ORDINANCE NO. P-32
MARICOPA COUNTY ORDINANCE PROVIDING FOR ZONING
FOR MEDICAL MARIJUANA DISPENSARIES AND
OFFSITE CULTIVATION LOCATIONS
CHAPTER 1 – LEGISLATIVE FINDINGS
The Maricopa County Board of Supervisors (Board) finds the following:
a. In November 2010 voters passed the Arizona Medical Marijuana Act {AMMA)
authorizing the dispensing of marijuana for medical purposes.
b. Prior to adoption of the AMMA the Ordinance for the Unincorporated Areas of
Maricopa County {Zoning Ordinance) did not make any provision for medical marijuana
dispensaries. Thus, they could not be located anywhere in Maricopa County, because
they were not listed as a permitted use in any zoning district.
c. In response to the adoption of the AMMA a need arose to regulate the location of
medical marijuana facilities under the new Act to protect and promote the public health,
safety and general welfare of the citizens of Maricopa County, and the Board
accordingly classified medical marijuana facilities as "industrial" uses.
d. By decision dated November 20, 2013, the Superior Court of Arizona, in White
Mountain Health Center, Inc. v. Maricopa County, CV 2012-053585, determined that
the Board's classification of medical marijuana dispensaries as industrial was
unreasonable, voided it as a matter of law and found that there was no zoning
ordinance that regulated medical marijuana dispensaries. This left Maricopa County
with no zoning regulations for medical marijuana dispensaries.
e. Because of the ruling of the court, and as of the date of the adoption of this amendment
to the ordinance, there are no use controls in place determining in which zoning
districts a medical marijuana distribution facility may, or may not be, located.
f. As a result of the decision of the Court, arguably a medical marijuana distribution facility
may be located within any zoning district in unincorporated Maricopa County.
g. The location of a medical marijuana distribution facility in a residential zoning district
would be a detriment to the health, safety and general welfare of the citizens of
Maricopa County. This detriment would be magnified were the proposed facility located
proximate to residential districts or uses.

h. The Board has authorized the County Attorney to appeal the decision of the Superior
Court in CV 2012-053585. One of the grounds of appeal is whether the AMMA is
preempted by federal law. Another of the grounds of appeal is whether the trial court
correctly ruled that the County's zoning was unreasonable, violated the AMMA, and
therefore void.
i. If the AMMA is not preempted by federal law, it remains the preference of the Board
that medical marijuana distribution facilities be classified as an industrial use, available
to be located only in industrial zoning districts, as the location of such facilities in
industrial zoning districts would be the least harmful to the best interests of the health,
safety and welfare of the citizens of Maricopa County.
j. In the event the decision of the Court in CV 2012-053585 is reversed, this Ordinance
No. P-32 shall be deemed repealed by the Board and the zoning for medical marijuana
distribution facilities in Maricopa County shall be as it was before being held
unreasonable by the Court.
k. The lack of any zoning for medical marijuana distribution centers creates an emergency
situation, threating the health, safety and general welfare of all of the citizens of
unincorporated Maricopa County and posing a threat to residential property values of
all residential property located in unincorporated Maricopa County.
CHAPTER 2 - PURPOSE AND TITLE
201. PURPOSE
The purpose of this ordinance is to establish zoning for medical marijuana dispensaries and
offsite cultivation location facilities within unincorporated Maricopa County in response to
decisions by the Superior Court which have resulted in such a facility being permitted on any
property without regard to the underlying zoning of the property.
202. AMENDING THE ZONING ORDINANCE
This ordinance is intended to be and shall be construed as an amendment to the Zoning
Ordinance {No. P-18) for the Unincorporated Areas of Maricopa County.
203. SEPARABILITY
If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any
reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
CHAPTER 3 - CHANGES TO THE ZONING ORDINANCE
301. PURPOSE

amount from $259,250 to $313,500 for the budget period, July 1, 2013 through December
31, 2013. The contract is set to expire December 31, 2013 and will not be renewed. All
other terms and conditions remain in full force and affect.
MCDPH’s Indirect Rate for FY2013-14 is 15%. The allowed indirect costs are estimated at
$7,076, which are fully recoverable, however payments to sub-recipients in the amount of
$173,920 are not subject to the indirect rate per OMB Circular A-87, thereby the indirect
cost is $0. The County should accept this PO even though the full indirect includes sub-
recipient cost which is not subject to the indirect rate because the Department of Public
Health has provided breast and cervical services to the public since January 2003 and
serves over 3,000 cases annually.

duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be

Arizona Child Care Local Market Rate Survey. The term of this agreement is February 1,
2012 through June 30, 2017, for a new not-to-exceed amount of $146,722.00. Revenues
and expenditures for the 2014 Market Rate Survey were included in the 2014 fiscal year
budget for Research & Reporting.
The Arizona DES Child Care Administration has requested that the Office of Research and
Reporting conduct the 2014 Arizona Child Care Local Market Rate Survey. The data
collected will be used to meet federal requirements in certifying the rates for the provision
of child care services. Research and Reporting has conducted the Arizona Local Market
Rate Survey bi-annually since first mandated in 1989 (1990, 1992, 1994, 1996, 1998,
2000, 2002, 2004, 2006, 2008, 2010 and 2012). The methodologies developed by
Research and Reporting for conducting the survey are very acceptable in meeting the
federal requirement and have been used as models by other states. This previous
involvement and other considerations translate into savings for all Arizona Residents if
Research and Reporting conducts the survey again this year. The data is used to
determine the distribution of federal funds. The data collected is beneficial to the Maricopa
County Human Services and Public Health agencies. (C-46-12-002-3-01)

56. IGA WITH PINAL COUNTY AND THE TOWN OF QUEEN CREEK FOR
IMPROVEMENTS TO THE INTERSECTION OF EMPIRE BOULEVARD AND MERIDIAN
ROAD
Approve Intergovernmental Agreement (IGA) between Maricopa County, acting as the
Maricopa County Department of Transportation (Maricopa County), Pinal County (Pinal
County) and the Town of Queen Creek (Town) for the traffic signal upgrade and roadway
improvements at the intersection of Empire Boulevard and Meridian Road.
The intersection of Meridian Road (Gary Road) and Empire Boulevard forms the boundary
between Maricopa County and Pinal County. Meridian Road is currently a two-lane
undivided roadway. Gary Road, south of the intersection, is currently a three lane
undivided roadway. Empire Boulevard is currently a three lane undivided roadway east of
the intersection and becomes a two-lane undivided roadway west of the intersection.
Empire Boulevard and Meridian Road (Gary Road) at this intersection are both classified
as urban arterial roads that are considered a major arterial corridor for the Town.
The purpose of the project is to improve the intersection of Meridian Road (Gary Road) and
Empire Boulevard by modifying the existing striping at the intersection and installing
exclusive turn lanes on all approaches of the intersection. Improvements will also include
the widening of the pavement on Meridian Road and Empire Boulevard in the northwest
quadrant of the intersection to match the existing pavement width of Gary Road and
Empire Boulevard east of the intersection. Pinal County currently operates and maintains
the intersection, which has signals that are supported by span wires. The Project will
include an upgrade of the span-wire signal, which crosses from the southwest corner to the
northeast corner of the intersection, to Pinal County Department of Transportation
standards. The Project design is expected to be completed in spring of fiscal year 2014
and the construction is expected to begin in fiscal year 2015. Supervisory District No. 1 (C-

from a 3-lane roadway to a 7-lane roadway in accordance with the County’s standards,
relocate the utilities, install underground conduit for a potential future traffic signal at the
Riggs Road and Recker Road intersection, and provide drainage infrastructure.
Riggs Road, from Recker Road to Power Road, is located in southeastern Maricopa
County and lies partially within the Town of Gilbert and partially within unincorporated
Maricopa County. Riggs Road is designed as a major east-west principal arterial in
Maricopa County’s major streets and routes plan. The Town has constructed the existing 3-

60. PROPOSED CHANGES TO TRANSPORTATION ADVISORY BOARD BYLAWS
Approve the proposed changes to the Transportation Advisory Board (TAB) Bylaws as
recommended unanimously by the TAB on May 21, 2013 and November 19, 2013.
The Transportation Advisory Board (TAB) bylaws require that the Vice Chairman of the
TAB review the bylaws annually and recommend any changes he deems appropriate or
necessary. At the May 21 TAB meeting, Vice Chairman Jeff Martin proposed and the TAB
recommended changes to the bylaws. At the November 19, 2013 TAB meeting, the TAB
recommended additional changes to the bylaws. (See attached copy of bylaws with
proposed changes highlighted.)
The proposed changes to the TAB bylaws are the following:
Article II, Section 3 – Delete reviews and recommendations associated with the former
Small Cities Transportation Assistance Program (SCTAP) from the duties of the TAB. This
change is recommended because the SCTAP was ended on advice of the Maricopa
County Attorney’s Office (MCAO). The SCTAP could potentially involve expenditures of
Maricopa County Highway User Revenue Fund (HURF) monies in low income areas of
certain incorporated cities and towns. Such expenditures are not permitted by law because
MCAO advises County HURF monies may only be expended on County highways. Thus,
the SCTAP language is recommended for deletion from the TAB duties under the bylaws.
Article III, Section 2 – Provide that if a TAB Member’s (3-year) term expires and there is no

Formal Meeting Minutes

appointed replacement, the Member’s term shall extend until a replacement is appointed.
This proposed change is to address situations where terms may expire during periods
where the Board of Supervisors (BOS) is not scheduled to meet. This also addresses
instances where re-appointments or new appointments are not decided in time to coincide
with the end of a Member’s term. The Maricopa County Attorney's Office (MCAO) has
advised that it is acceptable by State law for an advisory board member to continue to
serve until a new member is appointed. So, the recommended change to the bylaws will
formalize the allowable continued service by a TAB member until a re-appointment or a
new appointment can be made.
Article VII, Section 1 - Clarify that proposed changes to the bylaws should be officially
posted two weeks prior to a TAB meeting where the recommended changes to the bylaws
are to be considered, so that all interested persons can see the proposed changes and
have an opportunity to comment.
Article VIII, Section 1 - This is technical or clerical adjustment. “Arizona Revised Statutes”
is currently abbreviated in the bylaws as “A.R.S.” The recommendation is to use the long
form for those who are not familiar with the abbreviation. Other changes are grammatical.

68. SET PUBLIC HEARING FOR RULES 321, 360, 370, 371 AND APPENDIX G
Pursuant to A.R.S. §49-479(b), set a public hearing for March 26, 2014 to solicit comments
and consider the adoption of proposed amendments to Maricopa County Air Pollution
Control Regulations, Rule 321: Municipal Solid Waste Landfills; Rule 360: New Source
Performance Standards; Rule 370: Federal Hazardous Air Pollutant Program; Rule 371:
Acid Rain; and Appendix G: Incorporated Materials. Upon Board approval, this item will
become effective March 26, 2014.
The Maricopa County Air Quality Department (department) is proposing to revise Rule 321:
Municipal Solid Waste Landfills; Rule 360: New Source Performance Standards; Rule 370:
Federal Hazardous Air Pollutant Program; Rule 371: Acid Rain; and Appendix G:
Incorporated Material by incorporating by reference federal regulations and documents
promulgated by the U.S. Environmental Protection Agency (EPA) and published in the
Federal Register: New Source Performance Standards (NSPS), National Emission
Standards for Hazardous Air Pollutants (NESHAP), Acid Rain and other parts of Title 40
Code of Federal Regulations. The proposed action will include amending the incorporation
by reference date from July 1, 2011, to July 1, 2013, in each of the rules and appendix to
remain current with federal regulations. The adoption of the proposed amendments to
Maricopa County Air Pollution Control Regulations Rules 321, 360, 370, 371 and Appendix
G is necessary prior to requesting the EPA’s delegation of authority to the department for
the implementation and enforcement of the federal regulations and documents.
These amendments should not have an economic impact on businesses in Maricopa
County and should not impose additional costs on the regulated community, small
businesses, political subdivisions, and members of the public beyond that already incurred
by reason of federal or state rule or law. The costs of compliance with these rules have
already occurred and were considered when the federal and state rule or law was
proposed and adopted.
The department did not receive any public comments during the public comment period.
