d. All transformers, back-flow prevention devices, utility boxes and all other utility related

n. All necessary building permits must be obtained for proposed changes.
o. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval is temporary
and allows the property to enjoy uses in excess of those permitted by the zoning existing
on the date of application, subject to conditions and stipulations. In the event of the failure
to comply with any condition or stipulation, and at the time of expiration of the Special Use
Permit, the property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to comply with any
conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation or expiration of the Special Use Permit. The Special
Use Permit enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of the
property as if the Special Use Permit had never been granted. (C-44-14-072-M-00)
Debra Stark, Director of Planning and Development, stated that a super majority vote is
needed for approval of this item. Planning and Development made its presentation to
the Board of Supervisors on April 23, 2014, but new photos were added to the
presentation.
Gary Hayes appeared on behalf of the applicant, AT&T, and said his presentation is the
same one that was given at the meeting held on April, 23, 2014. He explained that he
followed Chairman Barney’s instruction to meet with Sun Lakes residents in an effort to
resolve their concerns. He gave a summary of the meeting, stated who attended the
meeting, and explained the various suggestions that were made, including suggestions
for alternative sites. One of the suggested alternative sites is Risen Savior Lutheran
Church. Mr. Hayes explained some of the adverse issues that would be faced with this
suggested alternative site, such as it would not successfully cover the entire area that
needs cell coverage.
Chairman Barney stated that one of the major issues is the height of the tower. He
commented that he believes AT&T has exceeded certain standards that needed to be
met. The Chairman asked if the monopalm structure was less obtrusive.
Mr. Hayes displayed maps from his presentation and stated that the further north the
tower site goes the less chance of providing the cell coverage that is needed. He
explained AT&T’s process for selecting sites to place a tower and the actions taken by
AT&T to choose the sites. Mr. Hayes said it was important to note that there are 30,000
homes in Sun Lakes and there are multiple towers due to the density of the population.
Mr. Hayes addressed the Chairman’s question about the impact the tower would have
and displayed illustrations of the structure.
Chairman Barney asked which tower structure was more expensive. Mr. Hayes
responded that most governments and zoning agencies now require the camouflaged
structure. He stated that the faux structure costs three times more than the monopole.
Michael Stewart asked to see the picture with the monopalm structure displayed and
stated that this illustration proved that the structure did not fit in with the existing foliage.
Mr. Stewart explained that he is an elder on the board of Risen Savior Lutheran Church
and stated that the church is interested in having this structure on the church property
for the income it would provide the church. The church has acquired property north of
church on the corner of Chandler Heights Rd. and Alma School Rd. He stated that the

applicant has not done additional site studies for the newly acquired property.
Chairman Barney queried Darren Gerard, Assistant Director, Planning and
Development, about certain aspects of the property displayed in the photo.
Kristen Neff, resident of Sun Lakes, explained the circumstances that led to her lot
selection which backs up to the structure site. She stated that her house is her only
asset and she will be adversely affected because of this structure. She claimed that the
maintenance yard in the photograph did not make the area an industrial area.
Barbara Stewart submitted a speaker form indicating opposition but declined to speak.
Barbara Smith, resident of Sun Lakes, stated that she was a former realtor and
disagreed with the real estate letter presented to the Board and claimed it was
inconclusive. Ms. Smith said that this structure will have to be disclosed to potential
buyers in the area and the structure will depreciate the value of the homes. She stated
that she does not believe the information received by the Board is complete.
Chairman Barney asked how tall the church tower is. Darren Gerard stated he did not
have that information. Supervisor Chucri asked how tall the trees are and Mr. Gerard
responded that the highest trees were approximately 35 feet high.
Clark Champion, General Manager, Sun Lakes Homeowners Association (HOA) No. 3,
stated that HOA No. 3 is the owner of the property. He claimed this project has been
discussed for one and one-half to two and one-half years. He said it has been
supported unanimously by two HOA No. 3 Boards of Directors and that the HOA’s
interest is based on providing adequate cell reception for residents and not monetary
gain.
Jill Townsend, resident of Sun Lakes, said that AT&T was directed to meet with
stakeholders who were opposed to this project and she claimed that AT&T still has not
provided anything to support that the proposed site is the only site that will work for this
structure. Ms. Townsend stated that previous meetings with AT&T and the Lutheran
Church indicated that the church would meet needs for coverage. Ms. Townsend
requested that the Board postpone the vote today if they cannot deny the permit.
Supervisor Chucri asked Mr. Hayes if the structure had to be 75 feet tall. Mr. Hayes
responded that some of the height is due to the camouflaging and he explained that the
reduction of every foot of the tower will shrink the service coverage by 200 to 300
homes.
Sunny Kim, resident of Sun Lakes, stated that she read the HOA regulations and asked
the HOA Board of Directors to deny permission for this tower to be located on this
proposed site. Ms. Kim said she submitted 426 signatures to Maricopa County that
opposed the tower location. Ms. Kim hoped that the Board of Supervisors will do the
right thing and deny this permit.
David Peters, President, Board of Directors for Iron Oaks HOA, stated that the CCRs
state that the HOA is not obliged to the homeowners when making a change in the use
of a property. He said that the HOA does try to take the homeowners’ considerations
into account. He explained that there have been several invitations from AT&T to speak
with residents and the results of several online polls support the tower because of the

need of cell service.
Gary Hayes responded to the Chairman’s request to discuss the height of the structure.
Mr. Hayes explained that the structure can be reduced to 67 feet if it is a monopole.
The structure can also be reduced to 67 feet if it is a monopalm with a flat top.
~ Supervisor Wilcox entered the meeting ~
Chairman Barney explained the responsibility of the Board of Supervisors in this matter.
He said the Board must determine if the application fits within the constraints of the
code and if it is in compliance with the approved standards that are in place. The
Chairman explained what issues do and do not factor in on the Board’s decision.
Chairman Barney stated that by his estimation the code and standards have been met
and that the best effort has been made to address the opposition’s concerns.
Supervisor Hickman asked if AT&T met with the opposition. Chairman Barney
responded that AT&T had met with the residents to answer the question if another
location would meet the needs of AT&T. Chairman Barney stated that the proposed
location best meets AT&T’s needs and those residents in the community.
Supervisor Kunasek stated that he agreed that this location best meets the needs of the
community. He said there are better locations to place towers such as schools, bus
barns, or water treatment plants, but that these types of locations did not best meet the
needs of the community in this case.
Motion to concur with the recommendation of the Planning Commission and Staff by
Supervisor Kunasek, seconded by Supervisor Wilcox
Supervisor Wilcox said that there was a similar case in Estrella and acknowledged that
residents do not like these towers but they are necessary. She stated that maybe
technological advances in the future will eliminate the need for these towers.

8. PATENT EASEMENT ABANDONMENT ORDINANCE
Convene the scheduled public hearing for the Patent Easement Abandonment Ordinance
P-34. This action affects all Supervisorial Districts. The purpose of this ordinance is to
establish procedures and guidelines for property owners to request the abandonment of
Patent Easements under certain defined conditions.
The Federal Small Tract Act of 1938 created easements for roadway and utility purposes
on parcels conveyed under the Act, generally referred to as “Patent Easements.” States
have the authority to abandon these Patent Easements. A.R.S. §11-251.16, effective
September 13, 2013, grants to Arizona counties authority to abandon these Patent
Easements. There will be an initial review fee of $250, credited against the full fee of
$1,600 if the property owner proceeds with a full review. The Transportation Advisory
Board (TAB) recommended approval at their January 21, 2014 meeting. (Hearing date was
originally set for April 9, 2014, under agenda item C-64-14-082-M-00.)
(C-06-14-310-M-00)
Fran McCarroll, Clerk of the Board, explained that as this item progressed through the
Enhanced Regulatory Outreach Program (EROP) a typographical error was discovered
on page 4 of the ordinance in Section 2.e. The language was corrected as follows:
e. Upon receipt of input from the departments and agencies to which the request for
abandonment of a patent easement have been circulated, but in no event later than
fourteen sixty (14 60) days after the request has been found to be complete, MCDOT
shall prepare a report to the Board of Supervisors, including a recommendation if the
request should be granted or denied. Said report shall include a determination of
whether or not consent of all affected utilities has been obtained and shall include an
analysis whether the patent easement for which abandonment is sought is being used
or if the patent easement is still necessary. A copy of said report, together with any and
all comments from any of the departments or agencies to which the request has been
circulated, shall be posted on the MCDOT web site. MCDOT shall provide to the contact
person named on the request for abandonment of a patent easement notice that the
required documentation has been posted on the MCDOT web site and shall provide the
necessary link to the posting.
The corrected ordinance was placed on the Internet for viewing.
Chairman Barney explained that this issue was not unique to Maricopa County or the
State of Arizona.
Supervisor Chucri commented that this ordinance would be welcome news to many as
this issue troubles many people concerning their private property rights.

9. TUBERCULOSIS (TB) TESTING HEALTH CARD FEES
Convene the scheduled public hearing for adopting an increase to the TB Testing for
Health Card. Upon close of the hearing, take action on the fee increases for both a Two-
Step TB skin test and a TB blood test, will become effective May 7, 2014.
The Department of Public Health requests a public hearing and comment regarding a fee
increase for the Two-Step TB Testing for Health Card which would include two (2) TB skin
tests and a Health Card. The new fee would be $130. More frequently, the public is
requesting a Two-Step TB Testing and Health Card because there are public schools that
are requiring students to obtain the two-step TB test.
In addition, the Department of Public Health is requesting a public hearing and comment
regarding a fee increase for a Health Card for blood test for either a T-Spot which is a
blood test to diagnose TB or a Quantiferon (QFT) which is also a blood test to diagnose
TB. The new fee would be $110. With the fee increase, the Department would include the
Health Card and an individual can retrieve electronically. (C-86-14-076-M-00)

10. PROPOSED REVISIONS OF MARICOPA COUNTY PARKS AND RECREATION
DEPARTMENT USER FEE SCHEDULE
Pursuant to A.R.S. § 11-251.13, convene the scheduled public hearing, to solicit comments
and adopt the proposed changes to the Maricopa County Parks and Recreation
Department User Fee Schedule. Upon Board approval, this item will become effective June
2, 2014.
The Maricopa County Parks and Recreation Department, with consultation from the Parks
and Recreation Commission, has determined the necessity to revise its user fee schedule
in order to bring the user fees more closely in line with typical fees for similar systems and
to recover fees for services. This will enable the Department to apply any changes in fees
to needed repairs and maintenance of park facilities.
The Parks and Recreation Commission held a public meeting regarding the revised fees on
November 12, 2013, and no comments were received from the public. The meeting was
advertised on the Parks web site and in the parks. The Board must set this matter for
public hearing pursuant to statutory requirement. (C-30-14-009-M-01)

until April 15, 2018. All other terms and condition of the Intergovernmental Agreement
remain in full force and effect. This agreement supersedes all previous agreements.
The purpose of this intergovernmental agreement is to provide a framework for mutual
emergency assistance between Maricopa County and the State Forester of the Arizona
State Forestry Division. The most likely scenario for the implementation of the agreement is
a wild land fire in or close to the county that is of such a magnitude that the State Land
Department requests the assistance of one or more county departments. The departments
most likely to be requested are MCDOT for heavy equipment operation; MCSO for traffic
control, evacuations, or search and rescue; and Emergency Management for emergency
operations center activation. The agreement does not obligate the county to respond to a
request for assistance; it simply outlines the terms under which assistance is to be
provided. (C-15-08-003-2-03)

Employee Benefits and Health - Beneficios a los Empleados y la Salud
31. EMPLOYEE BENEFIT TRUST – BENEFIT HOLIDAY - PAY PERIOD END 6/8/2014
Approve (1) a benefit holiday of Medical Plan related premiums paid to the Employee
Benefit Trust by employees for the 6/8/2014 payroll in an amount which is estimated to be
$520,821; and (2) approve a benefit holiday of Medical Plan related premiums paid to the
Employee Benefit Trust by departments for the employer share for the June 8, 2014 payroll
in an amount which is estimated to be $4,709,214. As benefit premiums fluctuate with each
payroll, the total rebate will not exceed $5,500,000.
The purpose of this premium holiday is to further reduce the fund balance in the Benefits
Trust in excess of recommended reserves as of June 30, 2013, as directed by the FY 2014
Adopted Budget. The employee rebate will implemented by not charging employees for
medical plan related premiums for all employees that have an active “A” status or leave
status “L” or “P” at the time of the premium holiday. The employer portion of the holiday will
be implemented in the same manner as the employee holiday. The Benefit premiums
involved in this action will be for the following Self-Funded plans: three Medical Plans, one
Pharmacy Plan, one Behavioral Health Plan and the three benefit premium incentive
programs.
This action will reduce Benefit Trust revenues but will not eliminate the Benefit Cost
allocation to the departments for the June 8, 2014 pay period. The cost allocation was
budgeted to be lower than actual benefit premium charges and thus the departments have
already benefited from receiving a discounted cost allocation. (C-39-14-030-2-00)

33. SOUTH COURT TOWER - CONSULTANT SETTLEMENT AGREEMENT
Approve the settlement agreement with Gould Evans Associates, LC which requires: 1.)
Gould Evans to provide additional replacement lamp ballasts and lamp bulbs in the types
and quantities listed in the agreement and to accept payment of $255,909.68 as payment
in full for prior services and 2.) requiring the County to pay $255,909.68. In addition, the
County will execute an allocation of tax incentives letter as specified the agreement.
Gould Evans is the architect of record on the Court Tower Project. They are owed a
remaining balance of $255,909.68. They approved a lighting system in the Court Tower
Project which did not work properly resulting in the courtroom lighting overheating and
shutting off. Before paying the remaining balance to Gould Evans and other vendors, in
2012, the County commissioned a financial audit of the Court Tower project which delayed
the disposition of payment. Certain deficiencies with fluorescent lighting systems in various
courtrooms have been repaired. The parties agree the lighting as installed will require
additional replacement lamp ballasts and lamp bulb as identified in the agreement. The
County agrees to pay Gould Evans its remaining balance and Gould Evans agrees to
accept payment of $255.909.68 in full satisfaction of its claim. Both sides agree that this
agreement represents final resolution of all claims with each side to bear its own attorney’s
fees and costs. (C-70-14-009-M-00)

The purpose of the amendment is to decrease the number of Head Start and Early Head
Start children to be served from 1,159 to 1,030 during July 1, 2013 to June 30, 2014.
The decrease matches the service levels approved by the U.S. Department of Health and
Human Services (DHHS)/Administration for Children and Families (ACF)/Office of Head
Start (OHS) for the grant funding year 2013-2014. Reduction in the number of children to
be served is a result of sequestration reductions.
Enrollment decreases are:
Head Start from 1,031 to 911
Early Head Start from 128 to 119
Total number of children impacted is 129
Also, this amendment modifies the contract to add language addressing Catholic Charities’
usage of the modular buildings transferred to the County from Catholic Charities approved
by the Board of Supervisors (C-22-14-036-V-00) on November 20, 2013.
Maricopa County has been the Grantee Agency providing Head Start services to areas of
the County, outside the City of Phoenix, since 1966 and Early Head Start services since
1997. Services for Western Maricopa County have been provided by Catholic Charities
Community Services, and the organization is designated by U.S. Department of Health and
Human Services (DHHS) as a Delegate Agency of Maricopa County’s Head Start Zero-

Motion to approve by Supervisor Chucri. There was no second. Supervisor Wilcox
made an alternate motion to continue this item. There was no second.
Supervisor Wilcox stated she wanted this item delayed to make sure the court-ordered
monitor has been notified and has approved the selection of the vendor to perform this
internal assessment.
Supervisor Chucri asked Tom Manos, County Manager, if this item was to help to
facilitate the court-ordered actions for the Melendres case.
Chairman Barney asked Chief Scott Freeman, Sheriff’s Office, to answer questions
about the monitor’s involvement with this item.
Supervisor Wilcox spoke to Chief Freeman explaining she thought that Judge Snow
ordered the monitor to look at everything concerning the Melendres case.
Chief Freeman stated the Sheriff’s Office was ordered to hire an outside consultant to
perform an internal assessment and this was not included in what the monitor has been
ordered to oversee.
Supervisor Wilcox said she was not comfortable moving forward with this item until
there was confirmation whether or not the item needed to be reviewed by the monitor.
Supervisor Chucri asked Chief Freeman if rescheduling this item would cause the
Sheriff’s Office to miss any deadlines called for in this court order. Chief Freeman
responded that he knew there was a time frame, but did not know the specifics.

Blue Crowley, resident, stated that there are proposed transit changes pending but the
changes have not been announced on the buses. He marked several of the route
changes being proposed but they are not a part of RPTA’s Planning. Mr. Crowley also
addressed other routes he claims are ineffective. He asked for the Board’s participation
with the RPTA directing funds to be used for covering bus stops instead of purchasing
dispensers.
Ed Bufford stated he has been attending the meeting for the past two months and has
only been able to speak for a total of 8 minutes. He expressed his appreciation of Dr.
Silva who has spent a lot of time meeting with him. He explained that there is an E-list
compiled almost every day and made available to Friends of Arizona Shelter Animals.
This group works overnight at times to find foster homes for the animals on this list or to
have animals pulled from the E-list, because they have a very short time span to
accomplish these efforts. Mr. Bufford claimed this was a depressing and dysfunctional
process. His request to the Board, to Mr. Manos, and the Director of Animal Care and
Control was that they consider extending the kill time for the E-list an additional 24
hours. He said this additional time would allow the Friends of Arizona Shelter Animals to
experience a higher success rate in finding homes for the animals.
