for the Clean Harbors Industrial project. This is an existing 
industrial site located at the northwest corner of 75th Ave. and the 
Union Pacific Railroad (UPRR) in the Tolleson area (although 75th 
Ave. itself is maintained by the City of Phoenix). 
 
 
Staff supports the applicant’s request. The subject property was the 
first in the Tolleson area to be granted industrial zoning and 
developed accordingly in the 1960s and is now consistent with 
surrounding land uses in every direction. There are no rural, 
residential, or community uses (such as schools, parks, or places 
of worship) within a ½ mile radius of the property, which negates 
the impact of a hazardous materials and warehousing facility on 
surrounding uses. The location of the property at the corner of a 
major arterial and a Class I railroad mainline further renders the site 
an appropriate location for continued industrial uses. The tailored 
development standards proposed with the IUPD overlay would have 
no negative impact on adjacent uses. 
 
 
There are no outstanding concerns from reviewing agencies. To 
date, staff has not received any public comment, including from 
Tolleson or Phoenix, regarding this case.

Z250030 subject to conditions ‘a’ – ‘h’:  
 
a. 
A Plan of Development is approved subject to the site plan entitled, “Site Plan for 330 S 
75th Avenue,” consisting of three full-size sheets, dated January 2026, and stamped 
received January 14, 2026. The Plan of Development may be amended administratively 
under a separate application as long as the amendment complies with the established 
IUPD development standards as approved by the Board of Supervisors. Staff may 
determine slight refinements to remain in substantial conformance with the approved site 
plan. Minor and major amendments to the site plan will be determined in accordance with 
Chapter 3 of the Maricopa County Zoning Ordinance. 
 
 
b. 
Development of the site shall be in substantial conformance with the Narrative Report 
entitled, “Narrative Report for 330 S 75th Ave / Clean Harbors Industrial Project,” consisting 
of 11 pages, dated January 12, 2026, and stamped received January 14, 2026, except as 
modified by the following conditions. 
 
c. 
The following Planning Engineering conditions shall apply: 
 
1. 
Proposed Basin A is showing ~6 feet of ponding. Pool barrier-compliant fencing is 
required around any retention basin with ponding greater than 3 feet. 
 
2. 
If alterations on any existing structure reach the 50% substantial improvement 
threshold, the entire structure must be brought into compliance with the Floodplain 
Use Regulations (i.e. FFE at or above the regulatory flood elevation or the structure 
must be floodproofed). 
 
3. 
Any development in the floodplain will require a floodplain use permit issued 
concurrent with building permit(s) required for site development. The proposed 
maintenance building will be required to meet current floodplain regulations. 
 
4. 
The subject premises is located within the County’s Urbanized Area and will 
disturb more than one (1) acre. A Storm Water Pollution Prevention Permit 
(SWPPP), issued by the County (PND), will be required prior to issuance of any 
building

takes action to rescind approval due to noncompliance with conditions.

The granting of this change in use of the property has been at the request of the applicant 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
may be considered for revocation to the zoning that existed on the date of application.  It 
is, therefore, stipulated and agreed that revocation due to the failure to comply with any 
conditions does not reduce any rights that existed on the date of application to use, divide, 
sell, or possess the property and that there would be no diminution in value of the property 
from the value it held on the date of application due to such revocation of the Zone Change 
/ Plan of Development.  The Zone Change / Plan of Development enhances the value of 
the property above its value as of the date the Zone Change / Plan of Development is 
granted and reverting to the prior zoning results in the same value of the property as if the

Project Summary: 
 
1. 
The applicant, Zach Hill of Kimley-Horn, is requesting a zone change from IND-3 to IND-3 IUPD for 
the Clean Harbors Industrial project. This is an existing industrial site located at the northwest 
corner of 75th Ave. and the Union Pacific Railroad (UPRR) in the Tolleson area (although 75th Ave. 
itself is maintained by the City of Phoenix). 
 
2. 
Industrial uses are not new to the site: what appears to have been a batch plant was developed 
on the property in the 1960s, as shown in a site aerial photograph dated January – March 1969. 
Likewise, County zoning maps show that the property was rezoned to IND-3 at some point in the 
1960s, prior to the adoption of the modern Maricopa County Zoning Ordinance and prior to the 
industrial zoning or development of any of the surrounding properties. Most of the existing 
buildings onsite were added in the 1970s and 1980s, mostly before industrial uses were required 
to be subject to plans of development (a requirement that was adopted in 1984). Since its initial 
development, the industrial use onsite has been served via siding by the Union Pacific Railroad 
(the Southern Pacific Railroad until 1996). Aside from some paving/grading and the periodic 
addition and/or removal of small accessory structures, the site layout remained largely 
unchanged until circa 2011, when the original batch plant was demolished. For much of the 
following decade, the site was underutilized, and the remaining batch plant structures attached 
to the main industrial building were demolished circa 2019. After this time, a new owner of the 
property used it primarily for general industrial uses such as heavy equipment storage. 
 
3. 
In February 2025, shortly before selling the property to the current owner, the previous owner 
submitted a request for an as-built plan of development to Maricopa County for administrative 
review. In the narrative report for this land use case (LU250004), the applicant noted that the 
proposal was on behalf of Clean Harbors Industrial, which was then in talks with the owner to 
lease or purchase the property. Clean Harbors proposed to use the site for the operation of a 
“cross-docking” facility for hazardous waste shipment. Hazardous waste materials would arrive 
onsite from other locations in USDOT-approved sealed containers. The primary use of the site 
would be the unloading and short-term storage (up to 10 days) of these containers, which would 
remain sealed, followed by the loading and shipping of these containers to offsite locations. In 
addition to this primary use, Clean Harbors also intended to use the existing buildings as a general 
warehouse for their cleaning-related products, and to establish an onsite general office for 
administrative purposes. With the as-built POD, Clean Harbors did not propose any expansion or 
changes to the existing site. Staff administratively approved LU250004 on March 7, 2025. 
 
4. 
Clean Harbors took possession of the property in April 2025. Shortly thereafter, the applicant and 
property owner did seek to expand the existing use. The applicant requested a pre-application 
meeting, which was held on June 10, 2025. Staff recommended the applicant request a full POD 
since the site was zoned IND-3. With an as-built POD already approved, a full POD application 
would be required to entitle further expansions of the existing use. However, the applicant 
submitted this rezoning request on September 12, 2025 to add an IUPD (Industrial Unit Plan of 
Development Overlay Zoning District) to the site in order to customize zoning district standards 
for site redevelopment. 
 
5. 
The request includes a concurrent POD, and while the zone change would preserve the existing 
IND-3 zoning, it would add an IUPD overlay exclusive to the property. This overlay is intended to 
tailor some of the applicable development standards, most of which would memorialize existing 
site conditions that are out of compliance with MCZO requirements (chiefly setbacks, screening, 
and site visibility triangles, summarized in the following IUPD table and further discussed in the 
staff analysis section of this report).

No changes to the existing use are proposed with this request. The few physical improvements 
proposed are consistent with the existing use. These improvements include the installation of 
new dock doors on the west side of the main warehouse building, along with a new paved area 
for loading and truck parking. A new maintenance building measuring approx. 3,850 square feet 
will also be constructed toward the south lot line. Two unenclosed loading structures measuring 
approximately 24’ in height will be added along the railroad siding on the inside of the south lot 
line. According to the site plan, these will not extend beyond the lot line over the UPRR mainline 
and will serve only freight cars switched onto the property’s own siding. Additionally, the 
employee parking lot will be reconfigured, providing up to 140 parking spaces, and the existing 
pavement will be resurfaced. Truck parking and temporary truck storage will be utilized 
throughout the site on the paved areas adjacent to buildings. 
 
7. 
The only other proposed improvements are to the existing entrances and site screening: the site 
plan shows that a combination of existing, new, and improved chain-link fencing (generally 7’ in 
height plus 1’ of barbed wire, but no less than 6’ in height) will screen the property from adjacent 
land uses as well as provide separation between different areas within the site. Two new rolling 
gates will be provided, one behind each driveway, as well as a new 72-square-foot enclosed guard 
shack at the south gate. 
 
8. 
The owner will continue to use the existing four buildings onsite. These include a 2,280-square-
foot “receiving building” (office) near the front entrance, a 1,633-square-foot maintenance 
building near the south lot line, a 5,036-square-foot shop building also near the south lot line, and 
the 59,124-square-foot main operations building and warehouse along the north lot line. The color

palette of the buildings will remain typical for industrial uses and will aim to minimize heat 
absorption and glare. Signage will be limited to site identification signs, OSHA-approved safety 
signage, and security signage consistent with MCZO requirements. Finally, security lighting will 
be limited to motion-activated lighting and other security-sensitive areas such as entry gates and 
parking areas. All installed lighting will be directed downward and into the site as required by the 
MCZO. 
 
9. 
The owner expects to employ up to 130 people, with most being field-based employees who will 
start and begin the workday onsite. Hours of operation will generally occur from 7:00 a.m. to 
11:00 p.m. Monday through Friday.

City of Tolleson General Plan 2024 (adopted November 4, 2014): Tolleson’s general plan places 
the property, as well as the surrounding industrial properties, within the city’s El Districto, or 
Business District. Per the general plan, El Districto comprises much of Tolleson’s total acreage 
and hosts light manufacturing and distribution centers. The purpose of this district is to continue 
Tolleson’s relationship with manufacturing and distribution companies, as well as to provide 
services to the employees working at those locations. Uses in El Districto align with the industrial 
districts in Tolleson’s zoning code, and the only development requirement identified in the general 
plan is to discourage residential uses. The as-built property, including the improvements 
proposed with this zone change and POD, is an appropriate land use within this land use category. 
 
Public Participation Summary:

The applicant complied with the requirements of the citizen review process by posting the site 
and sending notification by first class mail to interested parties and adjacent property owners 
within 300’ of the site. Two signs were posted onsite in accordance with applicable regulations. 
To date, staff has not received any public comment, including from Tolleson or Phoenix, regarding 
this case.

surrounding land uses in every direction. There are no rural, residential, or community uses (such 
as schools, parks, or places of worship) within a ½ mile radius of the property, which negates the 
impact of a hazardous materials and warehousing facility on surrounding uses. The location of 
the property at the corner of a major arterial and a Class I railroad mainline further renders the 
site an appropriate location for continued industrial uses. The tailored development standards 
proposed with the IUPD overlay would have no negative impact on adjacent uses. In particular, 
the reduced setback from the north lot line would accommodate existing site conditions that 
predate the turn of the century and would be mitigated by the existing Roosevelt Canal, which 
serves as a natural buffer between the subject site and the nearest development to the north. 
Likewise, the UPRR mainline serves as a buffer between the subject site and the nearest 
development to the south. As for screening, staff believes that allowing chain-link fencing (and 
the north wall of the main warehouse where it parallels the north lot line) to serve as the screening 
for the site will not negatively impact the surrounding industrial uses and will remain consistent 
with the site conditions that have existed (without complaint) since it was first developed. 
 
17. 
Staff notes that this application was received before the updated Maricopa County Zoning 
Ordinance was adopted effective January 9, 2026. The base development standards listed in the 
IUPD table in the project summary of this report are those against which this application was 
reviewed. Since the MCZO was updated, some of the IND-3 development standards, particularly 
concerning setbacks, screening, and landscaping, have been strengthened.  However, these 
stricter development standards will not be applicable to this project since it was received before 
the updates became effective. On the other hand, the updated MCZO relaxed parking and height 
requirements in the IND-3 zoning district. Although relaxing the original standards is not required 
to accommodate the existing site or its proposed improvements, staff will nevertheless 
incorporate the relaxed standards into the IUPD overlay. 
 
18. 
Staff is keen to note one peculiar condition of the property, which is the presence of strip 
annexation that separates the main site from the 75th Avenue right-of-way. Whereas the property 
itself is in County jurisdiction, the strip annexation (which corresponds with two parcels under 
mutual ownership with the subject site) is in Tolleson’s jurisdiction. Complicating matters further 
is that the right-of-way is owned and maintained by Phoenix. This strip-annexation extends only 
23’ into the gross area of the property (the total depth of the property measures nearly 1,200’), 
but it still carries consequences for measuring the front setback, the placement of screening 
along the front lot line, and the measurement of site visibility triangles. The existing front 
screening for the property is accomplished by a chain-link fence that mostly follows the boundary 
between the Phoenix right-of-way and Tolleson’s strip-annexation. Likewise, the accessory office 
/ receiving building would exceed the minimum front setback required if it were measured just 
from the right-of-way line. However, due to the strip annexation, the existing setback is deficient 
by just over 5’. The required sight visibility triangles against the right-of-way would also be located 
almost entirely within the strip-annexed area. 
 
19. 
The IUPD will allow a minimum front setback of 14’ (versus 20’) as measured from the east line 
of the subject parcel, which separates County jurisdiction from Tolleson jurisdiction. The IUPD 
will also waive the requirement for sight visibility triangles and screening along the front parcel 
boundary. Instead, staff offers conditions of approval that will require any improvements onsite 
to meet Tolleson’s and Phoenix’s requirements pertaining to sight visibility and screening along 
frontage.

The applicant and/or property owner(s) shall coordinate with the City of Tolleson and/or 
the City of Phoenix, as applicable, for any improvements to site access and screening 
within, adjacent to, or otherwise affecting their jurisdictions. 
 
f. 
Noncompliance with any of the conditions assigned to the approval of this Zone Change 
by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures set forth in the Maricopa County 
Zoning Ordinance. 
 
g. 
The property owners and their successors waive claim for diminution in value if the County 
takes action to rescind approval due to noncompliance with conditions. 
 
h. 
The granting of this change in use of the property has been at the request of the applicant 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, the property 
may be considered for revocation to the zoning that existed on the date of application.  It 
is, therefore, stipulated and agreed that revocation due to the failure to comply with any 
conditions does not reduce any rights that existed on the date of application to use, divide, 
sell, or possess the property and that there would be no diminution in value of the property 
from the value it held on the date of application due to such revocation of the Zone Change 
/ Plan of Development.  The Zone Change / Plan of Development enhances the value of 
the property above its value as of the date the Zone Change / Plan of Development is 
granted and reverting to the prior zoning results in the same value of the property as if the 
Zone Change / Plan of Development had never been granted.

1. PURPOSE OF REQUEST 
Kimley-Horn (the “Applicant”), on behalf of Clean Harbors Environmental Services INC,(the “Property 
Owner”) is requesting approval of a Zone Change with Overlay (rezone) from IND-3 (Heavy Industrial) 
to IND-3 IUPD (Industrial) Zone for the Clean Harbors Industrial site / 330 S 75th Ave Project (“Project”) 
on one (1) parcel (APN: 104-11-004X), sized approximately ±10.39 acres. The Project is an existing 
industrial site with planned improvements that require a rezone to IUPD due to proposed modifications 
to the existing IND-3 zoning standards. 
2. DESCRIPTION OF PROPOSAL

The property owner ‘Clean Harbors Environmental Services INC’ (based out of Massachusetts) was 
founded in 1980 and has become the leading environmental and industrial service provider and largest 
hazardous waste disposal company in North America. It has more than 400 service centers, 
strategically located across North America providing emergency response services, performing 
planned work on customer locations and is a recognized leader in environmental emergency response 
services. 
This service center is located on a Maricopa County island at 330 S 75th Ave, between the Tolleson 
and Phoenix city limits, in an industrial zoned area. The site features four existing buildings (receiving, 
shop, maintenance and main operations building) along with storage areas, employee parking, and a 
connection to the Union Pacific rail line to the south. Clean Harbors Environmental Services INC 
purchased the property in April 2025 and intends to make improvements to create a fully operational 
service center. All operations at this site will comply with the allowed uses under the county’s IND-3 
zoning criteria. 
The proposed improvements include the installation of new Dock Doors on the west side of the main 
building, along with a new paved area for loading and truck parking. A new maintenance building will 
also be constructed. Additionally, the employee parking lot will be reconfigured, and the existing site 
will be resurfaced. (see exhibit B & C Site Plans). Truck parking and temporary truck storage will be 
utilized throughout the project on the pavement areas adjacent to buildings.

2.2 Proposed Uses (Summary): 
Hours/Days of Operation:  
The site will be in operation and/or production from 7am – 11pm Monday - Friday.  
Number of Employees: 
The operation activities are anticipated to employ up to 130 with most being field based who will start 
and end the workday at subject service center.  
Description/Location of Buildings: 
The site currently has four existing buildings: the receiving building (2,280 SF) on the east side at the 
entry point, a maintenance building (1,633 SF) on the west side, the main operations building (59,124 
SF) on the north side, and a shop building (5,036 SF) on the south side. One of the proposed 
improvements includes adding a new maintenance building (3,850 SF), which will be situated next to 
the existing shop building. Two unenclosed loading structures, each with a height of approximately 24 
feet, will be added adjacent to the existing railroad along the south side of the site. 
Color Palette: 
The buildings on site will feature a light color palette, adhering to commonly accepted industry 
standards and matching the surrounding industrial setting. Final color choices will aim to minimize heat 
absorption and glare as much as possible. 
Sign Details:  
Signage will be limited to site identification signs, OSHA approved safety signage, and security signage 
in accordance with Chapter 14 of the Maricopa County Zoning Ordinance. 
Screening Wall/Fence Details and Location: 
The property is surrounded mostly by industrial, and warehouse uses. To ensure proper site security, 
related to these surrounding uses, the site perimeter will be enclosed with a 7’ tall chain link fence and 
1’ barbed wire (8’ total) where needed along the perimeter of the Project.   
Security Lighting: 
Security lighting will be limited to motion-activated lighting and other security sensitive areas such as 
entry gates, and parking areas, as shown on the Plan of Development. All lighting installed will be 
directed downward and into the site, in compliance with Maricopa County Zoning Ordinance Article 
1112, to ensure lighting will not be cast onto neighboring properties as much as possible.  
3. RELATIONSHIP TO SURROUNDING PROPERTIES 
The project is situated on a Maricopa County island, surrounded by other industrial businesses. To the 
south, it borders a Union Pacific rail line, while the north is bordered by the Roosevelt District canal. 
The east side adjoins City of Phoenix land, featuring a Target distribution center zoned as A-1 (Light 
Industrial) with an industrial land use designation according to the Phoenix general plan. The north, 
south, and west sides of the project are adjacent to City of Tolleson land, zoned I-1 (Light Industrial)

interchange, located 2 miles west of Loop 202, 0.5-mile drive north on 75th Avenue.  
No significant change to the traffic is expected from the proposed development, compared to the 
previous uses. A waiver on the Traffic Impact Study has been submitted to MCDOT. 
On-site Circulation  
The project site at +/-10.39 acres is relatively small and will be served by an internal network of asphalt 
and concrete driveways and parking lot lanes with a separate/dedicated truck entrance off 75th Avenue.

The site is located on a Maricopa County island/parcel within Tolleson's municipal planning area and 
general plan, though it is outside Tolleson's annexation boundaries. According to Tolleson's general 
plan, the site and surrounding area are designated as a 'Business District,' intended for light 
manufacturing, distribution centers, and services for Tolleson employees. Additionally, the parcels to 
the west and south are identified as industrial growth areas. The City of Phoenix's general plan 
designates the adjacent area to the east, across 75th Ave, as 'Industrial.' 
This rezone application does not change the existing industrial use or base zoning category and does 
not require a comprehensive plan amendment with the county. The proposed improvements will 
enable continued industrial operations on the site, consistent with the surrounding land use and in 
compliance with Tolleson's general plan classification. As noted in pre-application comments, there

Engineering Review has reviewed the first plan and report routed for review on 
1/15/2026, for the subject application and has no further objections: 
 
The following stipulations will apply: 
 
1. Proposed Basin A is showing ~6 feet of ponding. Pool barrier-compliant fencing 
is required around any retention basin with ponding greater than 3 feet. 
 
2. If alterations on any existing structure reach the 50% substantial improvement 
threshold, the entire structure must be brought into compliance with the 
Floodplain Use Regulations (i.e. FFE at or above the regulatory flood elevation 
or the structure must be floodproofed). 
 
3. Any development in the floodplain will require a floodplain use permit issued 
concurrent with building permit(s) required for site development. The proposed 
maintenance building will be required to meet current floodplain regulations. 
 
4. The subject premises is located within the County’s Urbanized Area and will 
disturb more than one (1) acre. A Storm Water Pollution Prevention Permit 
(SWPPP), issued by the County (PND), will be required prior to issuance of 
any building permits required for site development.

5. Engineering review of planning and/or zoning cases is for conceptual design 
only. All development and engineering design shall be in conformance with 
Section 905 of the Maricopa County Zoning Ordinance; Drainage Policies and 
Standards; Floodplain Regulations for Maricopa County; MCDOT Roadway 
Design Manual; and current engineering policies, standards and best practices 
at the time of application for construction. 
 
6. Based on the conceptual design nature of the information submitted, changes 
to the site layout may be necessitated by the final engineering design of the 
drainage infrastructure.

7. Detailed Grading and Drainage (Infrastructure) Plans must be submitted with 
the application for Final Plat Approval and Building Permits

The below comments are limited to traffic study impacts for the proposed development based 
on the land use described in the Project Summary of this comment review sheet. Any additions 
to the subject parcel that will meet MCDOT criteria for a Traffic Statement (TS) or Traffic 
Impact Study (TIS), will require the developer to submit a TS or TIS for review and approval by 
MCDOT.

As per the waiver request letter, no additional traffic will be generated due to the proposed 
site activities. As per the information provided by the applicant for the traffic study waiver 
request, the project meets MCDOT criteria for a waiver request. MCDOT anticipates no impacts 
on to the surrounding MCDOT roadway network. Therefore, MCDOT has no traffic concerns on 
proposed usage of this property.

The developer is seeking for traffic study waiver for the property located at 330 S 7th Avenue, Tolleson, AZ.   The site is within unicorporated Maricopa County with parcel 
number APN# 104-11-004X. The applicant is proposing to constructing concrete pavement and overhead doors to allow truck-to-truck transfers in the northwest portion of 
the property and a proposed building that will serve as a maintenance shop. The site will serve vehicles already using the property and doesn't anticipate increase in traffic to 
and fro from the Site.
