5. 2014 BOARD OF SUPERVISORS CHAIRMAN'S ADDRESS
Chairman Barney thanked Supervisor Kunasek for his patience and leadership in
welcoming the three new members to the Board this past year, and presented him with
a commemorative plaque in recognition of his 2013 Chairmanship. Mr. Barney also
thanked his colleagues for their confidence in electing him Chairman in 2014.
CHAIRMAN’S ADDRESS
Chairman Barney called for a moment of silence in recognition of the three-year
anniversary of the shooting tragedy in Tucson where six people lost their lives and U.S.
Representative Gabrielle Giffords and others were wounded in the process of exercising
their democratic privilege during a constituent meeting.
Chairman Barney explained that the County has specific and critical roles in the scheme
of government oversight. During his chairmanship he said he would focus on five
issues.
First is Regulatory Reform. There will always be natural friction between those who are
charged to regulate, and those that are regulated. We will continue to work through the
process of adopting new regulations and amending current regulations by following the
same process we did with some departments like Planning and Development that will
help make that regulatory interface more effective and manageable. Appointing
specialized ad hoc task forces and direct conversations with industry and stakeholders

will be the pattern to follow.
The second major issue is the Fiscal Health of the County. A major statutory authority
and responsibility is to manage the budget of the entire county. Chairman Barney
covered the following points regard budgets and fiscal concerns:
Budgets developed with all Elected Officials and department directors
Plan to manage sustainable growth
Increased demands for services balanced with an increasing population
Dealing with major issues such as the Melendres lawsuit
Consider salary adjustments in order to keep good people
Replenishing depleted reserves
Budget decisions based on an analysis of mandated services
Pilot project in zero-based budgets
Reviewing state demands for county funding of state-operated functions or
programs
Articulating actual cost of services to taxpayers
Economic Development and Jobs is the next area of focus. Recent efforts to help bring
Apple to the valley were very successful. As a regional leader Maricopa County will
continue to work with cities and towns to enhance economic development.
The fourth item is to Operate Transparently. As the sixth largest employer in the state
Maricopa continues to make information available to all citizens. Every organization
within the county has initiatives to operate and provide services in a transparent
manner.
Finally the Chairman referenced the new Strategic Planning Process the Board has
started. This process is ongoing and includes all of the Elected Officials. The goal is to
articulate the priorities and goals of the county in order to provide strategic direction to
all parts of the organization.
Chairman Barney issued a challenge for all to “think outside the box,” and prepare to be
unconventional at times.
The Chairman closed with this final quote and thoughts…”Excellence can be obtained if
you care more than others think is wise, risk more than others think is safe, dream more
than others think is practical, and expect more than others think is possible. In 2014
may we care more, risk more, dream more and expect more that we might continue
moving this great county forward. This is my sincere hope and desire as the Chair and
as part of this elected body, as one of you, that we can do that. And, I thank you for the
privilege to serve and with that, ladies and gentlemen, we’ll briefly recess this meeting.”
Meeting Reconvened
Chairman Barney recognized Supervisor Wilcox who noted that Linda Mushkatel is leaving after
33 years of service to Maricopa County and spoke of her involvement in some of the most
significant achievements of the County, notably in the Homeless Campus and the Arizona Meth
Project, saying Ms. Mushkatel has always been an advocate and expert in Behavioral Health and
Managed Care. Starting tomorrow Ms. Mushkatel will begin an Encore Fellowship with the
Human Services Campus Governance Board. Supervisor Wilcox thanked Ms. Mushkatel for her
years of service.

1. Development and engineering design shall be in conformance with the Maricopa County

Maricopa County Drainage Policies and Standards.
3. All development and engineering design shall be in conformance with Section 1205 of
the Maricopa County Zoning Ordinance and current engineering policies, standards and

appropriate Fire District, servicing the site.
l. This Special Use Permit shall expire 75 years from the date of approval by the Board of

Permit as set forth in the Maricopa County Zoning Ordinance.
p. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval is temporary
and allows the property to enjoy uses in excess of those permitted by the zoning existing
on the date of application, subject to conditions and stipulations. In the event of the failure
to comply with any condition or stipulation, and at the time of expiration of the Special Use
Permit, the property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to comply with any
conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation or expiration of the Special Use Permit. The Special
Use Permit enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of the
property as if the Special Use Permit had never been granted. (C-44-14-039-M-00)

18. FUNDING MARICOPA COUNTY SHERIFF OFFICE JUDGMENT ORDER
In accordance with A.R.S. 42-17106(B), authorize a transfer of expenditure authority in an
amount not-to-exceed $7,687,376 by decreasing the Non-Departmental (470) General
Fund (100) Non-Recurring Non-Project (0001) Unreserved Contingency (4711) line and
increasing the Sheriff’s Office (500) General Fund (100) Non-Recurring appropriation in a
new project entitled “MCSO Judgment Order.” Also authorize the creation of a new project
entitled “MCSO Judgment Order.” Lastly, authorize adjustments to the Sheriff’s Office (500)
FY 2015 baseline budget thresholds of $10,055,731 for General Fund (100) Operating
(0000) and $4,200,000 for General Fund (100) Non-Recurring MCSO Judgment Order.
These actions will have a County-wide net impact of zero and they do not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to
A.R.S. 42-17105. Approval of this action will allow the Sheriff's Office to comply with the
Orders associated with the Melendres case.
In FY 2014, operating costs associated with the MCSO Judgment Order are estimated to
be $4,898,315 and non-operating costs are estimated to be $2,789,061. Since the FY
2013-14 adopted budget did not contain a General Fund operating contingency, all FY
2014 expenses are requested from the non-recurring budget. The estimated annual
operating costs for full implementation of the MCSO Judgment Order are estimated to be
$10,055,731 and future year non-recurring expenses are estimated to be $4,200,000. (C-
50-14-040-2-00)
Supervisor Wilcox asked questions to assure the public and herself that funds for this
item will pay the Melendres Judgment Order and will be kept separately from all other
Sheriff’s funds. The Court Monitor will work with the Sheriff’s Office to identify and track
interactions in the fund so there can be no intermingling of monies with other Sheriff’s
funds and expenditures.
Tom Manos said a new project fund to be called the MCSO Judgment Order will be
created so any costs incurred in complying with the order will be tracked separately from
the rest of the Sheriff’s budget. He said, “Today’s agenda item is to adjust the budget for
the remainder of fiscal year 2014 by $7.6 million and then to adjust the baseline for next
year, specifically for those costs that will be incurred to comply with the order . . . the
money will be accounted for and reviewed separately.”
Supervisor Wilcox said this is a high profile case and she wanted to make sure that at
any time any person of interest could review the costs for the Melendres case.
Chairman Barney said the Sheriff has done a nice job in taking the order from the court
and making line item identifications on actions and costs. He added that Melendres
began with a routine traffic stop and has evolved into a very complex and expensive
case. There will be increased costs associated in managing those mandates from the
federal court. The order is under appeal.

and cash matches; i3 grantees are required to obtain matching private funds or in-kind
donations.
The Grant Period is January 1, 2014 – December 31, 2016. The Federal award amount is
$2,969,722 with a cash/in-kind match of $450,000.
MCESA’s indirect rate for FY 2013 is 8.3 percent. Recoverable indirect costs on this award
are $227,596.42. No Budget adjustment is necessary at this time. A grant fund
reconciliation at year-end will account for this expenditure authority. Grant revenues are not
local revenues for the purpose of the constitutional expenditure limitation, and therefore,
expenditures of these revenues are not prohibited by the budget law. This action does not
alter the budget constraining the expenditures of local revenues duly adopted by the Board
pursuant to A.R.S. §42-17105.
The Investing in Innovation Fund provides funding to support (1) local educational agencies
(LEAs) and (2) nonprofit organizations in partnership with (a) one or more LEAs or (b) a
consortium of schools. The purpose of this program is to provide competitive grants to
applicants with a record of improving student achievement and attainment in order to
expand the implementation of, and investment in, innovative practices that are
demonstrated to have an impact on improving student achievement or student growth,
closing achievement gaps, decreasing dropout rates, increasing high school graduation
rates, or increasing college enrollment and completion rates. These grants will (1) allow
eligible entities to expand and develop innovative practices that can serve as models of
best practices, (2) allow eligible entities to work in partnership with the private sector and
the philanthropic community, and (3) identify and document best practices that can be
shared and taken to scale based on demonstrated success. (C-37-14-037-G-00)

Probation Department for a total cost not-to-exceed $127,000. These vehicles will be
purchased using operating savings that exist within this Department’s Detention Fund
(255).
Also, approve an exception from markings and issuance of non-governmental license
plates per A.R.S. 38-538.03 because these vehicles will be used to locate and apprehend
felony probation and pretrial absconders. Markings are detrimental to the mission.
They will be take home vehicles because surveillance and apprehension is not a regularly
scheduled assignment with set hours.
The vehicle information including the make, model, color and VIN numbers will be provided

32. ACCEPT HEALTH RESOURCES & SERVICES ADMINISTRATION FUNDS FROM
ARIZONA DEPARTMENT OF HEALTH SERVICES FOR PERFORMING A STATEWIDE
COMPREHENSIVE NEEDS ASSESSMENT
Approve an Intergovernmental Agreement between Arizona Department of Health Services
(ADHS) (ADHS 14-059037) and Maricopa County through the Employee Benefits and
Health (EBH) Ryan White Part A Program (RWPA), in the not-to-exceed amount of
$84,000 The purpose of this Intergovernmental Agreement is to provide funding for data
collection through a statewide needs assessment to identify barriers and gaps in HIV/AIDS
care in Arizona. This Intergovernmental Agreement is effective from November 1, 2013
until October 31, 2018.
The Ryan White Part A Program receives funds from HRSA, under Part A of the Ryan
White Treatment Modernization Act of 2006, to provide care and treatment services for
Maricopa and Pinal County people infected with or affected by HIV/AIDS. HRSA granted
Ryan White Part B funds to the ADHS to fill the gaps in care not covered by other financial
resources, identify barriers in care and to establish strategic planning to identify
methodologies to address the barriers to care. ADHS in a continued unified effort between
the state and county is requesting the RWPA Program assist them in this endeavor. The
RWPA will utilize a RWPA contracted consultant to perform the following duties in
response to the requirements of the IGA: 1) meet with key stakeholders to develop a
survey instrument 2) conduct Consumer Surveys (n=735) 3) analyze client level data to
show client utilization to determine the impact of the Affordable Care Act on the statewide
RWPA population and 4) analyze the survey findings and present the results to the key
stakeholders. The cost of this assessment is $112,000.00. ADHS will provide $84,000.00
of this cost and Maricopa County RWPA will provide $28,000.00 for this project. The
funding amount of $84,000 is effective November 1, 2013 through August 1, 2014.
This Agreement does not allow reimbursement for County indirect costs. The Maricopa
County Department of Finance has calculated the Department of Employee Benefits and
Health FY14 indirect cost rate at 16.1%. Therefore, the estimated unrecoverable indirect
costs are $13,524. Acceptance of the funds without indirect reimbursement is appropriate
because the funds will offset a portion of the direct cost for the statewide needs
assessment, which the County is obligated to conduct by the terms of the existing Ryan
White Part A grant. Without the funding provided under the Agreement, the full cost of the
needs assessment would have to be supported by existing grant funds.
Grant revenues are not local revenues for the purpose of the constitutional expenditure
limitation, and therefore, expenditure of the funds is not prohibited by the budget law. This
Agreement does not alter the budget constraining the expenditure of local revenues duly
adopted by the Board pursuant to A.R.S. §42-17105. The overall grant budget will be
adjusted as necessary to accommodate this grant through a future reconciliation. Funding
for this Agreement is provided by a Grant from ADHS and will not affect the County’s
general fund. (C-39-14-020-3-00)
Supervisor Wilcox commented that the last time a Needs Assessment was done was in
2010 and a new assessment is needed as it will help on the next grant application. She
said the State pays three/fourths of the cost of the assessment and the remainder
comes from the Planning Council.

FY 2013 ACTUAL EXPENDITURE RECONCILIATION
In accordance with A.R.S. 42-17106(B), authorize the following amendment to the FY 2014
Non Departmental (470) Technology Capital Improvement Fund (460):
a) Decrease the expenditure authority for the Sheriff's Headquarter's IT Infrastructure
Project (SHQI) by $2,454,499 from $10,276,315 to $7,821,816. This action will reconcile
the expenditures in FY 2013 that were more that the forecast at the time. The total project
budget remains at $18,820,482 over the life of the project.
b) Decrease the Project Reserve (PRSA) by $8,150,180 from $45,708,533 to $37,558,353.
This funding was budgeted for the Infrastructure Refresh project.
c) Increase the expenditure authority for the Infrastructure Refresh Phase 2 (TIR2) by
$10,604,679 from $24,161,230 to $34,765,909. This action will reconcile the expenditures
in FY 2013 that were less than the forecast at the time, as well as move the project reserve
funds back into the project total. The total project budget remains $49,484,264, as
originally adopted in FY 2013.
These actions will have a County-wide net impact of zero and they do not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to
A.R.S. 42-17105.
Approval of this action allows the Office of Enterprise Technology (OET) to finalize the
currently identified work requirements on the Infrastructure Refresh Phase 2 project which
is anticipated to be completed by June 30, 2014. (C-41-14-005-M-00)

Non Departmental (470) Technology Capital Improvement Fund (460):
a) Decrease the expenditure authority for the Contact Center System Project (CALL) by

A-4. AMENDMENT WITH AMERICAN LUNG ASSOCIATION FOR AZ SMOKE-FREE LIVING
COALITION
Approve Amendment No. 1 to Contract between the American Lung Association in Arizona
(ALAA) and Maricopa County by and through its Department of Public Health (MCDPH), for
the purpose of purchasing services related to the AZ Smoke-Free Living Coalition. The
Arizona Smoke-Free Living (ASFL) Coalition’s goals are to ensure all people living in
Maricopa County have access to smoke-free living facilities. The budget is not-to-exceed in
the amount of $244,457 for the budget period January 1, 2014 through June 30, 2014, for a
total contract amount not-to-exceed $489,457. This Amendment extends the Contract term
from January 1, 2014 through June 30, 2014 with the option to renew for additional terms
up to a maximum of five (5) years.
This Contractor is a successful respondent to a Request for Proposal PH RFP 13-004
issued by the Maricopa County Department of Public Health.
Funding for this Contract is provided through an IGA (HG060018) between Maricopa
County through its Department of Public Health, and Arizona Department of Health
Services (ADHS) and does not increase the County general fund budget. Grant revenues
are not local revenues for the purpose of the constitutional expenditure limitation, and
therefore expenditure of the revenues is not prohibited by the budget law. This Contract
does not alter the budget constraining expenditures of local revenues duly adopted by the
Board pursuant to A.R.S. §42-17105. The overall grant budget will be adjusted as
necessary to accommodate this grant through a future reconciliation. (C-86-13-107-3-01)

Connie Blayney, resident, said she and her husband purchased land near Tonopah six
years ago and have made improvements on it so they could bring their horses to
Arizona in the winter. They love the ambiance of rural Arizona and riding in the desert
and have recently been told there is nothing they can do to keep a chicken and egg
factory from opening and operating nearby.
She said air quality and also wells and aquifers will be negatively impacted by such a
factory and it will ruin the retirement they, and many others, have worked so hard to
attain. She expressed concerns on its impact on their health and also on property
values in the area and added that this was done without getting any input from the
4,000 to 5,000 residents that are going to be affected by this action.
Ms. Blayney asked how this could happen – and who they could go to for help because
it is their District 4 Supervisor (Clint Hickman) who owns the factory. She wants the
Board to find a way to protect and preserve their area’s way of life.
Chairman Barney said the Board is not allowed to respond to those who choose to
speak during Public Comment because there are no published agenda topics.
Linda Butler, resident of Tonopah, also commented on the Hickman egg factory that
will be located in their area. She said that the several thousand Tonopah residents

bought property to enjoy country living and outdoor activities and also because many
had respiratory problems.
Earlier plans for a hotel/restaurant/strip mall have been put on hold due to the economy
but if built it would be only a half mile, upwind, from where the planned Hickman Egg
Factory will be built. She said she has lived two miles from an egg farm in California
and did not enjoy the flies and smells that it produced.
She explained that there was no warning, no signs posted, no meeting with the town
council, no notification other than just within the last couple of weeks and there is great
concern. Residents do not want the added traffic, flies, odors or worry about water
contamination. She asked Supervisor Hickman to please move the factory to an
agricultural area that won’t impact this town of 5,000 people.
86. SUPERVISORS'/COUNTY MANAGER'S SUMMARY OF CURRENT EVENTS
Resumen de temas de actualidad de los Supervisores/Administrador del Condado
Supervisor Kunasek mentioned he’d had lunch with Governor Brewer the previous day
and their conversation included comments about the County and she had asked about
many of the acquaintances she made when she was a County Supervisor. He said it
was touching to find that she still has such strong feelings and ties with the wellbeing of
Maricopa County. He added that she sent good wishes to everybody and especially to
Tom Manos who had worked closely with her (several years ago) to turn around the
State’s finances.”
Supervisor Barney commented on several former colleagues who have passed away,
Sam Udall and Lela Steffy from District 1 and District 2. They actively served the County
civically and politically and he recognized their many years of public service.
Tom Manos congratulated Mr. Barney on being elected Chairman of the Board and said
he had been pleased to hear the Chairman’s five goals, adding that Members are
making good progress on those areas. He noted that he hears “talk” about the new
Board Members and noted that two of them have been Members for close to a year and
the third, Mr. Hickman, has been a member for many months. He stated that starting
today he would no longer make reference to “new” board members.
Chairman Barney said they appreciate the year they have had - even though they may
still be a little “wet behind the ears” - and it had been a dynamic learning process.
Supervisor Wilcox complimented Chairman Barney on his five chosen planks. She said
the Board has had rotating chairmen and has not had a new member as chairman in 18
years. She assured Chairman Barney that so far she didn’t think he had said anything to
scare any of the County’s elected officials.
She congratulated the Chairman on his meeting with the federal Environmental
Protection Agency Director, Gina McCarthy, adding that she hoped he could keep
convincing her that much of Arizona and most of Maricopa County is desert and there is
a lot of dust that Air Quality strives to control, which is often a very difficult task.
MEETING ADJOURNED
There being no further business to come before the Board, the meeting was adjourned.
