REQUEST FOR COUNCIL ACTION

ACTION:  Adopt a resolution authorizing the Mayor to execute an amendment to Agreement No. C99-
291 with Broadstone Tempe Station Apartments for maintenance of the Multi-Use Path and Path 
Improvements contained within the Path Easement. The applicant is the City of Tempe. (Resolution No. 
R2026.11)
FISCAL IMPACT:  The City of Tempe will take on a slightly increased maintenance responsibility 
related to the multi-use path, but it is not anticipated to have any significant budget impact.
RECOMMENDATION:  Adopt Resolution No. R2026.11.
 
BACKGROUND INFORMATION:  On May 13, 1999, City Council approved the development of the 
Trammell Crow Apartments (now known as Broadstone Tempe Station Apartments), including a General 
Plan Amendment, a Zoning Map Amendment, and a Site Plan Approval. On December 16, 1999, the 
City of Tempe signed an agreement with the Trammell Crow Apartments to maintain parts of the Multi-
Use-Path Easement along the south and east sides of the property. 
As detailed in the approved Site Plan and in the C99-291 agreement, the property owners were required 
to build and maintain an 8-foot masonry wall along the south side of the property. Originally intended to 
enhance security, the area along the wall has become a hot spot for calls for service to the Tempe 
Police. On July 1, 2025, City Council approved to modify the Site Plan, removing the requirement for 
the masonry wall. 
The City now seeks a modification to the C99-291 agreement. The request includes the following:
1. Demolition of the masonry wall along the south side of the property, paid for by the property owner
2. City maintenance of the Multi-Use-Path along the south side of the property, including landscaping, 
lighting, and routine debris removal
3. Cost sharing of any future improvements to the Multi-Use-Path
