MARKINGS
Approve the following five one-time additions to the Sheriff’s Office RICO fleet of vehicles
seized in HIDTA (High Intensity Drug Trafficking) operations: One 2005 Ford Mustang,
VIN: 1ZVFT80N555138751, with an estimated value of $7,500 to replace RICO vehicle 86;
one 2006 Nissan Altima, VIN: 1N4BL11D16N345238, with an estimated value of $4,000 to
replace RICO vehicle 113; one 2004 Nissan 350Z, VIN: JN1AZ36A84M252995, with an

These are one-time additions to fleet and will be retired at the end of their usefulness to the

The annual operating expenses are estimated to be $32,500 ($6,500 per vehicle). The
expenses will be paid from the RICO fund (212). (C-50-13-079-M-00)
Connie Wittig, resident, announced from the lectern that she opposed this item and
attributed the deaths of many innocent victims to Sheriff Arpaio’s abuse of power. Many
in the audience rose to display pink signs endorsing Ms. Wittig’s statement of
disapproval.
Chairman Kunasek asked Ms. Wittig if she had read the agenda item, understood that it
was to assign cars seized in high intensity drug trafficking operations to the Sheriff’s
fleet of vehicles, and if this is what she opposed. Ms. Wittig continued her criticism until
she had completed her prepared statement.
Chairman Kunasek recessed the meeting at 9:28 a.m. when the protest began and
Members left the auditorium. Protestors continued to stand and display their signs. After
the crowd dispersed, Members returned to the dais and Chairman Kunasek reconvened
the meeting at 9:32 a.m. He apologized to those who were in attendance on official
business of the County and for the public disruption and delay of the meeting.
The Chairman noted that as a matter of practice the Board has always allowed those
who submitted a speaker’s slip to speak on regular or routine agenda items believing
the public has the right to be heard. He asked the County Attorney if this is a
requirement for the Board or a courtesy the Board extends to the public.
Deputy County Attorney David Benton replied, “The statute says the public has the right
to attend a meeting and that’s where the language actually ends.” There is no statutory
right for people to speak on any regular agenda item at a public meeting and this is
usually subject to the prerogative of the Chairman.
The Chair also has the prerogative to control the speaker’s time and what is being
spoken about during that time. An open forum is usual and is on the Board’s agenda at
the end of the Formal Meeting for people to speak for a limited time and to raise issues
on anything they wish to say. During this public comment Board Members are restricted
from responding because the topics are usually not on the meeting agenda and any

response would violate the open meeting law.
Supervisor Barney agreed that it is important for the public to be heard and said the
Board currently and historically has allowed this. He believed speakers should be
respectful and communicate in a responsible, even if passionate, manner and in the
proper format. He stated that it is not fair to those who are attending on legitimate
business for a few to attempt to take over and disrupt a public meeting

The RICO fund (212) will support any initial repair and maintenance costs, estimated to be

21. TRADE IN OF OLD DESKS
Pursuant to Maricopa County Procurement Code MC1-803, D.3, Adult Probation requests
approval to trade in 120 metal desks that are twenty years old, have reached the end of
their useful life, and need to be replaced. Jerry’s Furniture (the awarded vendor) will allow
$20.00 per metal desk ($2,400.00) as a credit to be applied toward the cost of the
replacement desks.
The Judicial Branch of Arizona in Maricopa County has many items which the Maricopa
County Surplus Program has deemed to have no resale value and, therefore, can be
liquidated. These items include metal desks. Two alternatives to this proposal were
considered. A recycling company willing to take the old desks could be located or we could
hire a company to move these desks to the county landfill. The latter creates more landfill
waste and both of these alternatives present a coordination issue between the removal of
the old and delivery of the new. This could create down time for staff. To avoid these
problems, the Adult Probation Department of the Judicial Branch respectfully requests
approval to use these desks as a trade in towards the replacement purchase. (C-11-13-

27. WELLNESS PROGRAM REIMBURSEMENT CHANGE
Approve the increase in the amount reimbursed from $120 to $130 to eligible employees
and dependents who complete the wellness Waisting Away Program.
The Waisting Away Program provides an incentive for participation in a classroom-style
program, facilitated by Weight Watchers, and intended to increase the participant’s health
status awareness, facilitate weight loss, and promote healthier behaviors on an ongoing
basis. Active employees and their covered dependents, age 10 or older, who are enrolled
in a County-sponsored medical plan are eligible to participate in the Waisting Away
Program.
To receive the incentive, participants must attend 8 out of 10 Weight Watchers classes in a
10-week period, and must lose 10 pounds. The participant must provide a copy of their
paid receipt for the Weight Watchers Program, along with a copy of the Weight Watchers
booklet showing attendance dates and the participant’s recorded weight for each week. Up
until February 2013, the participant’s cost for the Weight Watchers Program was $120.
When a participant met the requirements in the paragraph above, he/she was reimbursed
the full cost of the Weight Watchers Program - $120. In February 2013, the Weight
Watchers organization increased their program fee to $130. As a result of this change,
approval is being sought from the Board of Supervisors to increase the amount that may be
reimbursed to participants who complete the Waisting Away Program from $120 to $130.
This change would be effective July 1, 2013. (C-39-13-034-2-00)

28. SHORT-TERM DISABILITY REFUND TO ALL POLICYHOLDERS FROM FY 2008 TO FY
2011
Approve the refund of $6,178,953 in excess contributions from the Short-Term Disability
Plan to all employees participating in the Plan for the Fiscal Years 2008 to 2011. Refunds
will be calculated on a pro rata basis based upon the total premiums paid. Approve timing
of payment to be made after July 1, 2013.
Short-Term Disability is entirely employee funded. Short-Term Disability Claims paid in FY
2008, 2009, 2010 and 2011 were substantially below budgeted expectations. This resulted
in Net Margin (“profit”) earned by the short-term disability plan as shown below:
Net Margin
FY 2008 1,830,018

Formal Meeting Minutes

FY 2009 1,959,820
FY 2010 1,549,142
FY 2011 839,960
FY 2012 196,668
Net margin by year caused the plan’s fund balance to increase significantly to the point
where it is far over reserved. The recommended reserve calculated by Mercer as of
6/30/2012 was $511,427 which means that the plan currently holds $8,096,314 in excess
reserves. This plan will bring reserve levels down to approximately $2,000,000. This level
is considered in line with fluctuating claims as required reserves are expected to rise with
the more generous provisions within the plan for changes made during the FY 2013 and
the FY 2014 plan design process.
Several alternate methods of lowering the excess reserves were considered. Based on
legal advice received it was decided that all policy holders, for the period of time from FY
2008 to FY 2011, should be treated equally in the refunding process. This equates to all
policyholders whether active employees or not would receive a refund based upon their pro
rata share of total premiums paid during that time period. (C-39-13-035-2-00)

(0000) to the Office of Contract Counsel (560) General Fund (100) Operating (0000). The
purpose of the transfer is to cover increased mandated case representation costs. Within
the appropriated budget for Non-Departmental, the amount to be transferred will be
deducted from Unreserved Contingency.

Legal Advocate (550), and Public Advocate (570) is insufficient to cover General Fund
expenditure deficits of the Legal Defender (540) and the Office of Contract Counsel (560).
The Office of the Public Defender projects full-year expenditures of $33,205,089 ($79,286
under budget). The Office of the Legal Advocate projects full-year expenditures of
$9,053,678 ($126,000 under budget). The Office of the Public Advocate projects full-year
expenditures of $6,533,913 ($286,181 under budget). The Office of the Legal Defender
projects full-year expenditures of $10,398,428 ($46,806 over budget). That overrun is the
result of mid-year position additions to the Office without an accompanying budget
increase. The Office of Contract Counsel projects full-year expenditures of approximately
$29M ($6.7M above its FY 2012-13 appropriation). The total anticipated FY 2012-13
overrun, after savings are reallocated from the departments with positive variances, is just
over $6.2 million. However, due to the delay in billing from contractors, and the normal
monthly variances, an additional $800,000 is requested to be set aside to help ensure full
funding is available. Contingency funding will only be utilized if required after financial
transfers.
Public Defense Service’s (PDS) combined projected FY 2012-13 year-end negative
expenditure variance of $6.2 million results from contract attorney expenditures in the
Office of Contract Counsel. Those expenditures are driven by increased costs for
mandated legal representation. The most significant forecasted negative variances for PDS
are: Non-Capital Felony ($3.1M), Capital Trial ($1.3M), Parental Representation ($1.6M),
and Juvenile Guardian Ad Litem ($1.2M). Savings from other activities are projected offset
a portion of the forecasted overrun. (C-56-13-011-M-00)

Operating (0000) for FY 2013 in the amount of $2,383,875 due to the increased revenue

repair activity. This will require offsetting revenue and expenditure adjustments to

constraining the expenditure of local revenues duly adopted by the Board pursuant to

A-1. RESOLUTION FOR MORATORIUM ON INCREASED REGULATORY BURDENS
Adopt the resolution that places a moratorium on all new county government regulations.
(C-44-13-104-M-00)
Spencer Kamps, representing the Homebuilders Association of Central Arizona, said
the Association supports this resolution for a moratorium. He said that regulations are
good as long as they create a level playing field. The association likes the caveats in the
resolution related to federal law. The County will now be able to better scrutinize the
submissions from departments on the level of need.
Supervisor Barney commented on a recent meeting he attended on the Enhanced
Regulatory Outreach Program and building code updates. He explained that there is
now a process in place that will invite those in the regulatory community to more
efficiently engage in the process.
Mr. Kamps believed there are plenty of opportunities for the business community to get
involved in and said he looked forward to working with the Board on the regulatory
reform process.
Supervisor Hickman read from the Moratorium, and said that businesses that are
already here and those that want to locate in the Valley look for such signs of stability
from the Board and that the Board supports job growth and not just more regulations.
Motion to approve by Supervisor Chucri, seconded by Supervisor Barney

Kim Baker, resident, said he discovered this board in the year 2000 when it established
the Department of Legal Advocacy and related that the Department now represents him
in his appeal. He said he has asked, unsuccessfully, to meet with Board Members and
hopes the representation from Legal Advocacy will remove any conflict of interest and
these meetings can now take place.
Trish Manes, No Kill Maricopa County, said that no-kill shelters continue to grow across
the country and advocated for Maricopa County Animal Care and Control (MCACC) to
also become a no-kill facility. She presented a No Kill brochure to each Supervisor.
Claudia Bloom, resident of Mesa, visited the MCACC shelter in Mesa in 2008 and found
conditions to be unacceptable. She contacted her Supervisor about conditions at this
shelter. She recently visited the shelter again and said there has been no change or
improvement. She provided statistics of the MCACC killing of animals and said she
wants the County to adopt the No Kill Model.
Gwendolyn Lee Helmsted, representative of No Kill Maricopa County, spoke on the high
ratio of animals killed at the Maricopa County Animal Care and Control facility. She has
volunteered in the MCACC program but was ineffective in reducing the number of
animals killed. She said that the spay/neuter program has not affected intake at the
shelter and it alone has not created a single no-kill community. She wants the shelter to
reflect her No-Kill values.

document No. 86-022992; and b) the termination of the August 10, 1987,
intergovernmental agreement between the City and the County regarding the development,
construction, operation and maintenance of a recreation area on County-owned property
identified as APN 500-26-003 (the “Coldwater Park site”).
The City has ceased to operate and maintain the Coldwater Park site as a functioning
recreational facility. The City is in the process of decommissioning the subject park. IGA

2013A002 establishes the City’s operational/financial responsibility to safely remove and
dispose of obsolete improvements from the subject property. In addition, IGA 2013A002
acknowledges the District has no interest in the Coldwater Park site and no responsibility
associated with the 1986 intergovernmental agreement among the parties. The companion
agenda item for consideration by the Board of Supervisors of Maricopa County is identified
as C-18-13-036-3-00. (C-69-13-053-3-00)
