The kennel is run with a great deal of care and concern for the community in that the dogs are not noisy. In fact, most of us were not even aware that a business was operating there. No foul or unusnal odors can be detected and the property is immaculately maintained_ Again, all outward appearances are that the property is just a home, nothing more! And, any additional traffic along our roads is not noticeable and therefore not a problem even during holiday times NAME ADDRESS COMMENTS - 1 .• 4,1 / -5 y77 , /57 /4 / g'7/t-14- 3' )57/775/ i; GI /73r`l 2 3 5 7 ( • r •-• -7 a. I'm not sure if you are aware of this or not, but finding a good dog boarding facility is extremely hard to find in Maricopa County. My pets are VERY important to me, and I am extremely particular about who looks after them. I personally have toured numerous facilities in the Valley — many of which are already overbooked and over capacity. I have been with Holiday Hound House for the last five years! The treatment and care that they provide is priceless. My dog has a number of health issues which require her to be on a special diet and take almost 4 separate medications a day. Many facilities will not take a dog that requires such specialized care. At Holiday Hound House, they have been looking after my dogs for years and have been 100% compliant with all medical requirements — and at no extra cost. Their operation is well organized, structured and very efficient. There is no odor, traffic issues or excessive barking. The facility should serve as a model for others. Please take special consideration to grant this Special Use Permit to Holiday Hound House. It would be extremely beneficial to all of us who continue to utilize these services to take care of our loved ones. With the shortage already of dog boarding facilities, to lose Holiday Hound House would be a big blow to the community. Thank you again for your consideration! Three years ago we began searching for a quality boarding facility for our loved pet. We were looking for a place that was fairly small and the animals were given personal attention. We found that at the Holiday Hound House. Mike and Deborah treat our Cira as if she were their own. Each dog is given personally supervised morning and afternoon exercise sessions in their field. This is where we believe the Holiday Hound House excels. They take the time to get to know the temperament and personalities of each pet and form small supervised play groups. This prevents any annoying behaviors in the dogs such as excessive barking or aggressive play. Other facilities we interviewed did not treat each animal with such personal care and attention. Mike and Deborah on multiple occasions have gone beyond just a standard kennel. We were on vacation when Cira was diagnosed with Valley Fever, it was imperative that she start medication immediately. Deborah worked with me, my vet and the pharmacy to get Cira on her medication within 24 hours. It is this type of service that allows us to take our vacations with out worrying about Cira's conditions. Cira absolutely loves going to visit Mike and Deborah. We can hardly contain her in the car when we arrive! We have recently added another dog to our family and I just hope he has the opportunity to visit Deborah and Mike while we are on vacations. We do not believe there is another kennel in the area that gives the same quality and care to their guest as Holiday Hound House. I fear if the Holiday Hound House is not given the Special Use Permit for their facility, they will be forced to close and the community would be losing a wonder business. They are simply not another kennel. They are a small responsible business that ensures the safety of the animals they take care of as well as being excellent neighbors. We have driven up to Holiday Hound House countless times and we have never heard any annoying barking. The kennels are kept extremely clean and there is never any odor associated with the kennel. Their property appears to be a home with a couple of dogs playing in the field. Any city should be proud to have business owners like Deb and Mike providing this service to their residences'. Stacey Rd. Queen Creek, AZ. My husband and I live at 17730 E. Stacey Rd, Queen Creek, approximately two blocks from the proposed location, also a part of the Chandler Heights Citrus Irrigation District. We have been clients of Ms. Mullen for more than five years, with her caring for our Akita dogs when we travel, four to six times per year. I welcome the concept of her locating the business within walking distance of our home. Ms. Mullen's existing business delivers high quality, personalized pet care to a clientele that has a high rate of return customers. This type of quality care is difficult to find and is in high demand; Ms. Mullen has.a track record of providing clean facilities, well trained and caring staff, and a long standing, well-run business. There are few_J comparable businesses like Ms. Mullen's in:this area, and her business plan fulfills a growing need.in the community. As to the impactof her business in the location proposed, I am certain that it will, a positive impact in the area. The neighborhood is culturally diverse, with many area residents owning a multitude of animals including dogs, bats, chickens, roosters, , goats, sheep, cows, horses, peacocks and bulls. We also have a variety of wildlife: coyotes, road.: runners, snakes, toads, mountain lion. The existing "pet" population makes considerable noise at times (cows, roosters and peacocks in particular), much more disruptive than several dogs at play in Ms Mullen's yard might be. Overall, the neighborhood is very animal friendly. Ms. will Mullen's business operations will be unobtrusive, fit seamlessly into the area, be well kept and clean. I view Ms. Mullen's plan for the property with enthusiasm; we need properties in the area well cared for, and under Ms. Mullen's care the existing property will be improved. Please provide your support to her application. Thank you for your consideration. You may contact me if I can answer any questions. Elizabeth Fulghum 17730 E. Stacey Rd. We are a rural residential neighborhood where neighbors enjoy the serenity and peace of living in this quiet area of Queen Creek. Currently, a woman by the name of Deborah Muliens is trying to obtain a Special Use Permit for use at the residence located on 18129 E. Stacy Rd. She intends to use this permit for her business, Holiday Hound House. This business is an animal boarding and possibly grooming facility. We, as neighbors, need your help to STOP this from happening. We have majority OPPOSITION to this venture when collecting petition signatures from residences within 300 feet of Ms. Muliens home. We would greatly appreciate your support in this matter at the Board of Supervisors Meeting, this week on Wednesday, August 20th. As concerned homeowners, we are truly at a loss as to what to do. Our main road affected by this venture is Valencia Ave. which is already a dirt road and which also has a huge amount of traffic due to the Chandler Heights Irrigation District (CHCID). CHCID is used for our residential water and irrigation. CHCID services a huge amount of customers that must use Valencia Ave. in order to sign up for irrigation twice a month. This does not even account for the traffic to pay water bills at CHCID or customers paying on their irrigation accounts. Besides our concern about Valencia Avenue, we have a variety of other concerns in regards to having an animal boarding facility next door to our residential homes! I also have a handful of homeowner letters that I would be more than willing to share with you to support our opposition to Ms. Muliens request for a special use permit. I would also be willing to fax a copy of our neighborhood petition to your office as well. Please contact me with any questions and I would truly value your input and insight regarding this issue. I am writing to you and to the Members of the Maricopa County Planning and Zoning Board to express my ABSOLUTE OPPOSI:110N to the proposed Special Use Permit requested by Deborah Mullen for the residence located at 18129 East Stacey Road in Queen Creek, Arizona (CASE # Z2008006). We have chosen to live in this neighborhood for a variety of reasons, but most importantly because of the peace and quiet. My wife and I spend all of our time at home when we aren't at work. I truly enjoy working in and around the house, building and working on our vehicles and toys and just relaxing in our yard with our neighbors. I enjoy doing these things and being at home because it's peaceful and we're surrounded by people who enjoy many of the same things Summer or winter, our windows are open most of the time so we can enjoy the fresh air and peace of our neighborhood. Right now, our neighborhood is being invaded by Ms. Mullens and her plans to turn the residential home across the street from us and its additional building into a dog boarding and grooming facility. In April, my wife visited the open house at Ms. Mullens current dog boarding facility in Gilbert. After her reports I still continued to be against this business venture. In fact, I would be against any business like this that someone would want to bring into our neighborhood because this area should be for residential only. Above all things, who would want a dog boarding and grooming facility across the street from their biggest investment, their home. My reasons for continuing to be OPPOSED to Ms. Mullens request for a Special Use Permit to board dogs are: • Approval of a Special Use Permit leaves neighbors limited when problems occur • Increased traffic on Valencia Avenue's dirt road • Additional noise • Decreased value of our home • Decreased ability to sell home because this business will be right across the street from us • We live in a residential neighborhood, not an area for businesses • We were fully aware of the Water Company before we purchased our house; we made the choice to live with the Water Company. • We want our peace and quiet With my neighbors, I will continue to fight against having a dog boarding and grooming facility not only in my neighborhood, but especially across the street from my house. Put yourself in my shoes when you are making this decision. Would you want a dog boarding/grooming facility with barking dogs, extra traffic and possibly spell next door to you? I highly doubt it. I am sure there are some neighbors that really don't care about this issue, but why should people outside of the 300 foot parameter matter. These people shouldn't be asked to help make decisions about whether or not a business shoul4 be in their neighborhood when they aren't immediately affected by Ms. Mullens proposal like my wife and I are. If you- should have any questions about my opposition to this proposal, please contact me. Please keep our interests in mind when making your final decision. Sincerely, Kristin K. My husband and I moved out of a congested area in Mesa into our home on Valencia Avenue in July of 2005. After two years of living in our rural, secluded, quiet home we proceeded to purchase it in 2007. We have chosen to live in this neighborhood for a variety of reasons, but most importantly because it is what we view as relaxing and gives us the ability to rejuvenate in order to return to the "hub-bub" of our society on Monday mornings. As a high school administrator in Gilbert, I deal with a plethora of stresses throughout my day and work week. Many times they creep into my weekend as well because of scheduled functions, but my relief at the end of the day or week is being home, in the yard, at the neighbors, sitting inside with the windows open and enjoying the peace. I am most frustrated to report that my peace and sense of relief is being invaded by Ms. Mullens and her plans to turn a residential home and additional building into a dog boarding and grooming facility. In April, my neighbors and I were invited to an open house at Ms. Mullens current dog boarding facility in Gilbert. There, we were informed of Ms. Mullens plans for the newest dog bording facility on Stacey Road. While visiting Ms. Mullens, we were able to tour her facility, ask clarifying questions and I was able to express my continued opposition for her plans within our neighborhood. During this meeting, when asked about living arrangements at the Stacey home, Ms. Mullens not realizing, gave several conflicting statements about who would be living in the home and when they would actually be present. In fact, since that meeting I have been told of more plans via neighbor conversations with Ms. Mullens step-daughter who is currently living in the home. There is no straight and narrow explanation for how this facility will be monitored, which essentially leaves us "up a creek" when there are problems. If Ms. Mullens wants a business that she can come and go from then why not set that business up within a strip mall or in a shopping center? The easy explanation of why Ms. Mullens does not want that is she will no longer be able to advertise that she is boarding these animals in her home. My reasoning for being ADAMANTLY OPPOSED to Ms. Mullens request of a Special Use Permit for a dog boarding can be explained directly as follows. • Approval of a Special Use Permit leaves neighbors limited when problems occur • Increased traffic on Valencia Avenue's dirt road • Noise, noise, noise • Decreased value of home due to business • Decreased ability to sell home, if need be, due to business • Residential neighborhood • Neighbors were fully aware of the Water Company prior to the purchase/building of their homes. • The smell within Ms. Muliens Gilbert facility was undesirable, would/could the smell of the new location wander into our backyard? • Peace and quiet wanted and needed • Why shoud Ms. Muliens problems become ours? (ie. the affect this will have on her "livelihood," husband's illness, decreased business because of all the tie-ups) I find as I write this letter and fight for my home, peace and investments that I truly am a prisoner to one woman who has decided to invade our neighborhood with a business that immediately surrounding neighbors do not agree with or want. Trying to put ourselves in each other's shoes is necessary when considering Ms. Muliens request. Granted there are neighbors among us that really don't care about this issue. But ask yourself, do they directly surround her home and are they the immediate homes in all directions to her? Probably not. So if they aren't within 300 feet of Ms. Muliens' residential home then why do they get to make a decision that affects those of us who are? Take a look at the water company for example. Why would they care if Ms. Muliens is awarded a Special Use Permit, they don't live, sleep or rest in their offices because their operating hours are minimal at best. There are though, two homes, one especially, who's bedrooms are within extremely close range to Ms. Muliens. We as neighbors have valuable reasons why this Special Use Permit should not be approved. If you should have any continued questions, please contact me. Please keep our majority opposition in mind when making your final decision. Sincerely, Kristin K. Apparently a request has been made for a Special Use Permit for an animal boarding/ grooming facility in the Rural-43 RUPD zoning district by our neighbor. I do not want this boarding/ grooming facility to be granted a Special Use Permit. The Chandler Heights Citrus Community is a quiet and calm neighborhood. We live on a dirt road next to the water company. This does create extra traffic, dust, and noise along Valencia road. However, the water company was established long before we moved into the area, so we were aware of the situation. Unfortunately, if a dog boarding facility is allowed to move in, even more traffic will arrive creating more dust and noise. The other factor is the possibility of barking, annoying dogs. I know that the owner may "promise" that we will not hear a peep, but how can we be certain? How can one be expected to keep 10, 20, or more dogs quiet at all times? The main concern is that once a Special Use Permit is granted, there will be little hope for the surrounding property owners to ensure that the promises made, are actually enforced. believe in the rights of all to pursue an income as they choose. However, I do not deem it fair that surrounding property owners be subjected to a nuisance that will be almost impossible to control. RECEIVE )juL 22 2 08 July 20, 2008 Mr. Jonce Walker, Planner Maricopa County Department of Planning and Development 501 N. 44th Street, Ste. 100 Phoenix, Arizona 85008 Dear Mr. Walker: I want to let you and the other members of the Maricopa County Planning and Zoning that we are vehemently opposed to the proposed "Holiday Hound House" dog kennel commercial facility venture (special use permit) for the property located at 18129 E. Stacey Road in Chandler Heights, Arizona. (CASE # Z2008006 — Deborah and Mike Mullen, owners/operators) We have lived in the home just south (yes, we share a block fence with the Stacey Road property in question) for 13 years and have invested our lives and incomes into this acreage. We purposefully moved to this area because we had horses, dogs, cats, and chickens and have been thankful for the quietness of this residential property we chose. It is with great concern and disdain that I'm sending this email to you regarding the commercial proposition that the Mullens are having you consider. Here are my concerns: 1. We are public school counselors/teachers who are home most of the time, especially in the summer. We DO NOT want dogs barking both day and night in our very own back yard as the facility BACKS RIGHT UP to our backyard and bedrooms. 2. We have four (4) dogs that are very well-mannered and we do not let them indiscriminately bark, but if you're a pet owner at all, you know that when dogs bark, it starts a chain reaction. WE DO NOT want dogs out in the yard (or in the facility) barking when we're trying to sleep or when we're home. Since this is to be a commercial venture, it's NOT LIKE normal pet ownership whereby dogs get used to neighbor dogs. The "Holiday Hound House" dogs will change and barks WILL BE constant. 3. This is a cozy, quiet neighborhood: not a commercial neighborhood. We are NOT HAPPY at all with a coming in. When we purchased our home 13 years ago, we knew CHCID (the water company) was across the street, but it's just that: a water facility. It's not an animal business (with barks, smells, noises, various and different customers and traffic, etc.) 4. If we need to sell our home, WHO wants to purchase a property NEXT to a DOG BOARDING FACILITY?? Not me! It will automatically lower our property values and that's NOT what we or any of our neighbors want. We are particularly concerned since the property is directly behind us. 5. My husband and I have a flock of chickens that is directly behind the block wall that we share with the 18129 E. Stacey Road facility. Currently, it is quiet, cozy, and they are settled. We, as residential pet owners are appalled at the prospect of clients, dogs and cats, and traffic coming in directly on the other side of our block wall. 6. The Muliens are wonderful people, but they DO NOT plan to live in the facility and to have this kind of venture in our neighborhood just isn't fair. We've invested our time, energies, and money into this home and frankly find it disturbing that they are pursuing this matter even after we told their realtor and Ms. Mullen in January (when she began looking at the property) that we'd fight to keep her commercial venture out of our neighborhood: our home, our investment, and our dream. Due to the scheduling of this meeting (9:00 on July 24 th), neither my husband, Chuck, nor I can come to the hearing. I am requesting that you read my letter, NOTE my disapproval and concerns, and I beg of you to DENY the Muliens the Special Use Permit to try to destroy our neighborhood with this "Holiday Hound House" venture. Thank you for noting mV'Eoncerns. Please document my complete opposition to the case. Mrs. Yvonne f. Warn 26646 S. Stacey Road in Chandler Heights, Arizona. (CASE # Z2008006 — Deborah and Mike Mullen, owners/operators) I cannot express my resistance to this proposal in strong enough terms. I am extremely upset about the possibility of the property next to ours becoming a commercial business. Our home since 1995 (13 years) is on the property adjoining the proposed dog kennel immediately to the south — only feet from the building that is supposed to house the kennel and right across the fence from what appears to be the proposed exercise yard. I do not want to live next to a commercial dog kennel with all the noise, odor, and traffic that will certainly result. I am generally not in favor of extreme restrictions on what a person can do on or with their own property as long as the activity does not adversely effect their surrounding neighborhood. The Mullens, however, are not even planning to live here and they will be able to sell their business to someone else in the future, so even if the Mullens were the perfect neighbors, there is no assurance that whomever would take it over would have any concern for the neighborhood and we would be stuck. I feel for the Mullens in that they were led to believe that their would be little or no resistance to their venture in our neighborhood (probably the fault of their real estate agent), but we expressed our opposition from the very outset. It's my understanding that Mrs. Mullen spent some time canvassing the neighborhood last weekend trying to drum up support for her kennel and part of her appeal was that her husband was in ill health and they needed this business to provide for his care since they were no longer able to keep the business in its current location (in another residential neighborhood — any surprise?). My wife, Yvonne, and I are both high-school counselors and cannot, because of our job commitments with back-to-school days, attend the hearing on the date you have set (Thursday, July 24, 2008). I am requesting that you read my letter, RECORD my disapproval, and DENY the Mullens the Special Use Permit for their "Holiday Hound House" venture. Thank y for noting my concerns. Owner: Deborah Mullen Request: Special Use Permit (SUP) in the Rural-43 RUPD zoning district Proposed Use: Animal Boarding / Grooming Facility Site Location: North of Hunt Hwy. and west of Valencia Ave. (in the Chandler Heights area) Site Size: Approx. 1.2 gross acres County Island Status: Class Ia (Town of Gilbert, Town of Queen Creek, Gila River Native American Community) Summary of Conformance with Adopted Plans: County Plan: The proposal is not in concert with the Queen Creek County Area Plan which designates the site as Suburban Residential (0-2 d.u./ac.). City/Town Plan: The proposal does not appear to be in concert with the Town of Queen Creek's General Plan which designates the site as Very Low Density Residential (0-1 d.u./ac.). Support/Opposition: Four (4) emails of opposition Recommendation: Continue to September 18 2008 Agenda Item: 14 - Z2008006 Page 1 of 18 Description of Proposal: 1. This request is for a Special Use Permit (SUP) for an animal boarding and grooming facility on a site approx. 1.2 gross acres in size. The site is zoned Rural-43 RUPD and is located north of Hunt Hwy. and west of Valencia Ave. in the Chandler Heights area. 2. There are currently two (2) structures on the site. One of the structures is a 1,952 sq. ft. home with a 714 sq. ft. covered patio on the northern end of the property that will be occupied by the applicant and not used in the animal boarding operation. The second structure is a 1,800 sq. ft. single room, 30' (w) x 60' (I) x 15' (h) metal shelled building that the applicant will modify internally to house twenty (20) runs for boarding dogs and six (6) enclosures for cats. Internal modifications to the boarding facility includes a laundry area, an ADA bathroom, an animal food preparation area, and a reception center. Total lot coverage for the home and the animal housing structure approx. 10.06%. The perimeter of the backyard grass area south of the house will be fenced in via a 6' (h) block wall. This area will be used as a potty and exercise space for the dogs. A series of fences and access gates will be used inside the backyard grass areas to control the amount of dogs in various sections. 3. In addition to boarding the animals, the applicant is proposing a grooming operation but has detailed that most of the grooming will consist of exit baths for animals that are leaving the facility after their stay. The applicant has stated that any grooming will be done on a request basis thereby only employing a groomer when needed. 4. The site will be maintained and cleaned daily with solid wastes bagged for pick-up at by the refuse company. The applicant is proposing debris traps inside the drains to prevent hair, fur, and food from entering the septic system. The applicant is also proposing that a pest control company be employed to spray on a monthly basis to eliminate any insect infestations. An HVAC unit and new duct-work will be installed inside the facility for heating and cooling. The applicant is also providing a generator and portable heating and cooling units on site in the event of a power outage so that the facility can maintain a safe temperature for the animals. Internal emergency lights will be affixed to the walls as well. Internal fit out of the facility includes blown insulation and sheet rock to mitigate noise, metal framing, and sheet rock. 5. Primary access to the site will be from a 25' (w) paved circular driveway off of 65' (w) dirt surfaced Valencia Rd. Stacey Rd is a dirt surface easement on the northern properly line, and could be used to access Valencia Rd. and then the facility. However, because Stacy Rd. is a smaller easement that mainly serves as Agenda Item: 14 - Z2008006 Page 2 of 18 access to homes and the Chandler Heights Irrigation District and not the general public, it is unlikely that customers will use Stacy Rd. to access the facility. Therefore, the applicant has expressed confidence that all clients will enter and exit from Valencia Rd. using the internal circular drive pattern. The applicant has proposed to put up a barrier chain so that customers will not be able to access the facility from Stacey Rd. The circular drive is gated to provide security and screening. For dust abatement, the circular drive and track out is paved. The applicant has stated that the traffic generated should only be about two (2) to three (3) vehicles per day. The circle driveway leads to a four (4) space parking area which is adjacent to the boarding facility. Three (3) of the spaces are standard with one (1) space handicap-accessible. All and parking spaces will be paved. There is one (1) flood light affixed to the boarding facility at 14' (h) to illuminate the parking area. 6. The applicant has stated that the facility will operate seven (7) days a week from 8:00 a.m. to 6:00 p.m. with drop off and pick up hours limited to 8:00 a.m. to 10:00 a.m. and 3:00 p.m. to 6:00 p.m. The facility will be closed on major holidays. There will be two (2) full-time employees and four (4) part-time employees at staggered hours of the day. However, details of how they will be staggered have not been clarified at this point. 7. The site will be screened via 6' (h) block walls on the perimeter. The block walls will also help manage the noise when the animals will be outside. 8. The applicant proposes one (1) sign 24" x 14" to be fastened to the block wall near the entrance gate. The applicant is not proposing any lighting for the sign. 9. The applicant has not requested a specific timeframe for the SUP. Analysis of Conformance with Adopted Plans: 10. Maricopa County "Eye to the Future 2020" Comprehensive Plan: The Comprehensive Plan designates this site within the General Plan Development Area (GPDA) of the Town of Queen Creek. Under this designation, the Comprehensive Plan indicates that staff will take into account the Town of Queen Creek General Plan as long as it has been updated in the last five (5) years with input of County residents. The Town's plan does not meet these requirements having been last updated and adopted May 15, 2002. Although the Queen Creek General Plan was approved more than 5 years ago, staff still considers the land use designation as valid. 11. Queen Creek Area Plan (County Area Plan): The land use plan of the Queen Creek Area Plan, was adopted April 6, 1992. The last revision was on June 1, 1996. The plan identifies Suburban Residential (0-2 d.u./ac.) as the designation Agenda Item: 14 - Z2008006 Page 3 of 18 for the site. The current zoning on the property is Rural-43 RUPD. As a commercial type of land use, the proposal is not in conformance with the plan. However, this type of use does not require that a Comprehensive Plan Amendment (CPA) be processed due to the similar density designation as a Rural Development Area (0-1 d.u./ac.) as confirmed by the Comprehensive Planning Division. 12. Town of Queen Creek General Plan: The General Plan designates the subject site for "Very Low Density Residential" uses of 0-1 d.u./ac. Uses found within this category include vacant land, single-family detached residential and certain agricultural uses. The proposed use does not appear to be consistent with the Town's plan. The applicant has stated verbally that the two (2) full-time employees will be herself and her husband who will reside at the site. Unfortunately, there has not been any information formally submitted to confirm this. Additionally, there is missing Agenda Item: 14 - Z2008006 Page 13 of 18 information about how frequently the applicant will employ an off-site mobile grooming service. 37. All of the customers will access the site from Valencia Ave. in order to minimize traffic on Stacy Rd. which is the dirt northern access easement. There are two gates located on the entrance and exit off of Valencia Rd. There has not been any further information submitted by the applicant detailing if these gates will remain open during all business hours or how these will function. 38. The applicant has not requested an SUP time frame. Therefore staff has determined that a time frame of ten (10) years is applicable for a project of this nature. This timeframe is also consistent with the Town of Gilbert recommendation. Staff will stipulate to a status report at one (1) year to ensure that stipulations are being complied with and at eight (8) years to provide adequate time for renewal discussion applications. 39. Although commercial in nature, an animal boarding / grooming facility can locate in rural and residential zoning districts as well as non-residential zoning districts with an SUP. Staff feels that even though the applicant has demonstrated a willingness to lessen any impacts to the neighborhood through some lot and building design, the applicant is proposing an intensity that is too great for a residential setting. Namely, the intensity of use (20 dogs / 6 cats/ undefined grooming operation on a one acre site) combined with an essentially stand alone commercial facility potentially impacting adjacent properties more significantly then the subject property is a concern. Some of the items the applicant is proposing to mitigate neighborhood impacts include sound attenuated walls of the boarding facility and screening the site with a CMU perimeter wall. Staff also feels that the applicant has made an effort to educate the neighborhood about this project throughout the entitlement process. However, there remains adjacent and nearby resident opposition as well as unknown parameters of the requests which both would be best addressed now via a continuance. Recommendation: 40. Staff recommends the Commission motion to continue of Z2008006 subject to a date certain of September 18, 2008 for the following reasons: • Adjacent and nearby residents continue to express opposition of the proposal. • Allow the applicant time to submit a revised site plan and narrative report to clarify some unclear parameters of the request. Agenda Item: 14 - Z2008006 Page 14 of 18 41. However, should the Commission .motion for approval of Z2008006, then staff offers the following stipulations: a. Development of the site shall comply with the site plan entitled "Holiday Hound House / Animal Boarding Facility", consisting of one (1) full-size sheet, dated revised March 20, 2008, and stamped received May 30, 2008, except as modified by the following stipulations. b. And the properties within the 300' radius are as follows: Chandler Heights Citrus Irrigation District is located directly east across Valencia Avenue. And to the south and east of this plot is an undeveloped orchid owned by Circle R Investments. Further east is another undeveloped lot owned by Rideal Investment, LLC. Directly behind applicant property to the east is owned by Charles and Yvonne Warner. To the west is a large multi-acre parcel owned by Eliseo Tony and Griselda Lucas. They share their large space ,ivith numerous farm Imimals. North across Stacey Road is owned by Anthony and Darlene Wood. The next property north is owned by Eric and Kristen Anderson. Brent and Kristin Connolly are north-west of the site. And one parcel west to the Conno owned by Elizabeth Johnson and David Coleman. To the north-east across Valencia Avenue is owned by Scott Daniels. Further east is the home site of Donald Hannum. Most all of the above neighbors are Animal lovers possessing one or more dogs and for cats. Having a boarding facility in close proximity will benefit the community when the need arises. The pet industry is one of the strongest economic sectors that will continue to grow in 2008 at a rate of 7% (see attached article, Page 8). Six out of ten homes own pets and the need for quality, well run boarding facilities will be in demand especially in the east valley which is also growing faster than any other community in metro Phoenix. This boarding facility will operate to benefit the Gomm° with valuable services and high standards. Excessive dog barking is an outdated misconception regarding kennels and should no longer be considered as a detriment Pet Industry Trends for 2008 2008 Trends December 10, 2007 _By Laura Bennett 1 Editor's Note: Last year our single most popular trends article was about the pet industry. So we invited the author, Laura Bennett, CEO of Embrace Pet Insurrarce (olamed left), back for this guest post to update us on pet industry trends far 2008. Perhaps this article will trigger ideasfor businesses you can start or larger companies you can partner up with. By Laura Bennett The 2008 economics for pet-related small businesses will be affected by a continuing increase in pet-related sproding, higher awareness of pet health, greater 'uptake of pet insurance, and continued Inenanipation of pets, integrating them into all aspects of our lives. Trends include: .1. Pet parents continue to upgrade their purchases • Spending on pet supplies and over-the-counter medicines continues to increase with $9.9 billion projected to be spent in 2007, an increase of 6.5% over 2006, according to the American Pet Products Manufacturers' Association (APPMA). Spending in 2008 will likely exceed $103 billion. People will continue to spend above and beyond on their pets as the population ages and pets take the place of children at home. Pet parents are upgrading necessities, such as food, leashes, and bedding, and some luxuries are not so unusual any more —how often do you see a dog dressed up to go out these days? }Ugh- end specialty pet stores continue to thrive despite competition from the big box stores as passionate pet owners look for selection, style, and a unique shopping experience. 2. Pet services for your pets grow in abund2nce More than $2.9 billion dollars will be spent on pet services in 2007 according to the AppmA, which will likely ceminoe to grow at around 7% for 2008. Again, pet parents are including their pets in their own lifestyles so visits to the spa, exercise regimes, and hotel-quality accommodations for day care are becoming more common place in urban areas. As we expected, we are seeing more services partnering together centered around pets, such as the Ritz-Carlton and the Therldev Pet Hotel and Day Spa providing pampering for your pet while you kick back in luxury. We also expect to see groomers, doggie daycares, pet hotels, pet insurance companies, lawyers providing pet trusts, and funeral homes providing services for pets also joining forces more and more in 2008. Location and Accessibility The property is located within the Chandler Heights Citrus Tract on the SW corner of Valencia Avenue and Stacey Road (lot #24) and is accessible one block north of Hunt Highway and three blocks from San Tan Boulevard. All Clients will enter and exit the property from Valencia Avenue. There are two (2) access gates which allow cars into the circular driveway area adjacent to the kennel building. No vehicles will be routed onto Stacey Road. Any cars that happen to come to the front of the property (residence) can also enter and exit via Valencia Avenue and not Stacey Road. A barrier (chain) will block the driveway entrance off Stacey Road so vehicles have no reason to travel onto Stacey Road. Valenc Driveway entrance to Residence from Valencia Ave. 9 Circulation System Because the site sits between two non-major Meets (Stacey Road and Valencia Ave) and within a residential sub-division no improvements or dedications are required. The property has a circular driveway with two access gates. The gates provide privacy and security when the facility is closed. The driveway is already paved with asphalt inside the property al a also beyond to the street perimeter. An 'ENTRANCE' sign will be affixed to the outside wall (see si description) near the te and an 'EXIT' sign will be affixed to the inside wall showing the exit gate. This will control the flow of traffic to eliminate any confusion or accidents. Traffic flow will be limited to about two to three vehicles on a day to day basis. SIGHT VISIBILITY TRIANGLES will not be necessary because of the low amount of traffic That will be generated from the site. There is adequate area on the drive for 4 patting spaces incla am one ADA designated spot. Since the kennel capacity is limited to a mall number of boarding animals the drop-off and pick-up hours are scheduled thereby keeping the traffic flow to a minimum. Three regular patting spaces will be more than adequate. Each client dropping off or picking up animals spends no more than ten minutes at the flicility. Parking is available for employee vehicles at the front of the residence Willing accessed dlr. =fly off Valencia Avenue or behind the 12' gate on the north side of the kennel ,1 The maximum amount of vehicle trips per day will be approximately three (3). Some days there will be no traffic at all Proposed P Ai Area 2 Spaces on each side of the building Each space is 9'x 18' The handicap space is 11' x 18' with additional space as needed on one side 11 Development Schedule • The development schedule for this project rests main/y with securing a Special Use Permit. And all applicable work is limited to the interior of the site. However, the applicant is moving ahead with some projects that are not SUP related. Phase I: DONE Clearing the property of weeds, debris and tree trimming. Phase II: DONE Building a block wall along the entire western perimeter thereby fully enclosing the pmperty on all four sides. Permit number is B2008-01612 After the perimeter screen block wall is built then the interior two block walls and wire fencing and gates will begin. Permit number is B2008-01757 North North Poles set for no-climb wire fencing to be attached in grass /Po areas for the dogs B2008-01757 Phase III: Remodeling the interior of the kennel building as outlined in the proposal description.. No permits have been issued yet as the architect has not finished the plans. Phase IV: This last phase will not begin until a SUP is Once done, the building will be fitted with the twenty dog runs and six cat enclosures. 12 • Community Facilities and Services There are no schools, parks or amenities within a one mile radius of the site. Engineering Program Supervisor SUBJECT: Holiday Hound House SUP; Z2008006 The Maricopa County Environmental Services Department (MCESD) has reviewed documents received from the Maricopa County Planning and Development Department for the above referenced project. This project is a request for a Special Use Permit (SUP) for a proposed animal boarding facility (primarily dogs) that will be located at 18129 East Stacey Road near Queen Creek. The 1.20-acre parcel is already developed with a residential home and a 30X60-foot building which will house the animals. The large building will be renovated to provide 20 individual dog runs and six cat enclosures. According to the submitted documentation, the property is served potable water by Citrus Heights Irrigation District. The submitted plans show a septic system serving the residential home. MCESD recommends a separate septic system be installed for the kennel to serve the laundry, bathroom and food preparation area. Based on the above, MCESD raises no objections to the proposed SUP to the • Planning & Development Department in Permits Plus on February 25, 2008 and can allow the project to proceed at this time subject to the following stipulations: Stipulations: No animals may be housed at the proposed kennel facility prior to the in Ilation and approval of a new septic system to serve the facility. It should be noted that several other Maricopa County agencies must review and recommend approval of this project. Final approval authority for this project rests with the Maricopa County Board of Supervisors. Stacey Road, Chandler Heights, AZ To Jonce Walker, Re: 18129 E. Stacey Road, Chandler Heights, AZ CASE # Z2008006 Hello, My name is Yvonne Warner and I've lived in the property just south of 1812 .9 E. Stacey koads - for at least 13 years. We have lived here before the home/shop property was even built. It is with great concern that I am emailing you regarding the wishes of Deborah Mullen to turn that home/grounds into a'dog boarding facility. There are several reasons for our :concerns: 1. We are teachers and are home much of the time. We DO NOT want dogs barking both day and night in our very own back yard as the facility BACKS RIGHT UP TO OUR backyard and bedrooms. F ' We have 4 dogs who are very well-mannered and we do not let them indiscriminately Abark, but if you're a pet Owner at all, you know that when dogs bark, it starts a chain - ,reaction. WE DO NOT want dogs out in the yard barking when we're trying to sleep or when we're home., 3. This is a cozy, quiet NEIGHBORHOOD: not a commercial facility We are NOT HAPPY at all with a commercial venture being allowed into our neighborhood. We moved in with the . full knowledge of CHCID, the water facility, but it's just THAT A water facility NOT an animal (noisy, smelly) facility. 4. If we should have to sell, WHO wants to purchase a home NEXT tcy A DOG BOARDING Facility?? Not ME! It will automatically lower our property values. That's NOT what I, or any of my neighbors want: In January, when Ms. Mullen and her realtor came by telling, us of their intent to purchase and turn the home @ 18129 E. Stacey into a dog facility, we were alarmed to say the least. We reacted very negatively to both of them. The reason is: it is just not fair for us to have invested our monies, time, and energy into making this neighborhood a wonderful place to be. We've invested into this place, NOT TO HAVE SOMEONE COME AND turn the very property next door into a commercial venture. There are other places for that, but not here in this quiet area of Chandler Heights/Queen Creek. When are the meetings at which we may plead our case? The signs posted at the property are vague (at best) and the meetings are announced as TBD (which I interpret to mean: To Be Determined). This is very concerning because I'm fearful that you're going to have the meetings and NOT allow US to take part and you'll ACCEPT-OR PASS this commercial venture without our knowledge. AND WE CARE... .WE WANT TO KNOW! Please get back to me because I'll do whatever it takes to keep a commercial, especially a barking dog, venture OUT OF OUR NEIGHBORHOOD. Chandler Heights Az. 85227 I live two houses west Of the location requesting the zoning/special use peiutit. I spoke with Ms. Mullen several weeks ago when she was looking to buy the house directly next door to us. As I stated to her then, q am strongly opposed to a commercial dog boarding facility located next door to me. The property she wishes to use is located on aone lane, undeveloped, irrigation easement road, in a quiet rural residential area. The added traffic and dust, not to mention the barking dogs, this would bring to our quiet neighborhood would be unacceptable to the residents on Stacey rd. thatI have spoken with. I would greatly appreciate being kept fully informed of any and all hearings, 'meetings and findings associated with this case so that I may attend and voice my opposition to this change in zoning. Stacey Rd., Queen Creek, AZ. 85242.1 am not in favor of rezoning to allow this boarding facility here in our quiet residential neighborhood. There are other locations in the area that are already zoned for commercial/residential purposes such as locations on San Tan Blvd that runs parallel 1/2 mile north of Stacy Rd. All of us neighbors are in agreement and do not favor this action for primary concerns of noise control and the resulting property value. It is also already difficult enough for us residents to take our young children for walks w/out dogs barking through gates and fences and scaring the children. We don't need another stretch of road where the kids are afraid to go bye. Even though there is a brick wall surrounding the property, just the sound of the dogs would be too much for them. Again, I am all in favor of small businesses but this is the wrong place. If I can be of help to answer any questions or concerns, I can be reached best by phone (480)294-9296 Thank you for your time on our unified neighborhood rejection of this plan.
