C-22-25-004-X-03 Amendment No. 3 TCAA FY26 Rapid Rehousing Page 1 of 4 AMENDMENT NO. 3 TO THE CONTRACT BETWEEN MARICOPA COUNTY ADMINISTERED BY ITS HUMAN SERVICES DEPARTMENT AND TEMPE COMMUNITY ACTION AGENCY I. Maricopa County (“County”) administered by its Human Services Department and Tempe Community Action Agency. (“Subrecipient”) entered into a financial agreement (“Agreement) on or about August 28, 2024. The original Agreement term was July 1, 2024, through June 30, 2025. The purpose of the Agreement is to provide housing stabilization services and short-term and/or medium-term rental assistance and case management services to help individuals and families at risk of or experiencing homelessness. The County provided the Subrecipient with $307,110.00 in funding provided to the County through an Intergovernmental Agreement (IGA) with Arizona Department of Economic Security (DES) with U.S. Department of Housing and Urban Development (HUD) Emergency Solutions Grant funds (ESG) for Program Year 2024, Fiscal Year 2025, provided under Assistance Listing Number (ALN):14.231. The County and the Subrecipient may be referred to individually as the “Party” or collectively as the “Parties.” The Parties fully executed Amendment No. 1 on or about December 4, 2024. The Amendment revised and replaced the Itemized Service Budget which realigned the line-item expenditures. The total Agreement funding remained unchanged. The County Point of Contact was updated in the Amendment. The Parties executed Administrative Change Order No. 1 on or about March 21, 2025. The Administrative Change Order realigned line-item expenditure categories in the Itemized Service Budget in Section 3 (Work Statement), Subparagraph 2.3. The total Agreement Budget remained unchanged at $307,110. The Parties fully executed Amendment No. 2 on or about October 07, 2025. The Amendment revised Agreement funding to reflect new total Agreement funding in the amount of $403,952 for Fiscal Year 2026, revised the Contract Termination Date to June 30, 2026, revised and replaced required Paragraphs in Section 1, Section 2 and Section 3 (Work Statement) to replace the budget Paragraph 2.0 and updated Points of Contact, and Added Attachment 5: Budget Modification to the Agreement. II. The Parties now agree to modify the Agreement as authorized by Section 1 (General Provisions), Paragraph 4.0 (Amendments) of the Agreement as follows: A. Revise Agreement Amount on Page 1 to reduce funding by $67,959.57 to reflect a new Agreement funding total of $335,992.68, for Fiscal Year 2026. The Agreement expiration and expenditure period for reimbursement remains unchanged at June 30, 2026. B. In Section 3 (Work Statement) revise and replace the following: 1. Paragraph 2.0 (Budget) with the following: C-22-25-004-X-03 Amendment No. 3 TCAA FY26 Rapid Rehousing Page 2 of 4 2.0 BUDGET Activity Budget Fiscal Year Rapid Rehousing $335,992.68 FY2026 Total $335,992.68 2.1 The County shall provide an amount not-to-exceed three hundred thirty-five thousand nine hundred ninety-two and sixty-eight hundredths ($335,992.68) subject to terms of this Agreement and availability of funds. Funding is provided to the County through an Intergovernmental Agreement (IGA) with Arizona Department of Economic Security (ADES) (Agreement #D123-002395) for Fiscal Year 2026. This Agreement amount constitutes the County’s entire participation and obligation in the performance and completion of all work to be performed under this Agreement. 2.2 Reimbursement to the Subrecipient is in accordance with actual allowable costs incurred not to exceed the service reimbursement ceiling as stated in the Itemized Service Budget in 2.4. 2.3 Funding for this Agreement is through the following published programs in the Federal Register by the executive departments and agencies of the Federal Government of the United States under Assistance Listing Number (ALN): $335,992.68 - 14.231 Emergency Solutions Grant 2.4 Itemized Service Budget: 2. III. The Agreement is amended to incorporate the changes contained in this Amendment No. 3. All other terms and conditions of the Agreement remain in full force and effect as executed by the Parties. This Amendment No. 3 is subject to and incorporates the provisions of A.R.S. § 38-511. IV. The Parties have authorized the undersigned to execute this Amendment No. 3 on their behalf and it shall be effective upon approval and signature by both Parties.
