be processed as a revised application with approval by the Board of Supervisors upon
recommendation of the Commission. Revised applications shall be in accordance with the

County in accordance with the goals and policies in its comprehensive and applicable area
plan. This report shall be scheduled for public hearing by the Maricopa County Board of
Supervisors (Board), upon recommendation by the Maricopa County Planning and Zoning

Board rescinds this DMP and reverts the current land use designations back to Rural (0-1
du/ac), and Community Retail Center, all entitlements associated with this project that were

approval of any roadway improvement plans. Additional lane capacity on offsite arterial
alignments will be reviewed with each resubmittal of the TIS. The project must comply with
all recommendations in the MCDOT-approved TIS.
2. The Developer shall make a contribution to regional transportation infrastructure. The
contribution shall be $3,281.00 per residential dwelling unit. The Developer may construct
off-site and certain on-site regional improvements as further defined in the Development

transportation network needs and future traffic interchange locations along I-10 from
SR303 west to approximately 459th Avenue. The Developer shall reserve sufficient right-
of-way for transportation facilities in compliance with the MAG Hassayampa Study,
including any additional right-of-way necessary for future widening of I-10.
5. The Developer shall be responsible for design and construction of the ultimate full-width
of all interior roadways, and the ultimate half-width of all perimeter roadways, unless
approved otherwise by MCDOT. A portion of these improvements may be creditable to the
Developer’s contribution referred to in item #2. All roadways must meet county standards in
effect at the time they are improved. All roadways must include appropriate ITS
infrastructure. Half-width roadways must be designed so as to safely carry two-way traffic
until the ultimate roadway is constructed. Roadway improvement plans must be approved
and permitted by MCDOT. The Developer shall relocate well site(s) and/or provide
additional right-of-way in the event of conflict with any transportation.
6. The Developer is responsible for assuring paved access to their site at the time of the
first final plat. Improvements necessary to provide paved access may or may not be
creditable to the Developer’s contribution referred to in item #2.
7. The Developer shall provide all-weather access to all parcels and lots, and on all arterial
roadways.
8. The Developer shall provide and make available a minimum of two access points to
each development phase and/or subdivision unit.

necessary, the route to school shall only cross arterials at signalized intersections.
10. The Developer shall design the development to promote pedestrian, bicycle and other
alternative modes of transportation to public facilities within and adjacent to the site, by
means in addition to the roadway system. Crossings of arterials at other than signalized
intersections may be required to be grade separated. (Please note: “Shared Use”
pedestrian/bicycle facilities should be 10 feet wide.)

contact the Office of the Superintendent of Streets (602-506-8797) to initiate the SLID
process.
12. The Developer shall design landscaping to comply with all county requirements and to
conform to the MCDOT Roadway Design Manual. The Developer (or as assigned to the
Home Owner’s Association (HOA)) shall be responsible for maintenance of landscaping
within public rights-of-way.

ADOT documentation shall be received before any zoning (rezoning) or preliminary plat
approval, or at the discretion of MCDOT.
16. The Developer shall address access to Parcel 1 (south of I-10).
17. The Developer should be aware that per their approved TIS, if some of the
improvements listed as “existing” (assumed constructed “by others”) for year 2011 (Phase
I) are not in place, and are necessary to mitigate Phase I site traffic, the Developer will be
required to construct the improvements. The costs of such off-site street improvements (as
demonstrated by the developer and approved by MCDOT) shall be deducted from the
amount of the developer’s contribution to regional transportation infrastructure as required
per stipulation 2 above.

FEDERAL REGULATIONS FEMA RULE 44 – PART 350. Adequate siren coverage shall
be provided prior to the occupation of any proposed buildings/residences.
2. The applicant shall ensure that public safety information regarding nuclear emergencies
is initially provided to any new residents or building occupants. The applicant shall obtain
this information from the Palo Verde Nuclear Generating Station – Emergency Planning
Department. All costs associated with the duplication and dissemination of the initial

Generating Station will provide this public safety information annually.
dd. The following Drainage Review conditions shall apply:
1. All development and engineering design shall be in conformance with the Drainage
Ordinance, Drainage Policies and Standards, and current engineering polices, standards
and best engineering practices at the time of application for construction.
2. Drainage review of planning and/or zoning cases is for conceptual design only and does
not represent final design approval nor shall it entitle applicants to future designs that are
not in conformance with the Drainage Ordinance and design policies and standards.
3. The hydrology data which was used for this development is dependent upon FEMA
approval of the Palo Verde Study. Hydrology analysis will need to be developed in
accordance with the County’s design methodology manuals for this development if FEMA
does not approve the Palo Verde Study.

oriented to the southwest and northeast. Noise will be more noticeable during overcast sky
conditions due to noise reflections off the clouds.
Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these hours
and during most weekends.”
Such notification shall be permanently posted in front of all home sales offices on not less

which identifies and assesses the native trees and cacti within the applicable platted
parcels, and which determines the preservation/disposition for each of the selected native
trees and cacti.
aa. The following Maricopa County Department of Transportation stipulations shall apply:
1. The Traffic Impact Study (TIS) shall be updated prior to the first final plat approval and
with each development phase to reflect current conditions and any changes to the
development plan. The TIS shall comply with MCDOT requirements and shall address
development phasing and the offsite improvements necessary to accommodate the
anticipated traffic demand with each phase. The TIS must be approved before subsequent
approval of any roadway improvement plans. Additional lane capacity on offsite arterial
alignments will be reviewed with each re-submittal of the TIS.
Agreement, in lieu of payment of this contribution. Such off-site street improvements must
be “system roadways,” must be all-weather facilities, must meet county standards in effect
at the time they are improved, and must be pre-approved by MCDOT. MCDOT will require
a Development Agreement to detail the specifics of construction, including phasing and
timing, or if the Developer does not construct regional roadway improvements, the
Development Agreement shall discuss the method and timing of payment.
3. The Development Agreement shall be executed prior to any zoning (rezoning) approval.
The Development Agreement shall be an enforceable contract, regardless of annexation.
4. The Developer shall provide the ultimate full or half-width of right-of way for all public

The above references interior and perimeter roads. (The project boundary is the centerline
of all perimeter roadways and/or roadway alignments.) Full-width right-of-way shall be
provided where the entire roadway is within the development (interior roadways). Half-
width right-of-way shall be provided where “half” of the roadway is within the development
(perimeter roadways).
Additional right-of-way shall be dedicated at any intersections where future dual left turn
lanes are possible. The widened right-of-way section shall accommodate the length of the
left turn lane, including reverse curves.
The Maricopa Association of Governments (MAG) in conjunction with the Arizona
Department of Transportation (ADOT) is conducting a “Hassayampa Valley Regional
Transportation Network Study.” This study is evaluating future regional arterial
transportation network needs and future traffic interchange locations along I-10 from
SR303 west to approximately 459th Avenue. The Developer shall reserve sufficient right-
of-way for transportation facilities in compliance with the MAG Hassayampa Study.
The Developer shall relocate well site(s) and/or provide
additional right-of-way in the event of conflict with any transportation facilities.
9. The Developer shall not locate elementary or middle schools on arterial roads. (The
schools may not “back up” to arterials.) Pedestrian routes to school shall be planned so if
necessary, the route to school shall only cross arterials at signalized intersections.
11. If streetlights are provided, installation shall be provided by the Developer. If streetlights
are within public rights-of-way, a Street Light Improvement District (SLID) or comparable
authority shall be established to provide operation and maintenance. The Developer should

contact the Office of the Superintendent of Streets (602-506-8797) to initiate the SLID
process.
12. The Developer shall design landscaping to comply with all county requirements and to
conform to the MCDOT Roadway Design Manual. The Developer (or as assigned to the
Home Owner’s Association (HOA)) shall be responsible for maintenance of landscaping
within public rights-of-way.
13. The Developer shall provide a construction traffic circulation plan. The construction
traffic circulation plan must be approved by MCDOT.
14. The Developer shall comply with all applicable local, state and federal requirements.
(Dust control, noise mitigation, AZPDES, 404 permitting, etc.)
15. The Developer shall provide written documentation of ADOT’s review and response.
ADOT documentation shall be received before any zoning (rezoning) or preliminary plat
approval, or at the discretion of MCDOT.
16. The Developer should be aware that per their approved TIS, if some of the
improvements listed as “existing” (assumed constructed “by others”) for year 2011 (Phase
I) are not in place, and are necessary to mitigate Phase I site traffic, the Developer will be
required to construct the improvements. The costs of such off-site street improvements (as
demonstrated by the developer and approved by MCDOT) shall be deducted from the
amount of the developer’s contribution to regional transportation infrastructure as required
per stipulation 2 above.
bb. The following Maricopa County Department of Emergency Management stipulations
shall apply:
1. Adequate coverage by the existing Outdoor Warning Siren System for the Palo Verde
Nuclear Generation Station is required. Otherwise, the applicant shall be responsible for
installation of adequate additional sirens providing for adequate coverage for the Silver
Springs Ranch Development Master Plan. The applicant shall obtain information on
existing siren coverage from the Maricopa County Department of Emergency Management.
If existing coverage is inadequate, the master developer shall provide funding to cover
expenses of installing new sirens. Palo Verde Nuclear Generating Station will coordinate
installation of the sirens. Siren coverage must meet the standards set forth in CODE OF
FEDERAL REGULATIONS FEMA RULE 44 – PART 350.
Department. All costs associated with the duplication and dissemination of the initial
distribution shall be assumed by the applicant. Thereafter, the Palo Verde Nuclear
Generating Station will provide this public safety information annually.
cc. The following Drainage Review conditions shall apply:
1. All development and engineering design shall be in conformance with the Drainage
Regulation and current engineering policies, standards and best practices at the time of
application for construction.
2. Drainage review of planning and/or zoning cases is for conceptual design only and does
not represent final design approval nor shall it entitle applicants to future designs that are
not in conformance with the Drainage Regulation and design policies and standards.

3. The hydrology data which was used for this development is dependent upon FEMA
approval of the Palo Verde Study. Hydrology analysis will need to be developed in
accordance with the County’s design methodology manuals for this development if FEMA
does not approve the Palo Verde Study.
dd. The following Maricopa County Sheriff’s Office stipulation shall apply:
Prior to any zoning change, the master developer shall enter into a development
agreement with the Maricopa County Sheriff’s Office to pay for startup costs and interim
fees for law enforcement services associated with the property until it is annexed into an
incorporated city or until a full law enforcement service contract is otherwise implemented.
This development agreement shall be signed by both the master developer and the
Maricopa County Sheriff’s Office, and provided to the Maricopa County Planning and
Development Department for public record.
ee. The following Luke AFB stipulation shall apply:
The master developer shall notify future residents that they are located within the vicinity of
a military training route with the following notification:
“You are buying a home or property within the vicinity of a military training route, and may
be subject to direct overflights and noise by Luke Air Force Base and other military jet
aircraft in the vicinity.
Luke Air Force Base executes over 200,000 flight operations per year, at an average of
approximately 170 over flights per day, although Luke’s primary flight paths are located
within 20 miles from the base, jet noise will be apparent throughout the area as aircraft
transient to and from the Barry M. Goldwater Gunnery Range, and other flight training
areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways
oriented to the southwest and northeast.
Such notification shall be permanently posted in front of all home sales offices on not less
than a 3 foot by 5 foot sign, be permanently posted on the front door of all home sales
offices on not less than an 8½ inch by 11 inch sign, be included in all covenants,
conditions, and restrictions (CC&Rs), and be included in the public report.
ff. The property owner and their successors waive claim for diminution in value if the
County takes action to rescind approval of this Development Master Plan due to
noncompliance with any of the approved stipulations. (C-44-14-087-M-00)

Case: CPA2014002
Supervisor District: 4
Applicant: Marbella Homes
Owner: El Paso Natural Gas Company
Request: Comprehensive Plan Amendment (CPA) to change the land use designation in
the White Tank / Grand Avenue Area Plan from Mixed Use Employment to Medium Density
Residential (5 - 15 d.u./ac.). CPA case approval is by Resolution.
Site Location: Approximately at the northwest corner of Glendale Ave. and El Mirage Rd.,
in the Glendale area
Site Size: Approx. 252 acres
Commission
Recommendation: By a vote of 7-0, recommended approval of CPA2014002 subject to
conditions ‘a’ – ‘g’ as shown below.
Provided the following conditions are met:
a. Development and use of the site shall comply with the narrative report entitled, “Marbella
Ranch Project Narrative”, including all exhibits dated revised April 3, 2014, and stamped
received April 4, 2014, except as modified by the following conditions.
b. If the Board takes action to amend or revert/rescind subsequent zoning, this land use
plan shall be considered for amendment.
c. The total number of residential units shall not exceed 1,260 dwelling units.
d. Prior to initial Final Plat approval or initial precise plan of development, the applicant
shall submit to the Maricopa County Planning and Development Department a “will serve”
letter and verification of approval of a Maricopa Association of Governments (MAG 208)
amendment from Liberty Utilities.
e. The following Maricopa County Sherriff’s Office conditions shall apply:
• Prior to any final plat, the master developer shall enter into a development agreement
with the Maricopa County Sherriff’s Office (MCSO) to provide law enforcement services to
Marbella Ranch and surrounding areas.
• This development agreement shall include, but not necessarily be limited to, the master
developer’s requirement to pay their proportionate share for start-up costs (vehicle
purchase and patrol equipment, e.g. radios, tasers, and vehicle laptops); and interim fees
for law enforcement services associated with the property unless it is annexed into an
incorporated municipality or until full law enforcement service contract is otherwise
implemented. The development agreement may also include, but not necessarily be limited
to the master developer’s requirement to donate to the County, for use by the MCSO, their
proportionate share of separate office space complete with tenant improvements or land
(the size to be determined in the development agreement), or payment of fees when a
permit is issued.
• This development agreement shall include the terms listed in this stipulation unless
otherwise mutually agreed to by MCSO and the master developer; furthermore, the

development agreement shall be signed by both the master developer and the MCSO and
provided to the Maricopa County Planning and Development Department for public record.
f. The following Luke Air Force Base condition shall apply:
Marbella Ranch shall notify future occupants/tenants that they are located near a military
airport with the following language:
“You are locating in a residential dwelling inside the State Statute defined “territory in the
vicinity of a military airport,” which means that aircraft flying in this area are authorized to fly
as low as 1,500 feet above the ground. You will be subject to direct overflights and noise
by Luke Air Force Base jet aircraft in the vicinity.
Luke Air Force Base executes an average of approximately 165 overflights per day.
Although Luke’s primary flight paths are located within 20 miles from the base, jet noise will
be apparent throughout the area as aircraft transient to and from the Barry M. Goldwater
Gunnery Range and other flight areas.
Luke Air Force Base may launch and recover aircraft in either direction off its runways
oriented to the southwest and northeast. Noise will be more noticeable during overcast sky
conditions due to noise reflections off the clouds.
Luke Air Force Base’s normal flying hours extend from 7:00 a.m. until approximately
midnight, Monday through Friday, but some limited flying will occur outside these hours
and during most weekends.
For further information, please check the Luke Air Force Base website at
www.luke.af.mil/urbandevelopment or contact the Maricopa County Planning and
Development Department.”
Such notification shall be permanently posted on not less than a 3 foot by 5 foot sign in
front of all leasing offices and be permanently posted on the front door of all leasing offices
on not less than 8½ inch by 11 inch sign.
g. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval allows the
property owner to enjoy uses in excess of those permitted by the land use existing on the
date of application, subject to conditions. In the event of the failure to comply with any
condition of approval, the property shall change to the land use designation that existed on
the date of application. It is, therefore, stipulated and agreed that revocation due to the
failure to comply with any conditions does not reduce any rights that existed on the date of
application to use, divide, sell or possess the property and that there would be no
diminution in value of the property from the value it held on the date of application due to
such revocation. The Comprehensive Plan Amendment enhances the value of the property
above its value as of the date the Comprehensive Plan Amendment is granted and
changing to the prior land use designation results in the same value of the property as if
the Comprehensive Plan Amendment had never been granted. (C-44-14-086-M-00)
Debra Stark, Director, Planning and Development, explained that this item and item PZ-
4 have been pulled from the consent agenda and are companion items but will need
separate motions. She provided background information and stated that discussion
among County departments indicated that a more comprehensive study should be
initiated concerning law enforcement conditions as detailed in condition “e.” Therefore
she recommended that condition “e” be removed from this case.

Supervisor Hickman stated he has been involved with this item and the issues involved
since he took office. He thanked Marbella Homes and Bill Lally for working with his
office and addressing his concerns about law enforcement in the area. Supervisor
Hickman said, “There should not be an obligation for Marbella Ranch to provide law
enforcement services to surrounding areas but only to Marbella Ranch and our current
stipulations can’t assure me of this.” He is hopeful that with the help of development
stakeholders the county-wide issue of law enforcement in unincorporated developments
can be resolved. He explained that as the County works through regulatory reform,
stakeholders are identifying problems giving the Board an opportunity to resolve issues
before residents become upset.
Chairman Barney commented that there are county-wide issues that are being carefully
looked at in an effort to resolve the problems. He said this project needed to proceed
but this challenge would be presenting itself in several facets of the development
process. The Chairman thanked Mr. Lally for his involvement in the ad hoc task force
speaking for the industry.
Supervisor Kunasek agreed the County needs to work on this issue going forward. He
referred to development in Anthem that has a similar problem and commented that it is
somewhat unfair to the taxpayer to pay for an enhanced level of service for one area.
Supervisor Kunasek stated he is confident that the County will eventually be able to
provide the level of law enforcement required in those areas where it is desired.
Supervisor Rogers stated that she agrees with the comments that have been made.
She said it is important for growth in the west valley and the partnerships that have been
made continue. Supervisor Rogers stated that she appreciates the efforts that have
been made by the Supervisors and the developers. She commented that a
comprehensive study is important in moving forward.
Motion to approve as amended subject to conditions “a” through “g” with the removal of
condition “e” and renumbering of the subsequent conditions, made by Supervisor
Hickman, seconded by Supervisor Kunasek

thirty (30) year Special Use Permit timeframe. The status report shall be reviewed by staff

Maricopa County Drainage Policies and Standards.
3. Detailed Grading and Drainage Plans showing the new site improvements must be
submitted for the acquisition of building permits.

k. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval is temporary
and allows the property to enjoy uses in excess of those permitted by the zoning existing
on the date of application, subject to conditions and stipulations. In the event of the failure
to comply with any condition or stipulation, and at the time of expiration of the Special Use
Permit, the property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to comply with any
conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation or expiration of the Special Use Permit. The Special
Use Permit enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of the
property as if the Special Use Permit had never been granted. (C-44-14-084-M-00)

Debra Stark provided background information and explained that the applicant was
expanding the facility. She said there was opposition from residents of Sun Lakes.
Chairman Barney invited the applicant to comment.
Mark Howard, U-Haul, explained this endeavor has been a two year process. The
company’s representatives met with the residents who had concerns or complaints
about the expansion. He said that one of the concerns was that U-Haul was going to
erect a pole sign on Riggs Rd. and this is not the case. He stated that the entrance on
Riggs Rd. will allow the development of a different traffic pattern so that there will not be
any traffic through the neighborhood.
Chairman Barney thanked Mr. Howard for U-Haul’s efforts and wanted to address other
concerns residents had brought to his office. He provided the following concerns:
 High level illuminated signage
 The existing sign flickering on and off through the night
 Perimeter fencing
Andy Smith, Marketing President, U-Haul, responded that a timer can be placed on the

existing sign that would allow the sign to be turned off at a certain time at night.
Chairman Barney asked if there were plans to install wall mounted signs on the building
facing 110th Ave. Mr. Howard responded there were no plans to install signage on 110th
Ave.
Chairman Barney asked if there were plans to install signage on the side of the building
facing Riggs Rd. Mr. Howard stated that there are plans to install a sign on the side of
the building facing Riggs Rd. but the sign would not be illuminated.
Chairman Barney stated that the plans indicate that the fencing on 110th Ave. will be
extended down to Riggs Rd. He asked if the new fencing would be painted the same
neutral color as the current fencing. Mr. Howard confirmed the new fence would be the
same color as the existing fence.
Chairman Barney asked what the color of the proposed vertical structure would be and
Mr. Howard responded it would be the same neutral color as the perimeter wall and
other structures. Mr. Howard added that there will landscaping along the Riggs Rd. side
of the property and that U-Haul would be responsible for maintaining the landscaping.
Chairman Barney gave a review of the added stipulations and Darren Gerard, Assistant
Director, Planning and Development, confirmed that the added stipulations would be as
follows:
r. No wall-mounted signage on north or west planes of buildings/structures.
s. No illumination of wall-mounted signs along Riggs Rd. frontage.
t. The existing free-standing sign along the Arizona Ave. frontage shall be equipped
with a device to automatically shut off illumination between 10:00 p.m. and 7:00 a.m.
u. The perimeter wall shall be painted (or integral block color) brown, tan or other
muted tone.
v. The southern facades of buildings shall be painted tan or a muted desert tone.

Recommendation: Approval
Commission
Recommendation: Approval (C-44-14-090-M-00)
Debra Stark stated this text amendment will create an annual facilities permit process.
This will allow large commercial and industrial uses such as hospitals to apply for an
annual permit that will eliminate them from having to apply for permits every time there
is an improvement or an upgrade. She said this action will allow these uses to make the
improvements or upgrades with a building inspector on sight. Ms. Stark informed the
Members that this was vetted through the ad hoc task force and went through the
Enhanced Regulatory Outreach Program (EROP) with a great amount of support.
Supervisor Hickman remarked this is streamlining the regulatory process that he has
supported since he took office.

7. ES-2013-006/CONFECTIONARY FOOD ESTABLISHMENT PROPOSED REVISIONS TO
CHAPTER VIII OF THE MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE
(MCEHC)
Pursuant to A.R.S. §A.R.S. § 11-251.13 and A.R.S. §36-184(B)(5), convene the scheduled
public hearing, to solicit comments and consider the adoption of proposed revisions to
MCEHC Chapter VIII (EROP Case ES-2013-006/Confectionary Food Establishment). This
item will become effective immediately upon Board of Supervisors approval.
The Maricopa County Board of Health (BOH) reviewed and discussed proposed revisions
to MCEHC Chapter VIII (EROP Case ES-2013-006/Confectionary Food Establishment) at
a public meeting held at 3:00 p.m. on Monday, October 28, 2013, at the Board of
Supervisors Conference Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona
85003.
The proposed revision to MCEHC Chapter VIII (EROP Case ES-2013-006/Confectionary
Food Establishment) creates a new permit and applicable plan review and annual permit
fees of $307.50 and $155.00, respectively. This proposed revision will allow citizens of
Maricopa County to prepare not potentially hazardous bakery and confectionary items for
direct consumer sales and for wholesaling to other Maricopa County permitted food service
establishments. The permit definition establishes these food items as an approved food
source for sale by other Maricopa County permitted food establishments. This proposal
lessens the burden of equipment/infrastructure requirements necessary to qualify for an
MCESD permit for an owner that may have begun as a home business and has outgrown
the home kitchen. (C-88-14-007-6-00)
Supervisor Rogers stated there are great partnerships that have enabled the County to
reach this point.

governmental license plates and exemptions from county markings for one (1) undercover
vehicle. This vehicle is replacing one (1) vehicle that is used for law enforcement
investigative purposes. Vehicle details and identification numbers will be kept on file in the
Clerk of the Board’s office and retained in accordance with Arizona State Library Archives
and Public Records (ASLAPR) approved retention schedule.
This vehicle was purchased in accordance with Maricopa County’s vehicle replacement
process. The replacement was acquired using General Government (Agency 470) General
fund (100) monies through the Equipment Services department. The County Attorney
agrees to reimburse General Government Equipment Services for the cost difference of
upgrading the class of vehicle from that of the one it replaced.
This replacement was deemed critical by equipment services due to excessive mileage
and/or the age of the vehicle which made it cost prohibitive to acquire replacement parts
with which to maintain the vehicle. As this action involves the a replacement of an existing
vehicle in the fleet, expenditures for the operation and maintenance of the vehicle will
continue to be absorbed by the County Attorney's general fund budget with zero net
impact.
As the vehicles being replaced is currently exempt from markings and governmental
license plates, the Maricopa County Attorney's Office requests that the replacement vehicle
also be exempt from County markings and issued a regular Arizona license plate as
provided in accordance with A.R.S. § 38-538.03 and A.R.S. § 28-2511(A). This will ensure
that it can be used in furtherance of their law enforcement mission. (C-19-14-049-V-00)

Non Recurring Non Project (0001) Contingency (4711) in the line "Unreserved

b) Increase the expenditure authority in the Non Departmental (470) General Fund (100) in
the Other Programs line for Outside Counsel Overage (4712) Non Recurring (0001) by an
amount not-to-exceed $600,000 from $0 to not more than $600,000;
These actions will have a County-wide net impact of zero and they do not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to
A.R.S. 42-17105.
Approval of this action will allow the County Attorney Civil Division to continue to provide
Maricopa County, the Board of Supervisors, and various elected and appointed agencies,
with legal representation through contract legal service providers.

Non Recurring Non Project (0001) Other Programs (4712) in the line "Elected Official and
Judicial Branch Unmet Personnel Savings from Chairman's Budget Balancing Adjustment "
by an amount not-to-exceed $643,880;
b) Increase the expenditure authority in the County Attorney’s (190) General Fund (100)
Non Recurring Non Project (0001) by an amount not-to-exceed $643,880.
These actions will have a County-wide net impact of zero and they do not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to
A.R.S. 42-17105.
Approval of this action will allow County Attorney to meet their FY 2014 budget as adjusted
for reduced vacancy savings and contract personnel services which were not realized. Due
to high workload demands nearly all vacant County Attorney positions are filled. In addition,
many state and federal grant awards for FY 2014 were less than the actual costs
associated with the positions and these shortfalls were transferred to the County Attorney
general fund. These funds were set aside for this purpose in the FY 2014 Non Recurring
budget. (C-19-14-052-2-00)

16. FUND TRANSFER
In accordance with A.R.S. 42-17106(B), authorize a fund transfer of not-to-exceed
$512,929 from the Sheriff’s Office (500) Detention Fund (255) Operating (0000) budget to
the Sheriff’s Office (500) Inmate Services Fund (252)Operating (0000) budget, authorize an
increase in revenue and expenditure authority in an amount not to exceed $512,929 in the
Sheriff’s Office (500) Inmate Services Fund (252) Operating (0000) budget with offsetting
revenue and expenditures adjustments in Eliminations (980) Eliminations Fund (900)
Operating (0000). This action will have a net zero impact on the overall County budget.
The fund transfer is needed because Inmate Services Funds were used to purchase
services outside the permissible uses defined in statute. Inmate Services Funds are used,
in part, to provide counseling services to inmates. Over the last seven years, counseling
services were provided to some inmates upon their release from jail in order to reduce the
likelihood of their return. A legal opinion issued by the County Attorney’s Office on March
21, 2014 states that these funds are statutorily restricted to pay for services provided to
inmates within the jails. Upon release from jail, they are no longer eligible to receive
services paid for with the Inmate Services Fund.
Upon receipt of the legal opinion, MCSO immediately stopped using Inmate Services for
this population of offenders. In addition, MCSO reviewed billings back to 2007 (the earliest
year in which bills were available) and identified $512,929 in spending that was
inconsistent with the statutory restrictions. The requested fund transfer will return funds to
the Inmate Services Fund from the Detention Fund, which is statutorily authorized to cover
community-based treatment for offenders.
The Sheriff’s Office intends to transfer all $512,929 from its existing operating budget
during FY 2014. If that is not possible, the Sheriff’s Office will transfer as much as possible
in FY 2014 and look to cover the remaining amount sometime in FY 2015. (C-50-14-074-2-

45. APPLY AND ACCEPT GRANT FUNDS FROM EDWARD J. BYRNE MEMORIAL
JUSTICE ASSISTANCE GRANT/DRUG ENFOREMENT ACCOUNT
Approve the application and acceptance of grant funds from the Edward J. Byrne Memorial
Justice Assistance Grant/ Drug Enforcement Account (DEA) in an amount not-to-exceed
$236,492 for the portion allocated to the Office of the Public Defender (520). This grant is a
recurring grant administered by the Arizona Supreme Court, Administrative Office of the
Courts (AOC). The Office of the Public Defender applies for this grant jointly with Adult
Probation, Clerk of the Superior Court, and Superior Court. These funds support the justice
system by providing staff in all of these departments. In FY 2013-14, this grant funds 15.36
full-time equivalent positions Countywide. The Office of the Public Defender is requesting
authorization to again apply for the DEA Grant for FY2014-15.
The new grant period will begin on July 1, 2014 and end on June 30, 2015. The grant does
not currently allow for the recovery of indirect costs in FY 2013-14, and no change is
anticipated in future years. Therefore, the Office of the Public Defender and Maricopa
County may receive no administrative cost recovery for this grant in FY 2014-15. The
Maricopa County Department of Finance has calculated the Office of the Public Defender's
composite indirect cost rate at 11.4%. The non-recoverable indirect cost will not exceed
$26,960.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore expenditures of these revenues are not prohibited by the budget
law.
The grant award will begin on July 1, 2014 and end on June 30, 2015. However, the
application for funding has historically been received late and submitted even after the start
of the applicable fiscal year. The application turnaround involves tight time constraints;
therefore, the Office of the Public Defender is requesting advance approval to apply for the
departmental share of these funds through a joint application with the Superior Court, Clerk
of the Superior Court, and Adult Probation. The FY 2014-15 budgeted amount for this grant
is $236,492 as developed through the normal annual budget process. If funding is awarded
in excess of that amount, a budget adjustment will be requested. We also anticipate we will
be required to provide an in-kind match of 25%. We have a General Fund position which is
being used to fulfill the match requirement in the current year, and that position is funded in
the following year as well. Therefore, there is no additional burden to the General Fund as
a result of the in-kind match requirement. (C-56-14-010-G-00)

SERVICES COSTS

Formal Meeting Minutes

Pursuant to A.R.S. §42-17106B, transfer FY 2013-14 expenditure authority in an amount
not-to-exceed $3,500,000 from Non-Departmental (470) General Fund (100) Non-
Recurring (0001) to the Office of Contract Counsel (560) General Fund (100) Non-
Recurring (0001). The purpose of the transfer is to cover increased mandated case
representation costs.
The contingency funding will be used only if the transfers authorized by the County
Manager for the FY 2013-14 year-end General Fund savings within the offices of Public
Defense Services (PDS) are insufficient to cover General Fund expenditure deficits. The
offices in PDS include: Public Defender (520), Legal Defender (540), Legal Advocate (550),
Contract Counsel (560) and Public Advocate (570).
Public Defense Services’ (PDS) combined projected FY 2013-14 year-end negative
expenditure variance is $2,794,245. The most significant forecasted negative variances
are: Non-Capital Felony ($1,477,062), Capital Post-Conviction Relief ($1,179,294), and
Capital Trial ($907,076). Savings from other activities are projected to offset a portion of
the forecasted overrun. Due to the delay in billing from contractors and the normal monthly
variances, an additional $705,755 is requested to be set aside to help ensure full funding is
available. Contingency funding will only be utilized if required after financial transfers. (C-

Revenues in the amount of $5,200,000. This action will decrease the revenue and
expenditure appropriation in the Medical HMO Fund (601) by $3,500,000, increase the

increase the revenue and expenditure appropriation in the Medical HDHP with H S A Fund
(606) by $5,500,000.
These increases will be partially offset by an increase to Elimination in the amount of $
1,500,000. The adjustments result in a net increase of $3,700,000 in revenues and
expenditures in the FY 2014 budget. Budgeted expenditures in the Benefits Trust can be
increased pursuant to A.R.S. § 11-981 (C), which states that expenditures during the fiscal
year from a trust are not subject to the provisions of title 42, chapter 17, article 3.
Three factors have contributed to the increase in expenditures over the budgeted amount:
1) There has been a shift from “Employee Only Coverage” to “Employee plus Family
Coverage” of about 80 employees which effectively increases the number of members in
the plan; 2) Total employees enrolled in plans has increased by about 100 subscribers; 3)
Claims have come in slightly higher than anticipated. (C-39-14-031-2-00)

C-17-05-107-2-00 Approved Maricopa HOME Consortium Intergovernmental Agreement
on June 22, 2005. The Cranston Gonzales Affordable Housing Act allows for local
governments that are geographically contiguous to form a consortium for the purposes of
receiving an allocation of and participating in the HOME Investment Partnerships Program
(HOME). The purpose of the HOME program, administered by HUD, is to strengthen
public-private partnerships to increase the supply of affordable housing. The Maricopa
HOME Consortium IGA will be effective for Fiscal Years 2015-2016, 2016-2017, and 2017-
2018. The Agreement contains a three year renewal clause for members beginning on
June 30, 2018. Consortium members have the opportunity to opt out of the Consortium
prior to the automatic renewal date. The Maricopa HOME Consortium currently receives
approximately $3.3 million annually under the HOME program. These funds will be used to
serve housing needs of residents within the Consortium service area boundaries. If

Formal Meeting Minutes

JUVENILES
Approve an Intergovernmental Agreement (IGA) between Maricopa County (the County)
and the Arizona Department of Health Services (ADHS) which in effect extends the existing
arrangement for the County's funding of behavioral health services for a term of one year.
County funding for services to the seriously mentally ill (SMI) under this IGA will be
$47,992,438 for FY2014-15. This increases the level of County funding based on medical
inflation for services to the seriously mentally ill by $2,285,354 over the funding paid under
the previous IGA in FY2013-14. The FY2014-15 IGA also requires the County to fund non-
SMI services in the amount of $3,366,705 and substance abuse services in the amount of
$1,489,871 (LARC) for the one-year term which is equal to the FY2013-14 level. The IGA
will be in effect upon signature of the last party and shall remain in effect until June 30,
2015. The IGA may be amended, further extended or terminated pursuant to the IGA
provisions, including a 90-day termination without cause provision. Total County funding for
behavioral health services in FY2014-15 under the IGA will be $52,849,014 for a one-year
term.
Approve an Intergovernmental Agreement (IGA) between Maricopa County and the
Arizona Department of Health Services (ADHS) authorizing ADHS or its contracted
Regional Behavioral Health Authority (RBHA) to provide mental health services to
remanded juveniles (of a screening agency, an evaluation agency and mental health
treatment agency) when evaluation is ordered by the Maricopa County Superior Court
pursuant to Arizona Revised Statutes, (A.R.S.) Title 36, Chapter 5, Article 4 and treatment
is ordered by the Superior Court pursuant to Arizona Revised Statutes, Title 36, Chapter 5,
Article 5.
Pursuant to the judgment in Arnold v Sarn and the subsequent March 10, 1994 court order,
the County is required to enter into an Intergovernmental Agreement (IGA) between
Maricopa County and the Arizona Department of Health Services (ADHS) under which the
County contributes funding for behavioral health services for seriously mentally ill (SMI)
indigent residents of the County. The County also contributes funding for non-SMI services
under the IGA in order to integrate the behavioral health system in Maricopa County. The
IGA requires the County to adjust its SMI contribution annually. Through FY04, the
adjustment was calculated by using a base amount established in the FY96 IGA, as
adjusted in subsequent IGA's. Since FY01, the amount has been determined by multiplying
the base amount for each year by an inflation factor derived from the Bureau of Labor
Statistics medical market basket cost index. Program: State Withholdings and Contract
Management Activity: State Mental Health Programs Activity. This IGA will provide financial
management and oversight for County Administration of funds that are paid to, or withheld
by, the State and/or the Maricopa Integrated Health System so they can ensure accurate
and proper distribution of funds to health programs. The activity will provide financial
oversight of funds that are paid to the State under court order for mental health programs
for County Administration so that they can limit their liability while ensuring that their court-
ordered obligations are met in an efficient and effective manner.
This IGA also authorizes ADHS or its RBHA to expend up to $200,000 from the “Non-SMI”
payment funds for remanded juveniles. The Department of Health Care Mandates and
ADHS, in conjunction with the Superior Court, previously negotiated to provide evaluation
services for remanded juveniles using funds that are not part of the County’s mandated
obligations under Arnold v. Sarn. A “remanded juvenile” means a person under the age of
eighteen who has been transferred to the criminal division of the Superior Court pursuant
to A.R.S. § 8-327 or who has been charged with an offense pursuant to A.R.S. § 13-501;
and has not been sentenced, pursuant to A.R.S. § 13-701 on the charges pending against
the juvenile in the criminal division of the Maricopa County Superior Court pursuant to
A.R.S. § 8-327 or A.R.S. § 13-501. (C-49-14-040-3-00)

Results from the Queen Creek & Sonoqui Wash Hydraulic Master Plan for Queen Creek
and Sonoqui Washes indicate that the most feasible solution to contain breakouts from
Sonoqui Wash is to increase the cross section of the wash to contain the 100-year flood
flows. Sonoqui Wash Channelization Phase I from Higley Road to Chandler Heights Road
was completed in 2008. Phase IIA from Chandler Heights Road to Riggs Road (Main
Branch) and along Riggs Road to Ellsworth Road (East Branch) was completed in 2012.
Phase IIIA (Main Branch) from Riggs Road to Hunt Highway was completed in 2013. The
final design of the Sonoqui Wash Channelization Phase IIIB (West Branch) Project from
Riggs Road to Old Hunt Highway was completed under contract number FCD2009C011
with J.E. Fuller Hydrology & Geomorphology, Inc. The proposed contract 2014C005 will
provide engineering support services to update the construction documents for bidding and
obtain permits and provide support services during construction of Phase IIIB.
This procurement has been conducted in accordance with the Maricopa County
Procurement Code section MCI-351, Competition Impracticable Procurement. As the
engineer of record for the Sonoqui Wash Channelization Phase IIIB (West Branch) Project,
J.E. Fuller Hydrology & Geomorphology, Inc. is the only firm with sufficient project
expertise to provide post-design engineering support. This Agenda Item impacts

F-4. IGA WITH MARICOPA COUNTY TO UTILIZE DISTRICT PROPERTY FOR
COMMUNICATION SYSTEMS
Approve a master Intergovernmental Agreement (IGA) FCD 2014A003 between Maricopa
County (County) and the Flood Control District (District) to facilitate siting of communication
systems. Under the terms of the Agreement, site-specific agreements may be negotiated
under which the District may provide use of its property, and the County will reimburse the
District any realized additional costs. This Agreement shall become effective as of the date
it is executed by the Chairman of the Maricopa County Board of Supervisors and the
Chairman of the Board of Directors of the District, shall remain in full force and effect for a
term of one (1) year, and will be automatically renewed for nine (9) additional one (1) year
periods unless canceled by either Party upon written notice at least six (6) months prior to
the expiration of this Agreement.
The County and the District both utilize radios in vehicles for communication purposes
especially in areas where cell phone coverage is minimal. These radios require radio tower
facilities on real property. The District has large areas of property that may be compatible
with these tower facilities. This IGA will assist the County and the District in installation of
these tower facilities which will be of benefit to both agencies. Subject to negotiation of site-
specific agreements, the District will not charge the County rent for use of the facilities
since the District will benefit from the use of the towers. A site specific IGA will be prepared
for each radio control tower site on each District property. This agenda item impacts all
Supervisorial Districts. (C-69-14-048-3-00)

Maricopa County (County) and the Flood Control District (District) to utilize District property
at Miller Road and Interstate-10 for communication system siting. Under the terms of the
Agreement, the District shall allow site-specific exclusive use of its property for the County
System; the County shall adhere to the District right-of-way use permitting process. The
property belongs to the District and is located near the District’s Buckeye 1 Flood Retarding
Structure. The term of this IGA will be governed by FCD 2014A003 (G30165).
The County and the District both utilize radios in their vehicles for communication purposes
especially in areas where cell phone coverage is minimal. These radios require radio
control tower facilities on real property. The District has property available for flood control
purposes wherein a radio control tower could coexist. A location has been selected by the
County for this purpose and the District has agreed that this is acceptable. Since the
District will also benefit from the installation of the radio control facilities, it will not charge
the County for the rental of District property. The County will work through the District’s
right of way permit process to meet the District’s technical requirements for the placement
of the tower facilities. This agenda item impacts Supervisorial District 4. (C-69-14-049-3-

authorizes application only and does not commit the District to accept funding. Authorize
the Chief Engineer and General Manager of the District, or his designee, to sign
applications, standard assurance forms, certifications, disclosures and similar documents
