Board Action - SETTING OF HEARINGS
1. ES-2013-001- PROPOSED REVISIONS TO CHAPTER VIII OF THE MARICOPA
COUNTY ENVIRONMENTAL HEALTH CODE (MCEHC)
Pursuant to A.R.S. §36-184.B.5, 11-251.05, 11-251.08, and 11-251.13 set a public
hearing for September 25, 2013 to solicit comments and consider the adoption of
proposed revisions to Maricopa County Environmental Health Code (MCEHC) Chapter
VIII. Upon Board approval, this item will become effective September 25, 2013.
The Maricopa County Board of Health reviewed and discussed proposed revisions to
MCEHC Chapter VIII at public meetings held at 3:00pm on Monday, April 22, 2013 and
3:00pm on Monday, July 22, 2013 at the Board of Supervisors Conference Room, 301
West Jefferson Avenue, 10th Floor, Phoenix, Arizona 85003.
To align with Chairman Kunasek’s vision of “adaptive reuse”, the Department proposes
changes to MCEHC Chapter VIII to create a new food service permit that may
accommodate food service establishment design concepts not specifically allowed for by
MCEHC regulations. The new permit type, Trial Review Establishment Permit, will allow a
prospective restaurant owner the option to submit their drawings and management plan
addressing any food safety and sanitation hazards not in line with regulations as a result
of the establishment’s unique or novel design/layout and will be six months in duration.
The Trial Review Establishment plan review fees are the same as the Chapter I Fee
Schedule “Environmental Health Plan Review” fees for categories “All Other Food

John Kolman, Environmental Health Services, explained the proposed change to the
County’s Environmental Health Code that would allow prospective restaurant owners to
submit drawings outlining equipment and space configurations that deviate from the
Code regulations. An example could be an establishment’s unique or novel design
and/or layout as an adaptive re-use of a building. The change would be provisional and
reviewed for its success in six months. After a satisfactory review the temporary permit
would roll into a regular permit.
Mr. Kolman said the change could allow owners to choose alternative methods or
designs and still meet health safety concerns.
Supervisor Chucri said the department has been working on this change for a long time
and it would help restaurant owners regarding capital costs. If a problem should arise
