AIRFIELD #1 NOISE CONTOURS AND ACCIDENT POTENTIAL ZONES .................................................................................... 153 APPENDIX K – GILA BEND AUXILIARY FIELD NOISE CONTOURS AND ACCIDENT POTENTIAL ZONES ................................................................ 154 On page 23 of the Maricopa County Comprehensive Plan, the following shall read: Military Compatible The Military Compatible designation includes areas located within the state- statute defined High Noise or Accident Potential Zone of Luke Air Force Base, the Auxiliary Airfield #1 near Surprise, and the auxiliary airfield near Gila Bend. State statute defines this area as being within the noise contours that surround these facilities and the accident potential zones that extend off the ends of their runways. The purpose of this designation is to ensure that future development is compatible with the high noise or accident potential generated by these military facilities that may have an adverse effect on public health and safety. This 1 designation is established in compliance with Arizona Revised Statutes §28-8461 and §28-8481 and only those uses found by the Arizona Legislature to be compatible and consistent with the high noise or accident potential generated by these facilities are allowed. Other uses may also be permitted upon mutual consent of Luke Air Force Base and Maricopa County. The compatible and consistent uses are identified in Chapter 10, Section 1010 of the Maricopa County Zoning Ordinance. On page 29 of the Maricopa County Comprehensive Plan, the following shall read: Policy L4.3 Encourage development patterns and standards compatible with the continuing operation of military airports and ancillary military facilities pursuant to Arizona Revised Statute §28- 8461 and §28-8481, civilian airports, and other major noise generating employment centers within unincorporated county areas. On page 59 of the Maricopa County Comprehensive Plan, the following shall read: NOISE ABATEMENT While state laws protecting Luke Air Force Base have existed for some time, in 2004 the Arizona Legislature enacted additional laws that provide enhanced protections for Luke Air Force Base, added ancillary military facilities to the list of protected installations, and required that local governments adopt land use plans and zoning for property in the high noise or accident potential zone of ancillary military facilities. For Maricopa County, ancillary military facilities include the Auxiliary Airfield #1 in Surprise and the auxiliary airfield south of Gila Bend. The purpose of this requirement is to ensure that future development is compatible with the high noise or accident potential generated by these facilities’ operations. While these requirements apply to Maricopa County, pursuant to Arizona Revised Statute §28-8481A the political subdivisions of Surprise, Glendale, El Mirage, 2 Goodyear, Youngtown, Buckeye, and Gila Bend are also required to adopt general plans and zoning regulations to assure development compatible with the high noise and accident potential generated by military airport and ancillary military facility operations that have or may have an adverse effect on public health and safety. Arizona Revised Statutes §28-8461 and §28-8481 identify specific uses that are deemed compatible with the high noise or accident potential of these facilities. Other uses may also be permitted upon mutual consent of Luke Air Force Base and Maricopa County. The consistent and compatible uses are identified in Chapter 10, Section 1010 of the Maricopa County Zoning Ordinance and are applicable to Luke Air Force Base, Auxiliary Airfield #1, and the auxiliary airfield south of Gila Bend. On page 72 of the Maricopa County Comprehensive Plan, the following shall read: Policy EE5.5 Support compliance with Arizona Revised Statute §28-8461 and §28-8481 relating to land use compatibility and consistency with the high noise or accident potential generated by military airport and ancillary military facility operations. On page 88 of the Maricopa County Comprehensive Plan, the following shall read: Airports Given their potential noise and safety hazards, airports can impact the type of development that is appropriate in certain areas of the county. In particular, the type of airport plays a significant role in determining the impact it has on surrounding areas, as well as the suitability of specific uses. Maricopa County contains a variety of airports, ranging from Sky Harbor International Airport to smaller general aviation airports located throughout the 3 Phoenix metropolitan area. Of the existing airports, Luke Air Force Base and Williams Airport are of particular importance because of their potential impact on unincorporated areas. While both airports create certain noise and safety issues, they also have an important economic impact on Maricopa County and the entire state. As such, compatible land use planning around these airports is an important consideration and is required by Arizona Revised Statute §28-8461 and §28-8481 for the high noise or accident potential zone around Luke Air Force Base, Auxiliary Airfield #1, and the auxiliary field near the town of Gila Bend. 4 On page 150 of the Maricopa County Comprehensive Plan, the following shall read: APPENDIX G–LAND USE CATEGORIES The regional standardization of land use designations is crucial to the efficient coordination of the Comprehensive Plan with municipal general plans. The following land use categories (Table 5-Land Use Categories) will be applied throughout the next steps of the comprehensive planning process, including updates to the existing area land use plans and the development of new area plans. These categories are based on the regional land use categories developed in 1995, with the intention of unifying land use designations throughout the region.
