriation of $521,505 and expenditures
appropriation of $521,505 for one time items that will be purchased and reimbursed by the
Town in FY 2015. Intergovernmental revenues are not local revenues for purposes of the
constitutional expenditure limitation, and therefore expenditure of the funds is not
prohibited by the budget law. This budget adjustment does not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to
A.R.S. 42-17105.
The FY 2015 increase is incremental beginning September 1, 2014 with two additional
positions and then adding nine positions January 1, 2015. If, because of the length of time
it takes to fill positions, the Sheriff's Office is unable to staff the contract to the levels of
service for which the Town is being charged, the Town's costs will be pro-rated until
positions are actually filled with a credit for the difference to be applied to the June 2015

18. APPLY AND ACCEPT GRANT FUNDS FROM HEALTH SERVICE AND RESOURCES
ADMINISTRATION FOR LIFE SAVING MEDICAL AND SUPPORT SERVICES
Approve the application and acceptance of grant funds from Health Services & Resources
Administration, (H89HA11478), in the not-to-exceed amount of $9,081,224 for the purpose
of providing lifesaving medical and support services to people living with HIV/AIDS. The
grant award begins on March 1, 2015 and ends on February 29, 2016. Authorize the
Chairman to sign all documents related to these grant funds, as applicable. The grant
allows a 10.0% rate for indirect costs, or $122,517 which may be incurred by the
Department of Employee Benefits and Health or Maricopa County for the administration of
this grant. The Maricopa County Department of Finance has calculated the Department of
Employee Benefits and Health's composite indirect cost rate at 16.7%, or $204,603. The
recoverable indirect cost of administering this grant is $122,517; the non-recoverable
indirect cost is $82,086.
Ryan White Part A program receives funds from HRSA, under Part A of the Ryan White
Treatment Modernization Act of 2006, to provide services to people infected with, or
affected by HIV/AIDS. The grant provides contracts with HIV and AIDS service
organizations which deliver/enhance health related and support services for HIV
positive/affected persons. These services include, but are not limited to, case
management, counseling, outpatient health services, food and nutrition services, legal
services, transportation and emergency financial assistance. Pursuant to federal statue,
85% of the grant funds must be passed through to contractors ($7,719,040). HRSA's
allowable administration includes: 10% of grant award for Administration and Planning
Council Support $908,122); and 5% of grant award for Clinical Quality Management
($454,062). HRSA allows for indirect costs which are included in the 10% Administration.
The indirect reimbursement rate is limited to 10% by the U.S. Health Resources and
Services Administration. The Ryan White Part A program serves up to 3,500 People Living
with HIV/AIDS in Maricopa and Pinal Counties, and is the "Payer of Last Resort" for their
primary medical care. The Ryan White Act requires that the funding is provided to the
county in each state that has the largest number of people diagnosed with HIV/AIDS living
in an eligible metropolitan area. By providing continuity of care, People Living with
HIV/AIDS maintain a measurable lower viral load and are thus less likely to transmit the
virus to other individuals. (C-39-15-002-G-00)

23. EXCEPTION TO THE POLICY FOR ADMINISTERING GRANTS
Authorize the following actions relating to Human Services Grant Funds 222 and
Community Development Block Grant Housing Trust Fund 217 for FY 2015 funding:
1) Approve an exception to the Policy for Administering Grants (2505) Section D.1 for the
Maricopa County Human Services Department that would allow applications to be
submitted for grant funding which may or may not allow indirect cost recovery and which
may or may not have match requirements. Approval of this item authorizes application only
and does not commit either the Human Services Department or Maricopa County to accept
funding.
2) Authorize the Department and or Chairman if needed, to sign all applications,
resolutions, certifications, assurances etc. that are included in the grant application
process.
At times grant funds become available without notice on a first come first served basis, the
time for applying for grants passes too quickly therefore this action will allow the
department to submit grant applications. However, the Human Services Department will
submit to the Board of Supervisors for approval to accept any specific awards and
corresponding agreements. Requests to accept awards or enter into agreements that are
subsequent to this agenda will be presented as unique agenda items with separate
tracking numbers.
The Human Services Department indirect cost rate for FY 2015 is 18.4% of allowable

36. POST DECREE OPEN NEGOTIATIONS FEE
Pursuant to A.R.S. § 11-251.08, set a public hearing for September 24, 2014 to solicit
comments and consider the adoption of POST DECREE OPEN NEGOTIATIONS FEE.
Upon Board approval, this item will become effective September 24, 2014.
Pursuant to Rule 66(B) (5) of the Arizona Rules of Family Law Procedure, open negotiation
is a process of non-confidential negotiations between the parties conducted by a neutral
third party (a Conciliator) in an attempt to resolve their dispute. The intent of this rule is to
encourage the resolution of family- related cases through an additional non-adversarial
dispute resolution process created pursuant to the authority of Rule 68(E) of the Arizona
Rules of Family Law Procedure.
The fee will be assessed when a request for an open negotiation is sought following
dissolution of marriage and a report regarding legal decision making (formerly known as
custody) or parenting time is issued for judicial review. Parties will be permitted to request
a waiver or deferral of this fee utilizing the process that is established and no party will be
precluded from pursuing relief solely due to inability to pay these costs. Upon Board
approval, the post decree open negotiation costs will be assessed to each party that
requests or is ordered to a post decree open negotiation.
Requests for post decree open negotiations are directed to the Court’s Conciliation
Services unit with the Family Court Department. When a post decree open negotiation is
requested, a Conciliator is scheduled with the parties. Administrative support staff time is
expended as is time during the open negotiation and in drafting a report for the court. The
final product that is forwarded to the judicial officer for review is a completed parenting plan
or the parties position statements depending on the outcome of the conference. None of
these costs are currently billed to the parties and current statutes never contemplated this
service provided to the parties. Regardless how well-satisfied the parties might be with
initial results of their original judgment, many couples become discouraged with the court
orders as they apply these directives to daily parenting time, child(ren) exchanges, support,
and legal decision making issues. This leads to one or both parents coming back to the
Court to seek relief.
Authorizing the Post Decree Open Negotiations Fee of $100 per party will provide the
Court needed resources for staff time that is expended in preparing reports for the Court.
Revenue generated from this fee will be deposited into the Superior Court Special
Revenue Fund 259 and used to offset the costs associated Post Decree Open
Negotiations. Revenue projections for FY14 will be approximately $45,000; a full year of
revenue is projected at $68,000. (C-80-15-001-2-00)
