• 
The applicant requests a Special Use Permit to operate an outdoor event venue on a one-acre 
residential lot within the Rural-43 zoning district. The proposed operations include weekend 
events (Friday through Sunday) from noon to 11 PM with a maximum of 75 guests. The site is 
located within a county island surrounded by the City of Goodyear. The property is designated 
Rural Development Area in the County's Comprehensive Plan Vision 2030 and falls within the 
Neighborhoods category of Goodyear's General Plan 2035. Staff finds the proposed commercial 
event venue use inconsistent with both the County's Single Family - Rural Density land use 
designation (1 dwelling unit or less per gross acre) and Goodyear's Neighborhoods designation, 
which anticipates residential uses with compatible community facilities. No comments have been 
received from the City of Goodyear to date. 
 
• 
Water is via the City of Goodyear. Wastewater is proposed via an on-site septic system.  Adequate 
services appear to be available for the requested use. 
 
• 
The nearest major roads to the site are at W. Roosevelt St. and N. Perryville Rd. Site access is 
via W. Moreland Street, a local residential street. W. Moreland Street is accessed from 
Roosevelt St. via either 183rd Drive or 185th Avenue. The site is located within an established 
residential subdivision served by local streets designed for low-density residential traffic. 
 
• 
Per the Maricopa County Framework 2040 Comprehensive Plan the site is within an Urban Growth 
Area. It is adjacent to the I-10 freeway to the north. While the surrounding community is primarily

residential, there appear to be quasi-industrial uses with the community, especially to the site’s 
west where the MAAMF noise contours intersect with the existing neighborhood in Goodyear’s 
jurisdiction. The community appears to be in the early stages of transitioning to more industrial 
uses due to the MAAMF prohibiting residential development. However, the requested use is 
currently not in concert with the surrounding community. 
 
• 
The site is located within the Neighborhoods land use category of the Goodyear General Plan. 
Neighborhoods “Provides areas for the growth and development of neighborhoods. 
Neighborhoods include a wide range of densities and housing products, public and community 
facilities such as schools and places of worship, and commercial uses at appropriate intensities 
and locations.” Staff does not believe the proposed use complies with this land-use designation. 
 
• 
There are not any outstanding concerns from reviewing agencies. 
 
• 
The applicant complied with the public participation requirements according to MCZO Section 
304, including notification of property owners within 300’ of the subject site and posting. 
Registered areas of interest were contacted by the applicant and staff regarding the rezone 
request. To date, staff has received 19 letters of support and 26 letters of opposition. 
 
A super-majority vote has been triggered. This is when 20% of surrounding property owners within 
a 300’ radius, by both number and area, have registered opposition.  The opposition received 
accounts for 7 property owners with an area of 361,143 sq. ft. which equates to: 
 
45% opposed by number, and 
 
44% opposed by area.  
 
 
It will require four affirmative votes to approve SU250009.

Commission  
Recommendation: 
On 3/5/26, the Commission voted 6-0 (motion by Vice Chair 
Hernandez, D5, seconded by Commissioner Rochwalik D3) to 
adopt a motion recommending the Board of Supervisors deny 
SU250009. 
In the event the Board motions for approval of SU250009 staff 
suggests conditions ‘a’ – ‘i’:  
a.
Development of the site shall be in substantial conformance with the Site Plan entitled
“18401 W. Moreland Event Facility“, consisting of 1 full-size sheet, dated September 3,
2025 except as modified by the following conditions. Staff may determine slight
refinements to remain in substantial conformance with the approved site plan.  Minor and
major amendments to the site plan will be determined in accordance with Chapter 3 of
the Maricopa County Zoning Ordinance.
b.
Development of the site shall be in substantial conformance with the Narrative Report
entitled “Moreland Backyard Rental”, consisting of 7 pages, dated September 2025 except
as modified by the following conditions.
c.
The following Planning Engineering conditions shall apply:
1.
Engineering review of planning and/or zoning cases is for conceptual design only. All
development and engineering design shall be in conformance with Section 1205 of
the Maricopa County Zoning Ordinance; Drainage Policies and Standards; Floodplain
Regulations for Maricopa County; MCDOT Roadway Design Manual; and current
engineering policies, standards and best practices at the time of application for
construction.
2.
Based on the conceptual design nature of the information submitted, changes to the
site layout and/or a reduction in the number of building lots may be necessitated by
the final engineering design of the subdivision drainage infrastructure.
3.
Stormwater retention volume calculations shall be based on Table 6.3 of the Maricopa
County Drainage Policies and Standards. Use 0.95 for commercial/industrial areas
and 0.5 for retention basin areas
4.
Entitlement case is for the entire parcel and therefore the retention basin will need to
be sized for the full contributing area.
5.
The Grading and Drainage Plan must indicate that the required stormwater retention
volume for the 100 year, 2 hour storm event with one (1) foot of freeboard is provided
for the site. Basins one (1) foot or less in depth need not provide freeboard. Provide
documentation that the retention basin(s) will drain within 36 hours. (MCZO 1205.7.6-
2.a& c)
6.
When submitting the plans for a building permit include the septic facilities on the
plans. Maintain a minimum 25 foot separation between septic facilities.
7.
Drainage Clearance is for fence/wall construction within or along property lines as
shown on the approved plans. The drainage clearance does not include verification of
property boundaries or easements which is the responsibility of the owner/applicant.

Property line and easement disputes that may arise with new wall/fence construction 
are a civil matter. 
 
d. 
This special use permit is valid for a period of two years and shall expire on April 8, 2028, 
or upon termination of the use for a period of 90 or more days, whichever occurs first. All 
site improvements associated with the special use permit shall be removed within 90 days 
of such expiration or termination of use. 
 
e. 
Prior to utilizing any portion of the site for any use associated with the Special Use Permit, 
the applicant shall obtain Building Permits to retrofit the existing buildings to meet current 
commercial building code requirements as applicable and shall obtain a Certificate of 
Occupancy for the retrofitted buildings prior to occupancy. 
 
f. 
The following Rural-43 SUP standards shall apply:  
1. Min. Screening: 6-foot screen wall or similar with additional landscaping along the 
south and west side of the site. 12’ max. allowed fence height outside buildable 
envelope. 
2. Maximum Yard Coverage within Rear Setback: 47% 
3. Min. On-Site Parking Spaces: 43 (including 3 ADA accessible) 
4. Min. Parking and Driveway Aisles Surfaces: Alternative dust control measures such as 
decomposed granite or asphalt millings as approved by the County 
5. Max. Attendance: 75 total persons on site at any given time 
6. No amplified music or speakers at any time 
7. No use of generators related to events 
8. Outdoor lighting: Other than low intensity fixtures with a maximum candle power of 
less than 1,000 candelas, all lighting to be fully shielded so that light is emitted 
downward so as to not trespass onto neighboring properties and at angle of at least 
20-degrees beneath the horizontal plane at the bottom of the light source. All shielding 
shall be within 12” of the light source.  No lighting shall exceed 18’ in height. All lighting 
shall be turned off between the hours of 11:00 p.m. and sunrise. 
 
g. 
Noncompliance with any of the conditions assigned to the approval of this Special Use 
Permit by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures as set forth in the Maricopa County 
Zoning Ordinance.  
 
h. 
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions. 
 
i. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property may be considered for revocation  
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, or the expiration of 
the Special Use Permit, does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit.  The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to

the prior zoning results in the same value of the property as if the Special Use Permit had

Project Summary: 
 
1. 
The applicant, Jessica Sarkissian, on behalf of the property owner is requesting a Special Use 
Permit (SUP) for an outdoor event venue per the prior Maricopa County Zoning Ordinance (MCZO) 
Art. 1001.1.10. This article was formally known as Art. 1301.1.11 prior to the MCZO update 
effective January 9, 2026. The site is zoned Rural-43 and located within Quintana Estates, an 
established subdivision of originally 112 one-acre-plus lots developed prior to the construction of 
I-10. The site is just south of I-10 and a few parcels east of the Military Airbase and Ancillary 
Military Facility Overlay Zoning District (MAAMF) whose outer boundary is the 65 LDN noise 
contour. The subdivision is mostly zoned Rural-43 except for a C-3 zoned parcel to the site’s 
northeast.  That parcel was rezoned per Z2022176 to allow for a radio-controlled vehicle 
racecourse and billboard. 
 
2. 
The subject property owner was cited February 2024 for land use (outdoor event venue) without 
proper zoning entitlement, V202400241,. The event venue continued to operate under different 
names, including Casa Del Sol, and Mi Casa Backyard Rental. The violation at that time also 
included parking/storage of a non-accessory vehicle greater than 10,000 lbs GVW, the owner’s 
trailer vehicle stored in the front of the parcel; however, that violation was removed. This SUP 
application was submitted in February 2025. There is evidence the owner continued offering the 
site for events and hosting events through at least May 2025. The operation ceased and the 
violation was closed in May 2025. 
 
3. 
Staff received new complaints of events being held on the site as of September 2025. There were 
noise complaints involving MCSO Deputies who responded to calls involving the site.  There have 
been 53 calls for service to the address since January of 2024. Of these, 42 of these calls have 
been for disturbing the peace, 5 calls have been follow-up calls on prior incidents, 3 calls regarding 
issues between neighbors, 2 calls for disorderly conducts, and 1 call for citizen/motor assistance. 
Forty-one % of all these calls were received between 7:00 pm and 8:59 pm and 68 % of them were 
received between 7:00 pm and 5:59 am.  As of this writing, the venue is still advertised on sites 
such as Instagram, Facebook, and Peerspace. Despite the prior violation, the event venue 
continues to operate without benefit of required construction permits or proper zoning 
entitlement. This was most recently confirmed via email on December 22, 2025 with several 
reports having been received by staff beginning in September of 2025. New violation V2501799 
was opened on November 10, 2025 for an unpermitted 12’ tall fence on the west property line 
where an 8’ maximum fence height is permitted outside of the primary building envelope per 
MCZO Art. 811.5.3. 
 
4. 
In addition to the fence, there are multiple unpermitted structures on the site. It is apparent from 
site aerials and permit records that these additions were constructed after the owner took 
possession of the property in 2022: 
 
1. A small shed of about 120 sq. ft that has been converted into livable space to be used as 
a bridal suite; 
2. An addition built off the existing garage on the southeast corner that combines at 47% to 
exceed the 30% maximum yard coverage (aggregate area under roof); 
3. Much of the site, a portion of Moreland St., and a northern parcel across the street, under 
separated ownership, appear to have been paved/surface to act as event parking; and  
4. There is no permit for a commercial restroom that is ADA accessible. 
 
5. 
Case support material proposed by the applicant regarding site operations is noticeably different 
than how it is currently being advertised. The narrative report indicates operations only being

available on weekends between noon and 11:00 pm with up to 75 guests. Additional limits 
proposed by the applicant include no amplified music and restricting guests from accessing the 
rest of the property. All parking, 43 spaces (three ADA accessible) are to be located on site. 
 
6. 
In contrast, the Peerspace listing for the site under “Mi Casa Backyard Rental” as of this writing 
indicates that the venue is not wheelchair accessible; that operating hours are 6:00 am to 
midnight daily; that the site can “accommodate up to 200 guests”; and that there is “free street 
parking.” The hosts provide the following instructions: “pretty flexible and (have) no real ‘rules’, 
(but) just check with host with any questions before hand so there’s no confusion at the time of 
the event.”

Public Participation Summary:

The applicant complied with the public participation requirements according to MCZO Section

Registered areas of interest were contacted by the applicant and staff regarding the rezone 
request. To date, staff has received 19 letters of support and 9 letters of opposition.

Virtually all the support comes from a petition provided by the applicant. Several of these letters 
come from parcels along Moreland St. and nearby Latham St., indicating a local base of support. 
 
15. 
The opposition also primarily derives from parcels local to the community north of Roosevelt St. 
Many of these residents have continually been in contact with staff since the beginning of this 
case regarding site operations and have attested to the applicant continuing site operations 
beyond the ending of the first violation case. 
 
Outstanding Concerns from Reviewing Agencies:

Staff Analysis:

Staff’s recommendation for denial is based on two factors. First, outdoor event venues when 
placed within the matrix of a residential neighborhood can harm residential harmony with regard 
to noise, lighting, traffic, parking, etc. In fact, this is why the updated MCZO now requires a three-
acre minimum site size for an outdoor event venue.  The subject case was submitted and had 
benefit of technical review prior to effect of the updated MCZO and thus if approved (no later than 
July 9, 2026) will be considered legal non-conforming or “grandfathered” regarding the site size. 
 
18. 
MCSO Deputies have responded to complaints against the site 42 times since January 1, 2024. 
Calls have tended to be at night, including overnight. They’ve been called to police events that 
have grown too loud or disruptive, causing a strain on limited police resources. The nearest MCSO 
station is at 695 N 105th Ave in Avondale, which is approximately 12 miles and around 16 minutes 
away. 
 
19. 
The proposed outdoor event venue represents a commercial use within a platted residentially 
zoned subdivision. Quintana Estates is characterized by single-family homes on one-acre lots. 
Residents purchased homes with the reasonable expectation of a residential neighborhood. 
Arguably, outdoor events multiple times per week conflicts with this established residential

character. It is difficult to mitigate the potential adverse impact of noise, lighting, traffic, parking, 
and commercial level on a one-acre site with immediate residential neighbors. 
 
20. 
Second, the owner’s compliance history demonstrates a clear pattern of disregard for County 
regulations: 
 
1. Has operated an outdoor event venue without required permits or proper zoning 
entitlement since  2024; 
2. Cited for violation  but continued operations after citation through at least May 2025; 
3. Represented to County that operations had ceased when violation closed May 2025, but 
resumed unpermitted/unentitled operations as of September 2025; 
4. Continues to advertise offering the venue for events (confirmed as of February 2026) 
while SUP is pending; 
5. Constructed 12’ fence in violation of height limits (V2501799), and built multiple 
unpermitted structures including bridal suite conversion, garage addition, and extensive 
paving without benefit of issued permits authorizing the work. 
 
21. 
Should the Commission entertain a positive recommendation to the Board, staff has offered 
multiple conditions in an attempt to mitigate the potential adverse impact of this property on its 
neighbors. These include limiting the SUP to only two years to allow for a timely revisiting of the 
SUP, effectiveness of the SUP conditions and the venue under permitted operations. 
 
 
Recommendation: 
 
22. 
For the reasons outlined in this report, staff recommends the Commission adopt a motion that 
the Board of Supervisors deny SU250009. 
 
23. 
However, if the Commission choses to adopt a motion to recommend approval, staff offers the 
following conditions ‘a’ – ‘i’ for Commission consideration: 
 
a. 
Development of the site shall be in substantial conformance with the Site Plan entitled 
“18401 W. Moreland Event Facility“, consisting of 1 full-size sheet, dated September 3, 
2025 except as modified by the following conditions. Staff may determine slight 
refinements to remain in substantial conformance with the approved site plan.  Minor and

Noncompliance with any of the conditions assigned to the approval of this Special Use 
Permit by the Maricopa County Board of Supervisors may be grounds for revocation in 
accordance with the requirements and procedures as set forth in the Maricopa County 
Zoning Ordinance.  
 
h. 
The property owner/s and their successors waive claim for diminution in value if the 
County takes action to rescind approval due to noncompliance with conditions. 
 
i. 
The granting of this change in use of the property has been at the request of the applicant, 
with the consent of the landowner.  The granting of this approval allows the property to 
enjoy uses in excess of those permitted by the zoning existing on the date of application, 
subject to conditions.  In the event of the failure to comply with any condition, and at the 
time of expiration of the Special Use Permit, the property may be considered for revocation  
to the zoning that existed on the date of application.  It is, therefore, stipulated and agreed 
that either revocation due to the failure to comply with any conditions, or the expiration of 
the Special Use Permit, does not reduce any rights that existed on the date of application 
to use, divide, sell or possess the property and that there would be no diminution in value 
of the property from the value it held on the date of application due to such revocation or 
expiration of the Special Use Permit.  The Special Use Permit enhances the value of the 
property above its value as of the date the Special Use Permit is granted and reverting to 
the prior zoning results in the same value of the property as if the Special Use Permit had

Upfront Planning & Entitlements, LLC is pleased to submit for your consideration an application for 
a Special Use Permit (SUP) on approximately 1.0 gross acres along Moreland Street in land that in 
unincorporated Maricopa County. 
 
The property is located along Moreland St Road and Perryville Rd is identified as Maricopa Assessor 
Parcel Number 502-37-100 (the “Property”). The Property is located within unincorporated 
Maricopa County (the “County”) and is zoned as RU-43. The property owner requests to apply for 
a special use permit to allow backyard events on weekends.

The surrounding area has been slowly developing into more intense uses over the last ten years 
with quick access to Moreland St from Perryville Rd adjacent to the I-10 Highway.  Surrounding 
properties are zoned RU-43 with higher intensity uses. The site is currently utilized as a residence 
with the owner’s personal single commercial truck on site. The owner wants to use his backyard for 
a party space on the weekends. 
 
The property owners plan to continue to utilize the land with residential associated uses, and a 
weekend event space.  The property is situated in close proximity to residential and light 
employment uses associated with residential along Moreland St and higher intensity zoned parcels 
within the vicinity.

The property owner requests a Special Use Permit (SUP) in the RU-43 (Rural-43 Residential) to allow 
the site to be used for backyard rental space while the owner of the home also resides on site and 
operates the site.  This use is similar to what has been conducted throughout the Phoenix metro 
area and other similar facilities which have been approved with stipulations by the County to utilize 
their backyard spaces for gatherings and events with restrictions.  The space would only be available

on weekends (Friday, Saturday and Sunday) between the hours of 12 noon and 11 pm and is open 
for events such as: weddings, anniversaries, quinceañera and birthday parties. The events would 
be scheduled through the property owner and the owner or family member would be present 
onsite at all times during these events to monitor activities and attendees.  It is anticipated that up 
to 75 guests might be at an event and a permanent restroom will be provided onsite as detailed in 
the site plan.  Lighting is limited to restaurant string patio lighting as seen in the images and 
amplified music will not be permitted to meet County noise level code volume.  An upgraded shed 
has been added to be used as a bridal suite as needed and the restroom for the guests will be 
located nearby which does not allow guests to access the rest of the property.  These facilities 
require the increase of lot coverage to 46% in the rear yard from 30%.  No part of the existing home 
will be accessible to attendees as there is a wall which separates the property.  
 
40 parking spaces and 3 ADA parking spaces shall be provided onsite for a total of 43 onsite parking 
spaces for the maximum 75 guests anticipating an average of 2 guests per car.  The site activities 
will primarily be occurring on the west side of the site with no access to the house.  Parking will be 
accessed off of Moreland Road and parking in the rear will be done by the property owner during 
events. 
 
Food and Music will be supplied by certified vendors and be onsite during preparation of the event, 
during the event and breakdown of the event, but may not remain on site outside of events. 
 
Along the South, West and North sides of the site, Ficus trees have been planted as detailed below 
with the additional privacy screening until the Ficus grow larger.  This use of landscaping and 
screening also reduces any lighting and noise which may impact the neighbors.   Security cameras 
have been installed along the property which record activity and store for use for any issues or 
complaints about activities.  Additionally, a decibel sound meter has been installed onsite and 
measures the live activity to ensure sound levels remain within the requirements. 
 
The owner met with neighbors and continues to improve the property to work with neighbors and 
the department by restricting noise amplification, providing increased noise buffering measures 
with lush landscaping and screening, a decibel reader, live security cameras with recordings and 
restrictions on number of attendees for noise reduction and to ensure all onsite parking addressing 
neighbors’ comments.

3. Stormwater retention volume calculations shall be based on Table 6.3 of the 
Maricopa County Drainage Policies and Standards.  Use 0.95 for 
commercial/industrial areas and 0.5 for retention basin areas. 
 
4. Entitlement case is for the entire parcel and therefore the retention basin will 
need to be sized for the full contributing area.  
 
5. The Grading and Drainage Plan must indicate that the required stormwater 
retention volume for the 100 year, 2 hour storm event with one (1) foot of 
freeboard is provided for the site. Basins one (1) foot or less in depth need not 
provide freeboard. Provide documentation that the retention basin(s) will drain 
within 36 hours.  (MCZO 1205.7.6-2.a& c) 
 
6. When submitting the plans for a building permit include the septic facilities on 
the plans. Maintain a minimum 25 foot separation between septic facilities.

lines as shown on the approved plans. The drainage clearance does not 
include verification of property boundaries or easements which is the

Sir,
I have been informed by my neighbors that you are considering giving a permit to this house to
continue operating the events. I oppose this. Please understand that it is difficult to get any sleep
when he has events. They are very very loud.  I live behind and several houses down and I can still feel
the bass. That means I am likely 800 or so feet away yet It rattles my windows. My kids can't sleep and
they are too young to not get sleep. It starts early around 5 or 6 pm and goes until 12-1 am every
weekend. It used to be every Sat now it's every Fri and Sat and sometimes on Sun. It is not pleasant
and causes alot of problems.  Its difficult to get the kids to behave the next day because they are tired.
I can't get homework done because they just want to sleep all day. My husband goes to work at 4 am
on Saturdays and has had to go on 2-3 hours of sleep. We have had to do things like go to friends
house or rent hotels on the weekends just to get rest. I understand that several of the neighbors have
talked to him and I put a complaint in with code enforcement and was told that several others already
have. I hope that this ridiculous request will be denied. Thre is also issues with the amount of cars and
he's got semi trucks parked across the street from his house. We have alot of semi trucks in the
nighborhood. I have driven by the event and one day counted over 60 cars. Its far more than this
neighborhood should be forced to handle. There is likely less cars then that for the homeowners in the
entire neighborhood. This used to be a peaceful place to live. Now it's horrible to live here.  I hope you
do not issue this permit.  He's a very rude man that has ignored the neighbors complaints and ignored
the county and ignored the police. Police leave and the music goes back up. 
I strongly object and believe that most neighbors will also. I have talked to others and no one likes the
situation.  It impacts the neighborhood and causes quite a bit of issues.

I would like to formally notify your office of my opposition to the permit applied for by the owners of the
property at 18401 W. Moreland Street Goodyear, AZ 85338.
 
The owners of this property have shown complete disregard and consideration for the surrounding
neighbors of this property despite the many complaints, requests to stop and police calls over the past
year and a half. I no longer look forward to the weekends and I do not enjoy my home or property any
longer. The volume is so loud that I can hear it inside of my home a street over and three houses adject
over my TV. The illegal business has caused personal stress as well as mental and emotional suffering.
Physically my hair has falling out due to the stress and not being able to relax on my days off which are
the weekend.
 
The owner of this property constantly lies to his neighbors about limiting the volume and time
restrictions. He lies to police about not being the owner or living there to evade responsibility. He was
illegally using the property across from him as a parking lot for his illegal event venue. Now that it
appears someone stopped him from doing that his “guests” park along the street creating dangerous road
conditions. His “guests” speed down our dirt roads that are not well-lit creating clouds of dirt. At mid
night or after when the events end these people leaving his events are drunk, and drive recklessly though
our roads creating potentially dangerous road conditions. The owner(s) of this property has no regard for
other people or the law in general. As far as I am concerned, he is not a neighbor, but rather a person that
profits off of the suffering of those around him.
 
If the permit(s) is granted we along with the rest of the neighborhood is prepared to litigate.

I went to the "neighborhood meeting" regarding the rezoning of
property 18401 w Moreland st Goodyear AZ. It was hosted by
Jessica Sarkissian at Up Front Planning and the owners of the
venue. Myself and several other neighbors expressed how
horrible having this venue has been. The loud music, unwanted
traffic, and overwhelming amount of people coming in and out
of our neighborhood should not be allowed. We are opposed to
them continuing on with this weekly disturbance. We felt as if
the people who own the property, and the ladies from Up Front

Planning were basically laughing in our faces in response to
our cries of outrage and despair. We cannot allow them to
receive this permit. They have already been hosting large, late
night, weekly events for over a year. We need proper
representation and response for this common law nuisance. It
has to stop. Many of the people at the neighborhood meeting
weren't even residents of our neighborhood. They were family
and friends to the owner. We had 20 signatures on our petition
for our small little County island. Please, I beg of you. Please
do not allow SU250009 to go through.

I have been a proud resident of Quintana Estates for over 20
years. Our neighborhood is more than just a place to live — it is
a tight-knit, respectful community where neighbors know one
another, look out for each other, and take pride in the peace
and quiet that defines our way of life.
That peace has been shattered.

For the past year, an unwelcomed commercial wedding venue
has disrupted the very fabric of our community. Every weekend,
without fail, we are subjected to deafening music that blares
into the night — bass so loud it shakes our walls, our floors,
and our nerves. It’s relentless, and it’s invasive.
As a teacher of young children, my weeks are spent giving my
energy, attention, and care to others. Like many hardworking
residents here, I come home on Friday evenings looking for
rest, quiet, and time with my family. But instead of calm, we are
met with chaos. Instead of unwinding, we’re forced to endure
the thudding noise and escalating disruption coming from this
venue — noise that carries for acres, invading homes that have
stood peacefully here for decades.
The issues extend beyond sound. The influx of traffic to and
from the venue has created a dangerous and unsettling
situation. Strangers speed down our roads — roads that are
unpaved, unlit, and never meant to handle this volume or kind
of activity. Dust clouds the air, and the risk of an accident grows
with every weekend event. Our children cannot safely play
outside. Our friends hesitate to visit. Our lives are being
upended by an enterprise that has no regard for the community
it is affecting.
Worse still, each weekend sees multiple residents calling the
non-emergency sheriff’s line, desperate for intervention. Our
local law enforcement — whose time and attention are needed
elsewhere for true emergencies — are being diverted to
repeatedly address a problem that should never have been
permitted to exist here in the first place.
This venue is incompatible with the nature of our neighborhood.
It threatens our safety, our well-being, our peace, and the
sense of community we have built over the last two decades. It
is not simply an inconvenience — it is a violation of what
Quintana Estates stands for.
I urge the County to take this matter seriously and consider the
long-term damage being done to a neighborhood that has
always upheld its values and responsibilities. We need action.
We need protection. And above all, we need our neighborhood
back.

Regarding proposed Special Use Permit for 18401 W Moreland St Goodyear AZ 85338
As a neighbor to this business I adamantly oppose providing a permit to this individual.
I would like to point out several reasons why this should not be approved.
The first event was held over a year ago.  At that time I informed him that this type of business
was not allowed in a residential neighborhood.  Yet he’s continuously held events without
applying for anything until now.  He’s ignored all requirements despite having this knowledge.  I
even went as far as sending him copies of the county zoning codes that are relevant to his
situation. Yet he ignored it until now.
On a regular basis one of the neighbors behind him sends him texts that the music is too loud. 
No action on his part is ever taken as a result.  When a person in my home told him we didn’t
like the events his response was “It’s only once a week”.  Now it’s at least twice but him
disrupting our peace once a week shouldn’t be allowed. 
In the original code violation notice he was informed that Semi trucks weren’t allowed to be
parked at his home and that his event hall was in violation. After that notice he obtained
permission to use the empty lot across the street from his home and turned it into a parking lot
for the event hall AND rents out space for Semi’s to park.  Now he’s obtained permission to use
the empty lot 3 lots to the west of that lot and he’s renting that lot out to Semi’s.  We are now
surrounded by Semi trucks in a location where streets are rather narrow because of this man.
He took those actions AFTER being informed of the violations.  Clearly, having no intentions of
complying.  Just the opposite the violations are worse!  Now the lot across the street from his
home has a violation case.  But it’s not his lot so it seems like it’s a separate problem but the lot
was for his business so it’s his actions!
Even though we are on acre lots the houses are still rather close together. The houses are
usually at the minimum setbacks at the front so the constant traffic in a quiet residential area is
disruptive.  Every weekend we have cars parked in front of our homes. We’ve had our
driveways blocked.  We’ve witnessed drunk people leaving the events and driving in front of our
homes. It’s only a matter of time that we have drunk drivers wrecking into our homes or our cars
or killing our family members. We’ve been informed that cars have crashed into mailboxes in
the neighborhood and the neighbor across the street had a tree uprooted by a vehicle leaving
the event hall.
We've also experienced more thefts on our property.  Things disappearing from our driveway. 
The entire copper from under the trailer was stolen one night when he was having the events.

I've had to taking to locking our gates and putting locks on all of the side openings to the trailer. 
I've had to spend a considerable amount of money investing in cameras and locks to keep our
property secure. We went from leaving our doors unlocked during the day to locking them all
the time due to the extra traffic in the neighborhood.
He's in constant violation of noise ordinances.  Police are called EVERY weekend by multiple
people. I’ve called several times and been told calls were already made by others.  There have
been events so loud that they can be heard on Roosevelt 3 streets away. As someone directly
east of this event center, we’ve experienced events so loud we are unable to watch our TVs in
our homes with all doors and windows shut.  Just before police start to arrive the sound is
turned down suggesting they are monitoring police scanners so they don’t appear too noisy. 
The sound is turned back up when the police leave. I've made as many as four calls to police in
a night due to the noise.  Yet police can't come quickly because its low priority to visit a home
with music up too loud.  It's only been recently that the police are starting come down harder on
the house because of all the calls.
Even when he’s told to turn the music down by police the bass from the sound system can still
be felt.  I have a mother with Parkinson’s and my brother is mentally handicap.  Both have
sensory issues.  My brother, not understanding that his screaming doesn’t makes a difference,
will stand in our back yard screaming at them to turn the music off.  He shakes his head
constantly, holds his ears, and has cried. Every weekend!  I can put ear phones on him but it
doesn’t stop the bass from annoying him.  We cannot go to sleep until the events are over and
that is usually not until midnight or later.  Because all week long we usually go to bed between 9
and 10 pm and wake up between 5 and 6 am the long nights on the weekend disrupts our sleep
patterns and makes us all exhaused.  We still wake up at 5 or 6 am except on the weekend we
only get 4-5 hours of sleep because we can't go to bed until he stops the music.  We don't have
the energy on the weekend to attend to our normal weekend chores so our own lot has become
a mess.
This man has disrupted our lives for over a year with very little action from the county to stop it. 
Now he might be able to subject us to this problem forever? His event hall is clearly profitable.
Why allow him to continue operating on the cheap when he can afford to move his hall to a
commercial venue?
He has sent a notice out to the neighbors and invited them to attend a meeting at his house. 
Except us.  He knows we call the police regularly and has left us out of the situation.  He has
also not placed any signs at his home that an application has been submitted, I believe that is
also required.
In summary, this man has ignored all legalities regarding his situation.  It’s only now, that police
are becoming more involved, that he’s applied for the permit.  He’s not only ignored
requirements to not have Semi’s parked he’s gone as far as brought in more.
Why would we believe that with a special permit he’s going to shut the parties down at a
reasonable hour and keep the music down?  He’s not done either of those things for over a
year? Because he has a permit he’ll do it now?  I doubt it. I doubt he’ll stop even if the Special
Use Permit is not granted.  I suggest you visit the area on a Saturday night to see how it
impacts us.
I would also like to point out that when  police have visited they have been told that he already
has a permit!  So he’s lied to police about the situation on top of everything else.`
Is it reasonable to subject neighbors to the constant noise, constant house rocking bass,
constant traffic, constant risk by drunk people, just so he can make money? He's ignored you
for a year!

Please understand that this is not something that we can handle any longer. Our only option,
considering my brother and mother’s situations, is to try to move. Considering housing and
interest rate problems that would be difficult financially.  Plus who wants to buy a home next to a
loud event hall?  Our homes value will likely be impacted.
This guy’s business is thriving.  We have lived in this home for over 15 years. Yet this man
moved in, turned the house into an event hall, continously disregards our concerns and
complaints, and didn’t apply for a permit for over a year.  Please? Why would we believe he will
behave after he has one?  Just last night weekend I had to call the police twice because of the
music.  He thinks if he turns it down a bit it’s fine. Except the bass still rocks our home and
disrupts our ability to sleep.  It’s absolutely horrible to live next to this despicable, selfish,
inconsiderate human.  He’s only in this for his own pocket book. Be damned everyone he
impacts.
It simply isn’t right that we can’t have peace in our home because of this man.  Please please
please please shut him down. I cannot stress enough how negatively this has impacted our
lives. Please shut him down.

I have filed a request to stop the neighbor at 18401 W. Moreland St. Goodyear, AZ 85338 from
continuing to hold a venue for wedding receptions, quinceaneras, etc. in his backyard.  Their online
presence is Sunset Event Planning.  They often have live bands and D.J.'s on Friday and/or Saturday
nights and occasionally on Sunday.  The constant noise from the bass music is disconcerting.  It keeps
us from going outside to be in our own backyard and is interfering with my family and I using and
enjoying our property.  The music plays until 1:00 in the morning.  I cannot even get any sleep until
the music shuts off.   I have put up with this for a year.  The paperwork I added my name to indicated a
date of April 22 as a cease and desist date.  I would like that date to be upheld so that I may begin to
use and enjoy my property once again.  I would like to formally object to the Special Use Permit.

I have lived in this neighborhood for over 15 years. The
neighbors have always been quiet and respectful of each other.
The house at 18401 W Moreland is being run as an event
business. There are tons of cars here on Friday's and
Saturdays and the music gets very loud. We can feel the music
and it is very disruptive. I enjoy watching movies during the
evening but struggle to watch when the parties are going. My
son is mentally handicap. The music bothers him a great deal.
We've often gone out to eat or just drive around to calm him

down. We cannot go to bed until the party is over. Please do
not grant him a permit and please stop him from continuing this
activity. He is very rude and very disrespectful to his neighbors.

To whom it may concern,
I am a resident on Moreland st. The residence currently being used as a venue has caused undo stress, as well as major disturbances for
the neighborhood as well as for my family. 
I have 2 young children with medical conditions that make them sensitive to loud noises. This is especially stressful in the evenings when
they are sleeping. I have been forced on more than 1 occasion to call the sheriff's department as well as the maricopa noise ordinance
office to the extraordinarily loud music, as well as the bass. 
My home is at minimum an entire block away. I used sleep sounds on Alexa in all of the bedrooms to help with the noise sensitivity at
night. However, there is nothing available to offset the vibrations from the bass. Also, there has been more than 1 occasion of which my
children have wanted to take an evening stroll around the block before bed, that has ended badly. This has ended badly due to the venues
clientele being intoxication and nearly running us over. 
How are we supposed to feel safe in our neighborhood when we can't take a nice evening stroll without nearly being ran over. How are we
supposed to expect our children to sleep through the noise/vibration so loud and strong that as an adult I can't sleep through. 
Please do not rezone this residence.

Good Morning,
Thank you for updating me on what is happening with Mr. Benevides at 18401 W. Moreland.  He
played his music and ran his venue through the lovely days of May despite the cease and desist that
you placed on him.  It was quiet for the summer as it is too hot to host people outside in the summer
months.  Last Friday night, September 26, 2025, the music spooled up between 6:00pm and 6:30pm. 
Four Sheriffs came out and visited multiple homes.   Neighbors are pressing charges as is my
daughter.  Mr. Benevides was cited, and the venue was closed down that night. 
In speaking with some of my neighbors,  I understand that you would like pictures of the recent
fencing additions that Mr. Benevides has added to his property.  I am on the back side, so the pictures
I am sending are taken from Latham Street. (pictures attached)  I hope this helps.  If there is anything
new, I would appreciate it if you could let me know.  Thank you for your time and understanding.

Special Use Permits would still require one to obtain normal permits prior to operating a business
similar to any commercial rezone. They still have yet to file a second submission. There's nothing new
for us to review at this time. We've informed Mr. Benavidez he should not hold new commercial
events on his property until the SUP process is complete, as we did when the initial violation was filed.

Dear Officer Cook,
On December 5, 2024, Mr. Bruining of Planning and Development listed me as a complainant on
violation case V202400241. After working with Mr. Bruining, I was directed to Mr. Joel Landis. 
Recently, he directed me to you.  I also notified County Supervisor Steve Gallardo's office in 2024 of
what was transpiring in my previously quiet community. His representative, David Galaviz, called me
from the county supervisor's office last December.  Mr. Galaviz apologized that this was going on. He
also assured me that it would stop. It has not. 
I understand that neighbors may host parties, and we are very understanding of that when it does
happen.  This, however, is not a person having a house party each weekend, it is indeed a venue with
an online presence advertising to rent out the space for various types of events (including but not
limited to, birthdays, weddings, anniversaries, bat mitzvahs, quinceaneras, etc).  This cannot be
characterized as a house party, as it is a venue being rented for money and special events each
weekend.  Not only have they been hosting events since 2024, but they are now booking events for
the future months of 2026 and 2027 according to their online information.  The owners of the home
(18401 W Moreland St) have recently renamed their company from AZ Sunset Event Planners to
multiple other titles according to their public online social media presence.  I am attaching screenshots
of the TikTok information as well as Instagram listings that include the address as well as their phone
numbers.  These were simply the items I was able to find, but there could possibly be more.  Melissa
was the point of contact with the original AZ Sunset Event Planners with a phone number of 623-221-
6273.  They have a new address listed under one of the company names of Rancho Del Sol and the
same phone number and point of contact, Melissa, with the same phone number for Casa Del Sol or
Sotelo's Casa Del Sol Events.  The pictures shown on their media pages are of the venue's event space
located at the address 18401 W. Moreland St. Goodyear, AZ, which is in a residential neighborhood. 
TikTok/Instagram/Facebook are public online presences all showing an event venue located at 18401
W. Moreland street which indicates that the music every weekend is NOT from a house party, but from
a listed venue to host events and parties.

On April 14th Mr. Benevides hosted a neighborhood event informing the neighbors of his intention to
keep his venue going with a Special Use Permit #250009.  This letter indicates that the property is a
"rental" location.  I have attached a copy of this letter.  
The cease and desist order listed below was issued by Planning and Zoning.  It was not enforced, even
though the Sheriff's officers came out after multiple complaints made after the date of April 22, 2024.
In addition to the Sheriff's officers coming out to the venue, there was a citation made where a
member of my household was deemed a victim in the situation and is currently awaiting completion of
the trial.  That first victimization was made on April 26, 2025, just after the original cease and desist
order was in effect.  Recently, the same victim pressed charges again on September 26, 2025 for the
same reasons as the first.  There are now 2 trials for the same offense, and need to be taken into
consideration.   
We have enlisted the help of a lawyer to aid with fighting for our rights in regards to our home and
the ability to enjoy its space therein.  We seek relief from the loud bass and music each weekend
being caused by the Venue located within our residential community.
Thank you for your attention to this matter, as it is deeply appreciated.  Please let me know if there is
anything else I can do to help resolve this persistent issue within my residential community.

I would like to point out several reasons why this should not be approved.
The first event was held over a year ago.  At that time I informed him that this type of business

In the original code violation notice he was informed that Semi trucks weren’t allowed to be
parked at his home and that his event hall was in violation. After that notice he obtained
permission to use the empty lot across the street from his home and turned it into a parking
lot for the event hall AND rents out space for Semi’s to park.  Now he’s obtained permission to
use the empty lot 3 lots to the west of that lot and he’s renting that lot out to Semi’s.  We are
now surrounded by Semi trucks in a location where streets are rather narrow because of this
man.
He took those actions AFTER being informed of the violations.  Clearly, having no intentions
of complying.  Just the opposite the violations are worse!  Now the lot across the street from
his home has a violation case.  But it’s not his lot so it seems like it’s a separate problem but
the lot was for his business so it’s his actions!
Even though we are on acre lots the houses are still rather close together. The houses are
usually at the minimum setbacks at the front so the constant traffic in a quiet residential area
is disruptive.  Every weekend we have cars parked in front of our homes. We’ve had our
driveways blocked.  We’ve witnessed drunk people leaving the events and driving in front of
our homes. It’s only a matter of time that we have drunk drivers wrecking into our homes or
our cars or killing our family members. We’ve been informed that cars have crashed into

mailboxes in the neighborhood and the neighbor across the street had a tree uprooted by a
vehicle leaving the event hall.
We've also experienced more thefts on our property.  Things disappearing from our driveway. 
The entire copper from under the trailer was stolen one night when he was having the events.
I've had to taking to locking our gates and putting locks on all of the side openings to the
trailer.  I've had to spend a considerable amount of money investing in cameras and locks to
keep our property secure. We went from leaving our doors unlocked during the day to locking
them all the time due to the extra traffic in the neighborhood.
He's in constant violation of noise ordinances.  Police are called EVERY weekend by multiple
people. I’ve called several times and been told calls were already made by others.  There
have been events so loud that they can be heard on Roosevelt 3 streets away. As someone
directly east of this event center, we’ve experienced events so loud we are unable to watch
our TVs in our homes with all doors and windows shut.  Just before police start to arrive the
sound is turned down suggesting they are monitoring police scanners so they don’t appear
too noisy.  The sound is turned back up when the police leave. I've made as many as four
calls to police in a night due to the noise.  Yet police can't come quickly because its low
priority to visit a home with music up too loud.  It's only been recently that the police are
starting come down harder on the house because of all the calls.
Even when he’s told to turn the music down by police the bass from the sound system can
still be felt.  I have a mother with Parkinson’s and my brother is mentally handicap.  Both have
sensory issues.  My brother, not understanding that his screaming doesn’t makes a
difference, will stand in our back yard screaming at them to turn the music off.  He shakes his
head constantly, holds his ears, and has cried. Every weekend!  I can put ear phones on him
but it doesn’t stop the bass from annoying him.  We cannot go to sleep until the events are
over and that is usually not until midnight or later.  Because all week long we usually go to
bed between 9 and 10 pm and wake up between 5 and 6 am the long nights on the weekend
disrupts our sleep patterns and makes us all exhaused.  We still wake up at 5 or 6 am except
on the weekend we only get 4-5 hours of sleep because we can't go to bed until he stops the
music.  We don't have the energy on the weekend to attend to our normal weekend chores so
our own lot has become a mess.
This man has disrupted our lives for over a year with very little action from the county to stop
it.  Now he might be able to subject us to this problem forever? His event hall is clearly
profitable. Why allow him to continue operating on the cheap when he can afford to move his
hall to a commercial venue?
He has sent a notice out to the neighbors and invited them to attend a meeting at his house. 
Except us.  He knows we call the police regularly and has left us out of the situation.  He has
also not placed any signs at his home that an application has been submitted, I believe that is
also required.
In summary, this man has ignored all legalities regarding his situation.  It’s only now, that
police are becoming more involved, that he’s applied for the permit.  He’s not only ignored
requirements to not have Semi’s parked he’s gone as far as brought in more.
Why would we believe that with a special permit he’s going to shut the parties down at a
reasonable hour and keep the music down?  He’s not done either of those things for over a
year? Because he has a permit he’ll do it now?  I doubt it. I doubt he’ll stop even if the Special
Use Permit is not granted.  I suggest you visit the area on a Saturday night to see how it
impacts us.
I would also like to point out that when  police have visited they have been told that he already
has a permit!  So he’s lied to police about the situation on top of everything else.`

Is it reasonable to subject neighbors to the constant noise, constant house rocking bass,
constant traffic, constant risk by drunk people, just so he can make money? He's ignored you
for a year!
Please understand that this is not something that we can handle any longer. Our only option,
considering my brother and mother’s situations, is to try to move. Considering housing and
interest rate problems that would be difficult financially.  Plus who wants to buy a home next
to a loud event hall?  Our homes value will likely be impacted.
This guy’s business is thriving.  We have lived in this home for over 15 years. Yet this man
moved in, turned the house into an event hall, continously disregards our concerns and
complaints, and didn’t apply for a permit for over a year.  Please? Why would we believe he
will behave after he has one?  Just last night weekend I had to call the police twice because
of the music.  He thinks if he turns it down a bit it’s fine. Except the bass still rocks our home
and disrupts our ability to sleep.  It’s absolutely horrible to live next to this despicable, selfish,
inconsiderate human.  He’s only in this for his own pocket book. Be damned everyone he
impacts.
It simply isn’t right that we can’t have peace in our home because of this man.  Please please
please please shut him down. I cannot stress enough how negatively this has impacted our
lives. Please shut him down.

Do you have an updated schedule date for the meeting yet? He has begun holding venues again and 
illegally parking vehicles and playing the music. Same as before he stopped for the summer. Nothing 
has changed nor do I expect them to change or live up to any of the “promises” they made at the 
community meeting. They have no intention of making peace in the neighborhood or being a good 
neighbor. I am sorry to ramble but you would be just as frustrated if this was your home.

Well our worst nightmare has come as we have dreaded. This property owner has started his neighborhood disturbances again that calls “venues”. Load 
music and bass, cars parked all over the street and drunk people about. A neighbor sent this photo and shortly after a rock was thrown at his vehicle from the 
property. We as a neighborhood are not going to let this go on. He clearly doesn’t care about the cease and desist that was served to him nor the harm he is 
doing to our community. Attached are pictures and videos from this evening with the illegal parking, harassing neighbors who are not even on his property in 
intermediation, parking his commercial vehicle on vacant privately owned property next to my house. Some were taken personally and some sent to me by 
other neighbors being affected. This person is a criminal all around with no regard for anyone else.

Hello,
Well another night for you and another unpeaceful night for me. Once again Ruben the owner of
18401 W Moreland St. Goodyear,AZ 85338 throws a venue and nothing happens to him. I called the
Maricopa County sheriff’s department for help. The officer that went out told me they went to the
property, told them to turn the music down and took the owner at their word when they told the
officer it was a private birthday party he was throwing for a family member and that the party would
last till 10 or 11 and would keep it down.  Aside from the many many times this person has been
caught in lies the officer took him at his word and left. The call I got from the officer after he had went
was to say the least disappointing. I was told that since I was not home (had went to get dinner) they
could not make a violation because they could not prove that they were disturbing the peace. Also
after I told him there was an active cease and desist on this property he told me that there was
nothing he could see on it and that the property owner would need to provide that info to him which
he did not. He also stated that he did not go inside the gates. In what world is a criminal going to say
yes officer by the way I am doing this illegally here is the proof!? I am extremely upset at the fact that
we are almost 2 years of dealing with this crap and we can not get help from anyone. Apparently a
cease and desist doesn’t mean anything and is not enforceable by law enforcement. If I could move
tomorrow I would but I am stuck here till the housing market turns around. So what are my options?
What else can we do then keep writing emails and begging for help??? Unless I can afford an attorney
and sue him personally I am screwed. Crazy thought but aren’t criminals (those who break the law)
supposed to be held accountable? My apologies for the harshness of this email but I am fed up and
exhausted of fighting a never ending fight.

evening with the illegal parking, harassing neighbors who are not even on his 
property in intermediation, parking his commercial vehicle on vacant privately

We are long-term residents of this community and strongly oppose Mr. Benavides's activities. Although 
we do not reside within the 300-foot notification boundary and do not own the home in which we live 
(it is owned by Rayann's family), my family and I have been significantly impacted. 
Prior to Mr. Benavides and his family moving into the area, the neighborhood was relatively quiet. Since 
that time, weekends have become unpredictable due to increased traffic and loud music continuing late 
into the evening. 
A neighborhood meeting was held only after the organizers were required to do so. During that meeting, 
residents' concerns were not meaningfully addressed. When concerns were raised, Mr. Benavides's 
daughter, Melissa, became hostile. Following the meeting, Mr. Benavides contacted me requesting a 
"do-over," stating that the meeting had not gone well and asking what he could do to gain my support. 
When I declined to support the events, the behavior toward me escalated into harassment. 
On multiple occasions, I have spoken with the neighbor who lives directly east of Mr. Benavides's 
property and have contacted law enforcement due to excessively loud music. During these incidents, 
Mr. Benavides sat in his vehicle and shined a spotlight directly at my car, impairing my vision. 
On September 15, 2025, Mr. Benavides's wife drove at a high rate of speed and swerved into my yard, 
striking my children and me with rocks and dirt. On October 30, 2025, as I was leaving my home, I 
stopped my vehicle when Melissa swerved into my lane at a high rate of speed, narrowly avoiding a 
collision and striking my vehicle with debris. Both incidents are documented in police reports, and one 
was captured on my dash camera. 
These individuals are members of the family hosting the events, and Melissa is the primary organizer. 
Their actions demonstrate a disregard for the safety of residents, particularly children. Alcohol is served 
at these events, and I have personally observed visibly intoxicated individuals driving away from the 
neighborhood. Event attendees frequently drive at excessive speeds, including at night, despite the 
absence of street lighting or posted speed limit signs. 
My children are autistic and are unable to sleep during these events due to excessive noise and bass that 
is clearly felt inside our home, despite being approximately 700 feet away. I must constantly monitor 
traffic when assisting my children into vehicles out of concern that ongoing harassment and reckless 
driving could result in serious injury. 
For these reasons, I submit this statement out of serious concern for the safety and well-being of my 
family and the surrounding community, and I respectfully request that the Board deny the special use 
permit.

My family opposes this activity. The operators did not follow the proper approval process before 
beginning operations and have introduced excessive traffic into the area. This creates serious

The events are consistently loud and regularly keep my young children awake at night. Bass 
from the amplified sound system is strong enough to shake the windows and walls inside our 
home. I understand the operators were previously instructed to discontinue events, yet they 
have continued to operate in disregard of that directive. 
They have failed to comply with the rules and conditions imposed by the county and other 
agencies. I am concerned that approval of this application would only encourage continued 
noncompliance, further compromising the safety, peace, and livability of the surrounding 
residential neighborhood.

​There are several reasons this permit should be denied.​
​I. Adverse Impacts on Residents and Vulnerable Individuals​
​1.​ ​The proposed use has caused direct, ongoing, and foreseeable harm to nearby​
​residents, including members of my household.​
​2.​ ​A resident of my household diagnosed with Parkinson’s disease has been unable to​
​sleep during event nights due to excessive noise.​
​3.​ ​A resident of my household with special needs and significant sensory sensitivities​
​experiences severe distress from amplified music, including covering his ears, rocking,​
​and visible emotional agitation.​
​II. Escalation and Frequency of Events​
​1.​ ​Events initially occurred once per week and later increased to twice per week.​
​2.​ ​On multiple occasions, events occurred on three consecutive days, including Fridays,​
​Saturdays, and Sundays.​
​3.​ ​This escalation persisted despite repeated law enforcement responses and direct​
​notification to the applicants that the events were causing significant disruption to​
​neighboring residences.​
​III. Ignorance of Laws, Codes, and Permit Requirements​
​1.​ ​Shortly after the first event, the individual acting as event coordinator was informed of​
​applicable noise ordinances and county codes through e-mail correspondence.​
​2.​ ​Despite this notice, the applicants failed to apply for a special use permit for a period​
​exceeding one year.​
​3.​ ​The timing of the application strongly suggests it was submitted only after repeated​
​sheriff responses to loud music complaints.​
​IV. Unpermitted Construction and Continued Operations​

​1.​ ​Renovations and site modifications were completed without required permits.​
​2.​ ​After submission of the special use permit application, the applicants were instructed to​
​cease operations, including the use of amplified music, until approval was granted.​
​3.​ ​Despite this directive, events with amplified music continued, including within days of this​
​submission.​
​4.​ ​The center has attempted to hide operations by changing their name and not putting​
​their address on Instagram and Facebook accounts that are associated with the new​
​name.  Pictures on those pages display the location.​
​V. Creation of Traffic and Safety Hazards​
​1.​ ​The applicants constructed an approximately eight-foot fence and extended it to the​
​roadway without a permit, despite existing code violations under review.​
​2.​ ​This unpermitted construction obstructs visibility when exiting my driveway and creates a​
​significant traffic safety hazard.​
​3.​ ​This safety hazard impacts servicing of my dumpster since Waste Management has no​
​visibility to exit my property safely.​
​4.​ ​These hazards are exacerbated by frequent and excessive speeding by individuals​
​associated with the property.​
​VI. Unauthorized Commercial Use of Adjacent Properties​
​1.​ ​Mr. Benavides installed millings and rented parking spaces to semi-trucks on a vacant lot​
​directly across from his property without ownership or authorization.​
​2.​ ​After being instructed to discontinue this activity, the millings was relocated to a parcel at​
​the corner of 183rd Drive and Moreland, owned by the Arizona Department of​
​Transportation, where unauthorized commercial parking activity resumed.​
​3.​ ​This activity ceased only after enforcement action, and the property was subsequently​
​fenced.​
​4.​ ​An ADOT representative indicated that fines or criminal charges were likely.​
​5.​ ​Following the loss of access to these properties, Mr. Benavides began parking a​
​semi-truck on another vacant parcel along 183rd Drive without ownership or​
​authorization.​
​VII. Apparent Lack of Required Food and Alcohol Licensing​
​1.​ ​Public reviews and posted menus indicate that food is served at events; however, no​
​food service license has been obtained.​

​2.​ ​Reviews state that licensed bartenders are provided, while other reviews indicate that​
​family members act as bartenders.​
​3.​ ​No bartender licenses or alcohol service licenses appear to be on record with the state​
​licensing authority for the individuals or the business.​
​4.​ ​Since licensing requires 60 hours of education this raises serious concerns regarding​
​underage drinking, overserving, impaired driving, and public safety in a residential​
​neighborhood.​
​VIII. Hostile Conduct and Abusive Behavior Towards Neighbors​
​1.​ ​During a required neighborhood meeting, the individual acting as event coordinator​
​expressed hostility toward residents opposing loud events and alcohol-related activity​
​near their homes and families.​
​2.​ ​Following that meeting, a neighbor who had been especially vocal in opposition to the​
​activity, and his autistic children, were placed at risk when a vehicle associated with the​
​applicants swerved onto their property, throwing dirt and debris toward the neighbor and​
​his children while they were standing in their own yard.​
​3.​ ​In a separate incident, a vehicle associated with the applicants swerved toward the​
​same neighbor at high speed, serving at the last minute narrowly avoiding a collision.​
​4.​ ​Both incidents were reported to law enforcement, and one was captured on dash​
​camera footage.​
​5.​ ​These events appeared to be some form of intimidation.​
​IX. Noise Impacts Beyond the Notification Radius​
​1.​ ​Noise impacts extend well beyond the 300-foot notification radius.​
​2.​ ​Music has been audible approximately 800 feet away, including at the intersection of​
​Roosevelt and 180th Drive.​
​3.​ ​Event lighting has been visible from major intersections, including Roosevelt and Citrus.​
​4.​ ​Events have continued until approximately 3:00 a.m.​
​5.​ ​Bass from amplified sound systems causes vibrations that shake windows and can be​
​physically felt​​INSIDE​​homes located 800 feet from the venue.​
​X. Crime and Unsafe Road Conditions​
​1.​ ​Despite many years of very little crime since the events started we’ve had the Air​
​Conditioning Copper stolen from under our home, several items stolen from our property,​
​and screws drilled into the tires on our car.​

​2.​ ​The surrounding area consists primarily of narrow, unpaved dirt roads that are not​
​designed to accommodate high volumes of traffic or commercial activity.​
​3.​ ​The roadways lack overhead lighting, creating limited visibility during evening and​
​nighttime hours when events are held.​
​4.​ ​There are no traffic control devices in the area, including stop signs, yield signs, traffic​
​signals, or marked lanes.​
​5.​ ​Increased event traffic, including impaired drivers leaving late-night events, significantly​
​elevates the risk of collisions, pedestrian injuries, and property damage under these​
​conditions.​
​6.​ ​The combination of alcohol service, excessive speeding, limited visibility, and​
​unregulated roadway conditions creates a heightened risk of criminal activity, hit-and-run​
​incidents, and other public safety hazards.​
​7.​ ​These roadway conditions make the location unsuitable for a commercial event venue​
​and incompatible with the safe use of surrounding residential properties.​
​XI. Conclusion and Request for Denial​
​1.​ ​The applicants have demonstrated a sustained pattern of noncompliance with laws,​
​regulations, and permit requirements.​
​2.​ ​The applicants have shown disregard for public safety and the reasonable use and​
​enjoyment of neighboring properties.​
​3.​ ​The proposed use is incompatible with the surrounding residential area.​
​4.​ ​Approval of the petition would reward prior violations and create ongoing risks to​
​residents and patrons.​
​For these reasons, the petition should be denied.​

My grandchildren frequently spend weekends with me, and during event nights it is extremely 
difficult to maintain a reasonable bedtime. The music is often so loud that I have had to turn my 
television to maximum volume just to hear it inside my own home. 
I am also deeply concerned about the safety hazards this operation creates. The volume of 
vehicles is excessive for this area, which consists of narrow, unlit dirt roads with no traffic signs 
or controls. This is not an appropriate location for a commercial operation. The increased traffic 
and noise disrupt the peaceful use of our neighborhood and intrude into the interior of our 
homes. 
It is unreasonable for residents to endure these disturbances so that one individual can operate 
a business in a non-commercial area. If the center is as successful as it appears to be, Mr. 
Benavides should relocate to a properly zoned commercial venue. 
For these reasons, I respectfully urge the board to deny this application.

Staff has continued to receive several items of opposition since the publishing of the 
staff report and subsequent handout memo. Attached to this memo are additional 
letters of opposition. Staff has prior received opposition from all parties, so the total 
count is not changed. However, one of the parties has indicated that they own a 
property within the 300’ buffer. While the supermajority has already been triggered, 
staff has updated this map to show this parcel as now being against the project.

​I am writing because I do not want the loud event hall to be approved near my home.​
​I am an adult, but my brain works like a eight-year-old. Loud noises are very hard for me. When​
​there is loud music, bass, or lots of people, I feel like I am in pain. My body feels bad and I​
​cannot calm down. I cover my ears, cry, and sometimes feel like I need to run away. This is not​
​something I can control.​
​My home is where I feel safe. Loud music and shaking sounds go through the walls, even when​
​I am inside. I cannot escape the noise, especially the bass. I cannot just leave my house when​
​this happens, and I cannot get used to it. Everytime the cars start  to arrive my anxiety​
​increases and I start shaking.​
​Please do not approve this permit. I need my home to stay quiet so I can feel okay and live​
​safely.​

participants to park on or around my property, Mr. Benavides became disrespectful toward me. 
Despite my refusal, I have documented on camera individuals attending his events entering my 
property without permission, including visibly intoxicated individuals. 
These events generate significant traffic and safety concerns in what is otherwise a quiet 
residential area. Attendance has reached hundreds of people, which is wholly inconsistent with 
the character of the neighborhood and substantially increases the risk of disturbances, 
trespassing, and criminal activity. 
For these reasons, I strongly oppose approval of this permit.

To Whom It May Concern: 
With regards to Case 4SU250009, brought to our attention by Dave Bandley and other 
residents and owners in Quintana Estates. 1 wish to provide a brief history of our dealings with 
Ruben Benevides, 
I own the lot directly across fom M'. Benavides property, APN: 502'-37-0778. He approached 
us about renting our lot for use as a parking area a few years ago. We planned to lease to him 
this land, contingent upon signing a lease, and complying with various legal and logistical 
requirements including providing legal indemnity for us with an insurance policy for the use of 
that land. He failed to provide the requested insurance, and as a result, we declined to rent to 
him. 
Despite this, Mr. Benavides placed rock material and a large tank on our property and began 
using it as a parking lot, including renting parking spaces to semi-truck owners. We informed 
him that all activity must stop and made efforts to block him from using our land. Nevertheless, 
he continued to use the lot to park his on semi-truck. We have recently sent Mr Benevides 
text messages to his phone and mailed a formal Cease and Desist aemand, regarding the 
unauthorized use of our propeFty,  
Given his repeated disregard for property rights, failure to provide insurance, and use of our 
land without permission or compensaon, I question his willingness to comply with rules or 
conditions imposed by the county and his willingness to cooperate with the neighborhood. 
Based on this history of non-cooperation from Mr Benevides, I am currently supporting the 
petition to deny his application for a Special Use Permit.
