its subconsultants and their key employees, to be used on this Project prior to beginning the work
under this contract. Any subsequent changes are subject to the written approval of the COUNTY.
B. The CONSULTANT shall perform, with its own firm, work amounting to fifty percent (50%) or more of
the total amount of the contract value. Any deviation may be approved, in writing, at the discretion of
the Agent.
C. The failure of either party to enforce any of the provisions of this contract or to require performance of
the other party of any of the provisions hereof shall not be construed to be a waiver of such provisions,
nor shall it affect the validity of this contract or any part thereof, or the right of either party to thereafter
enforce each and every provision.
D. The CONSULTANT shall be responsible for the cost of any additional design, field layout, testing,
construction and supervision necessary to correct those errors or omissions attributable to the
CONSULTANT, and for any damage incurred by the COUNTY as a result of additional construction
costs caused by such consultant errors or omissions.
E. The fact that the COUNTY has accepted or approved the CONSULTANT's work shall in no way relieve
the CONSULTANT's responsibility.
F. It is mutually understood and agreed that this contract shall be governed by the laws of the State of
Arizona, both as to interpretation and performance. Any action at law, suit in equity, or judicial
proceeding for the enforcement of this contract, or any provision thereof, shall be instituted only in the

the COUNTY.
H. The CONSULTANT agrees that it, its principals, employees, sub-consultants, agents and assigns,
shall not accept employment as consultants, expert witnesses or otherwise in any pending or
contemplated litigation against the COUNTY during the term of this contract and any extensions thereof

jurisdiction an injunction to restrain a violation or alleged violation by the CONSULTANT, its principals,
employees, sub-consultants, agents or assigns, of the provisions of G., H., and I. of this section or of
the provisions of B. of Section IX, and the right of action for full damages at law, in addition to any other
remedies provided by this contract. In no case shall a waiver by the COUNTY of the right to seek relief
under this provision constitute a waiver of any other or further violation.

of the project and comply with the Maricopa County Stormwater Quality Management and Discharge
Control Regulation, the Maricopa County Drainage Policies and Standards, and the Maricopa County

purchased from a company or companies, which are authorized to do business in the State of Arizona,
provided that said insurance companies meet the approval of COUNTY. The form of any insurance policies

Study Overview
The Maricopa Association of Governments (MAG) prepared the Interstate 10/Hassayampa Valley
Roadway Framework Study (Hassayampa Framework Study) that identified a comprehensive
roadway network to meet traffic demands for the build out of the area west of the White Tank
Mountains. This long range regional transportation study identified the need for a roadway network
consisting of freeways, parkways, and major arterial roads and introduced the Arizona Parkway.
The Arizona Parkway, by design, is an enhanced arterial roadway (with a 200 foot right of way)
which utilizes a distinct intersection treatment prohibiting left turns at major cross-street
intersections. This design improves the functionality of the parkway allowing traffic to flow more
freely than a typical urban arterial roadway. The improved functionality increases capacity while
maintaining local access and a posted speed of 45 mph. Southern Parkway is one of the parkways
recommended in the Hassayampa Framework Study.
The purpose and need for this parkway was confirmed during the MAO study process. Thus, the
primary focus of this study is right-of-way preservation by identifying opportunities and constraints
(fatal flaws) within the study area.
The scope of work for the study includes the tasks necessary to prepare a parkway feasibility report
for Southern Parkway (Salome Highway to State Route 85) that will provide Maricopa County
Department of Transportation (MCDOT), Town of Buckeye (Buckeye), area property owners,
developers, and other stakeholders with a planning tool for future growth and development that
preserves the 200-foot right-of-way required for the Arizona Parkway design. This will require
significant coordination with various governing bodies, other public agencies, development interests,
and the general public.
Study Area
The study area is approximately 11 miles long, stretching from one-half mile west of Salome
Highway to one-half mile east of SR85, and two miles wide centered on the Southern Road
aligtunent.
Study Purpose
The primary objectives of the Parkway Feasibility Study are to: (1) clearly define and assess the
study area for strategic issues identification; (2) develop and evaluate candidate alignments within
the study area; (3) recommend a preferred alignment; and (4) subsequently define the characteristics
of the preferred alignment in greater detail. This study is the first step in the development process
and is meant to aid the governing bodies in protecting a continuous parkway right-of-way corridor in
this area.
Study Management
The study will be managed by MCDOT, Transportation Planning Division. The Consultant will
perform the technical analyses as described in this scope of work. All work herein shall be
completed within 365 calendar days after notice to proceed has been issued.
3
Coordination with Technical Advisory Committee
A Technical Advisory Committee (TAC) will be established to guide all aspects of the study. TAC
members will be selected by their respective agencies and will apply planning and engineering
expertise to the study. The TAC will meet with the MCDOT Project Manager and Consultant, as
noted in the description of the following tasks, to participate in the scoping of the study, review
study documents, and provide relevant input. TAC members will also serve as an important
resource for data collection and in identifying additional stakeholders within their organizations or
jurisdictions. A preliminary list of stakeholders and potential TAC members is included in Section
4.1.

development of a conceptual alignments graphic). As part of this planning process the
Consultant will work closely with staff and development interests in the affected jurisdictions,
both individually and collectively, to form a broad consensus of existing and future conditions.
The Consultant and MCDOT will conduct a public open house (in this phase) at a convenient
location in the study area to present and introduce the study purpose and goals and obtain public
input on existing and future study area features.
