Your abandonment request was granted CONDITIONAL APPROVAL.
This request will NOT be completed until all the stipulations have been met and this request is
formally adopted by City Council. It is the APPLICANT’S RESPONSIBILITY to ensure that all
stipulations are satisfied. Please contact the Abandonment Coordinator at (602) 262-7403
for questions and notification of your completion of the stipulations.
Upon completion of the stipulations your request will be scheduled for City Council formal
approval. You will receive a copy of the abandonment document after it has been recorded with
Maricopa County.
If the stipulations of abandonment are not completed within two years from the date of your
conditional approval (your expiration date is September 8, 2027), this request will then
expire. At that time a new submittal will be required along with the required payment for the
abandonment process. A one time, one year extension can be requested prior to the expiration
date, with applicable extension fee due.

Request to abandon: Request to abandon a 60-foot-wide
drainage easement totaling approximately
104,156 square feet (2.391 acres).
Purpose of request: The applicant states that the existing
drainage easement is no longer necessary
to accommodate the new development and
will be replaced with a narrower easement.

Recommends approval with the following stipulation:
1. The drainage easement can be abandoned as long as the storm drain within it is
rerouted in a new drainage easement. Also, remember that the flow coming in and going
out must be at the historical location

Stipulations of Conditional Approval
The request of abandonment ABND 250035 is conditionally approved, and the following
stipulation will need to be met:

1. Abandonment is conditioned upon the applicant/developer rerouting the existing storm
drain into a newly dedicated drainage easement, to the satisfaction of the City. The
applicant/developer shall ensure that the rerouted storm drain maintains historical flow
patterns, with both the point of inflow and the point of outflow preserved at their
historically established locations. The abandonment shall not be scheduled for City
Council consideration until the storm drain plans and the associated drainage easement
dedication have been reviewed and approved by the City.
2. The above stipulations must be completed within two years from the conditional
approval decision dated September 8, 2025.
