Action Requested:
Delegate to the Director of Transportation the authority to enter into agreements or contracts with utility
providers to relocate conflicting utility facilities from, or provide services to, previously-approved
construction projects in the Maricopa County Transportation Capital improvement Program. This
delegation of authority Is limited to $1,000,000 for each utility provider in a previously approved
construction project.
Complete description of action requested:
During the normal design process, the Department frequently finds that a utility provider's facilities will
need to be relocated because those facilities conflict with the newly-designed roadway's improvements.
If the utility provider's right-of-way pre-dates the County's right-of-way, the County is required to
reimburse the utility provider for the relocation of the provider's conflicting facilities. In addition, when
the County constructs new signals or updates existing signals, new or revised agreements need to be
negotiated with the utility provider. These agreements are standard format and outline each party's
financial responsibilities associated with the initiation and maintenance of the service as well as the
service levels and/or the rate tariffs to be assessed. The proposed delegation of authority would be
limited to situations where the utility provider is the only provider available in the geographical area and,
therefore, no competitive procurement is possible.
These projects are located In all Supervisor Districts,
