By mutual agreement of the parties, the following contract change(s) are incorporated into the above-identified contract. All other contract terms and conditions
remain unchanged.
Change Order No. 7 shall modify Contract No. 2011-039 as follows: 1) Extend the Base Contract Period of Service; and 2) Increase the Base Contract Not-to-
Exceed Fee for factors beyond the contract scope.
Extend the Base Contract Period of Service 61-days and increase the not-to-exceed contract base fee $218,763,89 due to the Construction Contractor being
over six-months behind schedule. With this Change Order No. 7 and prior Change Order No's. 3 thru 6, the Base Contract Period of Service will have been
extended a total 01231-days due to the Construction Contractor schedule slippage. The Optional Task Allowance time extension of 120-days per previous
Change Order No. 3 is unaffected by Change Order No. 7. The Optional Task Allowance completion date shall be 120-days after the revised Base Contract
completion date of 11130113.
With this Change Order, the total amount of this contract has increased 39%.
By reason of this change 61 days extension of time will be allowed.
The contract completion date is: November 30, 2013 (Base Contract) March 30, 2014 (Optional Task Allowance)

Dear Mr. Erives:
Tristar Engineering and Management, Inc. (Tristar) is pleased to submit our request for
Contract Modification #7 for MCDOT Contract 2011-039, Northern Parkway: Sarival to Dysart
Phase 1. We appreciate the continued opportunity to provide construction administration
services to MCDOT.
As part of Modification #3,#4,#5 and #6, the contract was extended until September 30, 2013.
This date was based on the contractor's revised CPM schedule, which at that time identified a
completion date of September 18, 2013. Based on the contractor's actual schedule, their new
completion date has delayed to October 31, 2013. Tristar respectfully requests a time extension
for an additional 61 calendar days, taking the contract end date from September 30, 2013 to
November 30, 2013. Also, this request for contract modification includes the additional cost of
extending the contract two months to November 30, 2013. The following staff will be part of the
two month extension along with myself;
• Bob Webb (Tristar) 89 Structures - Part Time
• Robert Clifford (QT) -59 Roadway/Materials
• Steve Tischler (Tristar) -87 working on fence, striping, MVVD and punch list
• Dennis Torres (CEI) - 86 working on channel, structures, and. barrier
• Corey Clifford (QT) -54 materials runner and testing
In addition, Omayra Jose (PB) 87 will continue to be our office manager reviewing contractor's
payrolls and submittals. PB's budget was previously increased as part of Modification #3, and
no additional cost is needed as part of this modification.
I would like to point out that this request is based on the data compiled by the contractor and
the dates that result from the CPM schedule they have provided. Tristar concurs with the
activity relationships and logic presented as part of our review, but I have expressed my
concern to the contractor that their resource loading within the planned schedule regularly does
not match their day-to-day anticipated productivity. For this reason, there is still uncertainty if
the contractor will be substantially complete by October 31, 2013 as they have indicated.

Furthermore, Modification #3 added four months as part of an optional task allowance to be
used in the event the two outstanding claims and time extension request were not resolved by
the end of the contract time. Since then, one claim is still pending, one additional claim has
been brought up and any contractor time extension has not necessarily been resolved with
contractor concurrence. Tristar would like to request that the contract maintain those additional
four months of the optional time as it was originally provided within Modification #3. In this
case, the contract end date would become March 30, 2014.

Change Order requested to modify the Construction Administration Services contract as follows: 1) Extend the Base
Contract Period of Service; and 2) Increase the Base Contract Not-to-Exceed Fee for factors beyond the contract scope.

Extend the Base Contract Period of Service 61-days and increase the not-to-exceed contract base fee $218,763.89 due
to the Construction Contractor being over six-months behind schedule. With this Change Order No. 7 and prior Change
Order No's. 3 thru 6, the Base Contract Period of Service will have been extended a total of 231-days due to the
Construction Contractor schedule slippage. The Optional Task Allowance time extension of 120-days per previous
Change Order No. 3 is unaffected by Change Order No. 7. The Optional Task Allowance completion date shall be 120-
days after the revised Base Contract completion date of 11/30/13.
