Letter of Explanation: Use Permit 
 
We respectfully submit this letter in support of our application for a Use Permit for our business 
located at 209 S. McClintock Dr. Tempe, AZ 85281. The building is an existing ±7,729 square 
foot industrial facility located on two parcels (132-41-008 & 132-41-009) within the General 
Industrial (GID) zoning district. Per Zoning Table 3-302A (Permitted Land Uses) Manufacturing 
is an allowable use, however a use permit is required for Manufacturing of Wood Products 
within the GID district. A1 Cabinetry is a cabinet fabricator for residential kitchens and 
bathrooms. 
The structure has historically been used for industrial & manufacturing purposes, including 
previously for cabinet manufacturing, and we intend to continue a similar use consistent with the 
property’s long-standing function and zoning designation. 
 
Project Scope & Narrative: 
I recently purchased the subject property with the intent to restore and reoccupy the existing 
building for light industrial use (Cabinet Manufacturing) consistent with the surrounding area and 
industrial uses. After my initial visit to the property as a potential buyer, I met with my design 
representative to also see the space and discuss the possibilities for my intended use. Together 
we visited the City to gather additional information regarding zoning and permitting steps. City 
staff indicated that the existing zoning and surrounding industrial area were well-suited for my 
intended operation, however a use permit would be required prior to submitting our tenant 
improvement plans. In general, the City was very positive about this project, and indicated that 
obtaining a use permit should not be difficult. That guidance and positivity gave me the 
confidence to move forward with the purchase and to establish my business in Tempe.  
When the property was initially listed, the interior was completely cleared, consisting of open 
spaces with two existing demising walls, which included a few existing openings between each 
section. These existing walls and openings will remain as they are, and the floor plan provided 
with this use permit application has been designed to reflect the intended layout and use of the 
space within those existing divisions. The detailed Tenant Improvement (TI) plans will be 
prepared and submitted after approval of the use permit, at which time all architectural, 
mechanical, electrical, and plumbing systems will be fully engineered and permitted. 
At the time of purchase, all storefront windows and doors facing McClintock Drive had been 
removed and boarded up. As part of this project, I plan to restore these entries in the exact 
same existing openings. The existing electrical service section (SES) had also been removed 
(or stolen) prior to my ownership. I will be bringing new electrical service to the building, location

as generally shown on the submitted site plan, to be finalized, engineered and permitted with 
the TI submittal. The mechanical equipment, which had also been removed, will be replaced in 
the same locations on the existing roof curbs, and the new systems will be fully engineered. The 
plumbing within the space will also be replaced to serve the new restrooms and sinks as part of 
the TI work, again with this new system designed and permitted per current codes. 
On the alley side of the property, I intend to build a new CMU wall with two automatic sliding 
gates to provide secure access and improve the site’s functionality. The design will also include 
an enclosed refuse area that can be serviced directly from the alley, allowing for easier and 
cleaner trash collection while maintaining an orderly site appearance. 
Overall, my goal is to bring the building back to a safe, functional, and code-compliant condition 
without making any major structural changes or alterations to the footprint. The improvements 
are focused on restoring the building back to a usable state, updating critical systems, and 
enhancing the overall operation of the property. The site plan and floor plan submitted with this 
application illustrate the intended functions and layout, which will be further refined and 
engineered during the TI permitting process. In summary, I am excited to revitalize this property 
while maintaining its industrial characteristics.  
 
 
 
Description of Use and Business Operation: 
Our business specializes in the design, fabrication, and finishing of custom cabinetry, serving 
the residential market. All operations will occur entirely within the existing building, with no 
changes proposed to the building's footprint or site layout. 
The space will be used for: 
●​ Cabinet fabrication and assembly, including woodworking using saws, routers, and 
joinery tools; 
●​ Minor finishing work in a small commercial spray booth area used for applying wood 
stains and protective coatings in compliance with safety and environmental standards; 
●​ A small office area for day-to-day business activities, project management, and 
customer service functions; 
●​ A limited showroom area, accessible by appointment only, for the rare occasions 
when clients wish to view cabinet samples and finish options in person. 
These components are supportive of the primary manufacturing use and designed to function 
efficiently within the building's existing infrastructure.

delivery vehicles 
 
Use Permit Justification: Zoning and Development Code Section 6-308(E) 
We believe this use meets the intent and criteria of the City of Tempe’s Zoning and 
Development Code and will not be detrimental to the surrounding area for the reasons outlined 
below: 
a. Significant Vehicular or Pedestrian Traffic 
The proposed use will not generate significant traffic. Employee parking is contained on-site. 
Customer visits are limited and pre-scheduled. Deliveries and pickups are infrequent and 
managed during standard business hours using light commercial vehicles. No public walk-in 
traffic or retail activity will occur. 
b. Nuisances from Odor, Dust, Noise, etc. 
All manufacturing and finishing work is conducted indoors. The building will include dust 
collection systems and a small spray booth area for finishing that meets applicable safety, air 
quality, and fire code standards. No dust, odor, fumes, vibration, or noise will escape beyond the 
building envelope. This operation is typical of industrial zones and consistent with surrounding 
uses. 
c. Impact on Neighborhood and Property Values 
This business continues the historic industrial use of the building and will not negatively impact 
nearby properties or contribute to neighborhood deterioration. On the contrary, the business will 
revitalize and occupy an existing industrial space, generating skilled employment and 
supporting Tempe’s economic development goals. The use aligns with the General Plan’s vision 
for employment corridors and productive industrial land use. 
d. Compatibility with Surrounding Uses 
The subject property is located in an area characterized by light industrial, service, and 
commercial trade uses. The proposed use is compatible with neighboring businesses and does 
not introduce any conflicting operational characteristics. No changes to building height, footprint, 
or setbacks are proposed.

e. Control of Disruptive Behavior 
This is a low-traffic, professional operation with no disruptive activities inside or outside the 
premises. There is no retail storefront or unsupervised public access. Employees are managed 
on-site, and customer visits are rare and scheduled. No loitering, exterior activity, or nuisance 
behavior will occur. 
 
 
 
Conclusion: 
This Use Permit request seeks to allow for the continued industrial use of an existing building 
within the General Industrial (GID) zoning district for the purpose of wood cabinet 
manufacturing/ fabrication. This use is consistent with the building’s history, the zoning 
designation and supports the business’s functional needs. With the approval of this use permit, 
it would not alter the industrial character of the site or neighborhood, as the proposed use is fully 
compatible with the surrounding context, meets the standards of the City of Tempe’s Zoning and 
Development Code, and will not be detrimental to the public health, safety, or welfare.
