Absent: Mark Stewart, Supervisor, District 1. Also present: Juanita Garza, Clerk; Mia Vargas, Minutes Coordinator (remote); Jen Pokorski, County Manager; Brooke Worcester, Legal Counsel. 1. EXECUTIVE SESSION Vote to convene in Executive Session to consider the items on the Executive Agenda dated Monday, January 05, 2026, for Board of Supervisors and relevant Special Districts pursuant to the statutory authority listed for each item. Motion to approve by Supervisor Debbie Lesko, seconded by Supervisor Steve Gallardo Ayes: Thomas Galvin, Kate Brophy McGee, Steve Gallardo, Debbie Lesko Absent: Mark Stewart OPEN SESSION ~ Supervisor Galvin attended remotely ~ Chair Brophy McGee opened the meeting and recognized the elected officials who were present. 2. SETTING OF HEARING FOR THE SUBMITTED PETITIONS TO FORM TOLSUN FARMS I IRRIGATION WATER DELIVERY DISTRICT (Supervisorial District 5) Pursuant to A.R.S. 48-3428 consider the petition for the formation of the Tolsun Farms I Irrigation and Water Delivery District and if the petition is accepted, set a hearing to consider formation of the proposed district for Wednesday January 14, 2026, at 9:30 am. RESIGNATION OF IRONWOOD JUSTICE PRECINCT JUSTICE OF THE PEACE Accept the resignation of Joe Getzwiller, Justice of the Peace in the Ironwood Justice Precinct, with an effective date of December 31, 2025. (C-06-26-190-X-00) Motion to approve by Supervisor Debbie Lesko, seconded by Supervisor Steve Gallardo Ayes: Thomas Galvin, Kate Brophy McGee, Steve Gallardo, Debbie Lesko Absent: Mark Stewart Supervisor Gallardo thanked Judge Getzwiller for his years of service as a Justice of the Peace. 5. ADOPT RESOLUTION FOR CALL OF AN ELECTION - JAIL FACILITY EXCISE TAX PURSUANT TO ARIZONA REVISED STATUTE (A.R.S.) § 42-6109.02, ADOPT A RESOLUTION to call a countywide election to establish a jail facilities excise tax of one- fifth of one cent ($0.002) on transactions, the same rate as the jail facilities excise tax that has been in place since 1998 and is set to expire in March 2027. The countywide election will appear on the November 3, 2026 General Election Ballot as proposition 413. (C-06-26-208-X-00) Chair Brophy McGee asked the Clerk if there were any speaker slips for this item. She responded there was one speaker slip submitted. Dianne Barker, resident, spoke in favor of this item. Chairman Brophy McGee asked County Staff to come forward to present on this item. Zach Schira, Assistant County Manager, and Danny De Hoog, Deputy Director of Government Relations. Mr. Schira provided background on how much revenue the jail excise tax is expected to generate, what it will be used for, and noted it will expire in March of 2027. He explained a committee was formed to provide the Board with recommendations on ways to fund this item. Mr. Schira acknowledged each member of the citizen led committee those being; John Lewis, Chairman, Special Meeting Minutes Monday, January 05, 2026 Page 5 of 12 East Valley Partnership; Kevin Robinson, Councilman, City of Phoenix; Assistant Chief Dan Butler, City of Mesa; Brian Tobin, Chief of Daisy Mountain Fire District; Jason Barann, SRP; Marisa Calderon, Chief Counsel of Echo Canyon Consulting; Matthew Kenney, Maricopa County Attorney’s Office; Dr. Dawn Noggle, former Correctional Health Director, Maricopa County Sheriff’s Office; and Barbara Broderick, former Adult Probation Officer, Maricopa County Superior Court. Mr. Schira reported that the Committee brought in consultants who reported 99% of the detention fund expenses are mandated by law, court order of constitutional provisions. He said after a year of research, the Committee recommended the Board ask the voters to approve a tax at the same rate that has been in place and is set to expire. He noted this will be the measure to appear as Proposition 413 on the ballot for the November 3, 2026 General Election. Danny De Hoog thanked the Board for their support of the Committee. They had great things to say about the County Board and County experience. Vice Chair Lesko asked Mr. Schira what this money is used for. Mr. Schira stated it is used for the operation and maintenance of the County jails and gave a list of the departments that fall within this category. Vice Chair Lesko asked what percentage of the detention fund does this public safety tax fund. Mr. Schira stated it funds approximately 50% of the detention fund. Chair McGee thanked staff for their work on this item. Supervisor Galvin noted it will be an important vote for Rachel Mitchell, County Attorney, and Jerry Sheridan, County Sheriff. Supervisor Gallardo thanked the District 5 representative on the committee. He highlighted her background and accomplishments and thanked her for her service. He noted this revenue source was important for public safety. Vice Chair Lesko noted the most important duty of the government is to protect its citizens. She read a message that was tweeted out by Sheriff Sheridan expressing his support of this initiative. Vice Chair Lesko emphasized the importance of this public safety tax for the operation of the Maricopa County jail system.
