appointment will be for the period commencing July 1, 2014 through June 30, 2015.
In order to obtain greater flexibility in the use of Court Commissioners, the Superior Court
customarily has all Court Commissioners appointed as Superior Court Judges Pro
Tempore so they may, on occasion, hear contested matters. This serves the interest of
judicial economy and promotes sound caseflow management. Court Commissioner Jane
E. McLaughlin would serve as a Superior Court Judge Pro Tempore without any additional
compensation other than that to which she is entitled as a Court Commissioner.

34. COMPETITION IMPRACTICABLE TO MSS TECHNOLOGIES FOR CONSULTANT
SERVICES RELATED TO JUSTWARE CONVERSION AND IMPLEMENTATION
Approve Competition Impracticable for IT Consulting Services – MSS Technologies. Public
Defense Services (PDS) would like to continue utilizing consulting services with MSS
Technologies to assist with ongoing data conversion and implementation of the Justware
case management system. The MSS consultant currently assigned to PDS has handled all
API support during conversion of data from the previous case management system (IRIS).
The vendor for Justware (New Dawn) does not support API. The Application Programming
Interface (API) is used for all data exchanges coming from ICJIS to Justware. The MSS
Consultant has also built web applications and provided coverage for the vacant Database
Analyst position. The anticipated cost for the consultant hours is $140,000.00 for FY15.
Several lines of business in PDS have yet to be converted into the Justware system.
Because the current MSS consultant has been assigned to PDS since September 5, 2012,
he has developed extensive knowledge of Justware and PDS business needs. Without
continued assistance from the consultant, PDS would be severely hindered in efforts
already underway toward full implementation. His skills and working knowledge are critical
to our project at this juncture, and loss of this resource would definitely delay the
completion of the remaining efforts. (C-56-14-013-M-00)

35. APPROPRIATED BUDGET ADJUSTMENT
Approve increases in the appropriated budget for the County Manager's Office (200) Non-

This appropriation adjustment brings the County Manager's Office grant budget to the
amount of $1,405,308. The appropriation adjustment is necessary because the award

Appropriation. Grant revenues are not local revenues for the purpose of the constitutional
expenditure limitation, therefore, expenditures of these revenues are not prohibited by the
budget law. The approval of this budget adjustment does not alter the budget containing

A sole source contract was awarded to TCAA for SFY 2014. Prior to the 2014 contract
award, the City of Tempe City Council submitted a resolution to Maricopa County
requesting that the City of Tempe become a separate geographic service area, with a
Community Action designation apart from Maricopa County. The Maricopa County Board of
Supervisors issued a resolution supporting the City.
On April 18, 2014, the Arizona Department of Economic Security notified the Maricopa
County Human Services Department that a separate designation will not be made by the
State. Consequently, the geographic service area remains within the purview of the
Maricopa County Human Services Department, Community Action Program. Additionally,
the Arizona Department of Economic Security expects service delivery to continue
uninterrupted for the City of Tempe service area. For this reason, the Department believes
issuing a Sole Source Contract to the Tempe Community Action Agency is the best means
to assure continuity of the services. (C-22-14-076-3-00)

JPMorgan Chase Bank N.A.
Motion to approve by Supervisor Hickman, seconded by Supervisor Kunasek
Supervisor Kunasek asked for a follow up from the Treasurer regarding the bank
servicing agreement. He stated there are a few items he would like better
understanding on, although he is comfortable enough to pass the agreement.
Chairman Barney stated there is a similar item on for approval on the Board of Deposit
agenda. He thanked Fran McCarroll for the work she has done on the item. He said
that the agreement is pretty complex on how the money is received and held. He stated
that it is really a legacy agreement that is being amended.
Supervisor Kunasek stated that it seems that some of the parts are greater than the
whole when it came to the line of credit. Supervisor Kunasek stated that he doesn’t
believe that the County will ever get to the point when departments are maxed out on
their line of credit. He would still like a better understanding.
Chairman Barney stated this is a great point and believes there is portioning in the credit
based on the way that the security is set up. He restated it is a complex element.
Supervisor Kunasek stated that during a previous Treasurer’s tenure, there were cases
where school districts and other government entities would go over their line of credit
and the Treasurer would allow it. He would like a follow up with the Treasurer.
Chairman Barney restated that a follow up would be a good thing and that the Clerk of
the Board, Fran McCarroll, has spent time on this item as well.

108. IGA WITH THE CITY OF MESA FOR THE ADOPT-A-HIGHWAY PROGRAM
Approve the Intergovernmental Agreement between Maricopa County and the City of Mesa
for the Adopt-a-Highway program.
The purpose of this Intergovernmental Agreement is to establish procedures to authorize
the County Transportation Director (or his designee) and the City’s designee to enter into
Letters of Agreement (LOAs) for specific roadway segments where right-of-way is owned
by both Parties in order for the volunteers to perform roadside clean-up activities.
The Parties desire to develop and implement a cooperative process that will allow the
Parties to provide joint coordination efforts (exchange of services) through the County
Adopt-a-Highway Volunteer Program (“AAH Program”) where shared roadway right-of-way
exists due to annexations by the City. The AAH Program is designed for individuals or
organizations who desire to provide volunteer clean-up activities within their community.
The Agreement is a method of facilitating these activities by entering into Letters of
Agreement (the “LOA” or “LOAs”). The Parties desire to authorize the County
Transportation Director (or his designee) and the City’s designee to enter into separate
LOAs for specific roadway segments where right-of-way is owned by both Parties. It is
anticipated that the exchange of services between the County and the City will be revenue
neutral. The benefit to the volunteers is that they may be able to work with one
governmental entity rather than two. This Agreement should, therefore, provide a more
efficient and cost effective program for the government entities and volunteers alike.

(ASCT) Deployment project. The County’s estimated total cost is $7,695 but may also

The County is the lead agency for this project. The project is part of an ongoing joint effort
by the County, the Arizona Department of Transportation and the Cities of Glendale,
Peoria, Phoenix, Scottsdale and Surprise to provide for the efficient management of traffic
on Bell Road and Frank Lloyd Wright Boulevard in Maricopa County. The Project consists
of the installation of adaptive traffic signal control technology at 52 signalized intersections
in four distinct areas along Bell Road and Frank Lloyd Wright Boulevard. This agreement
applies to the eight intersections along Bell Road between 35th Ave to 19 Ave.
The term of the agreement is effective as of Board of Supervisors approval, and shall
remain in full force and effect until all stipulations have been satisfied except that it may be
amended upon written agreement by all parties. Funding for this project includes federally
mandated local matches. The estimated total project cost is $2,455,000 with federal funds
of $2,315,065 and a local match of $139,935. The County’s estimated total cost share
responsibility is $14,250. The City’s estimated total cost share responsibility is $15,390. (C-

SR101L, ITS (the Olive Avenue ITS project). An additional $252,043 was subsequently
allocated for this project by the Maricopa Association of Governments (MAG), for a total
authorized federal-aid amount of $756,129. This project is substantially complete, with
some accounting activities to be completed. The current total cost of the project is
$1,021,830.44, with up to $756,129 provided through federal-aid highway funding and the
remainder from MCDOT Highway User Revenue Fund (HURF) monies.

determined that ADOT has inadvertently reimbursed MCDOT a total of $52,513.52 in
federal-aid highway funding for MCDOT expenses that were not eligible for federal

Trish Manes, President of No Kill Maricopa County, which advocates for animal shelter
reform stated that shelter killing is the leading cause of death for healthy dogs and cats
in the U.S. Due to the No Kill Movement it no longer has to be. She announced that
Nathan Winograd, Director of the No Kill Advocacy Center, will be visiting Phoenix,
Arizona during his 30 city tour to release his documentary and teach communities how
to achieve lifesaving success in their shelters. She handed tickets to the Clerk of the
Board for each of the Supervisors to attend and stated she would give one to Dr. Silva
Rodrigo, Animal Care and Control Director, as well.
Claudia Bloom, representing No Kill Maricopa County, stated that she volunteered for
several years at Maricopa County Animal Care and Control (MCACC) until she felt that
spending hours of her life at a kill shelter was a waste of her time. She said that the
shelter would keep killing no matter what she did, and said regressive shelters are to
blame for the death of over 13,000 or more animals every year at MCACC alone. She
urged the Board of Supervisors to attend The No Kill Revolution in America tour. She
gave the Clerk of the Board a handout to place on file.

Eloise Prevost, representing No Kill Maricopa County, stated that she is an animal
advocate and lover of animals. She said that the problems she sees in Arizona are
tremendous and she wants to make people aware. She claimed she helps find people
to save animals from the kill list. She stated that there are thousands of animals that
are being destroyed and noted it is a nationwide problem. She stated that she has the
time and would like to work with Maricopa County and Dr. Silva to find a positive
solution to the problem. She claimed that Maricopa County is 2nd or 3rd in the country
in the rate of euthanasia.

White Council where she worked with Mary Rose Wilcox for many years. The following
is what he spoke on regarding transportation within Maricopa County: Wickenburg
connector; amount spent on Monorail; expanding West Valley bus system; lack of bus
replacement; running transportation grid to 24 hours 7 days a week; include Gila Bend
and Tonopah on the transportation grid.
121. SUPERVISORS'/COUNTY MANAGER'S SUMMARY OF CURRENT EVENTS
Resumen de temas de actualidad de los Supervisores/Administrador del Condado
Supervisor Chucri commented on the presence of constituents of District 2. He
informed the Board Members that he and Supervisor Rogers will be attending a
Maricopa Association of Governments (MAG) meeting to accept 2014 Desert Peaks
Awards on behalf of Maricopa County. He applauded the hard work of the Air Quality
and MCDOT departments and employees in achieving the prestigious awards.
Supervisor Rogers commented on the recent tragedy at a dog boarding facility. She
expressed her sympathy to those 20 families that lost their beloved family member and
stated that if there was any wrong doing at the facility they must be held responsible.
She asked staff to provide her and Board Members with any measures that could be
implemented to boarding facilities so no other family has to endure a loss such as this
one. She stated that she will be calling for a bipartisan effort with Board Members for a
common sense solution to prevent another tragedy at animal boarding facilities.
Supervisor Kunasek commented on the addition of a dog to his family and the recent
attendance of his family at a microchip and free rabies vaccination event held at the
MCACC West Shelter.
Supervisor Hickman commented on his recent attendance at a meeting at the Luke Air
Force Base where he was informed that General Rothstein was returning to
Afghanistan. He expressed his gratitude to General Rothstein for his service. He
informed the West Valley public that the fighter aircrafts and “sound of freedom” would
diminish temporarily. He then wished Supervisor Kunasek well on his trip.

BD-1. 10016-ITN, BANK SERVICING AGREEMENT
Approve the renewal/extension of the following contracts: (These are recommended with the
concurrence of the using agencies and the vendors, upon satisfactory contract performance
and, when appropriate, after a market survey is performed.)
Renewal/Extension Date: July 01, 2014
Serial: 10016-ITN
Item: Bank Servicing Agreement ($1,000,000 estimate / 1 year until June 30, 2015) Approve
Amendment #3 to the Banking Services Contract, 10016-ITN with JP Morgan Chase Bank,
NA. a national banking association to provide all banking services for the Maricopa County
Treasurer and other agencies/departments as required under Arizona Revised Statues.
Specifically, the Amendment renews the contact for a period of one year until June 30, 2015;
modifies Exhibit A Pricing with respect to the Premium Managed Earnings Credit Rate and
establishes the monthly settlement of fees; and Amends Exhibit B, Scope of Work, with
respect to Short Term Financing Requirements related to the $35 million revolving line of
credit. (C-73-14-065-7-00)
JPMorgan Chase Bank N.A.
Chairman Barney stated this item is what Supervisor Kunasek was asking about. He
pointed out that Blair Bradshaw, Accounting Manager for the Treasurer’s Office, was
present if there were any questions.
Director Kunasek commented on the total of the various lines of credit.
Blair Bradshaw, Accounting Manager for the Treasurer’s Office, stated that it is close to
$600 million for the total of the individual credit lines. He stated that years ago the
County used to have individual lines of credit for each of the special districts and the
requirements from the bank were set. What has been found is that the requirements at
any given time are far less than what the total demands are. He stated that the
requirements of the bank for the reserves have been restructured and the overall credit
limit can meet the demands moving forward. Approval of this item will be setting the
limit approved by the Board of Supervisors so that the Treasurer can operate within
those limits without Board action. With the revision of the contract the Treasurer and
the bank can adjust those reserves as needed by saving the County money in the long
run and meeting the needs of the credit line users. It would still be under the preview
and watchful eye of the Board of Supervisors to make sure the Treasurer’s office would
continue to operate under their direction.
Director Kunasek asked if it is possible for the individual districts to go over their credit
limits and if they do who does the responsibility fall to.

Formal Meeting Minutes
Wednesday, June 25, 2014
Mr. Bradshaw responded that the statutes under the operations of school districts
outline that certain budget controlled funds can borrow on a credit line and still pay their
warrants up to the amount of their credit line. If the credit line is exhausted then the
Treasurer’s office would record the warrants being presented as unpaid until money
comes forth to pay the warrants. This is done to safeguard the other special districts.
The credit limit is set at 45 percent of unrestricted revenues so there is a large credit
capability but if they should exceed that then they would be in a difficult circumstance.
The question then remains on whether the bank should approve the increases to those
particular credit lines to cover for the demands and if the Treasurer’s office could
respond when those situations come up because in most circumstances the
adjustments must be made to meet the demands in a timely manner.
Chairman Barney stated that there is a difference between the $400 million cap and 1A
cap that’s approximately $580 million and believes it’s the way that the money flows.
Supervisor Kunasek said he thinks he understands the savings by not having the
districts track directly because the full amount will never be used.
Mr. Bradshaw recalled that to date there are 20 out of 60 districts borrowing on their
credit line. These 20 districts are actually exercising the use of the credit line during the
peak period of borrowing before money is received by the State while there are 40 other
districts that are not. So having the bank set aside the reserves for 60 districts
continually is a costly measure.
Chairman Barney stated that this is for the 58 school districts as well as some of the fire
districts.
Mr. Bradshaw stated that there is a separate credit line for the County.
Director Kunasek thanked Mr. Bradshaw for the through explanation.
Motion to approve by Director Kunasek, seconded by Director Chucri
