RESOLUTION NO. 7 RESOLUTION PROVIDING FOR THE COLLECTION OF ASSESSMENTS FOR THE PAYMENT OF BONDS FOR THE 130TH STREET AND CHANDLER HEIGHTS IMPROVEMENT DISTRICT IN THE MANNER AND BY THE OFFICERS PROVIDED BY LAW FOR THE COLLECTION AND ENFORCEMENT OF GENERAL TAXES LEVIED BY THE DISTRICT WHEREAS, the Superintendent of Streets of this District has levied and recorded an assessment for 130th Street & Chandler Heights Road Paving Improvement District Project No. 1 (the "project"), and the Superintendent of Streets has executed, and the chair of this board has countersigned, a warrant to collect the several assessments; and WHEREAS, the warrant and assessment have been returned, and a certified list of unpaid assessments has been filed with the Clerk of the Board of Directors of this District and presented to this board; and WHEREAS, Section 48-935, Arizona Revised Statutes, 1956, as amended, provides that the Board of Directors may direct that an improvement bond (the "bond") be issued in an amount which shall not exceed the aggregate amount of unpaid assessments exceeding $25 as may be shown on the certified list of unpaid assessments and cause such bond to be delivered to the contractor or his nominee as payment for all remaining amounts owed such contractor for work done with respect to the project; and WHEREAS, the Board of Directors has authorized the issuance of improvement bonds payable from the unpaid assessments levied against lots or parcels of land benefitting from such improvements; and WHEREAS, the Board of Directors has appointed the County Treasurer as custodian for such bond and registrar, transfer agent, and paying agent with respect to the book entry system of ownership herein authorized; and WHEREAS, A.R.S. ยง 48-946 authorizes the Board of Directors to provide for the payment of assessments in the manner and by the officers provided by law for the collections and enforcement of the general taxes levied by the District; and WHEREAS, the Board of Directors has determined that the collection of assessments for the payment of the bonds issued by the District in the manner and by the officers provided by law for the collection of the general taxes levied by the District will promote the orderly collection of assessments. NOW THEREFORE BE IT RESOLVED BY THE GOVERNING BODY OF 130TH STREET & CHANDLER HEIGHTS ROAD PAVING IMPROVEMENT DISTRICT OF MARICOPA COUNTY, ARIZONA, THAT: unpaid assessments exceeding $25 as may be shown on the certified list of unpaid assessments previously levied shall be collected in the manner and by the officers provided by law for the collection and enforcement of the general taxes levied by the District; and BE IT FURTHER RESOLVED that the time of payment of the respective installments of principal and interest shall be the last regular date for the payment of general taxes of the district before the date at which the installment of principal or interest would become delinquent and the delinquency and the penalties incurred for delinquency and the method of collection shall be the same as for general taxes of the district.
