The applicant is requesting to amend the IND-2 IUPD zoning for the Harquahala Energy
Generation & Industrial Campus (HEGIC South). This will allow for several additional industrial
uses on a 690 acre portion of four parcels of the overall 9,048 acre Harquahala Sun III-IV site. The
subject site is designated as a ‘Utilities’ land use per Maricopa County’s Vision 2030
Comprehensive Plan ( CPA2021010). There is not a precise plan of development at this time, but
will be submitted for administrative approval prior to construction permitting.
•
Water/sewer is currently via well and septic. Staff has included a condition that IND-2 entitled
uses are limited to those that can be accommodated via onsite wastewater and water until sewer
and water system connections are available to the site. The site is already zoned industrial which
is consistent with area land use and development patterns.
•
The nearest major roads to the site are Baseline Rd. and Harquahala Valley Rd. Site access is
undetermined until a formal Plan of Development is established. The site is located within an
established industrial area served by streets designed for future industrial traffic.
•
The Maricopa County Vision 2030 Comprehensive Plan designated the site as Rural Development
Area. Per the pending but not yet adopted Maricopa County Framework 2040 Comprehensive
Plan, the site is within a Rural Service Area. The subject use remains appropriate due to its
proximity to electrical transmission infrastructure, the APS Delaney Substation, and the existing
Harquahala Power Plant located a few miles to the south. The surrounding area consists of
approximately 30,000 acres of approved utility and industrial uses, including multiple solar

projects, battery energy storage facilities, and the Harquahala Power Plant, making HEGIC South
a natural continuation of the established industrial character of the Harquahala Valley.
•
There are not any outstanding concerns from reviewing agencies.
•
The applicant complied with the public participation requirements according to MCZO Section
304, including notification of property owners within 300’ of the subject site and posting. Staff
has not received any public comment.
Commission
Recommendation:
On 3/5/26, the Commission voted 6-0 (motion by Vice Chair
Hernandez D5, seconded by Commissioner Rochwalik D3) to
adopt a motion recommending the Board of Supervisors
approve Z250024 subject to conditions ‘a’ – ‘i’:
a.
Development shall be in substantial conformance with the zoning exhibit entitled
“Harquahala Energy Generation and Industrial Campus South” consisting of 1 full-size sheet,
dated July 2, 2025 except as modified by the following conditions. Staff may determine
slight refinements to remain in substantial conformance with the approved site plan. Minor
and major amendments to the site plan will be determined in accordance with Chapter 3 of
the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the narrative report
entitled “HARQUAHALA ENERGY GENERATION & INDUSTRIAL CAMPUS (HEGIC) SOUTH”,
consisting of 11 pages, dated December 11, 2025 except as modified by the following
conditions.
c.
The following Planning Engineering conditions shall apply:
1.
Engineering review of planning and/or zoning cases is for conceptual design only. All
development and engineering design shall be in conformance with Section 1205 of
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.
2.
Based on the conceptual design nature of the information submitted, changes to the
site layout may be necessitated by the final engineering design of the site’s drainage
infrastructure.
3.
Maricopa County does not supply water, fire or sewer services. It is the
applicant/owner’s responsibility to coordinate and secure water, fire and sewer
services for this site.
4.
Sealed final Grading and Drainage (Site Infrastructure) Plans and Sealed Final
drainage report must be submitted with the application for Building Permits.
d.
The following IND-2 IUPD Zoning District standards shall apply:
1.

3. Maximum Lot Coverage - 60%, solar panel arrays are not calculated as lot coverage.
4. Article 902.91 – All uses except for parking, loading, unloading, storage, electric
generation, electric storage and electric transmission infrastructure shall be
conducted within a completely enclosed building.
5. Site Enclosure and Screening – At a minimum, chain-link fencing and gates shall be
allowed on the perimeter of the project. One (1) foot of barbed wire strands will be
incorporated atop 6-foot fencing for additional security. Up to 12' aluminum anti-climb
fencing allowed.
6. Permitted uses – Solar electric generating facility and Battery Energy Storage System
(BESS) – including ancillary offices and ancillary uses only, Gas generating facility and
ancillary uses including accessory electrical substation, other power equipment, and
distribution facilities. Water storage and treatment. All Uses Permitted in the IND-2
Zoning District where wastewater can be accommodated via onsite septic and water
systems until such time that sewer and/or water service is available to the site.
e.
Noncompliance with any Maricopa County regulation shall be grounds for initiating a
revocation of this zone change as set forth in the Maricopa County Zoning Ordinance.
f.
The IUP overlay is applied to restrict the use of the site. Until such time as the site is served
by sewer, uses on the site shall only be those acceptable to the Maricopa County
Environmental Services Department (MCESD) that can be accommodated by septic
systems. A public water system and public sewer system shall be required prior to
establishment of any non-residential use that requires potable water.
g.
Administrative approval of a Plan of Development will be required prior to approval and
issuance of construction permits to develop and establish use of the site. Prior to issuance
of a building permit, written confirmation will be required from the emergency fire protection
jurisdiction having authority that the facility has been designed in accordance with their
regulations and requirements, and that emergency fire protection service will be provided
to the facility. Prior to issuance of the certificate of occupancy, local fire protection
jurisdiction review and approval will be required.
h.
The property owner/s and their successors waive claim for diminution in value if the County
takes action to rescind approval due to noncompliance with conditions.
i.
The granting of this change in use of the property has been at the request of the applicant,
with the consent of the landowner. The granting of this approval allows the property to
enjoy uses in excess of those permitted by the zoning existing on the date of application,
subject to conditions. In the event of the failure to comply with any condition, the property
may be considered for reversion to the zoning that existed on the date of application in
accordance with Maricopa County Zoning Ordinance requirements. It is, therefore,
stipulated and agreed that reversion of the zoning due to the failure to comply with any
conditions does not reduce any rights that existed on the date of application to use, divide,
sell or possess the property and that there would be no diminution in value of the property
from the value it held on the date of application due to such reversion of the zoning. This
zone change enhances the value of the property above its value as of the date the zone
change is granted, and reverting to the prior zoning results in the same value of the property
as if the zone change had never been granted.

Project Summary:
1.
The applicant, Keith Nichter, is requesting to amend the IND-2 IUPD zoning for the Harquahala
Energy Generation & Industrial Campus (HEGIC South). This will allow for a data center use on a
690 acre portion of four parcels of the overall 9,048 acre Harquahala Sun III-IV site. The subject
site is designated as a ‘Utilities’ land use per Maricopa County’s Vision 2030 Comprehensive Plan
( CPA2021010). There is not a precise plan of development at this time, but will be submitted for
administrative approval prior to construction permitting.
2.
The proposed amendment would expand allowed uses to include gas generating facilities and
ancillary uses including accessory electrical substation, other power equipment, distribution
facilities, water storage and treatment, and all uses permitted in the IND-2 zoning district (where
wastewater disposal can be accommodated via on-lot septic systems). To accommodate these
additional uses, the applicant requests an increase in maximum height from 60’ to 90’, not
including gas generating facility stack height up to 199’. Maximum electrical transmission line
height would increase from 150’ to 199’. Site enclosure standards would be modified to allow up
to 12’ aluminum anti-climb fencing in addition to the currently permitted chain-link fencing with
barbed wire. The amendment also clarifies that all uses except parking, loading, unloading,
storage, electric generation, electric storage, and electric transmission infrastructure must be
conducted within completely enclosed buildings. All other development standards including
setbacks, lot coverage, landscaping, parking, and paving requirements remain unchanged from
the original approval.

Maricopa County Vision 2030 Comprehensive Plan (adopted 2013): The site is designated as
Utilities. The Utilities designation is for electric generating plants, water, and wastewater
treatment facilities, associated offices, and accessory equipment. The subject site is designated
as a ‘Utilities’ land use per Maricopa County’s Vision 2030 Comprehensive Plan following a Major
Comprehensive Plan Amendment approved by the Board of Supervisors on December 8, 2021 per
case CPA2021010. Under a Utilities designation, the appropriate zoning district is IND-2.

Staff Analysis:

Maricopa County recognizes the need for diverse energy generation resources to support grid
reliability and renewable energy integration. The proposed amendment to allow gas generating
facilities and other industrial uses at HEGIC South would complement the existing solar and
battery energy storage approvals by providing quick-starting, fast-ramping power generation
capacity. The gas generating facilities would support the integration of renewable solar energy in
the Harquahala Valley area while providing reliable backup generation during periods of peak
demand or limited solar availability. The proposed facilities would comply with all local, state, and
federal air quality regulations, with emissions monitored and reported pursuant to air permit
requirements.

Staff believes the proposed industrial uses are well suited to this remote area, which is already
characterized by utility and industrial development. The subject site remains appropriate due to
its proximity to electrical transmission infrastructure, the APS Delaney Substation, and the
existing Harquahala Power Plant located a few miles to the south. The surrounding area consists
of approximately 30,000 acres of approved utility and industrial uses, including multiple solar
projects, battery energy storage facilities, and the Harquahala Power Plant, making HEGIC South
a natural continuation of the established industrial character of the Harquahala Valley. The
proposed gas generating facilities and associated infrastructure would not detrimentally affect
the area given the remote location and existing industrial context.
12.
The expansion of allowed uses at HEGIC South reinforces Maricopa County's role as a leader in
energy infrastructure development. The proposed amendment would promote economic diversity
and employment opportunities by providing permanent campus employment as well as hundreds
of construction jobs during development. Once operational, the site will contribute to the local
economy through real and property taxes, helping to fund public services and infrastructure within
Maricopa County. The amendment supports the comprehensive plan by recognizing the need to
redesignate land uses in response to changing market conditions and increasing demands for
energy generation capacity. As such, staff recommends approval of this zone change major
amendment with conditions of approval that ensure the site remains appropriate for the area.
13.
Staff notes that the proposed amendment requests "all uses permitted in the IND-2 zoning
district" as allowed uses. This can be problematic as most general industrial uses will require
public water and wastewater. However this site and surrounding area is an industrial area
characterized by power generation, storage and distribution uses for which wastewater can be
accommodated via septic systems. One of the proposed new uses are data centers. These can
be appropriate when located remove from residential neighborhoods. It is appropriate to locate
them in conjunction with power generation and storage due to their high power demand. Staff
recommends approval of the amended IND-2 IUPD zoning but with condition that IND-2 entitled
uses are limited to those that can be accommodated via onsite wastewater and water until sewer
and water system connections are available to the site. The site is already zoned industrial which
is consistent with area land use and development patterns.
Recommendation:
14.
Staff recommends the Commission adopt a motion recommending that the Board of Supervisors
approve Z250024 subject to the following conditions ‘a’ – ‘j’:
a.

1. PURPOSE OF REQUEST
Kimley-Horn, on behalf of Harquahala Campus LLC (the “Applicant”) with permission of CV Harquahala LLC
(the “property owner”) is proposing a Zone Change Major Amendment to update a portion of the existing IND-
2 IUPD zoning (Z2023131) to amend the conditions, IUPD zoning & the approved POD to allow for other
industrial uses on four parcels, of the larger Harquahala Sun III-IV project, to allow for the development of the
±697.77-acre Harquahala Energy Generation & Industrial Campus (HEGIC) South (the “Project”).
Harquahala Sun III-V is an approved ±9,047.58-acre Photovoltaic Solar Energy Generation and Storage project
that received unanimous Board of Supervisors approval for a Major CPA, from Rural Development Area to
Utilities, on December 7, 2022 with a subsequent Zone Change with Overlay, from RU-43 and RU-190 to the
IND-2 IUPD with a Plan of Development (POD), approval on July 24, 2024.

In addition to the utility-scale solar energy generation and battery energy storage system (BESS) uses currently
allowed, this proposal will look to make a significant investment within Maricopa County by providing residents
with additional crucial energy generation uses such as gas generating facilities and other ancillary uses, as
shown in Table 1: Industrial Unit Plan of Development.
Together, these facilities will maximize renewable energy available on the grid, providing substantial resources
for local electric providers servicing the growing Arizona population centers, contributing to grid resilience and
reliability. HEGIC South will also be a key contributor to numerous sustainability goals including reduced water
consumption in electricity generation and decarbonization of the grid by providing essential resource adequacy
capacity and reliability.

2. DESCRIPTION OF PROPOSAL
The Harquahala Energy Generation & Industrial Campus South is approximately 11 miles south-west of
Tonopah within the Harquahala Valley area and is located, north of the W Broadway Road, between S
Harquahala Valley Rd and 531st Avenue, as shown in Exhibit 1 – Site Context Map – Existing Zoning. The

HEGIC South represents a cost-effective, reliable electric capacity and storage resource that will meet near-
term and long-term electric supply requirements, while first embracing available, low-carbon renewable energy.
The Project includes quick-starting and fast-ramping power generation and storage capacity-based resources
for reliable energy and critical integration of thousands of megawatts of renewable solar in the area.

The amendment would further promote economic diversity and employment opportunities in the area by
providing quality jobs. In addition to permanent campus employment, the Project will generate substantial
economic activity during its development, including utility and support service jobs including hundreds of
construction jobs. Once operational, the site will contribute significantly to the local economy through both real
and property taxes, helping to fund public services and infrastructure within Maricopa County.
3. RELATIONSHIP TO SURROUNDING PROPERTIES
As seen in Table B – Surrounding Adjacent General Land Descriptions and Table C – Surrounding Adjacent
Parcel Descriptions (Zoning and Land Use), the Project is agricultural or vacant property surrounded by other
vacant and agricultural lands. HEGIC South would look to complement the other land uses in the greater
Harquahala Valley area which include a host of existing and planned renewable energy production centers,
battery energy storage facilities and industrial uses. These uses take advantage of the areas remoteness and
existing infrastructure, anchored by the nearby Harquahala Power Plant located a few miles to the south.
HEGIC South will comply with all local, State, and federal air quality regulations which are protective of human
health and the environment. The emissions from Project will be under federal thresholds and will be closely
monitored and reported pursuant to the requirements of the Project’s air permit. Total emissions will be more
than offset through the integration services provided for renewable energy in the area.

With this proper planning and strategic site selection, HEGIC South addresses the primary concern associated
with the increasing regional demand for energy generation: the risk of developments encroaching upon
residential and commercial areas, thereby disrupting neighboring communities. In response, Harquahala
Campus LLC is committed to developing a master-planned campus that offers a cohesive framework for future
energy generation—strategically located to minimize community impact and maximize access to critical
infrastructure.
HEGIC South looks to expand upon the ongoing improvements being constructed as a part of the approved
Harquahala III-V (Z2023131) project. In addition, many of the nearby parcels have been subject to previous
entitlements and approvals, by the Board of Supervisors, including the Applicants Harquahala Sun projects.
Overall, there are roughly 30,000 acres of Utility/Industrial approvals within the immediate Harquahala Valley
area, making HEGIC South a natural fit for this location. In addition to improving reliability, co-locating energy
manufacturing with adjacent solar and BESS infrastructure supports long-term cost savings and sustainability
goals. Additionally, offering more energy generation options provides significant operational, environmental,
and economic advantages. This strategic pairing demonstrates a commitment to responsible development.

In addition to these planned utility and industrial
developments, as shown in Exhibit 2 – Surrounding
Utilities/Industrial Land Uses and Table D – Existing
Surrounding Solar (Utility) Land Use Approvals, the
surrounding area is mainly characterized by active
and passive agricultural land uses, Bureau of Land
Management
(BLM)
and
Arizona
State
Land
Department (ASLD) owned and managed lands,
native desert lands along with a few sparsely
distributed residential land uses.
The proposed Zone Change Major Amendment
request is consistent with the approved and/or
implemented mixture of solar projects, BESS, a
hydrogen facility, utility corridors, transmission lines,
substations, a gas generation power plant and
industrial uses all within an approximately 5-mile
radius of the Project site.
Approval of the Project strengthens the overall energy
production output within Maricopa County. The
increased local production overtime will create energy
surplus within the market resulting in a reduction of
cost and consumption by additional sectors of the
local and regional economy. Project approval
facilitates a larger regional share of renewable energy
generation activities within the national production mix
thereby promoting energy independence throughout
related national industries and markets.
Moreover, the Project aligns with the County’s 2030 Vision by recognizing the need to redesignate land uses
in response to changing market conditions and to address the increasing demands of growth to the public
infrastructure needs, specifically energy generation and consumption demands within the local economy.
HEGIC South will support the county and greater region within the state by providing additional renewable
energy resources for local energy reliability and resiliency. The location and surrounding utility land uses
minimize impacts to neighbors and lessen the impact to the environment based on proximity to the APS Delaney
Substation by minimizing very long electrical interconnects. The electricity generated through these facilities
would be distributed to the regional electrical grid, supplying the county and state while directly benefitting
Arizona corporations seeking competitively priced renewable energy and looking to add new clean energy
resources to power the record number of people and companies moving to the state. Specifically, consistent
with their 2020 Clean Energy Commitment, Arizona Public Service Co. (APS) is looking to add additional clean
energy resources to its diverse power supply and has issued a request for proposals (RFP) to supply renewable
energy, which the Project will respond to.

4. LOCATION AND ACCESSIBILITY
Location:
The proposed Project is located in an unincorporated portion of western Maricopa County. The site, currently
vacant, is located 11 miles south-west of Tonopah, south of I-10, north of Broadway Road, between S
Harquahala Valley Rd Avenue and S 531st Avenue in Township 1 North, Range 9 West, Sections 21,22.
Access:
The Project is located south of Interstate 10 (I-10), approximately 30 miles west of the State Route 85
(SR 85) connection to I-10.
Regional access to the site will be from I-10 to Harquahala Valley Road southward past W Lower
Buckeye Rd to the site.
Access to the site will be established by a variety of full-access driveways determined during the
subsequent Plan of Development.
Maricopa County Department of Transportation (MCDOT) requires that driveways be spaced a
minimum of 250 feet from adjacent intersections on major collector roadways.
5. CIRCULATION SYSTEM
Off-site Circulation (Access)
The roadway network serving the proposed Project from the I-10 corridor includes the I-10/Salome Highway
interchange that connects Salome Hwy to Harquahala Valley Rd. The site can be accessed from the I-10/
Salome Highway interchange. Salome Highway provides connections to Harquahala Valley Road which
extends south past W. Lower Buckeye Road to the Project. Primary access to the Project is via Harquahala
Valley Road on the east side of the site. There are a few smaller, existing roads, both named and unnamed,
that traverse the Project site, which are anticipated to be used and improved for construction and ongoing
operations of the Project. Site access will be identified with the zone change major amendment and plan of
development applications. Final access locations will be determined in accordance with access management
policies and permitting requirements of Maricopa County.
Harquahala Energy Generation & Industrial Campus South will work with MCDOT to coordinate the
preservation and/or dedication of necessary right-of-way, including the 65’ half street right-of-way for
Harquahala Valley Road and a minimum of 55’ half street(s) right-of-way dedication for W Broadway Rd. Per
Maricopa County Zoning Ordinance Section 1105, HEGIC South will provide the necessary setbacks starting
from the future half street rights-of-way of 65’ and 55’ respectively. Offsite improvements and any additional
right-of-way needed will be determined by MCDOT Traffic Design and MCDOT Permits based on the submittal
of a TIA/TIS. Final dedication, preservation, alignments, terminations, and vacations of unneeded ROW will be
determined in negotiation with MCDOT.
On-site Circulation
Internal circulation is planned via a network of private driveways and maintenance and service drive aisles to
provide vehicular access to the proposed facilities. For all solar, BESS and energy generation uses, driveway
aprons (as specified by MCDOT), shall be paved with a minimum asphalt millings bound with a liquid binding
emulsifier, or comparable, with the remainder of the typical 20’ internal drives being compacted decomposed
granite (DG), or similar road base material to minimize imperviousness and stormwater runoff, as proposed

with an approved dust control permit from Maricopa County Air Quality Control. Construction and maintenance
of the drives will conform to applicable requirements of the Maricopa County Air Quality Control Department.
Parking and Loading
HEGIC South’s proposed parking requirements, as a part of this IUPD, are because the operational model of
the proposed uses differ significantly from traditional industrial facilities since the proposed uses require little
on-site staff. During operations or maintenance parking, loading, and temporary maintenance staging will occur
within designated area within the substation(s)/yard(s) areas. Loading during maintenance activities in the solar
field will occur on private 20-foot (typical) all weather surfaced roads among the solar arrays and BESS Yard
as coordinated on the future Plan of Development.
6. DEVELOPMENT SCHEDULE
Following approval of the Zone Change Major Amendment application, the Applicant would submit a separate
Plan of Development (POD) application for administrative review. Pending POD approval and subsequent
permit approvals, the Applicant would move forward with an initial phase of the development with the size and
scope subject to market conditions at the time of approvals.
7. COMMUNITY FACILITIES AND SERVICES
The Project is not anticipated to generate any adverse impacts to the listed school districts. The Project is
located within the following district boundaries:
Western Maricopa Education Center (MEC) Technical School District (District Ward No. 2)
Buckeye Union High School District No. 1
Arlington School District No. 47
8. PUBLIC UTILITIES AND SERVICES
Unless otherwise coordinated with County staff during the subsequent POD, given the limited employees on-
site, the proposed energy generation uses are planned to operate without public water/sewer sources.
Service(s) to the Project site will be provided by the following providers. Water for construction purposes will be
transported to the site.

application for construction.
2. Based on the conceptual design nature of the information submitted, changes to
the site layout may be necessitated by the final engineering design of the site’s
drainage infrastructure.
3. Maricopa County does not supply water, fire or sewer services. It is the
applicant/owner’s responsibility to coordinate and secure water, fire and sewer
services for this site.
4. Sealed final Grading and Drainage (Site Infrastructure) Plans and Sealed Final
drainage report must be submitted with the application for Building Permits.

Staff has received feedback from the applicant regarding certain aspects of the staff
report. The changes regard ensuring that the requested use is for a gas generating
facility rather than a data center. Staff agrees with these requested changes. The
changes are to paragraphs one and thirteen and are as follows:

The applicant, Keith Nichter, is requesting to amend the IND-2 IUPD zoning for
the Harquahala Energy Generation & Industrial Campus (HEGIC South). This
will allow for a data center use gas generating facilities on a 690 697.77-acre
portion of four parcels of the overall 9,048 acre Harquahala Sun III-IV site. The
subject site is designated as a ‘Utilities’ land use per Maricopa County’s Vision
2030 Comprehensive Plan ( CPA2021010). There is not a precise plan of
development at this time, but will be submitted for administrative approval
prior to construction permitting.
13. Staff notes that the proposed amendment requests "all uses permitted in
the IND-2 zoning district" as allowed uses. This can be problematic as most
general industrial uses will require public water and wastewater. However this
site and surrounding area is an industrial area characterized by power
generation, storage and distribution uses for which wastewater can be
accommodated via septic systems. One of the proposed new uses are data
centers gas generating facilities. These can be appropriate when located
remove from residential neighborhoods. It is appropriate to locate them in
conjunction with power generation and storage due to their high power
demand. Staff recommends approval of the amended IND 2 IUPD zoning but
with condition that IND-2 entitled uses are limited to those that can be
accommodated via onsite wastewater and water until sewer and water
system connections are available to the site. The site is already zoned
industrial which is consistent with area land use and development patterns.
