Contract No. C-22-22-110-X-07 Amendment No. 7 City of Surprise Page 1 of 4 AMENDMENT NO. 7 TO THE INTERGOVERNMENTAL AGREEMENT BETWEEN MARICOPA COUNTY ADMINISTERED BY ITS HUMAN SERVICES DEPARTMENT AND CITY OF SURPRISE I. Maricopa County (“County”), administered by its Human Services Department, and the City of Surprise, (“Subrecipient”) entered into a financial Intergovernmental Agreement (“Agreement”), on or about August 10, 2022. The purpose of the Agreement is for the Subrecipient to provide Community Action Program (CAP) services to include crisis case management, coordination of services to assist low-income households in crisis situations, and assistance to move closer to economic self-sufficiency in Surprise. Funding for CAP Services is provided to the Subrecipient through an Intergovernmental Agreement (IGA) between Maricopa County and Arizona Department of Economic Security (ADES) under IGA DI25-002428 (C-22-26-011-X-00). The County and the Subrecipient collectively are referred to as the “Parties.” The Parties entered into Amendment No. 1 on or about March 28, 2023. Section 4 (Budget and Compensation), Paragraph 1.2 (Funding), Subparagraph 1.2.3 was replaced in its entirety to address funded positions. The Operating Budget in Section 4 (Budget and Compensation), Paragraph 1.5 (Operating Budget) was increased to a total of $536,250 for Fiscal Year 2023. The Parties entered into Amendment No. 2 on or about June 28, 2023. The Amendment extended the Agreement through June 30, 2024. Section 3 (Work Statement) was replaced in its entirety. The Operating Budget in Section 4 (Budget and Compensation), Paragraph 1.5 (Operating Budget) was replaced in its entirety with a not to exceed funding amount of $482,625 for Fiscal Year 2024. The Parties entered into Amendment No. 3 on or about June 26, 2024. The Amendment extended the Agreement through June 20, 2025, changed the County point of contact and the Uyghur Forced Labor Prevention Act (UFLPA) provision was added to the Agreement in Section 1 (General Provisions). In Section 4 (Budget and Compensation) the Assistance Listing Number (ALN) 21.027 for the American Rescue Plan Act (ARPA) was added and the Operating Budget was revised and replaced in its entirety with a not to exceed funding amount of $386,100 for Fiscal Year 2025. The Parties entered into Amendment No. 4 on or about February 13, 2025. The Amendment increased funding in an amount not to exceed $4,224 for Fiscal Year 2025. Updated County point of contact and Administrative Change Order Language. Required contract language was added to the Agreement. Incorporated Federal Award Identification Number (FAIN) and Award date into the Agreement in Section 4 (Budget and Compensation). The Operating Budget in Section 4 (Budget and Compensation), Paragraph 1.5 (Operating Budget) was replaced in its entirety with a not to exceed funding amount of $390,324 for funding period from July 1, 2024, through June 30, 2025. The Amendment increased funding by $115,000 in American Rescue Plan Act (ARPA) State and Local Fiscal Recovery Funds (SLFRF) under (ALN) 21.027 for Fiscal Years 2025 and 2026 to administer the ADOH Housing Stability Flex Program and extended the term of the Agreement through June 30, 2026. Section 3 (Work Statement) was revised and replaced in its entirety, and the ARPA SLFRF Federal Award Identification Number (FAIN) and Award date were incorporated into the Agreement in Section 4 (Budget and Compensation). The Parties entered into Amendment No. 6 on or about July 2, 2025. The Amendment extended the Agreement through June 30, 2026, and retroactively from July 1, 2024, the City of Surprise is identified as “Subrecipient.” The Amendment awarded funding in the amount of $386,100 for Fiscal Year 2026 through the County’s IGA with ADES for CAP services. The Agreement added paragraph Acronyms and Definitions. Section 2 (Special Provisions), Paragraph 4.0 (System for Award Management) was revised to add subparagraph 4.4. Section 3 (Work Statement) was replaced in its entirety. The Operating Budget in Section 4 (Budget and Compensation), Paragraph 1.5 (Operating Budget) was replaced to reflect $386,100 in CAP funding for the budget period July 1, 2025, through June 30, 2026, combined with ARPA funding awarded in Amendment 5 in the amount of $115,000, for a budget total of $501,100. The County and the Subrecipient collectively are referred to as the “Parties.” II. The Parties agree to enter into this Amendment No. 7 to amend the Agreement as follows: A. Revise the Agreement amount to increase the CAP services funding by $27,250 in ARPA-SLFRF funds under ALN 21.027, for Fiscal Year 2026 (FY26), funds to be fully expended by June 30, 2026. B. Revise Section 4 (Budget and Compensation), Paragraph 1.5 (Operating Budget) by removing it in its entirety and replacing it with the attached Operating Budget, Fiscal Year 2026 CAP Services Operating Budget, herein incorporated by reference. III. Section II above contains all the changes to the Agreement made by this Amendment No. 7. The Agreement is amended to incorporate the changes contained in this Amendment No. 7. All other terms and conditions of the Agreement remain the same and in full force and effect as executed by the Parties. This Amendment No. 7 is subject to and incorporates the provisions of A.R.S. § 38-511. Contract No. C-22-22-110-X-07 Amendment No. 7 City of Surprise Page 3 of 4 IV. The Parties have authorized the undersigned to execute this Amendment No. 7, and it shall be effective upon approval and signature by both Parties.
