ITIZEN PETITION pursuant to Phoenix City Charter, Chapter IV, Sec. 22, requests the City Council to: ADOPT AN ORDINANCE AMENDING THE PHOENIX CITY CODE REGARDING iTEM-BY-ITEM PUBLIC AUTHORIZATION OF EXECUTIVE SESSION MATTERS Submitted by: Jerry Van Gasse . 4610 E Via Estrella ; Phoenix, AZ 85028 (602) 622-3515 board@goodgoat.net af nor ng?T 1a for Council Request Action quest 4 Yea recorded vote of the r the Proposed Measure exactly nrmposed Measure The ee exact act mea e Cou Col | Citizen Petition JV-20261021-08 - Presented by Jerry Van Gasse for GOODIGOAT - goodgoat net Page 2 of 9 SUMMARY The Problem Every year since at least December 2022, the Phoenix City Council has approved a list of dates for the coming year’s executive sessions. The list names no subjects and cites state law generally. Weeks or months later, a notice for each date lists the matters to be discussed and the legal authority for closing each one. No Council vote follows that notice. The vote that closes the doors is taken before anyone, including the members voting, knows what will be discussed behind them. When the Council approved the 2026 dates, the City Attorney described the item as setting the dates “for planning and getting it on the calendar.” Phoenix already knows how to do this differently. For special meetings, the notice lists each subject and its legal authority, and the Council votes in public to call the session immediately before holding it. Even there, the published results show only that the vote was “Approved,” not how each member voted, and in one case a single vote covered twelve separate matters. Nothing in the Council's rules of proceedings addresses executive sessions at all. What the Proposed Measure Does Adopt an ordinance adding a new section to Chapter 2 of the Phoenix City Code that requires each executive-session matter to appear as its own numbered agenda item and to receive its own public roll-call vote, taken after the agenda is posted and before the public is excluded, and that bars any executive session not authorized in that way. Why the Council Should Adopt It » it puts the vote where the information is. Today members vote on dates before the subjects are public (Facts 1~3). A vote taken after the subject and legal authority are public is the only vote that lets members and residents judge whether a particular matter should be closed. The ordinance requires that vote, for each matter. every time. Phoenix already does part of this. Special-meeting notices list the matter and its legal authority, and the Council votes in public to call the session immediately before holding it (Facts 4-5). The ordinance makes that sequence the rule for every executive session, with a separate vote for each matter and an individual roll call. Citizen Petition JV-20261021-08 - Presented by Jerry Van Gasse for GOODIGOAT © goodgoat net Page 3 of 9 SUMMARY « Members’ votes should be visible, matter by matter. State law requires minutes of public meetings to include “a record of how each member voted” on legal actions (Fact 8). Council Rule 7(i) counts a failure to vote or a voluntary abstention as “aye” unless excused by an announced conflict, and Rule 7(!) requires individual votes in the journal for formal actions (Fact 7). The published results of the 2025 special-meeting votes record only “Approved” (Fact 5). The ordinance puts each member's actual conduct, and any vote attributed to it, on the record for each matter. That record matters: in an Attorney General suit for a knowing violation, a court may decline to penalize a member whose objection “is noted on a public record” (Fact 9). it keeps state-law emergency flexibility. The ordinance follows the emergency procedure in A.R.S. § 38-431.02(D) and (J), adding only a public identifier for each matter and the same individual vote (Fact 11). it is a local choice the Council is free to make. State law sets the minimum. Phoenix may require more openness of itself, and this ordinance does. The Facts 1. Council Action Required Phoenix City Charter, Chapter IV, Section 22 provides that a written petition presented to the Council at a regular meeting shall be acted upon by the Council in the regular course of business, within fifteen (15) days. Section 8 provides that the Council shall act only by resolution, ordinance, franchise, or formal recorded action. The Proposed Measure is an ordinance. Acting upon this petition requires that vote, as its own Formal Agenda item, with this Request and the Proposed Measure attached. Any change in the substance of the Proposed Measure, in whole or in part, makes it a different measure from the one proposed by the petitioner, and a vote on it is not action on this petition. Referral, a staff report, a General Information Packet entry, continuation, or a consolidated vote also does not act upon this petition. ORDINANCE G- AN ORDINANCE AMENDING CHAPTER 2, PHOENIX CITY CODE, BY ADDING SECTION 2- , RELATING TO ITEM-BY-ITEM PUBLIC AUTHORIZATION OF EXECUTIVE- SESSION MATTERS. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PHOENIX as follows: SECTION 1. That Chapter 2, Article II of the Phoenix City Code is hereby amended by adding Section 2- to read as follows: 2- . ITEM-BY-ITEM PUBLIC AUTHORIZATION OF EXECUTIVE-SESSION MATTERS. A. EXCEPT AS PROVIDED IN SUBSECTION H FOR AN ACTUAL EMERGENCY, BEFORE THE PUBLIC IS EXCLUDED FROM ANY MEETING, EACH MATTER PROPOSED FOR EXECUTIVE- SESSION CONSIDERATION SHALL BE IDENTIFIED AS A SEPARATELY NUMBERED ITEM ON A PUBLICLY POSTED AGENDA. EACH ITEM SHALL STATE THE GENERAL SUBJECT TO BE CONSIDERED AND EACH PROVISION OF LAW ASSERTED AS AUTHORITY FOR EXCLUDING THE PUBLIC. B, AFTER THE AGENDA REQUIRED BY SUBSECTION A HAS BEEN POSTED AND BEFORE THE PUBLIC IS EXCLUDED, THE COUNCIL SHALL TAKE A SEPARATE PUBLIC ROLL-CALL VOTE TO APPROVE OR DENY EXCLUSION OF THE PUBLIC FOR EACH SEPARATELY NUMBERED EXECUTIVE-SESSION MATTER. THE MOTION SHALL IDENTIFY THE AGENDA ITEM AND EVERY STATUTORY AUTHORITY ASSERTED FOR THAT MATTER. IF PRIOR AGENDA POSTING IS NOT POSSIBLE IN AN ACTUAL EMERGENCY PERMITTED BY A.R.S. § 38-431.02(D), SUBSECTION H SUPPLIES THE ALTERNATE IDENTIFICATION AND ANNOUNCEMENT PROCEDURE. C. EACH COUNCIL MEMBER WHO IS PRESENT AND HAS NOT ANNOUNCED A CONELICT OF INTEREST SHALL BE CALLED INDIVIDUALLY AND SHALL ANSWER “AYE” OR “NAY” ON EACH MATTER. IF AMEMBER INSTEAD VOLUNTARILY ABSTAINS, FAILS TO ANSWER, OR REFUSES TO ANSWER, THE CITY CLERK SHALL RECORD THE MEMBER’S CONDUCT ACCURATELY AS A VOLUNTARY ABSTENTION, FAILURE, OR REFUSAL, AS APPLICABLE. D. FOR EACH MATTER, THE JOURNAL SHALL SEPARATELY IDENTIFY EVERY MEMBER’S STATED VOTE, ABSENCE, ANNOUNCED CONFLICT OF INTEREST, VOLUNTARY ABSTENTION, FAILURE TO ANSWER, OR REFUSAL TO ANSWER. IF THE CHARTER OR THE COUNCIL RULES IN SECTION 2-60 ATTRIBUTE A VOTE TO A VOLUNTARY ABSTENTION, FAILURE, OR REFUSAL, THE JOURNAL SHALL RECORD BOTH THE MEMBER’S CONDUCT AND THE VOTE LEGALLY ATTRIBUTED TOIT. A FE. APPROVAL OF A MEETING CALENDAR, MEETING DATE, LIST OF DATES, OR OTHER SCHEDULING MEASURE DOES NOT AUTHORIZE EXCLUSION OF THE PUBLIC FOR ANY MATTER SUBSEQUENTLY ASSIGNED TO A SCHEDULED DATE. A SINGLE VOTE ON MULTIPLE SEPARATELY NUMBERED EXECUTIVE-SESSION MATTERS DOES NOT SATISFY THIS SECTION. F. NO EXECUTIVE SESSION SHALL CONVENE, AND NO PERSON SHALL EXCLUDE THE PUBLIC FROM A MEETING, UNLESS THE COUNCIL HAS APPROVED THE EXCLUSION BY THE VOTE REQUIRED BY THIS SECTION AND APPLICABLE LAW FOR THE SPECIFIC MATTER AND EVERY STATUTORY AUTHORITY ASSERTED FOR THAT MATTER. G. IF THE PUBLIC MEETING RESUMES AFTER AN EXECUTIVE SESSION AND THE COUNCIL LATER PROPOSES TO EXCLUDE THE PUBLIC AGAIN, THE COUNCIL SHALL TAKE A NEW VOTE UNDER THIS SECTION, INCLUDING WHEN THE SAME MATTER WAS AUTHORIZED EARLIER IN THE MEETING. H. INAN ACTUAL EMERGENCY GOVERNED BY A.R.S. § 38-431.02(D) AND (J), THE PRESIDING OFFICER SHALL ASSIGN EACH EMERGENCY MATTER A SEPARATE PUBLIC IDENTIFIER AND, IMMEDIATELY BEFORE EXCLUDING THE PUBLIC, PUBLICLY ANNOUNCE THE MATTER, EVERY ASSERTED STATUTORY AUTHORITY, AND THE REASONS NECESSITATING EMERGENCY CONSIDERATION. THE REASONS SHALL BE PLACED IN THE MINUTES AS REQUIRED BY A.R.S. § 38-431.02(J). THE COUNCIL SHALL THEN TAKE THE SEPARATE PUBLIC ROLL-CALL VOTE REQUIRED BY THIS SECTION. I. THIS SECTION IS NOT SUBJECT TO SUSPENSION OR MODIFICATION UNDER RULE 10(B) OF SECTION 2-60. SECTION 2. NO APPROPRIATION. This Ordinance appropriates no funds. SECTION 3. SEVERABILITY. If any provision of this ordinance or its application to any person or circumstance is held invalid, the invalidity does not affect any other provision or application that can be given effect without the invalid provision or application.
