RESOLUTION NO. R2026.09
A RESOLUTION OF THE CITY COUNCIL OF THE 
CITY OF TEMPE, ARIZONA, AMENDING THE 
GENERAL PLAN 2050 FOR APPROXIMATELY .7 
ACRES LOCATED AT 1249 EAST 8TH STREET 
AND OWNED BY 8TH STREET FILLING STATION, 
LLC.
WHEREAS, the City has received an application for a Minor Amendment to 
General Plan 2050 seeking to change the land use designation for property located 
at 1249 East 8th Street; and
WHEREAS, the applicant has provided written justification for the 
amendment demonstrating public benefit; and after considering the land use 
principles, the amendment will help the City attain applicable objectives of the 
General Plan; and
WHEREAS, the proposed amendment has been considered by the 
Development Review Commission and received a favorable recommendation 
therefrom; and
WHEREAS, the Council finds by a two-thirds majority vote that the 
proposed amendment will not result in a substantial alteration of the City's land use 
mixture or balance as established in the General Plan 2050 land use element;
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF TEMPE as 
follows:
Section 1.  A minor amendment to the General Plan 2050 Projected Land 
Use Map is adopted for approximately .7 acres from Mixed-Use High (up to 65 
du/ac) to Commercial (0 dwelling units per acre), located at 1249 East 8th Street.
Section 2.  The Community Development Director or designee is hereby 
authorized to take such actions and to execute such further documents as may be 
necessary to carry out the purposes of this Resolution.
