ROAD ABANDONMENT AB-0395

A RESOLUTION OF THE BOARD OF SUPERVISORS OF MARICOPA COUNTY, ARIZONA,
DECLARING A PORTION OF A ROADWAY TO BE UNNECESSARY FOR PUBLIC PURPOSES AND
ABANDONING THAT ROADWAY.
RESOLUTION OF THE MARICOPA COUNTY BOARD OF SUPERVISORS ABANDONING AND
VACATING RIGHT OF WAY HELD IN FEE TITLE PURSUANT TO A.R.S. § 28-7215
WHEREAS, A.R.S. § 28-7215 authorizes a county board of supervisors to abandon and vacate a right-of-
way held in fee title; and
WHEREAS, Maricopa County holds right of way in fee title pursuant to a Plat of Subdivision from Melvin
A. and Berniece C. Green, recorded in the Office of the Maricopa County Recorder on March 6, 1967 in
instrument No. 1967-0416756 (“Plat Map”); and
WHEREAS, a legal description (Exhibit "A") and map (Exhibit "B") of the portion of right of way to be
abandoned and conveyed are attached; and
WHEREAS, the vacated right-of-way will be conveyed to Antonio Borquez, and Bianca Cano listed as the
GRANTEE on the attached quitclaim deeds; and
WHEREAS, the Director of the Maricopa County Department of Transportation has advised that said right
of way is not necessary to provide a public highway and is, therefore, no longer needed by the County;
and
WHEREAS, after abandonment no property will be left without a public or private legal access connecting
the land with an established public roadway, and
WHEREAS, the person taking the public roadway agrees to assume the costs of maintaining the public
roadway and the liability for the public roadway.
NOW, THEREFORE, be it Resolved by the Maricopa County Board of Supervisors that its Chair execute
this Resolution and Deeds evidencing the determination by the Board that the right of way is not
necessary to provide a public highway and is, therefore, no longer needed by the County, and that the
right of way referenced herein is hereby abandoned and vacated pursuant to A.R.S. § 28-7215; and it is
FURTHER RESOLVED that the Clerk of the Board record this Resolution in the Office of the Maricopa
County Recorder to provide public notice of the abandonment and vacation pursuant to A.R.S. § 28-7215;
and
BE IT FURTHER RESOLVED that this resolution does not abandon or extinguish existing utility
easements or the right a utility to access, operate and maintain a facility that existed before this
abandonment resolution, per A.R.S. §28-7210.
