Known as APNs 210-11-012A, 210-11- 002A, 210-11-004C, 210-11-004G, and 210-11, 014B. Department Recommendation: Having received no objection MCDOT finds that the proposed annexation No. 554, Briles Pass Annexation lying with a portion of Section 6 Township 4N Range 3E of the Gila and Salt River Meridian, Maricopa County, Arizona. Known as APNs 210-11-012A, 210-11-002A, 210-11-004C, 210-11-004G, and 210-11, 014B does not adversely impact the levels of county services to the remaining unincorporated territory. Presented by: Jesse Gutierrez, P.E, Director of Transportation Support/Opposition: Request for comments has been circulated to the Maricopa County Sheriff’s Office (MCSO) and Maricopa County Planning and Development (PND) to determine if there are any adverse impacts to the parcel that will remain in unincorporated Maricopa County. Discussion: A city or town may file a petition with the Maricopa County Recorder’s Office proposing to annex territory into the city or town. The city or town provides the notice to the Clerk of the Board under the provisions of A.R.S. § 9-471. A.R.S. § 9-471 sets forth the procedures for cities and towns to annex territory. Subsection I states, “A city or town shall not annex territory if, as a result of that annexation, unincorporated territory is completely surrounded by the annexing city or town or a combination of the annexing city or town and other cities or towns, unless the county board of supervisors for the county in which the territory is located makes a finding that the proposed annexation will not adversely impact the levels of county services to the remaining Page 2 unincorporated territory.”
