Administrative Conditions
All Administrative Terms and Conditions Remain in Full Force and Effect.
Programmatic Conditions
Programmatic term and condition P2 remains in full force and effect. Programmatic
term and condition number P1 is revised and Conditions P3 and P4 below have been
added as follows:
P1. This grant includes the performance of environmental measurements, therefore, a
QA Plan, a Sampling and Analysis Plan, or other comparable document covering QA
activities is required. A QA Plan for PM2.5 was previously approved by EPA and
Maricopa County Air Quality Department (MCAQD) on July 12, 2011. However,
comments were provided by the Quality Assurance Office on MCAQD’s Quality
Management Plan (QMP) on August 27, 2012 and a revised plan has not been
received. During FY14 the MCAQD will revise and resubmit its QMP for approval. The
QMP must be approved by the EPA Project Officer, the Region 9 Quality Assurance
Manager, and the recipient's Quality Assurance Officer. Measurement activities may
continue under the currently approved QA plan for PM2.5 until the new QMP is
approved. Contact the QA Office at 415-972-3411.
P3. EPA may terminate the assistance agreement for failure to make sufficient progress
so as to reasonably ensure completion of the project within the project period, including
any extensions. EPA will measure sufficient progress by examining the performance
required under the work plan in conjunction with the milestone schedule, the time
remaining for performance within the project period, and/or the availability of funds
necessary to complete the project.
P4. Consistent with local, state, and federal grant procurement rules, recipient shall,
when feasible, purchase environmentally preferable products/services and hold
conferences/meetings using environmentally preferable measures. Environmentally
preferable products/services and environmentally preferable measures include those
that have a lesser or reduced effect on the environment when compared with
competing products, services, or measures that serve the same purpose. This
comparison may consider raw material acquisition, production, manufacturing,
packaging, distribution, reuse, operation, maintenance, or disposal of the product or
service. In addition, environmentally preferable measures for conferences/meetings
apply to large gatherings of ten or more persons.
