“q. Prior to Zoning Clearance, the applicant shall provide a copy of a will-serve letter from a
fire protection organization suitable to the Arizona State Fire Marshal stating that said
organization will provide fire protection services to the subject site during construction and
from that point on.”
c. All other stipulations of Z2011034 shall remain in effect. (C-44-14-034-M-00)
Darren Gerard provided background on this request to modify conditions in a previously
approved special use permit. This is a two-fold request. MCDOT has requested to
relieve the requirement for rights-of-way along the north, west and south boundaries as
it has been determined they are no longer necessary. Secondly, to accept fire protection
from any entity acceptable to the Arizona State Fire Marshall’s Office – originally it
specified fire protection from the town of Gila Bend but Gila Bend will only agree to this
protection if the site annexes, which is not possible at this time.

as follows:
a. Development of the site shall be in general conformance with the conceptual site plan
entitled “Standing Stones“, consisting of one page, dated revised October 8, 2013, and
stamped received October 18, 2013, except as modified by the following conditions.

c. All transformers, back-flow prevention devices, utility boxes and all other utility related

Department of Transportation, and not MCDOT) for landscaping or other improvements
in the right-of-way. Portions of driveways within public rights-of-ways shall be paved.
e. All development and engineering design shall be in conformance with Section 1205,
Drainage Regulations of the Maricopa County Zoning Ordinance and current engineering
policies, standards and best practices at the time of application for construction.
f. All outdoor lighting shall conform to the Maricopa County Zoning Ordinance.
g. Development of the site shall be in compliance with all applicable Maricopa County Air

course of construction and shall obtain a ‘will serve’ letter substantiating coverage from the
appropriate Fire District, servicing the site.
i. Noncompliance with the conditions of approval will be treated as a violation in
accordance with the Maricopa County Zoning Ordinance. Further, noncompliance of the
conditions of approval may be grounds for the Planning and Zoning Commission to take
action in accordance with Chapter 3 (Conditional Zoning).
j. Non-compliance with the regulations administered by the Maricopa County
Environmental Services Department, Maricopa County Department of Transportation,
Drainage Review Division, Planning and Development Department, or the Flood Control
District of Maricopa County may be grounds for initiating a revocation of this Special Use
Permit as set forth in the Maricopa County Zoning Ordinance.
k. The granting of this change in use of the property has been at the request of the
applicant, with the consent of the landowner. The granting of this approval is temporary
and allows the property to enjoy uses in excess of those permitted by the zoning existing
on the date of application, subject to conditions and stipulations. In the event of the failure
to comply with any condition or stipulation, and at the time of expiration of the Special Use
Permit, the property shall revert to the zoning that existed on the date of application. It is,
therefore, stipulated and agreed that either revocation due to the failure to comply with any
conditions or stipulations, or the expiration of the Special Use Permit, does not reduce any
rights that existed on the date of application to use, divide, sell or possess the property and
that there would be no diminution in value of the property from the value it held on the date
of application due to such revocation or expiration of the Special Use Permit. The Special
Use Permit enhances the value of the property above its value as of the date the Special
Use Permit is granted and reverting to the prior zoning results in the same value of the
property as if the Special Use Permit had never been granted. (C-44-14-035-M-00)
Darren Gerard reported on the background of this case, asking for removal of a
Residential Unit Plan Of Development (RUPD) Overlay Zone and approval of a Special
Use Permit for a guest ranch retreat center. Clusters of Casitas would be built along the
rear of a proposed community hall and other site amenities. He said portions of the site
would remain natural open space on the northeast portion as it is a floodplain. There is
a fruit orchard in the northwest area that would be retained. He said the land-use
patterns are not anticipated to change in the future and it is therefore believed this
permanent entitlement would be appropriate. The Commission voted for approval
subject to conditions “a” through “k.”

from the November 20, 2013 meeting. (C-44-14-027-M-00)
Darren Gerard reported on the background of this Special Use Permit for antennae
installations on a wireless communication facility, which was continued from the last
Board meeting on November 20th.
He explained that the New River Desert Hills Community Association originally provided
opposition to the existing 104 foot high cell tower due to a lack of a screen wall for the
ground equipment. He said the original 1995 zoning ordinance required a solid, six-foot
screen wall but it was not erected when the tower was built in 1997. He said this is an
issue for the tower owner and property owner to install a screen wall and is not an issue

for the applicant, Sprint. However, the Commission directed the applicant to coordinate
with those owners to install a screen wall around the base of this tower.
Supervisor Barney asked about the enforcement mechanism for the property owner to
come into compliance with the zoning ordinance after being out of compliance for nearly
20 years. He asked how to accommodate the applicant and at the same time resolve
the underlying violation.
Mr. Gerard said that the proposal in this agenda item is to remove existing antennae
and replace them with new, larger antennas to accommodate 4-G technology. The
approval of this SUP does not waive the requirement for the screen wall. He said the
issue is with the property owner and not with the applicant. He said staff would pursue
enforcement against the tower owner with regards to the wall that was never installed.
Chairman Kunasek asked if this is for a 20-year extension for Sprint to the original
special use permit and asked for the specifications of the original SUP.
Mr. Gerard said there actually had not been a proper special use permit issued for this
tower, although at the time a SUP was necessary for towers built on the slope of a hill.
He said the tower exists but it does not have the proper entitlement.
Supervisor Barney noted the importance of moving this item forward for the applicant.
He asked staff to work with the property owner to bring this site into compliance and to
also accommodate the applicant with problems he may encounter.

16. EXCEPTION OF THE VACATION CARRYOVER LIMIT
Approve the request for an exception of the vacation carryover limit as of December 31
2013 for the following individuals:
J. Blair Bradshaw - Accounting Manager - Maricopa County Treasurer's Office
Royce Flora - Chief Deputy - Maricopa County Treasurer’s Office
The request would allow not more than 80 hours in excess of the current accrued vacation
limits of 240 or 320 hours to be used by March 31, 2014. Any hours that are not used by
March 31 will transfer to the sick hours for each respective individual.
Reasons for exception:
Due to the current economic crisis, the State continued to hold back school district monies
that required constant monitoring of credit lines in May and June of 2013 so that credit
limits were not exceeded and to ensure that cash was available to meet payroll and
operational demands. Then, the unexpected loss of a critical employee during year end
and audit periods made extended vacation periods impossible. After 4 months of waiting,

the position has been filled, but training of the new employee is still an issue for the next
several months. (C-43-14-014-M-00)
Supervisor Chucri expressed some concern at a two-month vacation carryover into a
new year for any County employee. He noted this is typically not done in business and
he felt this should be set for discussion on a similar County policy going forward. He
said employees deserve vacation time and they should take it.
Supervisor Kunasek agreed saying vacations are there for a reason
Supervisor Hickman believed vacations can be looked at as a test for employees to
make sure they are capable of doing their jobs and also taking time off for a vacation,
which concept is typical in the business world.

GOODYEAR FOR THE EL RIO WATERCOURSE IMPLEMENTATION AND
MANAGEMENT PLAN
Approve Intergovernmental Agreement (IGA) FCD 2013A003 to identify and define the
responsibilities of the Flood Control District of Maricopa County (District), Maricopa County,
City of Avondale, Town of Buckeye and City of Goodyear for the cost sharing, planning,

(Plan). The District’s contribution to the development of the Plan is capped at $50,000.00.

The El Rio Watercourse Master Plan (WCMP) identified flood protection projects, economic

Gila River between the confluence with the Agua Fria River and SR 85. The El Rio WCMP
was completed and adopted by Avondale, Buckeye, Goodyear and Maricopa County in
2006.
In 2007, the El Rio Steering Committee, comprised of elected officials from each
jurisdiction, endorsed a work plan to implement the vision for the Gila River outlined in the
El Rio WCMP. The work plan included vegetation management projects, education
projects, creation of design guidelines and the identification of multi-use flood control
projects in each jurisdiction. Since 2007 two vegetation management projects have been
completed and an educational exhibit installed at the county’s Estrella Mountain Park.
This IGA is for consultant services to develop the El Rio Watercourse Implementation and
Management Plan. The Plan will include design guidelines and conceptual design plans for
multi-use flood control projects in each jurisdiction. Avondale, Buckeye, Goodyear and the
District will fund the Plan. The total funding obligation for each party will not exceed
$50,000. Maricopa County will not provide funding. All parties (including Maricopa County)
will participate in the plan development including sharing data, reviewing submittals from

This Agenda Item impacts Supervisorial Districts 4 and 5. (C-44-14-017-M-00)
Motion to approve by Supervisor Wilcox, seconded by Supervisor Hickman
Supervisor Wilcox said she and Supervisor Hickman have been working on this and
plan to hold a meeting with all involved entities in January. She said it is hoped to
develop the El Rio watercourse into a recreational and economic engine for the West
side.
Supervisor Hickman commented that this item had been important to Supervisor Max
Wilson (whom he replaced after Mr. Wilson’s retirement earlier this year) and so working
on it had “brought it home to him.” He said these rivers run diagonally through the
County trail system. He hopes this becomes a mirror for all communities to follow to
make sure these rivers create economic value for communities. He added that it is
important to also keep them from becoming “dumping grounds” in the communities.
Chairman Kunasek said that unfortunately that is how they have been used for 100
years and he said the West Valley has already implemented some master plans to
transform some more of them.

CHAPTER VIII OF THE MARICOPA COUNTY ENVIRONMENTAL HEALTH CODE
(MCEHC)
Pursuant to A.R.S. §A.R.S. § 11-251.13 and A.R.S. §36-184(B)(5), set a public hearing for
February 26, 2014 to solicit comments and consider the adoption of proposed revisions to
MCEHC Chapter VIII (EROP Case ES-2013-006/Confectionary Food Establishment). This
item will become effective immediately upon Board of Supervisors approval.
The Maricopa County Board of Health (BOH) reviewed and discussed proposed revisions
to MCEHC Chapter VIII (EROP Case ES-2013-006/Confectionary Food Establishment) at
a public meeting held at 3:00 p.m. on Monday, October 28, 2013, at the Board of
Supervisors Conference Room, 301 West Jefferson Avenue, 10th Floor, Phoenix, Arizona
85003.
The proposed revision to MCEHC Chapter VIII (EROP Case ES-2013-006/Confectionary
Food Establishment) creates a new permit and applicable plan review and annual permit
fees of $307.50 and $155.00, respectively. This proposed revision will allow citizens of
Maricopa County to prepare not potentially hazardous bakery and confectionary items for
direct consumer sales and for wholesaling to other Maricopa County permitted food service
establishments. The permit definition establishes these food items as an approved food
source for sale by other Maricopa County permitted food establishments. This proposal
lessens the burden of equipment/infrastructure requirements necessary to qualify for an
MCESD permit for an owner that may have begun as a home business and has outgrown
the home kitchen. (C-88-14-007-6-00)

Governments) meetings with regards to transportation issues in the Valley.
She asked how many crashes there have been since the installation of the
Light Rail through several cities in Maricopa County. She said some business
owners were objecting to an extension of the light rail at a recent City of
Phoenix policy meeting, but she, and many others, endorse it.
118. SUPERVISORS'/COUNTY MANAGER'S SUMMARY OF CURRENT EVENTS
Resumen de temas de actualidad de los Supervisores/Administrador del Condado
Supervisor Wilcox commented on the recent passing of Nelson Mandela, President of
South Africa, and the many changes that have taken place in South Africa because of
his efforts. She said his message to the world was to give up any thoughts of revenge
and on the importance of working together peacefully.
She said Maricopa County received honorable mention in Best of the West for
partnering with the Indian Nations and with the Gila River Indian Community (GRIC)
on transportation issues. She anticipates many more of these agreements because
they cut a lot of the red tape in many areas to make it easier for everyone.
Supervisor Wilcox noted that Michael Johnson and Tom Simplot are leaving the
Phoenix City Council and lauded their exemplary accomplishments in downtown
Phoenix.
She also noted the honor accorded to Maricopa County by Governing Magazine in
making pay-as-you-go for large capital projects such a success. The article mentioned
that Maricopa County is one of the only large urban counties that did not suspend its
capital improvement program during the recession and stated that it has paid off. She
said Maricopa County has been pay-as-you-go for building large facilities, such as the
courts, for 20 years and that many governments are looking at what is being done as
being conservative and very beneficial for a major area.

Supervisor Wilcox said she had attended services during the 100th anniversary of the
Basilica and noted there is still a lot of history left in downtown Phoenix.

meeting as being beneficial and critical to the success of the County. He also
commented on the three new board members, himself, Supervisor Barney and
Supervisor Hickman, and thanked Chairman Kunasek for having the “patience of Job”
in leading them throughout the year
Supervisor Barney said “ditto” believing he could not match Supervisor Chucri’s praise
of the Chairman’s leadership.
Supervisor Wilcox explained that having the three new members had made the
Chairman and her take a new look at some old things and said it had been a
pleasurable experience.
Supervisor Hickman commented on the Chairman’s “air force” and said an F-35 had
flown over his ranch and “buzzed” his chickens yesterday.

DRIVE TO DEL CAMBRE AVENUE
Adopt Resolution FCD 2013R005 for the Ashbrook Wash Improvements Project, Bayfield
Drive to Del Cambre Avenue (Project [#670]), approving a 100-year flood design
recurrence interval for the Project, and authorizing the Chief Engineer and General
Manager of the Flood Control District of Maricopa County (District) to negotiate Project
Intergovernmental Agreements; include Project funding in the District’s current and future
Five-Year Capital Improvement Programs; advertise, select, negotiate, and award
contracts for Project Engineering and Construction Services; and acquire Project rights-of-

The Fountain Hills Area Drainage Master Plan, completed in 1997, identified flooding
hazards in the Town of Fountain Hills and recommended solutions, including the Project, to
mitigate those hazards. Conceptual plans for the Project include the replacement of the
culvert crossings at Bayfield Drive and Saguaro Boulevard and channelization and
vegetation clearing in Ashbrook Wash. The Project’s estimated cost is $1,652,000 and
Project implementation is expected to occur over a 2 to 3 year period. The District

F-6. IGA FCD 2013A003 AMONGST THE FLOOD CONTROL DISTRICT OF MARICOPA
COUNTY, MARICOPA COUNTY, CITY OF AVONDALE, TOWN OF BUCKEYE AND
CITY OF GOODYEAR FOR THE EL RIO WATERCOURSE IMPLEMENTATION AND
MANAGEMENT PLAN
Approve Intergovernmental Agreement (IGA) FCD 2013A003 to identify and define the

analysis and preparation of the El Rio Watercourse Implementation and Management Plan
(Plan). The District’s contribution to the development of the Plan is capped at $50,000.00.
The Plan is anticipated to be completed by the end of Fiscal Year 2014.
The El Rio Watercourse Master Plan (WCMP) identified flood protection projects, economic
development opportunities, recreational amenities and environmental enhancements to the
Gila River between the confluence with the Agua Fria River and SR 85.
All parties (including Maricopa County)
will participate in the plan development including sharing data, reviewing submittals from
the consultant and attending stakeholder and public meetings.
