APPLY AND ACCEPT GRANT FUNDS FROM EDWARD J. BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT/ DRUG ENFORCEMENT ACCOUNT Approve the application and acceptance of grant funds from the Edward J. Byrne Memorial Justice Assistance Grant/ Drug Enforcement Account (DEA) in an amount not-to-exceed $443,925 for the Office of the Public Defender (520) portion. The original requested budget amount for this grant was $445,651 through the normal annual budget process. However, this amount has been decreased due to communications with the Arizona Supreme Court/Administrative Office of the Courts (AOC) with regards to FY2011-12 funding availability. This grant is a recurring grant administered by AOC. The Office of the Public Defender applies for this grant jointly with Adult Probation, Clerk of the Superior Court, and Superior Court. These funds support the justice system by providing staff in all of these departments. In FY 2010-11, this grant funds 25 full-time equivalent positions countywide. The Office of the Public Defender is requesting authorization to again apply for the DEA Grant for FY2011-12. The grant award begins on July 1, 2011 and ends on June 30, 2012. However, the application for funding has historically been received after the start of the applicable fiscal year and with extraordinarily short turnaround time requirements. Therefore, the Office of the Public Defender is requesting advance approval to apply for the departmental share of these funds through a joint application with the Superior Court, Clerk of the Superior Court, and Formal Meeting Minutes Wednesday, May 25, 2011 Page 10 of 40 Adult Probation. The grant does not allow for the recovery of indirect costs in FY 2010-11, and no change is anticipated in future years. Therefore, the Office of the Public Defender and Maricopa County may receive no administrative cost recovery for this grant in FY 2011-12. The Maricopa County Department of Finance has calculated the Office of the Public Defender's composite indirect cost rate at 6.5%. The non-recoverable indirect cost will not exceed $28,856. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditures of these revenues are not prohibited by the budget law. The property owners and their successors waive claim for diminution in value if the County takes action to rescind approval due to noncompliance with stipulations. (C-44-11-095-7-00) Darren Gerard reported on the past history of this case. The Planning Commission and staff recommend approval with stipulations “a” through “v”. Mr. Gerard updated the Board on a revision to stipulation “e”, stating that prior to zoning clearance, the applicant shall submit evidence of acceptance from the City of Surprise regarding the landscaping and sidewalk concerns along Bell Road. In response to Chairman Kunasek’s questions, Mr. Gerard explained that the City of Surprise must give their approval of the landscaping as they have jurisdiction over that area of right-of-way. Nick Wood, Snell & Wilmer, and representative for the applicant, advised the Board that the applicant agreed to the stipulation with the Planning Commission. He stated the applicant supports the Planning Commission’s stipulations and advised if there were any additional complications, they would bring the matter to the Board. The applicant wants to stay in Maricopa County. Supervisor Wilson stated his support to move forward. Motion to concur with the recommendation of the Planning Commission for approval by Supervisor Wilson, seconded by Supervisor Brock Ayes: Kunasek, Brock, Stapley, Wilson, Wilcox Note: Planning & Zoning item 2 was taken out of order and heard before agenda item 7. 2.
