Change Order No. 6 shall modify Contract No. 2011-039 in two parts: 1) Extend the Base Contract Period of Service and increase the Base Contract Not-to-
Exceed Fee for factors beyond the contract scope; 2) An additional Optional Task Allowance for Overtime, to be used if pit

Base Contract Terms: Extend the Base Contract Period of Service 29-days and increase the not-to-exceed contract base fee $ e to the
Construction Contractor being five-months behind schedule. With this Change Order No. 6 and prior Change Order No's. 3, 4, & 5, the Base Contract Period of
Service will have been extended a total of 170-days due to the Construction Contractor schedule slippage. The Optional Task Allowance time extension of 120-
days per previous Change Order No. 3 is unaffected by Change Order No. 6. The Optional Task Allowance completion date shall be 120-days after the revised
Base Contract completion date of 9/30/13.
Optional Task Allowance: Optional Task Allowance in the not-to-exceed amount of $10,960.68 for Overtime. Per Section Ill of the contract, all overtime work
requires written pre-approval and compensation will be at the rates in Table D, Overtime Rate Designation, of the contract.
With this Change Order, the total amount of this contract has increased 33%.
By reason of this change 29 days extension of time will be allowed.
The contract completion date is:_ September 30, 2013 (Base Contract) January 28, 2014 (Optional Task Allowance).

Dear Mr. Kattan:
Tristar Engineering and Management, Inc. (Tristar) is pleased to submit our request for
Contract Modification #6 for MCDOT Contract 2011-039, Northern Parkway: Sarival to Dysart
Phase 1. We appreciate the continued opportunity to provide construction administration
services to MCDOT.
As part of Modification #3,#4 and #5, the contract was extended until September 1, 2013. This
date was based on the contractor's revised CPM schedule, which at that time identified a
completion date of August 27, 2013. Based on the contractor’s actual schedule, their new
completion date has delayed to mid-September, 2013. Tristar respectfully requests a time
extension for an additional 29 calendar days, taking the contract end date from September 1,
2013 to September 30, 2013. Also, this request for contract modification includes the additional
cost of extending the contract one month to September 30, 2013.
I would like to point out that this request is based on the data compiled by the contractor and
the dates that result from the CPM schedule they have provided. Tristar concurs with the
activity relationships and logic presented as part of our review, but I have expressed my
concern to the contractor that their resource loading within the planned schedule regularly does
not match their day-to-day anticipated productivity. For this reason, there is still uncertainty if
the contractor will be substantially complete by mid-September, 2013 as they have indicated.
Furthermore, Modification #3 added four months as part of an optional task allowance to be
used in the event the two outstanding claims and time extension request were not resolved by
the end of the contract time. Since then, one claim is still pending and any contractor time
extension has not necessarily been resolved with contractor concurrence. Tristar would like to
request that the contract maintain those additional four months of the optional time as it was
originally provided within Modification #3. In this case, the contract end date would become
January 29, 2014.

fee $162,001.27 due to the Construction Contractor being five-months behind schedule. With this Change Order No. 6
and prior Change Order No’s. 3, 4 & 5, the Base Contract Period of Service will have been extended a total of 170-days
due to the Construction Contractor schedule slippage. The Optional Task Allowance time extension of 120-days per
previous Change Order No. 3 is unaffected by Change Order No. 6. The Optional Task Allowance completion date shall
be 120-days after the revised Base Contract completion date of 9/30/13.
Optional Task Allowance: Optional Task Allowance in the not-to-exceed amount of $10,960.68 for Overtime. Per
Section III of the contract, all overtime work requires written pre-approval and compensation will be at the rates in
Table D, Overtime Rate Designation, of the contract.
Tristar’s Contract Modification Request letter dated 8/2/13 is attached.
Note to MCDOT Contracts Branch: This Change Order requires Board of Supervisors approval and it is requested that
the Change Order include the language necessary to reset the Contract Modification Authority.
