LICENSE No. P-50197 AMENDMENT No. 2 C-18-12-023-3-02 AMENDMENT No. 2 to LICENSE AGREEMENT BETWEEN MARICOPA COUNTY, LICENSOR/OWNER AND D.L. WITHERS CONSTRUCTION, L.C., LICENSEE RECITALS A. Maricopa County is successor in interest to Maricopa County Finance Corporation as OWNER in this Agreement. B. LICENSOR/OWNER and LICENSEE are parties to that certain license Agreement No. P-50197 (the “Agreement”) dated and approved January 13, 2012 by the Maricopa County Board of Supervisors and amended via Amendment No. 1 dated and approved November 6, 2013. The Agreement is for LICENSEE’s use of the southeast corner of 7th Avenue and Jefferson Street in Phoenix, AZ. C. The term of the Agreement expires February 28, 2014. D. LICENSOR/OWNER and LICENSEE now mutually desire to amend the Agreement to extend the license term. AGREEMENT NOW THEREFORE, in consideration of the foregoing and other valuable considerations, the PARTIES agree to amend the Agreement as follows: 1. The term of the Agreement is hereby extended two (2) months, commencing March 1, 2014 and expiring April 30, 2014. The Agreement is subject to termination pursuant to the provisions of A.R.S. 38-511. 2. The effective date of this Amendment No. 2 to the Agreement is the date of execution by the Maricopa County Board of Supervisors. 3. The foregoing paragraphs contain all the changes made by this Amendment No. 2. All other terms and conditions of the original agreement remain the same and in full force and effect.
