i. The Flood Control District of Maricopa County has no objection to the approval of the

Permit must be obtained from the Floodplain Management & Services division of the Flood
Control District.
j. Prior to zoning clearance approval, developer(s) and/or builder(s) shall establish
emergency fire protection services, covering all real property contained within the project
area during course of construction and shall obtain a ‘will serve’ letter substantiating
coverage from the appropriate Fire District, Department or Company servicing the site.
k. The following Drainage Review conditions shall apply:

2 All development and engineering design shall be in conformance with Section 1205 of

best practices at the time of application for construction.
3 Section G-G of the Drainage Report/plans submitted 8/06/2013, shows riprap being
placed in a layer completely through a berm. The riprap layer would allow retained
stormwater to seep through the berm and flow offsite. Section G-G will have to be revisited
in the construction permitting phase so that any inadvertent seepage through the berm is
prevented.
l. This Special Use Permit shall expire fifty (50) years from the date of approval by the

Board of Supervisors, or upon termination of the use, whichever occurs first. Prior to
closure of the landfill the owner will submit documentation showing compliance with all
state and federal regulation.
m. The applicant/owner shall submit a written report outlining the status of the development

status report shall be reviewed by staff to determine whether the Special Use Permit
remains in compliance with the approved stipulations.
n. Amendments to the site plan and narrative report shall be processed as a revised
application in accordance with Maricopa County Zoning Ordinance Article 304.9.
o. Noncompliance with the conditions of approval will be treated as a violation in
accordance with the Maricopa County Zoning Ordinance. Further, noncompliance of the
conditions of approval may be grounds for the Planning and Zoning Commission to take
action in accordance with Chapter 3 (Conditional Zoning).
p. Non-compliance with the regulations administered by the Maricopa County
Environmental Services Department, Maricopa County Department of Transportation,
Drainage Review Division, Planning and Development Department, or the Flood Control
District of Maricopa County may be grounds for initiating a revocation of this Special Use
Permit as set forth in the Maricopa County Zoning Ordinance.
q. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval is temporary
and allows the property to enjoy uses in excess of those permitted by the zoning existing
on the date of application, subject to conditions and stipulations. In the event of the failure
to comply with any condition or stipulation, and at the time of expiration of the Special Use
Permit, the property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to comply with any
conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation or expiration of the Special Use Permit. The Special
Use Permit enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of the
property as if the Special Use Permit had never been granted. (C-44-14-061-M-00)
Debra Stark reported on this public hearing for a major amendment to a Special Use
Permit to expand the area and time frame, and to include municipal solid waste (MSW)
for an existing landfill on 316 acres. The Planning Commission unanimously approved
the request subject to conditions “a” through “q.” She said that 33 letters of support and
35 letters of opposition have been received. Because of the opposition, Supervisor
Wilcox met with the applicant.
Supervisor Wilcox spoke on the support and non-support on this item. Two more
conditions, “r” and “s” are being added with the approval of the applicant, Mr.
Weinburger. Supervisor Wilcox read them into the record.
“r” – Operations of the Rainbow Valley Landfill shall adhere to all applicable
requirements of the Arizona Department of Environmental Quality (ADEQ)
and all other applicable state and federal regulations.
“s” – Operations of the Rainbow Valley Landfill will be limited to construction

debris only and shall accept no municipal solid waste.
She said additional stipulations to add municipal waste may be needed in the future but
everyone is satisfied with the conditions as they are at this time.
Supervisor Chucri noted two individuals are present who support this amendment and
wish to speak as follows. Robert Nehrling, also present, did not speak.
Robert Long spoke to say he has lived south of the operation for 28 years and explained
that he and seven of his neighbors met Monday night and discussion had ensued on
this item. These neighbors were unanimously in favor of Mr. Weinberger who has done
so much for the community and is well loved by all. He added that there is absolutely no
opposition to this amendment.
Supervisor Chucri commented that it is always nice to have a consensus and thanked
Mr. Long for his thoughts.
Pam Schrader, resident, said she and many of her family members have lived a couple
of miles from the facility for 40 years and they all support Mr. Weinberger, the owner of
the landfill, as a great neighbor to all and for his help to the community.
Motion by Supervisor Wilcox to concur with Planning Commission recommendation with
additional stipulations from Supervisor Wilcox, seconded by Supervisor Kunasek

11. CLERK OF THE SUPERIOR COURT REQUEST FOR REVIEW OVER THRESHOLD
Per the Board approved FY 2015 Budget Guidelines and Priorities, approve allowing the
Office of Management & Budget to review the following request(s) over threshold:
• Personnel Services for Fill the Gap Positions $565,176 (Operating expense, Fund 100,
Priority #4)
• Personnel Services for 3.0 Dependency Positions $138,395 (Operating expense, Fund
100, Priority #4)
The Fill the Gap Fund, which is funded by state and local revenues, has seen a significant
decline over the past several years. This fund pays for staff positions, primarily comprised
of courtroom clerks assigned to criminal divisions. In order to maintain structural balance
this fiscal year, fund balance is being used to cover personnel costs; however, this is a

one-time exception to special fund policy. Looking ahead and based on our revenue
forecast for FY15, there will be a $565,176 shortfall to meet expenditures. These
expenditures are comprised of filled positions and do not include an additional four
positions that are being held vacant. Our Office is requesting that the positions that
encompass the shortfall be fully-funded in the General Fund beginning in FY15. If revenues
come in higher, personnel costs will be shifted back to this fund on a year-by-year basis.
In Juvenile dependency cases, the number overall has risen significantly over the past
several years and the impact has caused an increase in operations including minute
entries generated by our juvenile courtroom clerks. In addition, there continues to be a
rapid increase in juvenile guardianship, severance and adoption filings. Filings of
dependency petitions must be handled within strict time requirements and is inflexible.
Based on time requirements and increased filings, our courtroom clerks and operations
staff must shift other responsibilities in order to comply. The cost for three FTEs (including
benefits and merit increases) is $138,395. In FY14, the Office of Management and Budget
agreed to temporarily fund these positions, acknowledging the operational need but
desiring to determine its permanency. However, as we have seen through data, the
increase in dependencies continues to escalate, with estimates increasing another 30% in
FY15. As a result, the Clerk's Office requests permanent funding for the three positions in
FY15 and respectfully requests additional funding consideration if dependency
responsibilities continue on their upward trend. (C-16-14-012-M-00)

revised budget:
a) Reduce the expenditure authority in the Non Departmental (470) Non Departmental
Grants (249) Non Recurring Non Project (0001) budget by $550,000, and

and Restitution Interest fund (269) Non Recurring Non Project (0001) budget by $70,000

fund balances to draw from for this one-time expenditure budget increase.
The County Attorney expects to receive $1,663,719 in state and federal grants to pay for
victim compensation claims paid to victims of criminal injurious activity. Actual costs for
claim payments have increased during the fiscal year and the County Attorney forecasts
expending $2,213,719 for compensation claims. The funds in the Restitution/Subrogation
and Victim Compensation fund are established to cover such costs. (C-19-14-036-2-00)

a) Reduce the expenditure authority in the Non Departmental (470) Non Departmental
Grants Fund (249) Operating budget (0000) by $70,000, and
b) Increase the revenue and expenditure authority in the County Attorney (190) Criminal

increases received by employees.
The net impact to the county budget is zero.

$674,485 for the use of non-recurring fund balance - (Fund 201, Priority #4)
Adult Probation is a low cost alternative to jail and prison. At the current caseload ratios,
which are based on evidence based practices, this department has been showing
remarkable MfR results in areas such as successful completions from probation/pretrial
supervision and sentencings for new felony offenses. These successes have a positive
influence on community safety, as well as reduced present and future court and jail costs.
There has been steady growth in probationer and defendant numbers in several high risk
programs over the last several years. These increases show no sign of subsiding.
Additionally, the FY2014 budget balancing adjustment and loss of department revenue
negatively impacted this Department's ability to appropriately budget for normal operations.

32. ENVIRONMENTAL SERVICES REQUEST FOR REVIEW OVER THRESHOLD
Per the Board approved FY 2015 Budget Guidelines and Priorities, approve allowing the
Office of Management & Budget to review the following request(s) over threshold:
• 2 – 275 Gallon Totes of Zenivex mosquito adulticide chemical for $82,668 per tote – Total
$165,336 (Operating expense, Fund 100, Priority #4)
• 1 case – Altsoid Ingot Briquettes mosquito larvacide for $26,664 per case. (Operating
expense, Fund 100, Priority #4)
Approve the following Non-Recurring, Non-Project over the FY14 budget request of
$57,298. The department budgeted for non-recurring expenditures totaling $155,037,
$97,739 over the FY14 allocated amount which includes:
• OET IT – Developer Tools, ESX Server, Fiber Switch, Hardware and Software Upgrade,
GIS Performance, VID - $39,937 ($19,798 requested in FY14)(Non-recurring, Non-project
expense, Fund 100, Priority #4)
• 10 Replacement Laptops - $29,000 (Non-recurring, Non-project expense, Fund 100,
Priority #3)
• 10 Laptop Truck Mounts - $7,500 (Non-recurring, Non-project expense, Fund 100, Priority
#2)
• 10 Field Cameras - $1,000 (Non-recurring, Non-project expense, Fund 100, Priority #2)
• PCR Plate Spinner - $2,600 (Non-recurring, Non-project expense, Fund 100, Priority #4)
• Replace 6 gas foggers with electric foggers - $75,000 ($37,500 requested in FY14) (Non-
recurring, Non-project expense, Fund 100, Priority #4)
Over the past two years the baseline budget thresholds have been increased to
accommodate salary increases for pay retention but have not been increased to include
the rising allocation expenses such as OET IT, RDSA and Risk Management. In FY14 the
allocations increased by $51,869 and FY15 will see an additional increase of $79,303.
Environmental Services has been decreasing the supply and service line items in order to
be able to adjust for the increasing allocation costs. This will eventually lead to less
supplies and chemicals that can be purchased for the Vector Control Program. Chemicals
are required in order to keep citizens of Maricopa County safe from the risk of arbo-viruses
such as the West Nile virus. Without these chemicals, appropriate treatment cannot be
used to reduce the exposure of arbo-viruses and fogging will not be able to be completed
in known breeding sites. This will ultimately increase the public’s exposure and risk to arbo-
viruses. (C-88-14-009-M-00)

a) Decrease the General Fund County Improvement Fund (445) Project Reserves (Res1)
in FY 2018 in the amount of $1,200,000; and
b) Increase the General Fund County Improvement Fund (445) East Court Improvement
Project in FY 2015 by $1,200,000. The new project total for the East Court Improvement
will be $12,430,394.
These actions will have a County-wide net impact of zero and they do not alter the budget
constraining the expenditure of local revenues duly adopted by the Board pursuant to
A.R.S. 42-17105.
In the course of this project it was discovered that there is asbestos in the return air shaft of
the East Court Building which requires abatement far beyond the original scope. Approval
of this action will allow the Facilities Management Department to perform the abatement.
This project is split over multiple years and additional expenditure authority is not required
in FY2014, but the project increase is necessary to move forward with the contract
amendments. (C-70-14-006-2-00)

34. FACILITIES MANAGEMENT DEPARTMENT REQUEST FOR REVIEW OVER
THRESHOLD
Per the Board approved FY 2015 Budget Guidelines and Priorities, approve allowing the
Office of Management & Budget to review the following request(s) over threshold:
1. ”As Builts” Document Services $250,000 (Non-recurring expense, Fund 100, Priority #3)
2. Tririga Real Estate Environmental Sustainability Module $175,000 (Non-recurring
expense, Fund 100, Priority #4)
3. Tririga Facility Assessment Module $133,000 (Non-recurring expense, Fund 100, Priority
#4)
4. Additional FY 2015 funding to reconcile project to prior year actual; prior spending of
$674 is below the FY 2013 forecast of $913,022 for the Central Court Building Major
Maintenance project; FY 2014 spending is forecast at $901,457; therefore, requested FY
2015 funding is $4,897,869. The total project budget is $5,800,000. (Non-recurring
expense, Fund 100 Major Maintenance, Priority #4)
5. New FY 2015 funding for one-time major repairs to the Chambers Building $3,568,322
(Non-recurring expense, Fund 100 Major Maintenance, Priority #3)
Additional information for each numbered item in the action requested follows:
1. Document services for “as builts” will aid us with future repairs/maintenance on key
existing facilities in the downtown area. This service will update the currently outdated as-
built documents that denote building systems, layout, etc., that are used by contractors for
any repair, maintenance, or remodeling work completed on these buildings. These
documents contribute to the accuracy, timeliness of future work and reduced costs.
2. The Tririga Sustainability Module provides environmental and energy management
software to streamline enterprise carbon accounting and sustainability investment analysis.
It provides a single repository of energy and environmental data to measure and help
improve environmental performance. Maricopa County will be able to lower energy costs
and achieve carbon reduction goals. Annual maintenance costs beginning FY 2016 of
$18,000 will be needed. Additionally, our current software (Utility Manager Pro) for
collecting energy data will no longer be supported by our vendor, nor will they be providing

any upgrades. New software will need to be put into place for this function.
3. The Tririga Facility Assessment module provides capital planning software to help
generate higher returns from capital investments. It delivers financial, operational and
environmental impact analyses to help improve capital planning for a single building,
selected buildings or the entire Maricopa County portfolio. Currently, this service is
provided by a consultant. FMD would avoid paying the cost for these assessments at
consultant rates. Additionally, our current vendor will no longer be providing this service.
Annual maintenance costs for this module will be $26,000 beginning FY 2016.
4. Incorrect forecast for FY 2013 caused a shortfall of carry forward budget for FY 2014. FY
2015 reconciled budget request will not exceed the total project budget of $5,800,000
approved in FY 2013. FY2015 funding is required as this project is underway and needs to
be completed. The project purpose is to upgrade/modernize and maintain six elevators.
5. The Office of Enterprise Technology (OET) is requesting the repair/remodel of the
Chambers Building interior and exterior. This project will maintain and preserve the
condition of the Chambers Building while improving the business functionality for the
occupant, the Office of Enterprise Technology. The Historic Chambers Transfer and
Storage Co. Warehouse Building was built in 1923, is in need of a number of exterior
improvements to maintain the value of the asset and reduce future maintenance costs.
This project will address the deterioration of the grout between the bricks in the exterior
walls; replace the dry rotted wood façade and substandard storefront glazing system at
street level; and replace the roof. The purpose of the Chambers building interior remodel is
to bring the vast majority of OET staff together in one building, to make the interior of the
building a place where OET functions that rely upon one another can be housed together,
and to create a work environment that fosters staff communication, collaboration, and a
sense of pride in working for Maricopa County. OET staff are currently located in several
locations – Maricopa County Administration building, RDSA, FMD swing space, Public
Defense Services, as well as the Chambers building. In order to foster a great work
environment that encourages communication, collaboration, and a sense of pride in
working for Maricopa County, each floor of the Chambers building needs to be painted;
have new floor coverings installed where appropriate; have some new offices and
conference rooms constructed; as well as new furniture and equipment for OET staff. (C-

36. HUMAN RESOURCES DEPARTMENT REQUEST FOR REVIEW OVER THRESHOLD

Formal Meeting Minutes
Wednesday, March 12, 2014
Per the Board approved FY 2015 Budget Guidelines and Priorities, approve allowing the
Office of Management & Budget to review the following request(s) over threshold:
•Additional funding to conduct a comprehensive job analysis and related training for
department staff to become certified in job analysis. The comprehensive job analysis and
staff certification is a one-time expense (estimated $391,000 non-recurring expenditure,
priority level 3).
•Funding to conduct comprehensive, professional background screenings on new hires,
rehires and transferring employees (estimated $70,000 operating expense, priority level 4).
•Procuring and implementing an effective performance management system (2012 County
analysis identified Cornerstone Performance Management System (PMP) as the preferred
solution) (non-recurring expenditure $50,000, estimated operating costs in the first year of
implementation $114,325, estimated operating costs at full-implementation $241,380,
priority level 3).
•Procuring and implementing a compatible learning management system (2012 County
analysis identified Cornerstone Learning Management System (LMS) as the preferred
solution) (non-recurring expenditure $70,000, estimated operating costs in the first year of
implementation $178,800, estimated operating costs at full-implementation $241,380,
priority level 2). This request is a separate but related issue with regard to Cornerstone
Performance Management System.
•Create one Business Systems Analyst Senior/Lead position within Department 310 –
Human Resources (estimated operating cost of $94,556, priority level 3).
JOB ANALYSIS
Additional funding is needed to conduct the comprehensive job analysis required to
develop valid class specifications, minimum qualifications, job descriptions, and
assessment/testing procedures. To begin the analysis, assistance from outside of
Maricopa County, such as consultants or contractors, may be necessary to: 1) establish
the processes for the analysis to ensure best practices are adopted and; 2) complete the
analysis to minimize delays in addressing these critical deficiencies. Once the process is
complete, additional staff may be necessary to keep position information current and
training and/or certification will be necessary for some department staff to keep the job
analyses updated going forward.
BACKGROUND CHECKS
To ensure that a comprehensive, professional background screening is conducted on all
new hires, rehires and current employees (when transferring to a position that requires a
background screening), it is recommended that the Human Resources Department assume
ownership of the background screening process in order to maintain consistency and
confidentiality. In addition, it is recommended that Maricopa County utilize a third party
vendor to perform background screening functions. The Employment Services Division of
Human Resources processed 2,955 hire actions in 2013. Using an outside vendor to
screen hire actions (excluding actions of departments that do their own screening) would
likely involve approximately 2,000 screenings per year.
CORNERSTONE PERFORMANCE MANAGEMENT (PMP) & LEARNING MANAGEMENT
(LMS)
The County needs an effective performance management system in order to: 1) measure
employee performance against strategic goals and results, and 2) use that information to

Formal Meeting Minutes
Wednesday, March 12, 2014
enhance employee performance via a system of performance improvement strategies and
rewards, including compensation. The inability to accurately and consistently identify and
reward top performers results in diminished services, higher labor costs, and increased
turnover. An analysis from 2012 conducted by various County stakeholders identified
Cornerstone as the preferred performance management solution.
The LMS component of the system integrates with the PMP, allowing the training and
performance improvement aspect of performance to be identified and tracked in a single
location. The LMS piece unlocks the maximum functionality of the PMP system.
BUSINESS/SYSTEMS ANALYST SENIOR/LEAD (ANALYTIC AND HRIS NEEDS)
The HR Department currently does not have the requisite technical expertise to manipulate
HRIS and deliver information. This prevents the adequate analysis of HR data, which
results in decision-makers being less than fully informed. Additionally, the current HRIS
requires basic ongoing maintenance and periodic updates, which are currently delivered by
the HRIS consultant and highly-compensated subject matter experts (SMEs). The HRIS
consultant and SMEs are better utilized for major projects, system improvements or other
high-level tasks. A less expensive, though highly-skilled analyst could deliver the ongoing
maintenance, freeing the more highly compensated staff to manage the annual, one-time,
and ongoing projects that are expected to be implemented. The addition of a
Business/Systems Analyst Sr-Ld would satisfy the technical gaps of the department. (C-31-

37. DONATION FROM ARIZONA CHILD CARE ASSOCIATION FOR THE EMPOWER PLUS
PROJECT AN ARIZONA EARLY CARE & EDUCATION LEARNING COLLABORATIVE
Accept a $5000 monetary donation (grant), $2,500 now and a future donation of $2,500 to
be received at a later date, from the Arizona Child Care Association a non-profit
organization in cooperation with the National Early Care and Education Learning
Collaborative Project EMPOWER PLUS. These funds will be used to provide Head Start
and Early Head Start classrooms materials and supplies. The supplies and materials will
assist early care and education (ECE) providers in improving the quality of care they
provide to young children with respect to nutrition, breastfeeding support, physical activity
and screen time. It is anticipated that each classroom (10) shall receive $500.
Donation funds are not local revenues for the purpose of the constitutional expenditure
limitations, and therefore expenditures of these revenues are not prohibited by the budget
law. Approval of this action does not alter the budget constraining the expenditures of local
revenues duly adopted by the Board pursuant to A.R.S. §42-17105. The overall budget will
be adjusted as necessary to accommodate this donation through a future reconciliation.
This donation will not affect the County General Fund. (C-22-14-057-D-00)

Per the Board approved FY 2015 Budget Guidelines and Priorities, approve allowing the
Office of Management & Budget to review the following request over threshold:
Additional funding ($64,377) to create a Community Liaison/Social Worker position
(Operating expense, Fund 100, Priority #4)
A critical focal point for our department is our high volume of cases and communication
with the families of decedents both of which affect customer satisfaction and magnifies the
need for a single point of contact within the Office of the Medical Examiner. Creation of this
“Community Liaison” position would require an increase in budget of $64,377 and is a high
priority. (C-29-14-005-M-00)

Commission, (CV-14-02), in the not-to-exceed amount of $149,735 for the purpose of
toxicology laboratory personnel travel and training. The grant award begins on October 1,
2014 and ends on September 30, 2015. Authorize the Chairman to sign all documents
related to these grant funds, as applicable. The grant allows a 0% rate for indirect costs, or
$0 which may be incurred by the Office of Medical Examiner or Maricopa County for the
administration of this grant. The Maricopa County Department of Finance has calculated
the Office of Medical Examiner's composite indirect cost rate at 27.5%, or $41,177. The
recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost
is $41,177.
Upon receipt of funds and pursuant to ARS §42-17106(B), approve revenue and
expenditure appropriation adjustments to the Office of Medical Examiner (290) Medical
Examiner Grant Fund (224) associated with the grant in the amount of $149,735 for FY
2015. Grant revenues are not local revenues for the purpose of the constitutional
expenditure limitation, and therefore, expenditure of the funds is not prohibited by the
budget law. This budget adjustment does not alter the budget constraining the expenditure
of local revenues duly adopted by the Board pursuant to A.R.S. §42-17105. (C-29-14-006-

slides, and ADA compliance (equipment does not meet current ADA standard in several
parks). Funding requested by park: Estrella - $450,000, Usery - $300,000, White Tank -
$150,000, Lake Pleasant - $150,000, Cave Creek - $175,000 (Non-recurring expense,

Lake Pleasant Regional Park in the Desert Tortoise and Roadrunner Campgrounds and
one new playground at McDowell Mountain Regional Park in the Group Campground.
Parks has identified the need to attract more families and younger visitors to our system.

this segment of the market will increase fee revenue that is required to fund day-to-day
park operations and ensure continued use of the park system in the future. Funding
requested by park: Lake Pleasant - $300,000, McDowell - $150,000 (Non-recurring
expense, F100, Priority 2)

multiple restrooms in multiple parks including, but not limited to: replacement of leaking
water faucets, sinks, and toilets, updated toilet paper dispensers, replacing rusted doors
and stall partitions, installation of electric hand dryers, painting, replaster and tile work, and
repair to weathered roofing materials and structural issues. These facilities constantly
struggle with leaking and non-functional amenities and routinely require repair due to heavy
use and blocked septic systems due to paper hand towels being flushed down the toilets.
Funding requested by park: Estrella - $1,000,000, McDowell - $400,000, Usery - $400,000,
White Tank - $400,000, Lake Pleasant - $800,000 (Non-recurring expense, F100, Priority
4).
- SES Electrical Cabinet Repair: New FY2015 funding to repair electrical components that
operate the White Tank drinking water system. In 2012 and 2013, numerous water outages
occurred at the Park and Library due to failure of the electrical system/components. This
system was Installed over 20 years prior and has been repaired multiple times. The
electrical system is out dated and components are difficult to find. Funding requested by
park: White Tank - $200,000 (Non-recurring expense, F100, Priority 4).
- Water Line Design: New FY2015 funding for one-time design and consultation work to
provide plans and specification to repair and correct major water line deficiencies causing
