Re: Application for Use Permit – Driveway Parking Encroachment into Easement
Dear Sir or Madam,
I am writing to formally request approval of a use permit to allow for two parking spaces located on my
private driveway that partially extend into a City easement adjacent to my residence located at 2057
East Orange Street, Tempe, Arizona.
The home was constructed in the same general location as the previously existing residence, with the
front of the house aligned with the established front setbacks of surrounding homes in the
neighborhood. This alignment preserves the existing streetscape and neighborhood character. After
construction was completed, it was determined that the recorded property line is set further back than
anticipated, resulting in insufficient depth on private property to accommodate the required parking
without a minor encroachment into the easement area.
Due to this condition and the existing lot configuration, a portion of the driveway parking area
necessarily extends into the easement. The proposed parking arrangement will remain primarily on
private property and will be used solely for residential purposes.
Approval of this use permit will not be detrimental to persons residing or working in the vicinity, to
adjacent property, to the neighborhood, or to the public welfare in general. The proposed use will be in
full conformity with any condition, requirement, or standard prescribed by this Code. The request will
not increase significant vehicular or pedestrian traffic and will not create any nuisance arising from
emissions, odor, dust, gas, noise, vibration, smoke, heat, or glare at a level exceeding ambient
conditions, nor will it contribute to the deterioration of the neighborhood.
The proposed use is compatible with existing surrounding structures and uses and provides adequate
control of behavior both inside and outside the premises, such that no nuisance will be created for
adjacent properties or the general public. The encroachment will not obstruct traffic flow, pedestrian
access, sidewalks, utilities, or emergency vehicle access, and will not interfere with neighboring
driveways or access points.
I am fully prepared to comply with all City of Tempe standards and any conditions associated with this
use permit. Supporting documents, including revised site plans, elevations, and photographs, are
included or can be provided upon request.
