AMENDMENT No. 3 TO LICENSE AGREEMENT
FOR USE OF REAL PROPERTY
BETWEEN
MARICOPA COUNTY, dba UNDER ONE WOOF, LICENSEE
AND
CARLYLE ER METRO, LLC, LICENSOR
RECITALS
A. Licensor and Licensee are parties to that certain License Agreement No. P50138
(“License”) dated and approved by the Maricopa County Board of Supervisors on July 7,
2010 with Addendum thereto approved on September 1, 2010 and amended July 15, 2011
and amended March 21, 2012. The License is for exclusive use of space located at 9617
N. Metro Parkway W., Suite 1116, Phoenix, AZ 85051, consisting of 5,400 square feet
of inline mall space.
B. The term of the License expires on February 28, 2014
C. Licensor and Licensee now mutually desire to amend the License to extend the term.
AGREEMENT
NOW THEREFORE, in consideration of the foregoing and other valuable
considerations, Licensor and Licensee agree to amend License No. P50138 as follows:
1. The term of the license is hereby extended through [end of April or May, 2014] This
License is subject to termination pursuant to the provisions of A.R.S. §38-511.
2. Licensee shall reimburse Licensor for use of the mall space at a rate of Nine Hundred
Fifty Dollars ($950.00) per month plus applicable taxes of Twenty Four Dollars and
Seventy Cents ($24.70) per month.
3. The effective date of this Amendment No. 3 is the date of execution by the Maricopa
County Board of Supervisors.
4. The foregoing paragraphs contain all the changes made to the License by this
Amendment No. 3. All other terms and conditions of the original License and subsequent
amendments and addenda remain the same and in full force and effect.
