RE: Fountain Hills Sanitary District Board of Directors Election — Cancellation of Election
Dear Lori:
Per our conversation, the Fountain Hills Sanitary District Board of Directors held a special meeting
on August 15, 2013 in which they passed Resolution No. 257 calling for the cancellation of the
November 5, 2013 election pursuant to A.R.S. §48-2010(A). I have enclosed a copy of this
resolution requesting cancellation and also the August 15, 2013 Board meeting minutes indicating
that the Board unanimously voted to cancel the election with a vote of 4 to 0.
There are two seats up for election and only two persons filed petitions for the two openings.
Therefore, we are requesting that this item be put on your September Agenda for cancellation of the
Fountain Hills Sanitary District Board of Directors election and appoint the following two people as
Directors for a term of four years (January 1, 2014 through December 31, 2017.

A RESOLUTION OF THE
FOUNTAIN HILLS SANITARY DISTRICT,
BOARD OF DIRECTORS
REQUESTING THE MARICOPA COUNTY BOARD OF SUPERVISORS
CANCEL THE NOVEMBER 5, 2013 ELECTION
WHEREAS, A.R.S. Section 48-2010(A) allows the Maricopa County Board of
Supervisors to cancel an election in the event only one person or no person files a
nominating petition for each opening on the Board of Directors and to appoint those
who have filed nominating petitions;
WHEREAS, the purpose of A.R.S. Section 48-2010(A) is to avoid incurring the
expense associated with holding an election where only one or no candidate has filed a
nominating petition for each opening on the Board of Directors;
WHEREAS, as of the date of this Resolution, the deadline for submitting
nominating petitions has passed and only Thomas M. Reski and Glenn A. Panaro have
filed nominating petitions to have their names placed on the ballot for the two Board of
Director positions to be filled at the November 5, 2013 election; and
WHEREAS, the deadline for filing nomination petitions as a write-in candidate
for the November 5, 2013 election is August 21, 2013;
WHEREAS, the Board of Directors has determined that unless one additional
write-in candidate qualifies for the ballot it is in the best interest of the District and the
District landowners to avoid the expense of an unnecessary election
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE FOUNTAIN HILLS SANITARY DISTRICT, that the Maricopa County Board of
Supervisors be hereby requested to cancel said election and appoint the persons timely
filing nominating petitions to fill the office of Director, unless more than two candidates
have qualified to be placed on the ballot for the two Director positions to be filled at the
November 5, 2013 election no later than August 21, 2013.
BE IT FURTHER RESOLVED, that District Staff take all necessary and
appropriate steps to secure the 'cancellation of said election, including preparing and
filing documents with the Maricopa County Board of Supervisors for that purpose.

Sanitary District on the 15th day of August 2013.

FOUNTAIN HILLS SANITARY DISTRICT
The Board of Directors of the Fountain Hills Sanitary District met in a Special Meeting
on Thursday, August 15,2013 at 9:30 a.m. in the District's Board Room located at 16941 E.
Pepperwood Circle, Fountain Hills, Arizona 85268 at which one or more of the Directors
participated telephonically.
Agenda Item No 1
Call to order and roll call.
Upon roll call the following Directors were present:
Chairman Robert Thomson, Vice-Chairman Tom Reski, Director Thom Besett, and
Director Bruce Hansen. Director Glenn Panaro was absent,
Also present were Ron Huber, District Manager and Penny Cook, Assistant Secretary.

Discussion and consideration to approve Resolution No. 257 requesting cancellation of the
November 5, 2013 District Election.
District Manager informed the Board that only two persons filed petitions for the two
positions open for the Board of Directors. Statutes allow the Board of Supervisors to cancel
the election if the number of candidates is less than or equal to the number of seats up for
election. District Manager is requesting approval of Resolution No. 257 which would be
contingent on no write in candidates by August 21,2013 and will allow the District to ask the
Board of Supervisors to cancel the election.
Director Hansen moved to approve Resolution No. 257 requesting cancellation of the
November 5, 2013 District election. Vice Chairman Reski seconded the motion which passed
unanimously.

Director Hansen moved to adjourn the meeting. Vice Chairman Reski seconded the
motion which passed unanimously and the meeting was adjourned at 9:34 p.m.
