promote community involvement on pollution and prevention. The contest is for children
to learn about stormwater pollution and express their knowledge through art. Mr.

e. The wireless communication tower stealthed as a monopine shall be maintained to
retain the stealth properties intended by the design. Any damaged or missing fronds or
branches shall be replaced within 60 days of such damage occurring.
f. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.
g. This Special Use Permit shall expire twenty (20) years from the date of approval by the

h. The applicant/owner shall submit a written report outlining the status of the development
at the end of five (5) years from the date of approval by the Board of Supervisors. The
status report shall be reviewed by staff to determine whether the Special Use Permit
remains in compliance with the approved stipulations.
i. Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
j. The following Drainage Review conditions shall apply:
1. Drainage review of planning and/or zoning cases is for conceptual design only and does
not represent final design approval nor shall it entitle applicants to future designs that are
not in conformance with section 1205 of the Maricopa County Zoning Ordinance and the
Maricopa County Drainage Policies and Standards.
2. All development and engineering design shall be in conformance with Section 1205 of
the Maricopa County Zoning Ordinance and current engineering policies, standards, and
best practices at the time of application for construction.
k. Noncompliance with the conditions of approval will be treated as a violation in

n. All necessary building permits must be obtained for proposed changes.
o. The granting of this change in use of the property has been at the request of the

and allows the property to enjoy uses in excess of those permitted by the zoning existing
on the date of application, subject to conditions and stipulations. In the event of the failure

to comply with any condition or stipulation, and at the time of expiration of the Special Use
Permit, the property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to comply with any
conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation or expiration of the Special Use Permit. The Special
Use Permit enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of the
property as if the Special Use Permit had never been granted. (C-44-14-072-M-00)
Darren Gerard, Deputy Director, Planning & Development, provided background
information for this special Use Permit to construct a monopole cell tower subject to
conditions “a” through “o”. The department received 3 emails of support, 6 emails of
opposition, and 2 petitions with a total of 474 signatures of opposition. This has
triggered a super majority vote (4 affirmative votes required) with 43 percent by area
and 32 percent by number of property owners within a 300 foot radius registering
opposition.
Gary Hayes, AT&T Wireless Communications, explained he was accompanied by: Scott
September, Area Manager for AT&T for Arizona/New Mexico and Declan Murphy, Site
Acquisition Manager, who has been dealing with the residents for the last 1½ years. Mr.
Hayes gave a review of the actions taken to inform surrounding residents of the project
details and hearing dates.
 Supervisor Wilcox left the meeting 
Mr. Hayes further explained the efforts of the Iron Oaks Homeowners’ Association
(HOA) to inform residents about this project. The HOA sent out notices and held a
neighborhood meeting.
 Supervisor Wilcox returned to the meeting 
Mr. Hayes commented on how and why this site was chosen. He stated that one of the
concerns from residents was the possible property value depreciation. A real estate
study was done using a similar site found in Gilbert where a monopalm cellular tower is
currently located. He explained that the report reflected no reduction in property value
near that location, however, the Realtors Association claimed that there is a diminution
of value when there is no cellular coverage. Mr. Hayes stated that another concern
from residents was noise and explained that the equipment would be located within a
building with an 8’ block fence that would surround the cooling units as well as the
perimeter.
Mr. Hayes concluded by stating the following goals of AT&T Wireless Communications:
1) minimize the visual aspect by least intrusive location
2) rectify a significant gap in coverage
3) minimize neighborhood impacts and address concerns
Sun Yung Kim, resident of Sun Lakes, stated she is opposed to this item. She said she
mailed a petition with 426 signatures opposing the tower to the Planning & Zoning
Department in hopes they would present it to the Commission. She stated that the
meeting took place on March 27, 2014 without any consideration of the petition. She
said that most of the homeowners are older and are unable to attend the meetings. She
referred to a map showing the location of the proposed cellular tower and said that 60

homeowners surrounding the tower were opposed to it. Ms. Kim asked the Board of
Supervisors to deny the cellular tower request because it will be located directly behind
her home.
Jill Townsend, resident, stated that she also is opposed to this item. She also claimed
that due to a one year delay in holding a hearing the petitions submitted at the March
27, 2014 hearing were said to be invalid due to the age of the petitions. She said a new
petition was circulated and 84 percent of the immediate stakeholders were still opposed.
She stated what her concerns are regarding the location, design of the proposed tower
and the existence of current towers in the Sun Lakes area. Ms. Townsend commented
on the mishandling of AT&T’s request by Sun Lakes Homeowners Association. She
pointed out concerns regarding setbacks, and resident safety and health. Ms.
Townsend concluded by requesting that the Board of Supervisors deny the proposal.
Chairman Barney asked Ms. Townsend if she lives in the immediate vicinity.
Ms. Townsend replied that she is not within the 63 homes that are in the 300 foot area
but she lives in the community within the Iron Oaks area.
Natasha Bell employee of the Sun Lakes Homeowners Association (HOA), stated she is
in favor of the cellular tower. She said that as an HOA they need to consider the full
7,500 homeowners not just the 66 in the particular vicinity. Ms. Bell claimed there have
been previous meetings held and multiple homeowners were able to come in for
discussion. She said all of those homeowners gave favorable feedback on the
proposed cell tower.
 Supervisor Wilcox left the meeting 
Ms. Bell agreed with Ms. Townsend that it is indeed an elderly community. She said for
safety concerns the HOA Board approved the cellular tower. Ms. Bell pointed out that
the original petition of 426 residents was not 426 homes and clarified that it was multiple
residents in one address that signed the petition which does not make up 10 percent of
the 4,000 homes.
 Supervisor Hickman left the meeting 
Ms. Bell asked the Board of Supervisors to consider the 8,000 residents involved. She
stated that the HOA has had positive feedback from residents and believes it would be a
great service to their resident members.
 Supervisor Hickman returned to meeting 
Chairman Barney explained that Supervisor Wilcox left the meeting because she was
offering the Invocation at the Legislature.
Chairman Barney stated that he is in favor of the request and the Board of Supervisors
has a responsibility to balance all of the issues. He stated that more time needs to be
spent together between the residents the HOA and AT&T. He then asked Gary Hayes
to be the responsible party in meeting with the residents in the immediate area and the
HOA to make sure all are communicating effectively. Chairman Barney explained that a
super majority vote was necessary to approve this item. This requires four votes. He
stated that the Board of Supervisors would revisit this item at a later date.
Fran McCarroll stated that there is a meeting on May 7, 2014 and there is also one on
May 21, 2014.
Chairman Barney asked the parties involved to come together and work through the

issues.
Gary Hayes stated that he appreciates Chairman Barney’s comments. He hopes that
the Board of Supervisors and County staff knows AT&T Wireless Communications and
staff are happy to meet with the residents again and work with the HOA.
Chairman Barney stated that he wants Mr. Hayes himself to meet with the residents
because he knows the area and lives in the community. He is asking Mr. Hayes to give
the residents the time and opportunity to understand the request. Chairman Barney
said he is confident that with some time the opposition can be mitigated.
Gary Hayes stated that he would meet with the HOA and the neighbors.
Chairman Barney stated that even though the Board of Supervisors is not in a position
to approve the request procedurally today he would have still asked that the groups
come together and talk through the issues so that everyone would understand exactly
what was going on. The most critical element in this process is that everyone is
communicating and understanding the same thing.

35. IGA WITH ARIZONA STATE UNIVERSITY
Approve an Intergovernmental Agreement (IGA) between Arizona State University and
Maricopa County. This Intergovernmental Agreement is effective from April 23, 2014 until
April 23, 2019.
This agreement will provide the framework for educational internship opportunities between

provide student enrichment and educate future leaders about Maricopa County
government. Interns may be provided a stipend at the discretion of Maricopa County,
however interns are not entitled to wages, benefits or other forms of compensation from
Maricopa County. This agreement does not supersede or replace any existing internship
agreements at Maricopa County. In cases where interns receive a stipend, departments
will absorb any related costs within existing budget appropriations.
Added 4/21/2014: This general agreement between Maricopa County and Arizona
State University may be used for unpaid interns (volunteer), interns offered a stipend
not entitled to wages, and interns hired and treated as temporary employees. The

36. TRANSFER EXPENDITURE AUTHORITY FOR THE MELENDRES COURT
MONITORING JUDGMENT FROM THE SHERIFF'S OFFICE
In accordance with A.R.S. 42-17106(B), authorize a transfer of FY 2014 expenditure
authority in the amount of $1,126,250 by decreasing the Sheriff’s Office (500) General
Fund (100) Non-Recurring appropriation in the “MCSO Judgment Order” (MEL0) and

increasing the non-Departmental (470) General Fund (100) Non-Recurring project (MEL0).
This action will have a County-wide impact of zero and they do not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to
A.R.S. 42-17105.
Authorize an expenditure reallocation of $1,725,000 from the FY 2015 Sheriff’s Office (500)
General Fund (100) Operating appropriation in the “MCSO Judgment Order” (MEL1) to the
Non-Departmental (470) General Fund (100) Operating project (MEL1). Approval of these
items will allow for accurate tracking of the costs incurred by the Court Ordered Monitor
associated with the MSCO Judgment order.
In FY 2014, the costs associated with the Court Monitor are anticipated to be $1,126,250
and in FY 2015 the costs are anticipated to be $1,725,000. Moving the funds from the
Sheriff’s Office to Non-Departmental allows separating the actual Court Monitor costs from
the other actions deemed necessary by the Courts for compliance with the Court Order and
allows the Monitor to be autonomous from the Sheriff’s Office as directed in the Court
Order. (C-49-14-045-2-00)
Supervisor Chucri referenced a meeting with Tom Manos and Sandi Wilson. He stated
that the Board of Supervisors is complying with the Melendres ruling, however, he thinks
the County has to be mindful of the fact that this is taxpayer money. When the County
pays invoices the County needs backup information.
Chairman Barney agreed with Supervisor Chucri’s comments. He said that the
expenses for the Monitor should not be paid from the Sheriff’s Department. This item is
transferring those funds from the Sheriff’s Department to a fund in the Office of
Management and Budget.

Sciences, Ltd., to provide Relocation Services for Maricopa County Department of
Transportation’s MAG ALCP Projects subproject T347 Northern Parkway Dysart Road to
111th Avenue.
The City of Glendale initially assumed lead agency responsibilities for acquisition of
Northern Parkway right-of-way and relocation of affected property owners. The City
contracted with Acquisition Sciences to perform this work. In 2010, Maricopa County
assumed the lead role, and due to limited staff resources and project schedule, has utilized
the City’s Acquisition Sciences contract (11141-IGA) for Relocation Services. The City’s
contract has expired, but acquisition and relocation services for the project are expected to
continue until an estimated completion date of December 31, 2016.
Approximately half of the relocation work on the project is ongoing, and federal processes
mandate an 18-month follow-up on completed work. Seeking a new vendor is impractical,
as ensuring a continuity of service is critical to avoiding delays to the Northern Parkway
project and to avoiding jeopardizing federal funding for the project.
This $135,000 contract will continue the previous $85,000 contract through December,
2016. Sum of both contracts will then be $220,000. This Agenda Item impacts

Ed Bufford, resident, addressed animal shelter adoption hours. He stated that the East
Shelter is open until 6:00 p.m. Monday through Friday, yet the West Shelter is only open
until 5:30 p.m. and is closed on Wednesday. He asked the Board of Supervisors to
change the hours because many people work until 5:00 p.m. Mr. Bufford requested the
Board of Supervisors consider the one-half hour extra to allow residents in the West
Valley the opportunity to come look at the animals for adoptions.
Chairman Barney stated that Tom Manos and Dr. Silva would contact him to see if that
is something that can be considered.
Dennis Ball, resident, stated that he attended the last meeting and commented on an
audit report on his mother's estate that was published in the Arizona Republic in 2010.

He stated that he made a demand letter that day and filed a copy of the audit report. He
expressed his opinion that there are serious issues regarding those involved in the
probate court.
Tom Manos stated that if a claim has been filed, it has become a legal matter. The
County Attorney’s office or Risk Management would be the best offices to communicate
with Mr. Ball.
Christine Porter, resident, voiced concerns about the probate court system. She said
that a number of issues were never brought forward because the white collar crime
division has been shut down. She referenced a recent settlement in the Marie Long
case. Ms. Porter also stated that she was a member of two groups related to
accountability in the judicial system. Finally, Ms. Porter stated she will be filling a claim
for compensation for the $300,000.00 that was “fleeced from her late husband’s trust”
by Brenda Church and was orchestrated by Commissioner Ellis.
Supervisor Chucri stated that he and Chairman Barney were sworn-in in January of
