Report to the Planning and Zoning Commission
Prepared by the Maricopa County Planning and Development Department
Case: Z2007119 - Horizon Landscape
Meeting Date: September 4, 2008
Agenda Item/s: 1
Supervisor District/s: 1
Applicant: Jason Chouinard, Chouinard Design Studio
Owner: Mitch Holloway, Horizon Landscape
Request: Precise Plan of Development in the IND-2 zoning district
Site Location: West of the Southwest corner of Curry Road and Miller
Road (in the north Tempe Area)
Site Size: Approx. 0.881 ac.
Density: N/A
County Island Status: Class 1 (City of Tempe)
County Plan: The Maricopa County "Eye of the Future 2020"
Comprehensive Plan identified this site as being within the
General Plan Development Area (GPDA) of the City of
Tempe. However, the existing IND-2 zoning has been in
place in the neighborhood and the neighborhood is
characterized by an eclectic mix of uses including
predominantly industrial.
Municipal Plan: The City of Tempe General Plan identifies the region as
Mixed Use (MU). The category is defined as areas for
residential and commercial development, with
opportunities to live work and recreate within the area.
Industrial uses are considered employment, but not
consistent with the City's land use plan. Industrial uses are
not identified within the land use category of the City's
plan.
Agenda Item: 1 - case # Z2007119
Support/Opposition: None Known
Recommendation/s: Approve with stipulations
Project Summary:
1. The new Precise Plan of Development encompasses a proposed prefabricated
metal landscape storage building with a rolled metal roof, and parking and
landscaping improvements. As described in the Horizon Landscape narrative
report, the site will be used to store landscape maintenance materials and
equipment in the new building. Daily operations consist of twelve (12)
employees storing their personal vehicles in the designated parking spaces and
driving twelve (12) landscape pick-up trucks to job sites. There are no office
employees, nor signage for the business.
Public Participation Summary:
2. There is no Public Participation Plan required for a Plan of Development case
with existing zoning entitlement.
Background:
3. June 301 1986: The BOS approved case Z 5-121, a request for an Industrial
Unit Plan of Development (IUPD) in the IND-2 zoning district subject to
stipulations.
4. September, 2007: Application received for the subject Precise Plan of
Development (POD) case, Z2007119.
Existing On-Site and Adjacent Zoning and Land Use:
5. On-site: IND-2 (Z85-121) — Industrial
North: Arterial (Curry Road), then R-2 (City of Tempe) —
Residential
East: IND-2 — Industrial
South: IND-2 PD (Z87-20) -- Industrial
West: IND-2 -- Industrial

Utilities and Services:
6. Water: City of Tempe
Wastewater: Septic
School District/s: Rural Metro Fire Department
Fire: Maricopa County Sheriff's Office (MCSO)
Outstanding Concerns from Reviewing Agencies:
7. None
Staff Analysis:
8. The request for a precise POD will be situated on 0.881 ac in the IND-2 IUPD
zoning district. The zoning district classification allows light industrial uses.
The applicant is requesting a new Plan of Development which does not
Agenda Item: 1 - case # Z2007119
deviate from any of the zoning standards of the IND-2 zoning district. The
IUPD entitlement was granted under the previous Plan of Development (Z 85-
121). The IUPD is no longer applicable and staff recommends it be removed
from the site. Staff feels the proposal would be better suited under an IND-2
classification due to no zoning standard variations. Horizon Landscape is
located within a Class 1 county island on a contiguous border of the City of
Tempe. The City of Tempe's Development Services Department addressed
concerns over fencing, lighting, landscaping and address number visibility.
The applicant incorporated Tempe's recommendations into their project.
The applicant's proposal will improve the aesthetic character of the property.
Paved parking, landscaping, accompanying lighting, CMU block walls, and
wrought iron gating are proposed. This replaces unpaved parking, chain-link
fencing and gating, and a lack of landscaping. Proper detail has been placed
on landscape selections and locations to ensure matured vegetation will be
manageable in the future. No signage will be posted on the site, and there
will be no office employees.
Recommendation:
9. Staff recommends the Commission motion for approval of case Z2007119
with stipulations "a" — "g" for the following reasons:
• The proposed changes under this Precise Plan represent an improvement
to the site, and comply with the IND-2 zoning district's development
standards and use regulations.
• Reviewing agencies have no objections.
Subject to the following stipulations:
a. Development of the site shall comply with the site plan entitled,
"Horizon Landscape — New Facility New Plan of Development — Case
#Z2007119 Lot 12 of Fruitland Farms", consisting of nine (9) full-size
sheets, dated revised June 20, 2008, and stamped revised June 24,
2008.
b. Development of the site shall be in conformance with the narrative report
entitled, "Horizon Landscape Plan of Development Submittal", consisting
of four (4) pages, dated revised March 19, 2008, and stamped received
March 21, 2008, except as modified by the following stipulations.
c. All outdoor lighting shall conform with the Maricopa County Zoning
Ordinance.
Agenda Item: 1 - case # Z2007119
d. Prior to zoning clearance, developer(s) and/or builder(s) shall establish
emergency fire protection services, covering all real property contained
within the project area during course of construction and shall obtain a
'will serve' letter substantiating coverage from the appropriate Fire
Department servicing the site.
e. Major changes to the site plan and narrative report shall be processed as
a revised application, with approval by the Board of Supervisors upon
recommendation of the Planning and Zoning Commission. Minor changes
may be administratively approved by the Planning and Development
Department.
f. Noncompliance with the conditions of approval will be treated as a
violation in accordance with the Maricopa County Zoning Ordinance.
Further, noncompliance of the conditions of approval may be grounds for
the Planning and Zoning Commission to take action in accordance with
Chapter 3 (Conditional Zoning).
g. Property owner and his successors waive claim for diminution in value if
the County takes action to rescind approval due to noncompliance with
stipulations.

E. Community Benefit
The proposed development will have significant benefit to the
community. As stated above, the majority of the surrounding
properties are run down and not well kept. Also, the subject site is
currently undeveloped. By construction this new building, the site
will be improved with on-site parking, it will provide a place for
indoor storage and any outdoor storage of small landscape
materials will be screened from Curry Road by the new building.
The site will also be landscaped along Curry Road, which will be
an improvement over almost all properties along this stretch of
Curry Road. In addition, all of the business operations take place
off-site, which minimizes traffic and noise impact to the
surrounding area.
F. Recent Area Changes Support
The surrounding area has not seen major changes to invalidate this
request. The majority of the properties contain older buildings.
Further to the south along Tempe Town Lake, there have been
major residential and retail developments which support
developing this site from its current undeveloped state. This
building and site will be one of the most aesthetically pleasing sites
along this stretch with the new building, screening and
landscaping along Curry Road.
G. Location and Accessibility
Per the vicinity map above, the site is located east of Scottsdale
Road on the south side of Curry Road. It has direct access to Curry
Road from two existing driveways and will have a new landscaped
parking lot. Access to the rear of the site will be along the east
side of the building through a new gate in new north masonry wall.
In addition, the site currently has a dedicated easement along the
east property line for sites south of the subject property and will
also have an additional gate in the new masonry wall along the
east side of the property. The two parking lot driveways and two
gates will allow for drive through access of the site with no need to
use Curry Road for backing up or turning around. All circulation
will occur on site.
H. Circulation System
As stated above, the entrance to the site will be through two
existing 24' wide driveways entering into the proposed parking lot
and (2) six-foot high painted wrought-iron rolling gates will allow for
drive through access to and on the subject site. Improvements will
be the new landscaped parking lot and the new gate allowing for
drive through access on the subject site. The loading zone will be
located on the south side of the building screened from Curry
Road.

I. Development Schedule
The project will constructed in a single phase. There are no
proposed phasing plans to construct a portion initially and
complete during a later phase. The construction schedule should
be rapid and non-disruptive due to the owner's choice of a
prefabricated metal building for the subject site.
J. Community Facilities and Services
The subject site does not have several community amenities
nearby due to the nature of the surrounding properties. Due to
the use and business operations of the site, these items are not
necessary or applicable to the proposed development. All
employee parking will be on site.
K. Public Utilities and Services
The site currently has refuse services through the City of Tempe, an
on-site septic system, City of Tempe water service, Maricopa
County Sheriff police protection, Rural Metro fire protection, APS
electrical service and Qwest phone service.
L. Other
The attached Precise Plan of Development contains a Site Plan,
Civil Grading and Drainage Plan and a Landscape Site Plan
detailing the proposed configuration of the site and building.

The Maricopa County Environmental Services Department (MCESD) has reviewed
documents received from the Maricopa County Planning and Zoning Department for
the above referenced project. This project is a Plan of Development for the proposed
Horizon Landscape facility located at 1155 East Curry Road in Tempe. The new Plan
of Development will replace an earlier Plan that was approved per zoning case Z87-
, 20. As such, the property already has an industrial zoning. The proposed facility will
be an office for a landscaping business. It will include a metal office building,
parking areas, and material storage areas. According to the submitted
documentation, the City of Tempe provides potable water to the site An existing
onsite wastewater system will manage sanitary sewage from the office.
,Based on the above, MCESD raised no objections to the Planning & Development
.toepartment in Permits Plus on September 27, 2007 and the project may proceed
with the following stipulations:
'

RE: HORIZON LANDSCAPE PLAN OF DEVELOPMENT
New Plan of Development
1155 East Curry Road
County Case # Z200701
Dear Ms. Zaricor:
The Development Services Department staff has reviewed your request for Horizons Landscape Plan of
Development. This site is located at 1155 East Curry Road in the COUNTY Zoning District.
The City of Tempe has no Planning and Zoning Authority for properties located in a County Island. If the City
of Tempe had authority we would require the plans to meet our Zoning and Development Code, Part 4,
Development Standards.
Recommendations:
1. Chain Link fence around perimeter of the property would not be supportable. A landscape company would have
exterior storage that would have to be screened by an equal height wall. We would recommend a six (6) to eight
(8) foot height CMU wall. A chain link fence is not a security fence, a six (6) foot wrought iron or an eight (8)
foot CMU fence is a supportable.
. The front access gate should be upgraded to a wrought-iron gate. Chain Link not supportable.
3. The Gate would require security lighting. Lighting to meet 5 foot candles at the gate and 2 foot candles within
15' radius of the gate. Light fixtures to be Dark Sky/ Full Cut Off compliant.
4. The parking spaces would require two (2) foot candles through out length of parking row.
5. All exterior doors on the building would require five (5) foot candles at doors and two (2) foot candles within a
15' radius of the doors.
6. Shrubs and groundcovers located in Landscape Islands, adjacent to sidewalks, or pedestrian walkways shall be
no taller than two (2) feet at maturity.
7. A three (3) foot parking screen wall would be required in landscape area along the street.

Re: 22007013 — HORIZON LANDSCAPE
I have reviewed the application and site plan for the above mentioned project.
Below are my comments.
Fire Department Access
Access to the property is adequate for fire department use. Internal circulation is
also adequate. Prior to vertical construction, all interior surface streets must be
installed.
Fire Hydrant Location
Hydrants have been identified on the plan. A Civil engineered water plan will
have to be approved. Hydrants must also be installed prior to vertical
construction.
Sprinkler Systems
No fire suppression systems are required for the landscape storage building.
Fire Flow
A hydrant flow test will have to be performed to verify the performance of the
hydrants.
With the stipulation listed above concerning installation of fire hydrants and
streets, Rural/Metro Fire approves this project.
