Citizen Participation Report for A King Steel Conditional Use Permit Request 660 E. 38th Ave, Apache Junction, AZ Case #: P-26-62-PDR October 14, 2026 INTRODUCTION: This Citizen Participation Report is included in conjunction with an application for a Conditional Use Permit application. The subject site is currently zoned B-5 Industrial within the City of Apache Junction, Arizona. The use of Steel Fabrication is allowed in this zoning district with an approved Conditional Use Permit (CUP). This application seeks to obtain that CUP to allow for this heavy industrial uses on the subject site. The Citizen Participation Report was prepared in accordance with City of Apache Junction Citizen Review Process & Procedures. As prepared, this Participation Report meets the City’s requirements and includes the recommended 300 foot notification area as identified by the Planning Department. The purpose of this report is three-fold: first, to identify the persons who may be directly affected by the proposed CUP; second, to identify any interested parties that need to be notified as a result of the proposed CUP request; and third, to provide an opportunity for area residents and interested parties to provide comments on the proposed CUP application prior to the public hearing so that if any issues arise they can be resolved before the hearing. PARTIES AFFECTED BY APPLICATION: The proposed CUP application may be of interest to all surrounding property owners. Their interest may include the need for the request, circulation, traffic patterns, and types of use. Those stakeholders and parties most likely to be affected by the CUP request include the following: • All property owners within 300’ of the subject site. • Any other interested person(s) or party as identified by City planning staff. NOTIFICATION AND INFORMATION PROCEDURES: The following Citizen Participation Report process has occurred or will occur soon: • The Citizen Participation Plan was approved by the Planning Department; a notification letter of the CUP request was sent by first class mail to all property owners within 300-feet of the subject site. • The notification letter informed the property owners/residents and/or interested parties of the CUP filing and a neighborhood meeting. The notification letter contained the following information: Purpose and description of request, brief description of request, a conceptual site report, applicant contact person, and applicant contact information such as address, phone, e-mail, and fax number, along with information about the neighborhood meeting at either the City of Apache Junction Multi- Generational Center. • There have been no substantial changes or amendments to the proposed CUP application after the applicant’s initial contact with those property owners within 300-feet of the subject site, any neighbors that reach out have been contacted by the applicant. There was one neighbor that reached out and we are in ongoing discussion to agree to mitigations. • The site was posted as per the City of Apache Junction code. RESPONSE PROCEDURES: The notification letter included the applicant’s contact person, and applicant’s contact information and encouraged property owners or interested parties to contact the applicant to express any concerns, issues, or problems or if they had simply want more information on the application. Questions and issues that were brought up from the notification letter have been included at the end of this report. These questions and issues were addressed in the following manner: • The applicant met with and worked with the single individual who responded to discuss the proposed development and to work to mitigate any concerns. A meeting was scheduled with this individual and discussions regarding the details of the mitigation plan were provided via email. • Information and questions by phone, e-mail or fax were answered immediately by the applicant. • Questions arose requiring potential change to the site were posed and answers were provided. The applicant’s project team reviewed the issues and determined how those were addressed to meet the needs of the property owner. • If the City perceives that there are still any unaddressed issues, the applicant’s project team will meet with City staff to discuss the issues and make appropriate changes prior to the public hearings. • A copy of the issues and narratives have been provided to the Planning Department in the form of this Citizen Participation Report. • The Citizens Participation Plan outlined the process, neighborhood comments, participation efforts and how questions and issues were addressed, in accordance with City of Apache Junction requirements. SCHEDULE FOR COMPLETION: As noted previously, notification and participation efforts occurred as follows: • Initial notification – a notice of this application was mailed to all property owners within 300’ of the subject site (as well as any other interested parties as identified by staff), and the subject site was posted per City of Apache Junction requirements. This notice also included information about when and where the neighborhood meeting was held. • Upon receiving approval of this Citizens Participation Report and notification by City of Apache Junction staff that the conditional use permit is scheduled for public hearings, the site posting will be modified to reflect the public hearing dates if needed. This will be completed at least 15 days prior to any public hearings (to the extent possible). The notification process used the following schedule: ACTION DATE Citizen Participation Plan Approval. September 2026 Send out Notification letters. September 2026 Hold a Neighborhood Meeting. October 2026 There was no need to meet with the Planning October 2026 Department to follow-up on any unresolved issues. Submit Citizen Participation Final Report. October 2026 STATUS PROCEDURE: The applicant recognizes that it is to our benefit to keep City of Apache Junction Planning Department staff apprised of the notification efforts that occur, and any responses received by any interested party. Therefore, the applicant, in addition to the Citizen Participation Report noted above, has kept staff apprised of meetings and discussions through periodic correspondence, including letters and/or e-mails, as well as phone calls. Additional notices of status changes will occur as necessary and/or requested by the City of Apache Junction. NEIGHBORHOOD MEETING RESULTS A meeting was held on October 8th, 2026 at the Town of Apache Junction Multigenerational Center, located at 1035 N Idaho Road in Apache Junction. There were a total of five people in attendance, all from the development team and representative. The meeting concluded at 7pm with no one else in attendance. The sign-in sheet for the meeting has been attached to the end of this report. RESOLUTION OF CONCERNS FROM NEIGHBORING BUSINESS OWNER One neighboring business, adjacent to the subject site, reached out with several concerns about the proposed CUP. The neighbor said that he could not make the meeting but offered a list of concerns. The applicant responded to the neighboring business owner and provided a detailed response to each of the issues raised by the adjacent business, which is an RV self-storage facility. Both parties agreed to the suggested mitigations and have arrive at workable solutions for all involved. A copy of the initial email from the neighboring business and the proposed resolutions have been attached at the end of this email. The adjacent business owner also visited the site to confirm the conditions and better understand how the proposed mitigations will work on the site. The applicant met with the neighbor and walked the site together on Thursday October 15, 2026. Current as of 10/15/26 On Friday October 16, 2026 Mr. Barry Raber provided an email that agrees to the 30 foot setback from their common property line that provides a fabric free buffer that assists in keeping potential sparks from going into the adjacent property. It also asks that as operations ramp up they will revisit any potential issues with sound, and odor and develop workable mitigations. With these two comments, Mr. Raber said he is “good to go”, with our application for the CUP. This email was provided to staff. Current as of 10/16/26 On October 21st an additional letter of support was provided to staff from the nearby “Sportsman’s Concrete business.” It was requested that this be included in the file for this application. Current as of 10/21/26 CONCLUSION There were no others in attendance or that brought forth any additional comments. We feel that adequate answers and mitigations were provided and detailed sufficiently to move the application forward for hearing. If any additional information or concerns are brought up they will be included in an amended version of this report. Those additional issues/concerns or resolutions have been added immediately above with the date they were added to the report. All issues have been resolved and all individuals or business that are currently in support of this application at of October 29, 2026. September 22, 2026 Dear Community Member, This notification letter is to inform you about an application for a Conditional Use Permit to allow for a steel fabrication business as an industrial use within the B-5 industrial zoning district on the parcel shown in the map to the right. This request for a conditional use permit is not a SITE change of zoning since the property is already zoned B-5 for industrial uses. Rather, this application is an additional layer of approval. A.King Steel has committed to mitigating potential issues in advance to resolve any concerns ahead of time related to sound, odors, glare, lighting, smoke, and heat. Traffic will be minimal and will produce less traffic than the previous use, which was a towing business with a vehicle impound yard. A steel fabrication business with several employees will not generate the same traffic and the circulation, roadways and parking will be adequate to allow for a steel fabrication business. Work will occur indoors and outdoors. The hours of operation will be from 6am to 4:30pm Monday through Friday. The site is surrounded by other industrial uses and is compatible with uses within the Baseline Industrial Park. We are hosting a neighborhood meeting to provide members of the community with an opportunity to meet with us, provide feedback, and ask questions. Information for that meeting is contained below. If you cannot make the meeting but want more information or want to provide feedback, please call or email us at the number and email address below. Neighborhood Meeting Information The neighborhood meeting will be held in an open house format so that you can come and go at your convenience. The doors will open at 6pm and will be there until 7p. You can come by anytime during that window. Here are the details: Location: Apache Junction Multi-Generational Facility (MGC), located at 1035 N Idaho Road Apache Junction, AZ 85119. As a result we discuss the following responses with him last night at the neighborhood meeting. Please find below a more detailed set of defined mitigation with specific measures and evaluation/enforcement methods. I’ve also provided an explanation in (italics) for each response so that you may better understand our client’s perspective. Let me know if you have any comments, or if you would like to jump on a call Tuesday of next week. Mitigations Fire and spark risk to stored vehicles A 30 -foot no-spark-work setback from the portion of the property line that is shared, will be established. All outdoor hot-work activities will occur outside of the 30-foot setback. Fire extinguishers shall be located near hot-work equipment on site. Specific hot-work and fire-watch procedure shall include inspection of the work area after hot work is completed. (Explanation - This setback along with a metal screen wall fence along the common portion of the shared boundary will help to mitigate many of your concerns, especially the sparking, viewing arc welds along with dampening the sound.) Work start times As a mitigation commitment, fabrication activities, particularly grinding, impact tools, hammering, steel loading/unloading, crane operations shall be prohibited before 5:00 a.m. Monday through Saturday from May through August 6am all other months. No work shall occur after 10pm. Work on Saturday shall occur from 7a-8pm. A solid, continuous noise barrier along the portion of the shared boundary will be considered to mitigate noise and welding lights and welding arcs. (Explanation - Our client feels very strongly about creating a safe work environment for their employees who do heavy work outside. They believe that employees should be able to start early, as construction workers would, since it is far too hot in our Phoenix summers to start outdoor work later than that. This especially important for worker that are working heat and hot material. We ask for your extra consideration for those that need to work outside to complete their jobs) Metal dust, smoke, and fumes Indoor actives will use a local exhaust ventilation, portable fume extraction, dust collection, or other appropriate controls. Cutting, grinding, and welding will typically occur within designated outdoor work areas and shall be positioned away from the RV storage boundary, when possible. Daily housekeeping procedures will prevent accumulation and windblown migration of metal debris and periodic cleanups of paved areas will occur daily. (Explanation – this mitigation will ensure daily housekeeping, ensure that work is done at least 30 feet from your property line and explains that work indoors will include additional measure of precaution, but that those conditions differ from working outside in the open air.) Glare and light No lighting should directly illuminate the RV storage property. Security lighting should be limited to the minimum necessary for safety and security. Welding screens or curtains should be installed around stationary welding areas to prevent direct visibility of welding arcs from neighboring properties in addition to the extended solid barrier that will be put up between the common portion of the property line. (Explanation – The combination of the both the extended opaque screen wall and the welding screens and curtains will eliminate the majority of, light, glare, and views of the welding arcs. Lighting is needed to provide safe working conditions.) Heavy truck traffic Truck loading/unloading shall occur away from the shared RV storage boundary outside of the 30- foot setback area. Semis and material-handling equipment will occur in clearly defined unloading staging areas. No off-loading or truck traffic will occur on 37th Avenue. (Explanation - Truck traffic is anticipated to be far less than other nearby industrial uses that are closer to the RV storage facility on 37th Avenue. The only place there may some additional traffic will be a shared drive on Winchester Rd. Which is also used by Ikon Steel, Sunstate Equipment, Empire Rentals, and Sportsman’s Concrete (all heavy industrial uses with significantly more semi- truck use than this use would produce). Other mitigation commitments The site plan, development narrative, and conditions of approval, will serve as enforcement tools. A written Operations and Mitigation Plan identifying operating hours, hot-work locations, noise controls, lighting, dust/fume controls, truck circulation, fire-safety procedures, and complaint- response procedures will be provided upon request. City mechanism for addressing violations shall be honored and enforced. (Explanation – We discussed adding these specific conditions to the project narrative with our staff planner. He said that would be good since the narrative is part of the record for this case and would document how enforcement and other conditions would be monitored and evaluated if issue come up in the future. The city has its own enforcement measures if a business is out of compliance with code or conditions of a Conditional Use Permit.) Impact on business and property value Create a 30-foot screening and operational buffer along the shared property line. A solid or equivalent noncombustible screen will occur on the portion of shared boundary with the RV storage property. Outdoor fabrication, hot work, and truck loading areas will be kept outside of the 30-foot buffer boundary, but material may be stored within buffer. The buffer will be maintained in a clean and orderly fashion. City driven complaint-response will be used to substantiated claims involving noise, dust, smoke, lighting, sparks, or traffic. (Explanation – The standard method for enforcement is the city complain driven process. Any issues that arise will then be investigated by staff to ensure compliance from a neutral third party). Our client has agreed to these additional restrictions to directly respond to your specific comments. This email exchange will be included in our report to city staff showing that we are offering reasonable solutions for a use that is only allowed in this industrial district. This use is not allowed nowhere else within the town of Apache Junction; this is one of the few location where a business as this can be located. It is also a location where residential uses are typically not allowed, so that these uses can occur somewhere that is safe and away from residential uses. As mentioned above we would be more than glad to continue the dialog and further discuss our efforts to meet your requests. Thank you for email, we hope that your concerns have been addressed to your satisfaction. Best regards, Michael S. Buschbacher II, AICP Principal Planner Earl & Curley (602) 265-0094 3101 N. We have some serious concerns about this. Because I live in Oregon, I cannot make it to the meeting on Thursday. Our facility stores customers' recreational vehicles, trailers and boats under covered canopies that sit along our shared boundary. We also have an on-site resident manager who lives on the property full-time for security purposes. This makes our parcel a residence as well as a business, and it places both people and high-value property within a short distance of the proposed outdoor fabrication work. Our concerns are as follows: 1. Fire and spark risk to stored vehicles. Outdoor cutting, welding and grinding throw sparks and hot slag. Our canopies shelter RVs and trailers that carry fuel, propane tanks and batteries. A single ignition at the property line could spread across multiple vehicles and endanger our resident manager. 2. Noise beginning at 6:00 a.m. Steel fabrication involves grinding, hammering, impact tools, cranes and the loading of steel. Starting at 6:00 a.m. five days a week, this noise would directly affect our resident manager, who lives on site, as well as customers accessing their vehicles. 3. Metal dust, smoke and fumes. Grinding and cutting outdoors releases fine metal particulates and welding fumes. These can drift onto stored vehicles, causing rust spotting and finish damage that our customers will hold us responsible for. They also raise health concerns for our resident manager. 4. Glare and light. Welding arcs produce intense, flickering light that is visible well beyond the work area, along with any added security or work lighting. 5. Heavy truck traffic. Steel is delivered and shipped on flatbed semis, often with forklift or crane loading. This is a different kind of traffic from a towing business, and it adds wear, congestion and safety risk on the shared roads our customers use to tow and drive large RVs. 6. Mitigation commitments are undefined. The notice says A. King Steel "has committed to mitigating potential issues" related to sound, odors, glare, lighting, smoke and heat. It does not say how. Without specific measures, there is no way for neighbors or the City to evaluate or enforce them. 7. Impact on our business and property value. RV storage customers choose a facility for safety and cleanliness. A fabrication yard on our boundary threatens customer retention, occupancy and the value of our property.
