3. ROLL CALL - LISTA
The Board of Supervisors of Maricopa County, Phoenix, Arizona, convened in Formal Session at
9:00 AM on Wednesday, May 21, 2014, in the Supervisors' Auditorium, 205 W. Jefferson, Phoenix,
AZ 85003, with the following members present: Denny Barney, Chairman, District 1; Steve Chucri,
Vice Chairman, District 2; Andrew Kunasek, District 3; Clint Hickman, District 4; Mary Rose Wilcox,
District 5. Also present: Fran McCarroll, Clerk of the Board; Lori Medaris, Minutes Coordinator;
Tom Manos, County Manager; and Michelle Wood, Legal Counsel.
Chairman Barney stated he wanted to take the opportunity to honor Supervisor Wilcox
publicly and thank her for her 21 years of service to Maricopa County and her
dedication.
Supervisor Kunasek commented he has enjoyed his longtime friendship with Supervisor
Wilcox and hopes to continue that friendship. He said when he became a Supervisor,
the Board Members at the time were working to correct the financial issues in the
County, and, during his and her tenure, the County has become the largest debt-free
government entity in the nation. Supervisor Kunasek wished Supervisor Wilcox success
in her endeavors.
Supervisor Hickman stated that Supervisor Wilcox was instrumental in moving his
appointment as Supervisor for District 4 forward. He thanked her for her support and
said he looks forward to working with her again in different capacities.
Supervisor Wilcox commented that she thought about the many things that had
happened in this auditorium over the years. She said she has enjoyed representing
District 5 and that sometimes the challenge was harder than she thought. She was able
to meet the challenges with the help of department heads, administrators and so many
other people. She stated she was a miner’s daughter from a small town and that only in
a democracy such as the one in the United States could a person such as herself be
able to serve in all the capacities she had. She thanked her colleagues both past and
present, the County Manager, the department heads, and her constituents.
Photo opportunities were taken as the Supervisors presented Supervisor Wilcox with a
clock commemorating her service to Maricopa County.

18. COMPETITION IMPRACTICABLE TO DEUTSCH ARCHITECTURE GROUP FOR
JUVENILE DETENTION KITCHEN REMODELS
Approve Competition Impracticable for Architectural Services - Deutsch Architecture
Group. Juvenile Detention is currently receiving meals directly from the LBJ Food Factory.
These meals are delivered via rethermilazation units designed to keep the food warm/cold.
These retherm units are being phased out at the end of the 2014 calendar year. A Juvenile
Detention Food Services Assessment was done to evaluate the existing Juvenile Detention
kitchens to determine what modifications would be required to bring these kitchens up to
code and turn them into full food service kitchens. Deutsch Architecture was involved in
this Juvenile Detention Food Services Assessment; they have specific knowledge of the
two facilities involved and have already completed schematic design as part of the initial
assessment. The cost of the design is $167,215.00.
There are many technical and operational issues that Deutsch is familiar with that a
different design professional would have to learn. A different design professional would
have to start over from the beginning and the effort and expenditures to date would be
mostly wasted. (C-70-14-010-M-00)

Motion to approve by Supervisor Kunasek, seconded by Supervisor Wilcox
Rick Stephenson, AZ Fly Guys, stated he has been working with the County for eight
months and does not know who is responsible for setting the insurance limits. He said
that the insurance requirements are killing his business because he is being priced out
of the game. Mr. Stephenson claimed that these insurance requirements are higher than
anywhere in the United States and he will not be able to continue to do business if he
has to pay for this much insurance.
Jim Herzner, JR Entertainment/AZ Fly Guys, said he started this process eight months
ago with the Parks and Recreation Department. He explained that this is a small
business they are excited to bring to the Phoenix area. He claimed that Risk
Management is pushing the small businesses out with the insurance limits because
there is now only one business left. He requested the Board to ask Risk Management
to re-evaluate their reasons for imposing such high insurance limits.
Tom Manos, County Manager, encouraged the Supervisors to visit the business website
to see what service the business is offering. He said the insurance coverage that is
being required is because of the high risk involved with the activity being offered, which
is basically flying across the water 45 feet in the air with a jet pack on a person’s back.
Mr. Manos explained that if there was no risk, the insurance underwriters would not
require the higher limits.
Pauline Hecker, Director of Risk Management, explained the department’s responsibility
to review contracts and look at the activities and determine if the normal $1 or $2 million
insurance limits are adequate to cover the amount of risk. In this case it was
determined that these limits were not adequate. She said one of the goals of Risk
Management is to save taxpayers money and if a catastrophic injury did occur, the
County could be brought into the claim and have to share the liability.
Supervisor Wilcox asked if other businesses offering this activity were reviewed and
what insurance requirements had to be met. Ms. Hecker responded that the department
did reach out to other municipalities that allowed this activity and explained that some
states have strict immunities for governmental agencies, but that Arizona does not have
these governmental immunities. The result is that the County has to protect itself
through insurance requirements.
Chairman Barney clarified that multiple concessionaires are acceptable if those
businesses can meet the required insurance levels. He explained the Board must
manage risk and protect taxpayers. The differences in insurance requirements may be
that Arizona does not have governmental immunities that are afforded other states.
Chairman Barney stated the Board’s decision would be based on protecting taxpayers
and it was not trying to exclude small businesses.
Tom Manos stated that Ms. Hecker might be able assist the business representatives to
start a discussion with the County’s insurance broker so they would have an opportunity
to make sure the broker fully understands the nature of their business.
Supervisor Kunasek requested clarification that there was no exclusivity in this matter
and Chairman Barney responded that there was not and that the Board could approve
contracts with multiple concessionaires if they proceeded through the process and met
insurance requirements.

Maricopa. Por favor límite comentarios a dos minutos. Tenga en cuenta que de
conformidad con el Derecho de Reunión Abierta de Arizona, miembros de la Junta no
podrán abordar las cuestiones planteadas en esta parte de comentario público de la

Ed Bufford, resident, commented on a request he made to the Board in a previous
meeting concerning the policy of the one-day evaluation of animals for euthanasia. He
said he received a call from Animal Care and Control and was told that their intent was
to implement a two-day evaluation policy for euthanasia. Mr. Bufford commented on
several other issues he does not understand concerning the euthanasia policy and
stated he does not understand why it is difficult to change these policies.
Blue Crowley, resident, provided handouts to the Board that included the Transit Book,
the RPTA calendar and agendas. He stated that the RPTA have been holding hearings
concerning changes in scheduling. He said that there were no announcements made
on the buses which contributed to low attendance at the hearings.
Sharine Enderson, resident of Tonopah, stated she is directing her comments to
Supervisor Hickman and claimed that the proposed egg farm in their community will
destroy their quality of life, air quality and water quality. She said the proposed egg farm
has forced the opposition to enter into a costly legal battle. Ms. Enderson claimed
Supervisor Hickman is not considering what is in the best interests of the residents in

his district.
Art Enderson, resident of Tonopah, shared that in a recent meeting with Hickman Eggs
the community was told that the new plant would not have the flaws of the plant in
Arlington, Arizona. He asked if the residents will be compensated for the losses to the
community that will be caused by the proposed Tonopah plant when it suffers with the
same flaws as the one in Arlington. He asked for a guarantee that no harm will come to
the community.
Rick Moreau, resident of Tonopah, commented that the community of Tonopah currently
has no representation on the Board of Supervisors because Supervisor Hickman claims
to have recused himself from acting on this matter and Supervisor. Wilcox is leaving. He
stated that the Board is neglecting the community and it will be destroyed by the
proposed egg farm if the Board does not intervene.
Dan Mack, resident of Tonopah, stated that there are rules about agriculture exemption
and claimed that the land should be zoned as commercial property before agricultural
exemption can be considered. He said there is no agricultural zoning on county record
and the proposed egg farm is going to be located on property where the land use is for
field crops. He claimed that none of the rules have been followed if a land use change is
being made.
Linda Davis, resident of Tonopah, read the mission statement of the Board of
Supervisors and commented that the Board is failing the community of Tonopah. She
said the community is not being represented by the Board. Ms. Davis read building and
other specifications concerning the egg farm structures. She concluded by stating this
project was not agricultural but industrial and asked why the Board was not doing
anything.
Linda Butler, resident of Tonopah, said this was the third time she has addressed the
Board on this matter and she has visited other County departments and has received no
help from anyone. She claimed that there are families within feet of the proposed egg
farm who have children with asthma problems and elderly with respiratory problems.
Ms. Butler read A. R. S. §11-223 and said Tonopah is currently without representation
on the Board of Supervisors. She quoted A. R. S. §3-109 and claimed Supervisor
Hickman violates this statute by receiving a paycheck from Hickman Eggs. Ms. Butler
asked for Supervisor Hickman’s resignation.
Ruby Harris, resident of Tonopah and realtor, commented that at a recent meeting with
Hickman Eggs the residents were told that the proposed egg farm will not affect
property values. Ms. Harris shared statistics that illustrated how property values are
adversely affected by chicken plants and her own experiences trying to sale homes near
chicken farms.
Leslie Saunders, resident of Tonopah, stated she is a retiree and her husband is on a
respirator. She said she lacks understanding on how the Board of Supervisors has
allowed this to happen. She explained that she was not against the business but she
thought it could be established further out and not one-half mile from the main
intersection of town.
Jeanette Fish, Executive Director of the Maricopa County Farm Bureau, stated she
supports the growth of agriculture in the County. She said she has seen agriculture use
decrease in last 15 years. She stated she shares the residents’ of Tonopah concerns

about odor and truck traffic, but she understands there are rules to regulate these
