Following the public hearing, the Board is requested to adopt the proposed amendment to the rule and to submit the amended rule as a revision to the (Arizona) State Implementation Plan (SIP) . Upon Board approval, this item will become effective September 25, 2013. This is a text amendment to add to one sentence in Rule 100 (General Provisions and Definitions), Section 108 (Hearing Board) the requirement that County Air Quality Hearing Board members not have a substantial interest in any person required to obtain an air pollution permit or subject to enforcement orders issued under the Maricopa County Air Pollution Control Regulations. This amendment is intended to resolve the U.S. Environmental Protection Agency’s (EPA’s) disapproval of the 2009 Infrastructure State Implementation Plan (SIP) - a deficiency in a SIP revision submitted by the State of Arizona to address the requirements of section 110(a)(2)(E)(ii) of the Clean Air Act for the 1997 8- hour ozone national ambient air quality standards (NAAQS) and the 1997 and 2006 NAAQS for fine particulate matter (PM2.5). AIR QUALITY RULE DEFINITION REVISIONS Pursuant to A.R.S. §49-479(b), convene the scheduled public hearing, to solicit comments and consider the adoption of set a public hearing on proposed amendments to Maricopa County Air Pollution Control Regulations, Rules 100 (General Provisions and Definitions); Rule 330 (Volatile Organic Compounds); Rule 33l (Solvent Cleaning); Rule 333 (Petroleum Solvent Dry Cleaning); Rule 334 (Rubber Sports Ball Manufacturing); Rule 335 Formal Meeting Minutes Wednesday, September 25, 2013 Page 5 of 48 (Architectural Coatings); Rule 336 (Surface Coating Operations); Rule 338 (Semiconductor Manufacturing); Rule 339 (Vegetable Oil Extraction Processes); Rule 340 (Cutback and Emulsified Asphalt); Rule 341 (Metal Investment Casting); Rule 342 (Coating Wood Furniture and Fixtures); Rule 343 (Commercial Bread Bakeries); Rule 344 (Automotive Windshield Washer Fluid); Rule 345 (Vehicle and Mobile Equipment Coating); Rule 346 (Coating Wood Millwork); Rule 347 (Ferrous Sand Casting); Rule 348 (Aerospace Manufacturing and Rework Operations); Rule 349 (Pharmaceutical, Cosmetic, and Vitamin Manufacturing Operations); Rule 352 (Gasoline Delivery Vessel Testing and Use); Rule 353 (Gasoline in Stationary Dispensing Tanks); Rule 358 (Polystyrene Foam Operations); and Appendix G (Incorporated Materials) . Upon Board approval, this item will become effective September 25, 2013. The definition of “non-precursor organic compound” and the definition of “volatile organic compound (VOC)” are proposed to be revised in 22 rules in the Maricopa County Air Pollution Control Regulations in order to incorporate the most current U.S. Environmental Protection Agency (EPA) definitions of each. The department is further proposing to list the EPA-recognized non-precursor organic compounds in Appendix G (Incorporated Materials). Non-precursor organic compounds are compounds that the EPA has determined make a negligible contribution to the formation of ground-level ozone. A consistent and current list of non-precursor organic compounds will benefit the department, sources and citizens of Maricopa County. It is to the department’s advantage to regularly update this list to provide sources alternatives to ozone creating VOCs as well as provide consistent application of the non-precursor organic compounds to all sources. It is to the source’s advantage to utilize the non-precursor organic compounds to reduce VOC emissions and the associated recordkeeping requirements. Citizens will benefit due to the reduction of ozone in our air. Although this rulemaking affects many rules and essentially any source that uses non- precursor organic compounds and VOCs, the rulemaking has been non-controversial. DONATION OF USED COMPUTERS TO AGUILA SCHOOL DISTRICT Approve the donation of 25 PCs from Maricopa County, through MCESA to Aguila School District. Aguila will be receiving 25 upgraded PCs, which include: Dell 17-inch flat-screen monitors; Dell OptiPlex 760; and accessories (cable, mice, and keyboards). Aguila School District will accept responsibility for the care and maintenance of the donated computers and will have no expectation that they will be replaced at the end of their useful life. On a recent visit to Aguila, it was noticed by a MCESA staff member that students were still utilizing computers that were over 15 years old. Although still in working condition, they were very obsolete. Discussion with the Aguila School District Business Manager revealed that the PCs needed to be replaced, but District funds were unavailable. MCESA was able to secure used PCs that were to be salvaged. The license expenditure is $1,587.14 from fund 669, the Small School fund. (MCESA will provide 1st year licenses for Windows 7 and install the 25 upgraded PCs.) The computers are non-capital equipment and salvage value is approximately $500.00. EXCEPTION TO COUNTY COMPENSATION PLAN FOR RETROACTIVE PAY Approve an exception to the Maricopa County Compensation Plan to correct an administrative error and allow a salary advancement to be effective retroactively for July 2, 2007 through July 7, 2013 for Public Defender Attorney Peter C. Rosales. The increase is $1.81 per hour or 4.05% above the employee’s base salary for that period. The department calculates the employee's accumulated retroactive gross compensation at $27,112.09. In addition, the FY2012-13 Performance Based Pay Award was determined based on the erroneous pay rate. The department calculates that another $131.56 is required to provide this employee with the appropriate total award amount. In combination, a total of $27,243.65 is anticipated to make this employee whole for compensation and benefits relating to this error. To ensure full authorization for the retroactive pay due the employee, it is requested that the Board authorize a total of not-to-exceed $30,000 to allow for calculation discrepancies that may arise with official calculations still pending with Employee Payroll. There was an approved merit increase that was given to all employees at the outset of FY2007-08, but due to an administrative error this employee’s increase was not processed resulting in his rate being incorrect since July 2, 2007. The market and merit salary adjustments effective July 8, 2013 corrected this error prospectively. However, the employee should be offered retroactive pay for the difference in salary from July 2, 2007 through July 7, 2013, as well as the difference in award amounts from the Performance Based Pay Plan of FY2012-13. The total of not-to-exceed $30,000 is to be paid from the Office of the Public Defender’s General Fund (100). A full release will be required of Mr. Rosales before this retroactive pay is finalized. (C-56-14-003-M-00) Motion to approve by Supervisor Wilcox, seconded by Supervisor Chucri Supervisor Wilcox expressed her approval that the $27,000 in retro-pay was being addressed. Formal Meeting Minutes Wednesday, September 25, 2013 Page 28 of 48 The Local Law Enforcement Block Grants (LLEBG) preceded JAG. LLEBG procedures included a provision to protect counties from major funding disparities that resulted from the block grant formula. The formula allocated funds to communities by rate of violent crime arrests (predominantly by municipal police agencies), failing to reflect the substantial responsibilities of counties for adjudicating these high level crimes (including incarceration, prosecution, defense, and court processing). If declared disparate, communities were required to concur in a reallocation of the award amounts or no distribution of LLEBG funds occurred. As a result of the request for consideration by Maricopa County, in FY 2004 the Arizona Attorney General certified that the cities of Phoenix, Mesa, and Glendale were scheduled to receive an award twice as much as the projected County award. As the County allocates more than 50% of the local incarceration or prosecution expenditures for Part I, violent crimes, the Attorney General declared that the local funding of LLEBG dollars was disparate. Because of this decision, the 2013 JAG grant again requires a collaboration of all named cities and towns with Maricopa County. The following is the result of the negotiation process whereby Maricopa County will be allocated $235,315 of the total award. Adult Probation will receive $56,985 for the Community Restitution Program. The County Attorney’s Office will receive $56,985 to prosecute violent crimes involving deadly weapons (guns). Juvenile Probation will receive $56,985 to fund JPO positions responsible for providing support to Juvenile Probation Department community safety efforts. AMENDMENT TO LICENSE AGREEMENT WITH DONOR NETWORK OF ARIZONA Approve and authorize the Chairman to execute, Amendment No. 3 to License P-50119 with Donor Network of Arizona (Licensee) for non-exclusive use of space at the Forensic Science Center located at 701 W. Jefferson Street in Phoenix for the purpose of eye and tissue recovery. Amendment No. 3 will extend the term of the agreement through June 30, 2016. In addition, Amendment No. 3 clarifies the County’s right to terminate the agreement upon ninety-day written notice and outlines operational procedures on behalf of the Licensee and the County. The Licensee will reimburse the County $500.00 for each use of the facility regardless of the tissue recovery results. (C-18-08-018-1-03) Motion to approve by Supervisor Wilcox, seconded by Supervisor Hickman The Clerk noted that Alan Taylor, donor Network of Arizona, was present to speak or answer any questions from Members. Supervisor Chucri asked for clarification on whether the non-exclusive component is with one company only. Tom Manos explained that the current contract is with Donor Network of Arizona and they have first right to refusal for any tissue from the Medical Examiner’s Office. The Chairman said they would have the right of first refusal but it would not give them the only right to use the space. Supervisor Wilcox commented that this involves changing techniques through research being done and hoped the three-year contract includes flexibility to include any new research findings. Tom Manos explained that he told all interested parties that the desire is for a shared objective to use any and all valuable tissue that is obtained. SUPPLEMENTAL PUBLIC HIGHWAY AT-GRADE CROSSING IMPROVEMENT AGREEMENT WITH UNION PACIFIC RAILROAD Approve Supplemental Public Highway At-Grade Crossing Improvement Agreement with Union Pacific Railroad. This agreement covers the reconstruction, widening signal improvement and preemption of the existing 107th Ave. at-grade public road crossing. The improvements required for this intersection include widening the track crossing and relocation and upgrade of the crossing arms. It will also require the addition of preemption for east bound traffic turning north on 107th Ave. during train movement in the area. The cost to execute this agreement with the railroad is $30,239. Supervisory District No. 5. (C- 64-14-017-M-00) Motion to approve by Supervisor Wilcox, seconded by Supervisor Chucri Ayes: Kunasek, Barney, Chucri, Hickman, Wilcox 77. PUBLIC HIGHWAY AT-GRADE CROSSING MAINTENANCE AGREEMENT WITH Formal Meeting Minutes Wednesday, September 25, 2013 Page 35 of 48 UNION PACIFIC RAILROAD Approve Public Highway At-Grade Crossing Maintenance Agreement with the Union Pacific Railroad (UPRR). Appleby Road from Arizona Ave. to the Consolidated Canal service road is approximately 3361 feet in length. It crosses UPRR right of way at approximately 1340 feet east of Arizona Ave. Appleby Road provides the only means of access to 16 parcels of land, 13 of which are on the east side of the railroad tracks. These parcels are both residential and commercial use. Without this agreement in place, anyone crossing the tracks could be charged with trespassing and since they would be using a county maintained road the county could be held liable for any claims arising from the use of this roadway at the railroad right of way and beyond. The railroad requires a one-time fee of $1,000.00 to put the agreement in place. While attempting to obtain authorization to pave this road in the railroad right of way, it was discovered that neither UPRR nor MCDOT could produce a Public Highway At-Grade Crossing Maintenance Agreement for this crossing. Supervisory District No. 1. (C-64-14- 015-M-00) Motion to approve by Supervisor Wilcox, seconded by Supervisor Chucri Ayes: Kunasek, Barney, Chucri, Hickman, Wilcox 78. Pursuant to A.R.S. 42-17106 (B), approve an amendment to the current FY2014-2018 five- year Transportation Improvement Program (TIP) in the Department of Transportation (640) Transportation Capital Projects Fund (234), Year 1 (FY2013-2014) by decreasing the capital expenditure budgets for the following projects for a total of $11,524,000: Project Transportation Administration (TADM) capital budget by $4,364,000; Project County Arterials (ARTS) capital budget by $3,655,000; Project Safety Projects (SAFE) capital budget by $2,965,000; Project Traffic Improvements (TIMP) capital budget by $540,000; And, adjusting the following projects by increasing the FY2013-2014 (Year 1) capital Formal Meeting Minutes Wednesday, September 25, 2013 Page 36 of 48 expenditure budget for a total of $11,524,000: Project Pavement Preservation (PAVE) capital budget by $4,815,000; Project MAG Arterial Life Cycle Program (ALCP) capital budget by $3,380,000; Project Dust Mitigation (DMIT) capital budget by $3,289,000; And Project Bridge Preservation (BRIG) Capital budget by $40,000; The requested adjustment is necessary to realign project budgets to provide funding for the sub-projects added to the TIP; provide funding for unfunded projects experiencing delays carrying over into FY 2014; and to more closely match the year-end projected expenditure amount. These adjustments result in a net impact of zero and do not change the duly adopted budget as approved by the Board of Supervisors. Supervisor Districts: 1, 2, 3, 4, and 5 (C-64-14-021-M-00) Motion to approve by Supervisor Wilcox, seconded by Supervisor Chucri Ayes: Kunasek, Barney, Chucri, Hickman, Wilcox 79. COMPETITION IMPRACTICABLE PROCUREMENT WITH ACQUISITION SCIENCES II, LLLP FOR RELOCATION SERVICES Approve a Competition Impracticable Procurement in accordance with the Maricopa County Procurement Code, section MCI-351, in the amount of $85,000.00, with Acquisition Sciences II, LLLP, to provide Relocation Services for the Maricopa County Department of Transportation’s Northern Parkway Project No. TT347 (Dysart Road to 111th Avenue). The City of Glendale initially assumed lead agency responsibilities for acquisition of Northern Parkway right-of-way and relocation of affected property owners. The City contracted with Acquisition Sciences to perform this work. In 2010, Maricopa County assumed the lead role, and due to limited staff resources and project schedule, has utilized the City’s Acquisition Sciences contract (11141-IGA) for Relocation Services. The City’s contract has expired, but acquisition and relocation services for the project are expected to continue until an estimated completion date of December 31, 2015. Approximately half of the relocation work on the project is ongoing, and federal processes mandate an 18-month follow-up on completed work. Seeking a new vendor is impractical, as ensuring a continuity of service is critical to avoiding delays to the Northern Parkway project and to avoiding jeopardizing federal funding for the project. This Agenda Item impacts Supervisorial District 4. (C-64-14-020-M-00) Motion to approve by Supervisor Wilcox, seconded by Supervisor Chucri Ayes: Kunasek, Barney, Chucri, Hickman, Wilcox 80. Trish Manes, No Kill Maricopa, gave statistics concerning the number of animal deaths at Animal Care and Control, saying an animal is killed every eight minutes. She alleged that she has met with Dr. Silva, Assistant County Manager and Director of Animal Care and Control, and provided him with alternative methods to use for the thousands of animals that are picked up or turned in at the shelter. She stated that he has refused to use suggestions provided by the No Kill Advocacy Center. She charged that Dr. Silva has wasted more than $21 million in taxpayer dollars to needlessly kill animals and added that pet overpopulation is a myth in this County. Gwendolyn Lee stated that Animal Care and Control refuses to try something new that has worked throughout the nation and instead prefers to kill 45-55% of the animals that go into the shelter. She asked that they try the No Kill equation and save over 90% of the animals they receive. ONE TIME WAIVER OF DIAMONDBACKS 2014 MAJOR LEAGUE BASEBALL SEASON OPENING GAMES IN SYDNEY, AUSTRALIA Authorize the execution and delivery to AZPB Limited Partnership (the “Team”) of a letter agreement between the Stadium District and the Team that grants a one-time waiver of the requirement that the Arizona Diamondbacks play all their home games at Chase Field and agreement on the calculation of revenues coming to the Stadium District. Major League Baseball has announced that the Arizona Diamondbacks will host the Los Angeles Dodgers at the Sydney Cricket Grounds in Sydney, Australia on March 22 and 23, 2014 to open the 2014 Major League Baseball Season. Section 11.2.1.1 of the Facility Use Agreement requires that the Diamondbacks play all their home games at Chase Field. This Letter Agreement would allow for a one-time waiver of this requirement. Additionally, the Letter Agreement would accept the proposal made by the Team’s Executive Vice President and CFO, Thomas Harris, in a letter dated June 26, 2013, which sets forth how the revenue calculations from these games will be accounted for in terms of revenue streams coming to the Stadium District pursuant to the Facility Use Agreement. District staff has analyzed the revenue calculation methodology proposed by the Team, and finds that it is fair to the Stadium District in that it approximates the revenues that would be expected to be received by the District if the two games were played at Chase Field. The letter from Mr. Harris is attached and incorporated into the Letter Agreement.
